Dabawenya who's an experienced international banker has been appointed member of the country's Monetary Board.

She's Anita Linda R. Aquino, daughter of businessman-civic leader Abdulah "Nonoy" Cabaguio-Aquino and Mrs. Linda Ramos-Aquino.

Monetary Board Chairman and Bangko Sentral ng Pilipinas Gov. Benjamin E. Diokno administered the oath of office of Ms Aquino the other day.

Prior to her appointment by President Duterte to the Monetary Board, Ms

Aquino served as director of Philippine Deposit Insurance Corporation.

She was former chief of staff of the Department of Finance and held key positions at the Standard:Chartered Bank in Manila, Rizal Commercial Banking Corporation, Citicorp Investment Bank in Singapore and Citibank NA Manila.

commissioner of the National Commission on Muslim Filipinos (NCMF) has filed a civil suit before the Quezon City Regional Trial Court against the agency’s head, Sec. Saidamen Pangarungan, and other officials for allegedly withholding the complainant’s “extraordinary allowance” and reimbursements.

In a six-page Petition for Mandamus, NCMF Commissioner Abubakar M. Mangelen, Ph.D., is likewise seeking the court’s enforcement of the appointment of two conterminous staff who will serve under his office.

Dr. Mangelen accused Pangarungan, along with Mr. Khamil Manalundong, NCMF acting chief of Finance Management Service (FMS), and Ms Anisa Lomondot, acting cashier, of unlawful refusal and/ or delay to perform their ministerial duties particularly in releasing his office’s extraordinary and miscellaneous benefits for the month of April, May and June 2020.

“On July 22, 2020, Petitioner wrote another memo-letter to respondent Secretary Saidamen B. Pangarungan, thru Chief Khamil Manalundong, asserting his claim. But up to present, Secretary Pangarun-

gan, with co-respondents, have not released/paid the claims and appointment papers of my coterminous staff,” Mangelen stated in his complaint.

The NCMF commissioner added that “by reason of the Secretary’s unlawful refusal and/or delay to perform his ministerial duty, plaintiff suffered damages and attorney’s fees of 100,000.00 (pesos), which should be assessed against the Respondents.”

Meanwhile, last August 8, 2020, Mangelen wrote a memorandum to Pangarungan, demanding the release of his office Maintenance and Other Operating Expenses (MOOE) budget covering the months of April, May and June 2020.

“This refers to the subject withheld MOOE of the undersigned the voucher of which, according to the FMS, including their required and appropriate attachments, have already been processed but Estrella L. Neri stopped the funding on your instructions”, the commissioner said.

City adds 3 more labs for Covid-19 cases

Mayor Sara Duterte-Carpio disclosed that the city is waiting for the laboratories to be set up -- one is to be donated by Unilab, the second is a laboratory in Los Amigos City Health Office, and a third is from the Davao Doctors Hospital (DDH).

“Once we have that up and running, all in all, we have five laboratories for Davao City and mga silin-

Currently, the Southern Philippines Medical Center (SPMC) and the Davao One World Laboratory are still the lead hospitals serve as Covid-19 testing laboratories in Davao City.

In a short Facebook live video shot by Senator Christopher “Bong” Go, Duterte assured the public that he never left his hometown as a precaution against catching coronavirus disease 2019 (Covid-19).

“Well as you can see clearly, I’ve been in Davao all along. Umiiwas tayo ng Covid (I have been avoiding Covid),” he said.

Duterte also took the opportunity to remind the public to strictly observe minimum health and safety standards.

“The admonition is wash your hands, wear a mask, cover your eyes and stay home. That’s what I did. Andito po ako sa Davao.

Huwag po kayong maniwala (I’m here in Davao. Don’t

believe the rumors),” he said.

Go, for his part, said Duterte went on cam shortly before meeting with members of the Inter-Agency Task Force for the Management of Emerging Infectious Diseases (IATF-EID).

“Andito po si Pangulo, papunta po siya, mag-aattend po siya ng kanyang talk to the people at mag IATF meeting (The President is here, he’s on his way to attend his talk to the people and IATF meeting),” Go said.

He urged fake news peddlers to refrain from spreading lies on social media.

