to others is bound to impress. Yet, the story of Mario Del Guidice and his relationship with his Community, as well as his unwavering devotion to supporting Desert Arc, is an incredibly heart-warming one. A staple in the Coachella

Valley’s hospitality industry for close to 50 years, Mario’s Italian Café brand has grown to include seven locations throughout the Coachella Valley. Mario Del Guidice got his first taste of the restaurant business in 1961, working in

Queens and Brooklyn, New York. After his first visit to Palm Springs, Mario realized he wanted to set down roots here, so he moved his family to the Coachella Valley in 1972. Today, 13 family members live in the Palm

Springs area, with eight family members working in the family’s restaurant business. Mario, along the way, strived to instill in his children the art of giving back at a young age, Continues on Page 7

Cooking for the Homeless

By Desert Star Staff Desert Hot Springs, Calif. - Margaret Webb, otherwise known as Team Mom, is working with volunteer cooks throughout the Coachella Valley community to feed the homeless during the Thanksgiving holiday. Team Mom Charities has asked restaurants and people to help her cook turkey and all the fixings starting Tuesday, Nov. 17 at 10:00 a.m. at the First Community Baptist Church in Desert Hot Springs. One local restaurant called to say they would make 100 spring rolls. Two days ago a Rancho Mirage resident called to say that she and her daughter would be preparing

special cookie bags for the homeless. These are just a few of the stories coming in from all around the Coachella Valley. Team Mom will be cooking at First Community Baptist Church in Desert Hot Springs between the hours of 10 a.m. to 12 noon. Other volunteer chefs will be cooking from their restaurants or at home. Team Mom is so proud of my community working together for the greater good. Thanksgiving dinner for the homeless in 10 cities. Travel Survival Handbook Reveals Coping Skills

Travel” was published in 2001 (Chronicle Books, San Francisco), the author Joshua

Piven added to the cover “How to Survive Runaway Camels, UFO Abductions, High-Rise Hotel Fires and Leeches.” In other words, this book is a rather unconventional travel guide, which nearly 20 years later is ideal for the current era of COVID-19. To be brief, he states, “The publisher, authors and experts disclaim any liability from any injury that may result from the use, proper or improper of the information contained in this book. Fasten your seat belt readers for an outrageous travel book covering situations from “How to Deal with a Tarantula” and “Gestures to Avoid” to “How to Jump from a Moving Train” and “How to Survive in a Riot.” Piven’s sense of travel humor knows no bounds revealing “Gestures to Avoid” such as the “OK” hand sign, which is considered signifying something worthless in France. Experts in the travel field provide information you may hopefully never have to use, such as “How to Control a Runaway Camel” or “How To Find Water on a Deserted Island.” However, the author consistently generates credible solutions on how best to cope with these unsettling situations.

Depending on where travelers are geographically and what’s available, a question about water might come up, such as “Why is the water green, brown or black?” Escalating the urgency to the extreme such as an unexpected accident, may require the traveler to ask someone, “May I use your belt as a tourniquet?” While I was on a bike tour in Portugal’s rural area with a friend who was also a Registered Nurse, she showed me how “How to Remove a Leech” as this was something I picked up along a country road. “Expect the unexpected when you travel,” says frequent traveler Anthony Grant. This practical guide translates this inquiry to French, German, Japanese and Spanish for you. Traveling in the desert, incidentally, brings up a danger whenever you find yourself amid a sandstorm. Common sense advice, according to the author, who obviously has weathered and survived global terrain, advises travelers to “wet a bandana and place it over your nose and mouth and use a small amount of petroleum jelly to coat your nostrils on the inside.” There are more exotic situations he covers, such as

how to cross a piranha-infested river. Revealing more down to earth dangers is advice on how to survive a high-rise hotel fire and survive a plummeting elevator. Should you be faced with how to “catch fish without a rod,” the author reveals an innovative method to manage this situation, too. This somewhat idiosyncratic book has accompanied me for two decades; the advice is reliable with a subtle sense of humor. This clever travel tome’s insider style is based on survival while anticipating all that can accidentally confront you as a traveler. “A travel emergency demands you know how to control a range of unpredictable incidences from a runaway camel or tactics for surviving a riot,” reminds the author. The Worst-Case Scenario is a classic read even after two decades, making the bestseller lists worldwide. Just remember, as the author quotes John Steinbeck, “People don’t take trips—trips take people. Pam Price has co-authored seven editions of Fun with the Family in Southern California, Globe Pequot Press.

In separate pan, bring orange juice, sugar and lemon juice to boil. Stir until sugar dissolves. Pour juice mixture into spiced tea. Garnish with orange slice and serve hot.

Gov. Lee Delays Execution in Case Spotlighting Intellectual Disability

By Desert Star Staff MEMPHIS -- Gov. Bill Lee has delayed the execution of Pervis Payne until next spring, citing challenges and disruptions caused by the COVID-19 pandemic. The execution originally was scheduled for December 3. The case has made national headlines because of Payne’s intellectual disability. According to the Innocence Project, Payne has a IQ score between 68 and 72, and the reading and writing skills of a child. Democratic State Representative G.A. Hardaway of Memphis and the Tennessee Black Caucus of State Legislators have

pre-filed legislation that would allow defendants like Payne to present a claim of intellectual disability to the courts. Hardaway said people with intellectual disabilities are more likely to be convicted of crimes. “When you have someone that’s intellectually disabled and has the mental capacity of a child, the simplest way to think of it is, ‘Would you allow a child to be executed?’” Hardaway said. Payne was sentenced to death for the 1987 killing of a Shelby County woman and her two-yearold daughter. He continues to maintain his innocence. State law does ban the death penalty for individuals with extremely low IQs, but for people already sentenced to death, there is no legal recourse. Payne’s attorneys recently filed a petition asking the governor to commute his death sentence. Hardaway said the definition of intellectual disability isn’t clear, and can be difficult to prove in court. “There’s a gap in the

Research has shown racial bias in the criminaljustice system against defendants of color especially when the victim

is white - has a strong influence on prosecution and sentencing. According to a report released earlier this year by the Death Penalty Information Center, since 1977, 295 Black defendants have been executed for the murders of white victims; while 21 white defendants have been executed for the murders of Black victims.

