HC rejects writ on state religion n Ashif Islam Shaon The High Court yesterday rejected the much talked about writ that challenged the legality of a constitutional provision recognising Islam as the state religion of Bangladesh. The bench of Justice Naima Haider, Justice Quazi Reza-Ul Hoque and Justice Md Ashraful Kamal summarily rejected the 28-yearold petition, saying the petitioners have no jurisdiction to move such a petition. “It was rejected on the ground that the committee under which the petition was filed in 1988 had no legitimacy as it was not a reg-

istered body,” said Murad Reza, an additional attorney general who opposed the petition on behalf of the government. The decision means Islam will

stay as the state religion in the nation’s charter, which also speaks of equal rights for other religious groups, Murad Reza said. “The writ petition was filed by

Prof Anisuzzaman, one of the petitioners of the 1988 writ, expressed his disappointment saying that the petitioners' initial intention had not stood at the court. He added that the court has given its order based on wisdom. “Further steps would be taken after consulting with our lawyers once the full order is released.” Unless there was a future decision on filing an appeal, the matter has been settled with the High Court order, the Dhaka University professor emeritus said. The court's decision was welcomed by Hefazat-e-Islam, which had been threatening to paralyse the country if the High Court repealed Islam as the state religion. Hefazat leaders present on the court premises said they were happy that the government had “honoured” Islam, and also thanked the court for providing people justice.” “This is a victory of the Muslim ummah,” said Hefazat leader Mujibur Rahman Hamidi. Fazlul Karim Kashemy, another Hefazat leader, said the rights of non-Muslims would not be affected by the decision. “We have been living together for long; we will stay like this. Our coexistence will not be affected.”

mittee’s banner, they did not sign it individually. So I think the rejection was rightly done,” Murad Reza said after the court gave its ruling. However, petitioners' counsel Subrata Chowdhury said they had no clear idea why it was rejected. “Let the full observation of the court be released,” he said. Earlier during the hearing, Murad Reza told the court that they needed more time for preparation as the matter was old and had a long course of legal battle. The court said it would hear from the petitioners' lawyer first and also asked a number of lawyers, who prayed to the court to be  PAGE 2 COLUMN 2