“Sa mga nagpapakalat ng fake news, makonsyensya po kayo. Nagtatrabaho lang po ang ating Presidente, para sa bayan (To those peddling fake news, have some conscience. The President is working for the country),” he said.

resident Rodrigo Duterte chided human rights groups for opposing the revival of death penalty anew, saying they should switch careers if they were only good at counting the dead.

In a public address from Davao City late Monday night, Duterte said rights organizations should operate as funeral parlors if it was the only purpose they could serve.

The National Economic and Development Authority -Investment Coordination Committee (NEDA-ICC) Cabinet Committee has approved the rehab project in December 2019 and is awaiting NEDA Board approval.

Detailed engineering design for DIA redevelopment up in 2021

The long-awaited improvement of DIA is expected to commence with the detailed engineering design and bidding for contractor by next year., according to DIA Manager Engr. Rex Obcena, who revealed the plans in Tuesday’s virtual presser.

Obcena said construction of the parallel taxiway that will connect the first halfway of the runway towards the apron (flight line or ramp), which is the area of an airport where aircraft are parked, unloaded or loaded, refilled, or boarded, has already started.

“Tuloy ang improvement ng Davao airport, in fact, na-umpisahan na ngayon ang construction ng parallel taxiway that cost more than P200 million,” Obcena said.

He added that the initial expansion of the passenger terminal building probably will be bid out early next year then construction of civil works, which according to him is a long and tedious process, will follow.

“The project will push through medyo na-delay lang gamay because of the pandemic. Murag dili pa

masugdan this year ang improvement kasi ang una na process is i-bid out sa ang detailed engineering then after that will be the bidding process for the construction of the civil works which is very long and tedious process and following regulations especially with the implementation of the procurement law,” he said.

Despite the delay, Obcena assured that the budget for the improvement is still available and that the project will push through.

“Probably in one or two years basin ma-start na. I know for sure the budget is not taken out, it is still there. But I cannot give you as of the moment the adjusted timeline of the start of construction,” he said.

Much is expected in terms of improvement of its operations, services and airport facilities in DIA with the creation of the Davao International Airport Authority (DIAA), which was approved by the House of Representatives through House Bill 8691 last year.

Meanwhile, Udenna Infrastructure Corporation has submitted the proposal for the DIA’s rehabilitation to DoTr also last year.

Udenna Infrastructure, a wholly-owned subsidiary of Udenna Corp., is providing technical support to Chelsea Logistics for the project, which has an estimated investment cost of P48.8 billion.

The Association of Vehicle Importers and Distributors (AVID) reported Monday that its vehicle sales in July 2020 increased by 38 percent to 5,100 units from 3,697 units in June this year.

Sales of passenger cars in July improved by 47 percent to 1,764 units from 1,199 units in June.

Light commercial vehicle sales also went up by 35 percent to 3,317 units last month from June’s sales of 2,462 units.

On the other hand, commercial vehicle sales decreased by 47 percent to 19 units in July from 36 units in June.

“The entire industry is undergoing rapid digital transformation to meet the evolving needs of consumers, employing innovative and disruptive selling tactics to win back customers, and the agility to adapt to a more complex and unpredictable business environment,” said AVID President Ma. Fe Perez-Agudo.

However, the seven-month sales of AVID declined by 50.9 percent to 24,607 units this year from 50,151 units in January to July 2019 period.

For the same period, passenger cars’ sales dropped 55 percent to 7,890 units this year from 17,701 units last year.

Sales of light commercial vehicles plunged by 48 percent to 16,561 units from January to July 2020 from 31,873 units in the same period in 2019.

Commercial vehicle sales also decreased by 73 percent to 156 units this year from 577 units in the previous year.

“Given that we have already bottomed out in the first semester, we believe the second half of the year will be better assuming there are no further lockdowns past August 18. We understand the government’s decision to shift back to MECQ (modified enhanced community quarantine) since we need to prioritize lives over livelihood. CDO to distribute 1 million cans of meatloaf amid pandemic

DO Foodsphere Inc. has pledged to distribute one million cans of meatloaf amid the coronavirus pandemic.

The initiative is part of its The Million Meats Project, which aims to help thousands of families who

have been affected by the loss of jobs due to the lockdown.

So far, a total of 360,000 cans have been distributed to over 65,000 households in Valenzuela City, Malabon City, and Malvar, Batangas.

