Candidates continue trend of non-lawyers as magistrates throughout Luzerne County By Bob Kalinowski staff writer
T
he choice Wilkes-Barre voters have for their next district judge is among a butcher, a wholesale seafood purchaser and a computer systems analyst. None have formal legal training, but that’s common in Luzerne County. Voters here almost always choose district judge candidates without a law degree. Only two of Luzerne County’s 16 district magistrates are lawyers. The rest come from a variety of different backgrounds, including six police officers — one who retired from police work to open a beer distributor. There’s an electrician, a union sheet metal worker, a car lot manager and a public works laborer. One judge served as the longtime secretary to her predecessor. Another is a veteran magistrate’s son, a bartender who defeated two attorneys. The ratio of lawyers as district judges in Luzerne County stands in stark contrast to neighboring Lackawanna County, where seven of the nine sitting district judges are attorneys. One of the two non-lawyers in Lackawanna has a law degree, but no law license. A seat currently vacant was occupied by a lawyer before he was elected as a Lackawanna County judge and four of the five people running for the position are attorneys. In nearby Wyoming County, one of the three district judges is an attorney. Statewide, the numbers show nearly threequarters of

district judges are not lawyers. Of the 527 district judges in the state, only 148 are attorneys, according to the Minor Judiciary Education Board, which offers a four-week certification course for non-lawyers. “I’ve noticed district magistrates have a great variety of backgrounds,” said G. Terry Madonna, a pollster and political science professor at Franklin & Marshall College. “I was often sort of stunned about the paucity of lawyers.” Attorneys likely avoid running for the spot because they could make more money in the private sector, Madonna said. The state pays magisterial district judges $88,290 per year. While the salary might not be attractive to some attorneys, that paycheck is just less than double the area’s median household income of $44,402.
