SU in court over inconsistency of suspensions ANINA VISSER
Stellenbosch University (SU) appeared in the Western Cape High Court yesterday after being challenged by suspended students from the #FeesMustFall movement. Students launched an application against the university for not adhering to procedural requirements whilst amending the university’s disciplinary code. This follows after 30 protesting students were interdicted for occupying the RW Wilcocks Building on 20 September, with 12 of these students being suspended from SU. Jacana Joy Redcliffe, one of the interdicted students, said she first noticed her Inetkey, SUNLearn and student e-mail was cut off before she received any notice of suspension. “On the Wednesday people started receiving suspension letters via e-mail, but because my e-mail
was blocked I couldn’t get my suspension letter,” she said. Redcliffe added that it was extremely difficult because SU’s tactics made her feel like a criminal without even telling her what she had done wrong. According to SU’s Corporate Marketing Team the “twelve students have been suspended pending the outcome of a disciplinary process and they may not attend lectures or participate in any academic activities until the disciplinary process has been concluded.” Johan Pienaar, a representative from Access to Justice, argued that the actions against the students are totally harsh and over the top from a judicial perspective. “I have a student that has been suspended from this university for disrupting a test and stopping the Men In Black (MIB) from closing the roller door on them. “This is while students who have
been accused of rape on fairly strong evidence have not been suspended and still attend class,” he said. According to Pienaar, who is assisting the interdicted students in legal matters, the main reason why this case has been taken to the high court is in order to uplift the effective expulsion. “It is an effective expulsion because if you kick a student out in this point during the academic year and you say ‘you can’t write exams’, it’s not a suspension, it’s an expulsion,” Pienaar explained. “There is a total lack of consistency in how the university is dealing with these legal matters.” Martin Viljoen, spokesperson of the university said, in a formal statement, that the students know why they have been suspended. However, according to Redcliffe, the students don’t know why they have been suspended, only what they have been charged with.