"We take it as a privilege to have been entrusted with this endeavor," Charmaine Ong-Castro, Lead for the Million Meats Project and CDO's SVP for Purchasing and Treasury, said in a press release.

"It was even more

gratifying when our other suppliers took part in the initiative and contributed to the project," she added.

The Million Meats Project was conceived after one of CDO's foreign partners visited the Philippines before the pandemic.

The payment leeway includes the 30-day policy contractual grace period plus the extension period that the Insurance Commission (IC) encouraged companies to employ.

Sison said “PLIA recognizes the difficulties policyholders may have in settling their due premiums in these trying times” thus, the additional period to pay the insurance policies leeway “offers a balanced consideration of the insuring public's interest as well as that of the insurance companies, who themselves need to ensure their continued ability to service all their commitments to their policyholders.”

"However, exempting insurance companies from this 60-day mandatory grace period would also turn out beneficial to our policyholders as steadier premium inflow would become available for investing and generating returns that would assure their readiness to respond to claims especially those related to Covid-19 (coronavirus disease 2019),” he said.

Sison said “at this time when people’s health and wealth are a bit more vulnerable, the role of the insurance industry becomes even more important as it helps people mitigate the risks they face”.

“Thus, it is also important that we work towards a balanced solution that would ease the plight of our fellow Filipinos while also ensuring the continued sta-

bility of the industries that are there to help them,” he added.

IC Commissioner Dennis Funa has written to the members of the Bicam for an alternative to the proposed 365-day moratorium on premium payments for life insurance and pre-need policies.

He said the one-year moratorium “if passed into law, will add to the life insurance and pre-need industries’ challenge of generating as much premiums from its existing business”.

“Right now, said industries need to generate such premiums from existing businesses in order to offset the decline in new business premiums resulting from the slowed market demand,” he said in a letter dated August 12, 2022.

he coronavirus pandemic pushed most of the world's major economies into unprecedented contractions in the second quarter, except for China which escaped a recession.

Here are second-quarter changes in gross domestic product (GDP) compared to the previous quarter for the world's top economies. Unless stated otherwise, the figures are from the national statistics institutes.

Japan Japan announced in mid-May that it was already in recession -- two consecutive quarters of contraction -- when first-quarter GDP slid by 0.6 percent after a 1.9 percent drop in the final quarter of 2019.

On Monday the world's number three economy recorded a further slump of 7.8 percent in the AprilJune quarter, its worst on record, as the coronavirus deepens the country's long-running economic woes.

Britain The UK suffered the worst recession in Europe in the first two quarters of the year, also recording the continent's highest number of coronavirus deaths.

GDP fell 20.4 percent in the second quarter after a 2.2 percent drop in the first.

Germany Europe's top economy was hit less hard by the coronavirus than its neighbors, but still saw its GDP fall by 10.1 percent in the second quarter after a de-

cline of 2 percent in the first.

Germany's previous record for a quarterly GDP drop was 4.7 percent in the first quarter of 2009, after the financial crisis of 2008.

France The eurozone's number two economy was in a longer and stricter lockdown than its eastern neighbor, and second-quarter GDP fell more steeply, by 13.8 percent, after a drop of 5.9 percent in the previous three months.

France's previous alltime worst quarterly blow to output was dealt by a general strike in May 1968.

Italy Italy's growth was impacted very early on by the coronavirus which hit its richest region, Lombardy, particularly hard. Italian GDP fell by 5.4 percent in the first quarter and then by 12.4 percent in the second.

Spain After a 5.2 percent drop in the first quarter, Spain's economy contracted a further 18.5 percent in the second, notably because of a 60 percent drop in tourism income and a fall by one-third in exports.

Eurozone The eurozone's overall GDP plunged 12.1 percent in the three months to June, after 3.6 percent in the first quarter, making the second quarter downturn "by far" the worst since statistics agency Eurostat started compiling growth data for the area in 1995.

emittances from overseas Filipinos rose in June, but not enough to offset the year-to-date decline, the Bangko Sentral ng Pilipinas (BSP) reported Monday.

According to data released by the central bank, cash remittances or money transfers coursed through banks grew by 4.2% to $2.465 billion in June from $2.290 billion the same month last year.

