ROWE: BILL WILL BE FORMER Livingstone Shire engineer Tony Rowe believes he has no chance of being reinstated to his former position ... "the numbers are against me," he said on Wednesday. And he sees one of the number against him as the Shire chairman Cr John Bowen. "John Bowen was the second person to give evidence at last year's inquiry into my actions ... and he wasn't even a councillor at that time," Mr Rowe said. "In his report issued after the inquiry, Judge Gibney said: 'On the balance of probabilities, it is very clear that Councillors r'-)wen and Cresta actively and closely ....,rsued the Shire Engineer Rowe from motives best known to them'." Mr Rowe was completely exonerated at

last year's inquiry and "his dedication, loyalty and integrity were found to be beyond question". Seven months later he was sacked by Livingstone Shire Council. His sacking was subject to appeal under Section 17 (B) of the Local Government Act. The appeal was heard on Monday this week and the decision handed down on Tuesday morning upheld Mr Rowe's appeal. The appeal board determined he should be reinstated. However, Livingstone Shire Council may elect not to reinstate Mr Rowe. Council must make a decision within two weeks of receiving the evidence and decision of the appeal board. This evidence and decision must be put before the next council meeting. LIVINGSTONE Shire Council has been given approval to borrow almost $3 million to sewer Emu Park ... and Member for Callide Lindsay Hartwig said this week the council should "go for it" and do the job. Mr Hartwig said he had been notified that council had approval to borrow the money over 40 years and also had a State Government subsidy of $215,400 for Emu Park sewerage treatment. He said the official notification to him that the Loan Council had approved the borrowings was something he had been hoping for during his year-long term as ' tngstone Shire chairman. \--1 implemented this 12 months ago when I was chairman (he retired in April for health reasons) and I think to get a loan over 40 years with a 30 per cent subsidy is something I feel the council can't refuse," he said this week. "Sewerage means the difference between a town and a township." Mr Hartwig was told of the loan council approvals earlier this week. He said council had been authorised to borrow, in all, $2,767,600 over 40 years. These two loans, plus the $215,400 subsidy, amount to $2,983,000. Mr Hartwig said he instigated the move to sewer Emu Park and "I am a strong supporter of it". He supported sewering Emu Park because it was the only way the town could grow ... but he predicted that when the job was completed, Emu Park's growth could outstrip Yeppoon's.

"Septics can't be used for development such as major blocks of flats ... the whole basis of putting in sewerage is development," Mr Hartwig said. "But there's also the health angle to consider. In the wet season 'it' floats to the surface and the ground can't absorb it. "The stench is terrible around some houses. "Livingstone Shire Council should grasp this opportunity to sewer Emu Park. "The cost in the future is only going to increase ... and the people want it." (A survey, by coupon in the Capricorn Coast Mirror in June backed Mr Hartwig's statement. In all, 200 coupons were sent to the Mirror and 76 per cent wanted sewerage ... 43 per cent of these wanted the whole of Emu Park and Zilzie sewered while 33 per cent called for just the town area of Emu Park to be sewered.) "Sewerage is what the people want because it does away with bath and sink water washing into yards, as well as the sewage itself ... it's what modern-day living is all about," Mr Hartwig said. "It's already late enough in the day. Council should go for it." Council was also authorised to borrow: Roadworks, $200,000; drainage, $1,100,000; land acquisition, $50,000; and plant, $165,000 therefore gaining approval to borrow $3,292,600 by debenture loans with total State Government subsidies of $373,862. Council will also be told that consideration will be given to other borrowings following submissions to the Premier's Department of details of works proposed.

him, it would have to pay him for the period from his dismissal on April 22 until he resumes work (about 18 weeks). However, if council elects not to reinstate him, council faces a payout of 20 months' salary which represents one month's pay for every year Mr Rowe has worked in Local Government. Mr Rowe said council would also have to pay his legal expenses and the expenses involved in the appeal board's meeting. He estimates the wages payment and legal costs to council will total about $120,000. "The whole of this exercise, to ratepayers, will be in excess of $200,000," Mr Rowe said.
