Journée Internationale des Droits des Femmes

Jugé «révolutionnaire» en 2004, mais parfois «dépassé» en 2022, le code de la famille doit faire l’objet d’une réforme «globale».

Al’occasion de la Journée Internationale des Droits des Femmes, la Fondation Diplomatique a organisé une cérémonie, au Sofitel Rabat, le 6 Mars 2022, à laquelle plusieurs membres du Gouvernement, ambassadeurs et ambassadrices et autres personnalités ont assisté. La ministre de la Solidarité, de l’Insertion sociale et de la Famille, Aawatif Hayar, a estimé, lors de cette rencontre tenue en partenariat avec l’ONU-Femmes sous le thème de la «Promotion des masculinités positives pour accélérer l’atteinte de l’égalité entre les sexes», que l’éducation des enfants est l’une des bases essentielles garantissant la promotion de l’égalité. «C’est à un âge très jeune, dans la famille et dans les écoles que cette nécessité de l’égalité doit être inculquée». A propos du code de la famille et de l’appel à la réforme de ce texte, vieux de 18 ans, la ministre a simplement répondu que «des observations sur le sujet sont en cours de recensement», dans le but de préparer le terrain à une réforme. La ministre a par ailleurs mis en exergue les efforts entrepris par son département pour lutter contre les violences faites aux femmes, rappelant aux participants que son ministère vient de conclure une convention avec 40 associations marocaines pour consolider les campagnes de sensibilisation et de lutte contre les violences faites aux femmes. Le rôle primordial et positif de l’homme dans la promotion de l’égalité entre les deux sexes a été aussi développé par les intervenants. Le ministre de la Jeunesse, de la Culture et de la Communication, Mehdi Bensaïd a d’ailleurs remercié les organisateurs pour le choix du thème du colloque. «Il faut agir contre les violences, éduquer au sein des familles à la sexualité et défendre les droits de la femme, surtout quand il s’agit d’une société patriarcale», a souligné le ministre. Le colloque a vu aussi la participation des représentantes d’associations féminines et des ambassadeurs étrangers accrédités à Rabat. Ainsi l’Association marocaine des droits des victimes (AMDV), par la voix de sa présidente Aicha Kelaâ, avocate de profession, a plaidé pour la réforme du code de la famille. «Comme toute loi qui prend de l’âge, il faut la rectifier et l’actualiser notamment au niveau du mariage des mineures».

During this meeting, which was organized in partnership with UN-Women, under the theme “Promotion of positive masculinity to accelerate the achievement of gender equality”, the Minister of Solidarity, Social Integration and the Family, Aawatif Hayar, reckoned that the education of children is one of the key foundations that guarantee the promotion of equality. “It is from a very young age, in the family and in the schools, that this need for equality must be inculcated”. Concerning the Family Code and the call for the reform of this 18-year-old text, the Minister simply replied that “observations on the issue are being recorded”, with the goal of preparing the ground for a reform. Furthermore, the Minister highlighted the efforts made by her department to fight violence perpetrated against women, reminding the participants that her ministry has just signed an agreement with 40 Moroccan associations for consolidating the awareness campaigns and for fighting violence against women. Bensaïd, thanked the organizers for the theme chosen for the colloquium. “Within families, it is necessary to take action against violence, to educate regarding sexuality and to defend the rights of women, especially since the society is a patriarchal one”, the Minister underscored. Representatives of women’s associations and foreign Ambassadors accredited in Rabat also took part in the colloquium. Thus, the Moroccan Association of Victim Rights (AMDV), speaking through its president, Aicha Kelaâ, a lawyer, pleaded for the reform of the Family Code. “Just like any law that has become old, it needs to be corrected and updated, particularly with respect to underage marriage”.