Meanwhile, personal remittances—the sum of transfers sent in cash or in-kind via informal channels—rose by 7.6% to $2.737 billion.

“This trend is a reversal from three consecutive

months of decline from their comparable levels last year,” the BSP said in an accompanying statement.

The BSP attributed the growth to the 14.2% rise in remittances from landbased workers with work contracts of one year or more to $2.164 billion.

Meanwhile, remittances mainly from seabased workers dropped by 13.1% to $515 million from $593 million previ-

ously.

“The continued drop in sea-based workers’ remittances was due to the repatriation of many sea-based workers amid the ongoing COVID-19 pandemic,” the central bank said.

The latest figures brought the year-to-date cash remittances down by 4.2% to $14.019 billion, and the personal remittances down 4.2% to $15.573 billion.

In a regulatory filing, PT&T said it trimmed its net loss to P3.898 million in the second quarter from P15.364 million in the same quarter last year.

This comes as revenues rose to P99.924 million from P90.564 million, while costs and expenses grew to P111.806 million from P107.097 million.

PT&T attributed the growth to a 22 percent increase in broadband connections during the period, as internet access became essential amid the lockdowns.

To recall, the strictest quarantine measures under the enhanced community quarantine (ECQ) were placed over Metro Manila and other “highrisk” areas from March 17 to May 15, followed by a modified enhanced community quarantine (MECQ) until May 31.

This comes as revenues rose to P99.924 million from P90.564 million, while costs

and expenses grew to P111.806 million from P107.097 million.

PT&T attributed the growth to a 22 percent increase in broadband connections during the period, as internet access became essential amid the lockdowns.

FRED C. LUMBA SPECKS OF LIFE

SENIOR CITIZENS’ LIVES MATTER In the US, since the violent death of African American George Floyd in the hands of an arresting police team, a campaign called BLM (Black Lives Matter) has gone viral.

Not only has it been made a political issue because it happened on an election year, it has also developed into a racist concern as if racism just surfaced recently in the US of A. Evidently, the enemies of Donald Trump, whose “Let’s Make America Great Again” slogan, are tearing at him from all imaginable fronts so that they could grab power anew.

Here, in the Philippines, little concern is given the plight of senior citizens (60 and older) who have been unfairly categorized as “vulnerable” by the IATF (Inter-Agency Task Force) in charge of the CoVid 19 pandemic.

Senior citizens, mind you,

are much better taking care of their physical self than the younger folks who arguably believe they have “stronger” and “more resistant” physical constitution than their senior counterparts.

Ever since the March 15 lockdown till this writing, SRs have not been allowed to wander around even for a walk and a stroll to the supermarket or drugstores to buy their vitamins and medicines.

This is so unfair.

As a member of the senior clan (I’m 72), I detest this because for the last 65 and more years I haven’t been sick of anything, much less did I land in the hospital for any illness.

Do I consider myself healthy?

Of course, I do! So why should I suffer, getting locked inside the apartment for the last 150 days or so in obedience to the government’s rules and regulations vis a viz

the CoVid 19 contagion?

I do not personally subscribe to the WHO directives that the virus is so contagious it could infect any number of people a carrier comes across with.

Why? Have you guys been to the slum areas of Tondo and Baseco near the Manila harbor where squalid and decrepit lean-tos are separated merely by thin sheets of plywood and other improvised barriers while the family members sleep side by side just inches away from each other?

How come there are no alarming reports of infections in these areas as the WHO would threateningly want us to believe?

These families are so poor and live in dire lack that what they would spend for soap they would rather spend for food, right?

I am a law-abiding citizen

but I find these IATF rules unfair and constricting to senior members of the community.

We are more respectful of the mask-wearing requirements than our younger counterparts and yet we are made to suffer.

The logic the WHO wants us to believe is that the virus and droplets of it are transferable by air. But it is not.

Otherwise, I would have been infected long ago because I started wearing the mask only in March leading to the lockdown.

Critics of the WHO in the US and in Europe say it grievously erred in not immediately declaring the CoVid 19 as a pandemic and airborne.

The AITF is like a tamed dog obeying the orders of WHO and has virtually led the government by its nose. The government is not tactfully fighting the unseen enemy.

