In a recent meeting with La Plata County Commissioner Julie Westendorff; Geoff Overington and Shane Dawson were updated on new revisions to the La Plata County Land Use Code and received an overview of the changes to the IGA between the City of Durango and La Plata County. The following is a recap of what they learned. Intergovernmental Agreement (IGA) Update 1. A new Intergovernmental Agreement, (IGA), between the City of Durango and La Plata County was entered into on April 1, 2014. This new agreement replaces the old IGA and all amendments. The purpose of the IGA is to facilitate short and long-term joint planning and urbanization between the City of Durango and La Plata County in the Joint Planning Area (JPA). It is also purposed to encourage and promote the extension of and connection to the City’s water system for properties within the JPA. 2. The IGA creates a Joint Planning Commission (JPC) which consists of three (3) members from the City of Durango Planning Commission and three (3) from the La Plata County Planning Commission. The JPC hears proposals for projects located within the JPA and makes recommendations to the La Plata County Board of Commissioners. 3. Transitional Area Development Standards (TADS) will apply to all properties located within the JPA. In addition to existing La Plata County Land Use Code, these standards require the owner (if developing) to come to a specific standard that is “in line” with current City of Durango standards. Since new projects in the JPA will be required to adhere to the TADS, if/when they receive City of Durango central services or are annexed into the City of Durango, they will already be in compliance with the City of Durango Land Use and Development Code. Updating and Streamlining La Plata County Land Use Code. Certain parts of the La Plata County Land Use Code have been revised. Some of these revisions were due to outdated and/or redundant policies, procedures or associated standards. Other sections will be revised in the future as County works towards further efficiencies. COMING SOON The first sentence of Article One of the Code of Ethics states…….”When representing a buyer, seller, landlord, tenant, or other client as an agent, REALTORS pledge themselves to protest and promote the interests of their client”……… We protect the interests of our client, NOT THE INTEREST OF OURSELVES. The Colorado Real Estate Commission has recently issued Commission Position 44 concerning “coming soon” listings which certainly relates to Article One of our Code. It consists of four paragraphs. In the interest of brevity I am giving you only the fourth paragraph ( I encourage you to read all of C.P.44) which states the following. “Ultimately, it is the seller or landlord’s decision how, when and where the property will be marketed. A broker who fails to advise a seller or landlord of the material benefits or risks, or does not allow the seller or landlord to decide how the property will be marketed, may be subject to license discipline by the Commission. The manner in which the broker and seller or landlord agree to market the property must be memorialized in writing in the listing contract prior to any marketing being performed.”

AWARDS Criteria REALTOR® OF THE YEAR

This is a one time AWARD. Criteria: Based on the last 12 months as a DAAR member Board Activity - 40% Board office and committee work, handling of special assignments, seminar activity, educational work, and membership / offices held in local chapters of institutes, councils, and societies. Civic Activity - 25% Local, state, and national participation in civic and service organizations, charitable activities, political commissions, fraternal & religious groups. REALTOR® Spirit - 20% High principles, faithfulness to laws and regulations of the Code of Ethics and the member Board, and furtherance of principles of good real estate practice among other brokers and the general public. Business Accomplishments - 15% Recognized good business conduct, service to clients, imaginative and creative advertising programs, rehabilitation work, land utilization, etc. If there is not a clear choice, the AWARD does not need to be presented this year.

COMMUNITY SERVICE AWARD (Formerly Alton Dorsett Award)

This AWARD will be presented to any person (member or non-member) who has made a substantial contribution to the area regarding real estate and/or housing. This AWARD may be presented more than once to the same person. If there is not a clear choice, the AWARD does not need to be presented for this year.

OUTSTANDING AFFILIATE AWARD (Formerly John Newton Memorial Award)

This AWARD honors an Affiliate Member (business or individual) who has demonstrated an outstanding commitment to the welfare of the Association. This AWARD may be presented more than once to the same business or individual. If there is not a clear choice, the AWARD does not need to be presented this year.

DISTINGUISHED SERVICE AWARD

This AWARD fills the void of honoring continued service to the Association by someone who may have already been given an AWARD, or for distinguished service that does not fit any of the other AWARD criteria. This would be awarded to an Association member for outstanding community or board activities at the discretion of the outgoing President.

ROOKIE OF THE YEAR AWARD

This is a one-time award honoring a member in good standing for their first two years as a member of the Association. The criteria for selecting Rookie of the Year will be based on the member’s pursuit of education, REALTOR® involvement, Board activity including committees, Association meetings and fund raisers, ethical conduct and business accomplishments. This award need not be presented unless there is a clear choice.

REALTOR SPIRITAWARD IN MEMORY OF PAULA SCHAEFER

Named in honor of Past President, Paula Schaefer, this award will be presented to a REALTOR® member who embodies REALTOR® spirit. The recipient will be an active REALTOR® member having a sales production level for the past 12 months that positions them in the top 50%. They will be actively involved on at least one association committee, involved in Community Service either inside or outside the association, be a PSF contributor, attend at least 2 DAAR sponsored events, and working to expand their knowledge by taking classes towards additional CAR/NAR recognized designations.
