14 January 2011 Introduction [1] By decision dated 4 December 2007 the Employment Tribunal (ET) found that the respondent unfairly dismissed the appellant and unlawfully discriminated against her in terms of sections 1(1)(a) and 6(2)(b) of the Sex Discrimination Act 1975 and sections 1(1)(a) and 4(2)(c) of the Race Relations Act 1976; and continued the case in respect of the award of compensation. The finding of unfair dismissal was conceded at the hearing. The respondent appealed against the decision on the issues of sexual and racial discrimination. By a majority decision dated 4 February 2009 the Employment Appeal Tribunal (EAT) sustained the appeal on both issues and dismissed the application. That is the decision appealed against. The legislation [2] Section 1 of the Sex Discrimination Act 1975 (the 1975 Act), as amended, applied at the relevant date.