Fear has overcome all of us,

including the citizenry.

Our economy has virtually collapsed while millions – including our repatriated OFWs – are complaining of losing their jobs.

Many businesses and employers have closed shop.

My suggestion is for the government to open up the economy and take the bull by its horns. Enough of this fear-mongering. The citizens have since been appropriately advised and they are the only ones to blame if they disregard the requirements set forth for their safety and protection.

Senior citizens should be allowed to live normal lives, perform their usual tasks as many of them are still able to do jobs and earn a living.

ANITA LINDA, THE PAMBANSANG LOLA AND THE MEMORIES OF ALHAMBRA The late actress Anita Linda should have been called the “Pambansang Lola” who gained critical acclaim for her portrayals in maternal or elderly roles.

Born Alice Buenaflor Lake on November 23, 1924, her movie career spanned seven decades until her demise at the age of 95 on June 10, 2020.

This year’s Cinemalaya Film Festival paid tribute to Anita Linda through the online screenings of two of her films, “Adela” and “Circa”.

At the age of 74, she became the oldest actress to ever win a FAMAS award in 1998 , when she was named Best Supporting Actress for “Ang Babae sa Bubungang Lata.”

At age 83, she was named Best Actress in the 10th Cinemanila International Film Festival in 2008 for her portrayal of the main character in “Adela”. It is a heart-breaking story of a woman who longs for the company of her loved ones. Her children all fail to show up and greet her on her 80th birthday, prompting her to spend the day alone in Freedom Island, a bird sanctuary where mangroves are abundant.

At age 84, she tied with

Rustica Carpio for Best Actress in the 33rd Gawad Urian for the 2009 movie “Lola”.

Driven by selfless love, “Lola” tells the parallel stories of two elderly women who scrape the bottom of the barrel to raise funds for their respective grandsons.

In her last film “Circa”, which was shot and released in 2019, Anita portrays Doña Atang, a once celebrated film producer from the earlier years of Filipino cinema. To celebrate her 100th birthday, she simply wants a reunion with all the actors and staff that she has worked with in the past. The preparation showed the glorious years of cinema from its workersfragments of a colorful past filled with faded memories.

Whenever I watched Anita Linda on TV and the big screen, I miss my Lola Maria.

I belong to the 45 grandchildren of Damaso Reyes and Maria Santos. I never met my lolo who died before I was born but his absence was greatly compensated by the love and caring that Lola Maria has given to her grandchildren. Their ten children followed the proverbial phrase “ go and multiply” thus out we came, the 45 grandchildren.

One of my vivid recollec-

tions of Lola Maria was her habit of inverted smoking of the Alhambra cigar - the lighted end was inside her mouth. it is amazing to see old women, particularly women from the provinces , having the capability of oddly smoking this cigar with the lighted end inside their mouth.

Years before she died in the 1980s. I asked her why her mouth served as an ashtray.

My lola said that the burning sensation in her mouth adds stimulation in the rather monotonous act of smoking.

With the lit cigar in her mouth, my lola could even roll her tongue and still talk at length only to stop to spit the ash from her mouth.

One urban legend was that this practice started during the Japanese war era when many Filipinos went into hiding, The only way the people could smoke without being discovered from their hiding places was to put the lighted end of the cigarette in their mouth.

Tobacco was earlier introduced by the Spaniards when they colonized the Philippines.

The cigar type cigarettes were blends of dark, aircured Philippine tobaccos principally sourced from the Cagayan and Isabela provinces where the stronger flavor tobacco was harvested.

These were more commonly called as the Regaliz type of cigarettes which were wrapped in dark brown sweetened paper imported from France.

The tobacco industry created a demand for female labor called “kahistas” , eventually making their work in the factory ranked first among the occupations of women in the Philippines.

The packing process was done by the scoop of the kahista’s hand as mold in bundling the sticks in 30’s and hand-packed them in swift and continuous motion.

The cigarettes were sold under popular brands like La Campana Largos, Ms. Philippines Fat, Ms. Philippines Thin, La Flor de Filipinas Fat, La Flor de Filipinas Thin, Marka Niyog Fat, Marka Niyog Thin, Malaya Largos, La Dicha, and La Flor de Luzon.

I just remembered one brand used by lola: Alhambra.

