Appellate Division hears Kamaruzzaman appeal case for the 13th day

n Ahmed Zayeef Two judges of a four-member bench of the Appellate Division yesterday reprimanded the attorney general and defence counsel of convicted war criminal Muhammad Kamaruzzaman as they were not prepared for the hearing. The court sat at 9am on the 13th day of hearing in the appeal case, which

‘You can bag more than three-fourths vote, but you cannot collect a few lawyers. This is a pathetic situation’ appealed the International Crimes Tribunal verdict handing down a death sentence to the Jamaat-e-Islami leader. The defence commenced arguments on the fourth and seventh charges in the case around 9:30am before the bench headed by Justice Sunrendra Kumar Sinha. During the hearing, defence counsel SM Shahjahan failed to properly present his case. He was stumbling when

the judges queried on different issues of his argument. In charge four, Kamaruzzaman was handed a death sentence for killing Golam Mustofa of Sherpur during the 1971 Liberation War. He was given a life sentence for killing Dara Mia of Mymensingh in charge seven. Shahjahan finished presenting arguments around noon. The court then asked Attorney General Mahbubey Alam to present the state’s side. As Mahbubey sought adjournment for hearings yesterday and today, Justice SK Sinha said: “If we adjourn the argument session, we will forget it later. Our head is not a computer.” The attorney general then looked for his assistant who was not present in the court at the time. The judge then wanted to know the name of his assistant. As Mahbubey replied that it was Deputy Attorney General Bashir Ahmed, another judge Md Abdul Wahhab Miah said he had seen Bashir earlier sitting idle on the prosecution bench. Terming Mahbubey an “all-rounder,” Justice Sinha said: “Writ, civil, company, crime...you conduct everything. The Bangladesh government finds  PAGE 2 COLUMN 1

Dr Kamal Hossain yesterday formed a committee of lawyers to protest the government move to amend the constitution for restoring the parliament’s power on removing judges; however, pro-Awami League lawyers Barrister Amir-Ul Islam and Barrister Rokanuddin Mahmud, who were announced as joint conveners, declined to join the committee. The committee was announced by BNP leader Barrister Mahbub Hossain following a discussion organised by Bangladesh Gonotantrik Ainjibi Samity at the Supreme Court Bar Association auditorium. Barrister Amir-Ul Islam told the Dhaka Tribune that he had recommended against protesting the bill like political activists, but urged all lawyers to go for a constructive protest by preparing a charter where all the clauses would be present. It was “absurd” to join the committee as the announcement came from Barrister Mahbub, he added. The views were also echoed by Barrister Rokanuddin, who said it was not the forum to form a committee, adding that they were not informed about the committee beforehand. After the two senior lawyers declined to join the committee, former adviser to the caretaker government Barrister Moinul Hossain and Dr Shahdeen Malik were announced as the

mal strongly criticised the proposed bill, claiming that the government was passing the bill in a hurried manner and without discussing it with stakeholders and lawyers. Terming the bill “totally wrong” and full of wrong constitutional statements, Dr Kamal, who led the first constitution framing committee, said the bill was mistreating the seventh article of the constitution.

Dr Kamal criticised the proposed bill, claiming that the government was passing the bill in a hurried manner Also present there, lawyer Dr Shahdeen Malik claimed that the bill was nothing but a “fraud” to the nation. Pointing out wrong information in the proposed bill, he said for Article 96, the revival of the 1972 constitution would not be possible as the latest amendment to the constitution extended the age limit for judges to 67, which was only 62 in the first constitution. If the bill is passed by claiming that it would revive the 1972 constitution, it would be committing fraud with the constitution, he added. According to the proposed bill,  PAGE 2 COLUMN 2
