Quader Molla’s execution halted again for hearing Court hears maintainability of petition against death penalty n Nazmus Sakib The Appellate Division has clearly stated that the execution of war criminal Abdul Quader Molla could not take place until disposal of the Jamaat leader’s plea filed seeking review of the death sentence. It said no further order was required to halt the execution as the matter was pending at the apex court. The top court yesterday heard both sides over the maintainability of the petition filed in the morning as there is no provision of review in the International Crimes (tribunals) Act, 1973. At the end of proceedings, the five-member Appellate Division bench that passed the verdict on September 17 adjourned the hearing until today. Usually, the apex court starts its sessions at 9-9:30am and lasts until 1pm.

Later, Attorney General Mahbubey Alam told reporters that Quader Molla would not be hanged until the plea was disposed of, “since the government has respect towards law and judiciary.” For the first time in the country’s history, execution of a death row convict was halted by the chamber judge of the Appellate Division, in absence of the government lawyers, hours before the Jamaat leader was set to be hanged on Tuesday. The government around 7:40pm on Tuesday made it clear that Quader Molla would be hanged by midnight and the family members were asked to meet him for the last time. Then the defence lawyers meet Justice Syed Mahmud Hossain, the chamber judge, and secured a stay order on the execution until 10:30am yesterday.  PAGE 2 COLUMN 2

UN Assistant Secretary-General Oscar Fernandez-Taranco has said the solution to the existing political deadlock centring the next parliamentary elections must be a homegrown one. “I strongly believe that a solution to the current deadlock is still possible if there is political will, leadership and an attitude of compromise,” Fernandez-Taranco said at a crowded press conference at the Hotel Sonargaon yesterday. “There are measures that would

contribute immensely: a call by all sides to end the violence, the release of opposition political leaders, and a mutually satisfactory solution to the concerns regarding the election schedule,” he said. The UN envoy left Dhaka last evening. He arrived on Friday and was scheduled to leave on Tuesday but prolonged his trip for another 24 hours. Asked if he got any assurance that the polls would be deferred, Fernandez-Taranco told reporters, without elaborating, that the issue had been discussed.

“All issues related to the current situation have been discussed,” he said. He encouraged both the ruling Awami League and the main opposition BNP to continue their dialogue. “I firmly believe there is ground for an agreement. Bangladeshi leaders must continue to come together,” he said, adding that compromise in the dialogue would be decisive in finding a solution. UN Secretary-General Ban Ki-moon, who sent his representative Oscar Fernandez-Taranco to Dhaka to get Awami League and the BNP to sit for talks, yesterday condemned the ongoing violence. Ban phoned Prime Minister Sheikh Hasina around 4:45pm and hoped that the next elections would take place in line with the constitution, the national news agency BSS quoted the prime minister’s Press Secretary Abul Kalam Azad as saying. US Secretary of State John Kerry also condemned violence and hoped that the upcoming polls would take place in fair and peaceful ways. He also encouraged Awami League and BNP to engage in talks to settle their difference of opinion over the polls-time administration. “I hope that the next polls will be held as per the constitution and it will further strengthen democracy,” Abul Kalam Azad also told the Dhaka Tribune. The UN secretary-general condemned the ongoing violence in Bangladesh and hoped this type of acts would stop immediately. Ban expressed his optimism that the ongoing dialogue between the ruling and opposition parties would continue in the future. Leaders of the Awami League and BNP committed to UN mediator Oscar Fernandez-Taranco to sitting again for a third round of talks even though none of the camps believe that the UN move would settle the political deadlock. Taranco in his wrap-up press briefing told journalists: “A third meeting was agreed between the parties.” The delegations of the two parties are likely to hold the meeting tomorrow afternoon to discuss the way out of the ongoing political impasse.

Though BNP is not much optimistic about the outcome of the current political impasse, they still believe if the ruling party responds positively, the solution will come at any time.