I recently watched the K-drama “Memories of the

Alhambra” which touches on a series of mysterious incidents surrounding a new and intricate augmented reality game inspired by the stories of the Alhambra Palace in Spain.

One landmark intellectual property case was decided in 1916 by the Supreme Court involving the mark “Alhambra Isabelas” wherein it was held that the name ‘Isabela” was a geographical and descriptive term and incapable of registration as a trade-mark. A manufacturer cannot be enjoined from using the word” Isabelas” on similar packages sold by it, the term “Isabela” being the name of the province where the tobacco in making cigarettes of this quality had been grown.

As there are few left who belong to my Lola’s generation, the tradition of inverted smoking is also slowly fading into oblivion.

ORDINANCE NO. 0307-20 Series of 2020 AN ORDINANCE REQUIRING THE MANDATORY WEARING OF FACE MASKS AT ALL TIMES IN PUBLIC PLACES DURING THE COMMUNITY QUARANTINE AND/OR UNTIL AFTER THE STATE OF PUBLIC HEALTH EMERGENCY IS LIFTED

Be it ordained by the Honorable Sangguniang Panlungsod of Davao City, in session assembled, that: SECTION 1. TITLE – This Ordinance shall be known as “AN ORDINANCE REQUIRING THE MANDATORY WEARING OF FACE MASKS AT ALL TIMES IN PUBLIC PLACES DURING THE COMMUNITY QUARANTINE AND/OR UNTIL AFTER THE STATE OF PUBLIC HEALTH EMERGENCY IS LIFTED”.

SECTION 2. DEFINITION OF TERMS – For purposes of this Ordinance, the following terms shall be defined as follows: (a) Face Mask- shall mean a protective device that is firmly fastened over the face and covering at least the nose, mouth and chin which serves as a protection or barrier against possible infection from a disease such as the COVID-19 and other airborne pathogens. These shall include surgical masks, cloth masks, bandanas, washable mask, N95 masks among others; and (b) Public Places- means all places, fixed or mobile, that are accessible or open to the public or places for collective use, regardless of ownership or right to access, including but not limited to, schools, workplaces, government facilities, establishments that provide food and drinks, accommodation, merchandise, spas, professional services, salons, barbershops, entertainment or other services. It also includes outdoor spaces where facilities are available for the public or where a crowd of people would gather such as, but not limited to, playgrounds, sports ground or centers, church grounds, health/hospital compounds, transportation terminals, markets, parks, resorts, walkways/sideways, entrance ways, and the like.

SECTION 3. MANDATORY WEARING OF FACE MASK - All persons within the territorial jurisdiction of Davao City shall, at all times, wear face masks in public places during the Community Quarantine and/or until after the State of Public Health Emergency is lifted as part of the precautionary and safety measures adopted by the City Government against COVID-19 to control and prevent the transmission of such infectious disease.

SECTION 4. PENALTY - Any person caught in violation of this Ordinance shall be penalized as follows: (a) First Offense - P 500.00 (b) Second Offense - P 2,000.00 (c) Third Offense - P 5,000.00 or 1 month imprisonment or both.

SECTION 5. CITATION TICKETS - A citation ticket shall be issued to violators of the provisions of this Ordinance. The Citation ticket shall state, among others, the name and address of the violator, the specific violation committed and the corresponding administrative penalty.

The Philippine National Police (PNP) and such other appropriate enforcers as commissioned by the City Mayor shall have the power to apprehend violators of this Ordinance and issue citation tickets.

The City Mayor may deputize Barangay Officials or representatives of the private sector, nongovernment organizations and government organizations in the strict implementation of this Ordinance, as the need arises.

SECTION 6. NO CONTEST PROVISION - A person liable or violator of this Ordinance who is apprehended or cited for violation and who does not wish to contest the violation and is willing to pay voluntarily the administrative penalty imposed upon him/her prior to the filing of formal charges with the proper court shall be allowed to pay a penalty of Five Hundred Pesos (P500.00) with the City Treasurer’s Office to avoid being criminally prosecuted within three (3) days from apprehension.

Otherwise, the case shall be prosecuted in court. The no contest provision can only be availed once.

All proceeds from the payment of the herein penalty imposed shall accrue to the City’s General Fund.

SECTION 7. ENFORCEMENT - The Davao City Police, Task Force Davao, City Health Office, as well as the barangay officials and other law enforcers and City officials to be determined by the City Mayor, shall implement this Ordinance.

SECTION 8. SEPARABILITY CLAUSE - The provisions of these Rules are hereby declared separable, and in the event that anyone or more of such provisions are declared invalid, the validity of all other provisions shall not be affected thereby.

SECTION 9. REPEALING CLAUSE - All ordinances, resolutions, rules or regulations which are inconsistent with or contrary to the provisions of this Ordinance are hereby repealed, amended or modified accordingly.

SECTION 10. EFFECTIVITY - This Ordinance shall take effect fifteen (15) days after its publication in at least three (3) newspapers of general circulation in Davao City.

ENACTED, on the 7th day of July 2020, by a unanimous vote of all the Members of the Sanggunian, there being a quorum.

AN ORDINANCE PROVIDING RELIEF TO MITIGATE THE ADVERSE ECONOMIC EFFECTS OF THE CORONA VIRUS DISEASE (COVID-19)

Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled, that: SECTION 1. TITLE – This Ordinance shall be known as “AN ORDINANCE PROVIDING RELIEF TO MITIGATE THE ADVERSE ECONOMIC EFFECTS OF THE CORONA VIRUS DISEASE (COVID-19)”.

SECTION 2. AUTHORITY – Section 192, Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that “Local Government Units may, through ordinances duly approved, grant tax exemptions, incentives or reliefs under such terms and conditions as they may deem necessary”.

SECTION 3. INCENTIVES/RELIEF - Any person firm, or entity conducting business in the City of Davao is hereby granted the following incentives/relief in view of the COVID-19 pandemic: 1. Proportional Reduction of Garbage Fee for Calendar Year (CY) 2021; 2. Deductibility from Gross Sales/Receipts of the Items provided under Section 5 hereof; 3. Waiver of Rental Fees for those Real Properties under the City Economic Enterprise Closed during Community Quarantine (CQ) and Enhanced Community Quarantine (ECQ); 4. Suspension of Implementation of Final Tranche of Increase in Real Property Payment.

SECTION 4. PROPORTIONAL REDUCTION OF GARBAGE FEE FOR CY 2021 - Business establishments which were mandated to close during the period of CQ and ECQ may avail of proportional reduction in the annual garbage fee imposed under Section 293 of Ordinance No. 0291-17, Series of 2017.

The garbage fee shall be reduced based on the number of months the establishment was closed, provided such closure is within the period of CQ and ECQ. The proportional reduction of the amount of garbage fee is considered as advance payment and shall be applied only during the renewal period for CY 2021.

SECTION 5. DEDUCTIBILITY FROM GROSS SALES/RECEIPTS - The following shall be deductible from the CY 2020 gross sales/receipts of business establishments and shall be applied during the CY 2021 renewal: 1. Waived rental fees granted by lessors to lessees, provided that a duly notarized Certification from the lessee evidencing such waiver is submitted; 2. Monetary value of contributions of establishments utilized as quarantine facilities; and 3. Monetary value of donations made to the City Government of Davao as aid to respond to COVID-19 situation; The gross sales/receipts less the aforementioned deductible amount shall be the basis for the computation of business taxes for CY 2021.

SECTION 6. WAIVER OF RENTAL FEES - Rental fees for real properties under the City Economic Enterprise which are mandated to be temporarily closed during the period of CQ/ECQ shall be deemed waived.

SECTION 7. SUSPENSION OF THE IMPLEMENTATION OF THE FINAL TRANCHE OF THE INCREASE IN REAL PROPERTY TAX PAYMENT - The implementation of the final tranche (3/3) of the increase in real property tax payment as provided for in Ordinance No. 0257-17, Series of 2017, otherwise known as “An Ordinance approving the Schedule of Market Values of All Lands and Base Unit Construction Cost as Basis in the 2018 General Revision of Real Property Assessments in Davao City and to Take Effect Beginning Calendar Year 2019” due on calendar year (CY) 2021, shall be suspended and moved to CY 2022.

SECTION 8. SEPARABILITY CLAUSE - If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 9. EFFECTIVITY - This Ordinance shall take effect immediately upon approval.