Complying With AB3182 is Manageable

By Kelly G. Richardson, Esq. CCAL This year in Sacramento only one major HOA bill, Assembly Bill 3182, passed to become law effective January 1, 2021. The bill creates a new Civil Code Section 4741 banning “unreasonable” HOA rental restrictions. The new law creates some uncertainties but is mostly manageable. The new Section 4741(a) prohibits HOA governing documents from containing anything which prohibits, has the effect of prohibiting, or unreasonably restricts rentals of homes, accessory dwelling units (“ADU’s”), or junior ADU’s (“JADUs”). It is clear what “prohibiting” rentals means, but the terms “effect of prohibiting” and “unreasonably restricting” are less clear. Most likely, these two terms are close to synonymous. Is a rental restriction a thinly veiled effort to halt rentals, or is there an explanation showing a legitimate purpose? This will be the critical question when evaluating present and future governing documents

rental requirements. Associations should be cautious regarding rental restrictions because unreasonable restrictions could result in a $1,000 civil penalty and attorney fees to the complaining party. One positive result of the new Section 4741 is its approval of rental caps as low as 25% of the HOA (excluding ADUs or JADU’s). The law allows caps of 25% or higher, so HOAs with a rental maximum of 25% or more are unaffected. Another helpful addition in Section 4741(c) is its confirmation that HOAs may ban short term rentals (30 days or less). It is not yet completely clear if this will have any impact on HOAs that have lease term minimums in their documents regarding normal non-vacation rentals (often 6 months or one-year initial lease term). However, since short term rentals are considered non-residential use by many cities, there is a strong likelihood that minimum lease term requirements will be defensible if HOAs can show the requirement is reasonable. New Civil Code Section November 18, 2020

4741(f)’s requirement that all HOAs must amend their governing documents to conform to the law by the end of 2021 has received major attention in the legal community. Many lawyers are already advising that HOAs must amend their CC&Rs, but this is a misreading of the statute which exposes HOAs to expense and possible frustration. Per Civil Code Section 4150, operating rules are also “governing documents.” As such, associations can adopt rule changes complying with the law and contradicting any illegal CC&R provisions. Such rules would not violate the CC&Rs since illegal CC&R provisions are overridden by the law. Passing rule changes is far easier and less expensive than seeking member approval upon CC&R amendments. One very problematic part of this law change is in an amendment to Government Code Section 65852.2. This statute will now provide that if a public agency does not respond to an application to build an ADU or JADU within 60 days, the application is automatically deemed

“approved.” Associations subject to creation of ADUs (primarily planned developments) should adopt solid architectural standards (which among other things incorporate local building codes) in case a building permit is approved due to inaction of the agency. Of course, HOAs also must be vigilant and prompt in responding to such applications to avoid having its own approval issued by default. While there is still uncertainty, reasonable associations led by competent professional managers and attorneys should be able to handle this new law.

GA state secretary claims Lindsey Graham prodded him to ‘throw out’ mail-in ballots

By Desert Star Staff Georgia State Secretary Brad Raffensperger has said he took Sen. Lindsey Graham (R-SC) questioning whether he could toss out mail-in ballots in counties with a high rate of non-matching signatures as an invitation to do this. In an interview with the Washington Post on Monday, Raffensperger said that “it sure looked like” Graham wanted him to think of a way to discard mail-in ballots in counties where a high rate of non-matching signatures was reported. “It sure looked like he was wanting to go down that road,” he said. Raffensperger was quoted by the WaPo as saying that Graham wanted to find out whether he, as a Georgia state secretary, could order the mailin ballots in these counties to be excluded from the tally.

Raffensperger said he told Graham that it was not his call to make since elections are administered by the counties. As the interview emerged, Trump detractors wasted no time in accusing Graham of arm-twisting election officials into “throwing out legal ballots.” Some suggested the South Carolina senator might have been “committing federal crimes to get Trump to 233 electors.” Graham denied the allegations, brushing off the notion that he encouraged fellow Republican Raggensperger to bend election rules as “ridiculous.” “If he feels threatened by that conversation, he’s got a problem,” Graham added. “I actually thought it was a good conversation,” he said, arguing that his goal was to ensure that mail-in voting is free from fraud. The main issue for me

is: How do you protect the integrity of mail-in voting, and how does signature verification work? In a subsequent interview with CNN, however, November 18, 2020

Raffensperger doubled down on his claim, saying that he “got a sense” from the conversation that Graham wanted him to get rid of the ballots.

Eva Green Shines in Alice Winocour’s “Proxima” Now Streaming on Amazon

Any career woman, who has been faced with juggling her work with parental responsibilities, will relate to French director Alice Winocour’s “Proxima.” Co-written with Jean-Stéphane Bron, the film is basically a family drama centering on a female astronaut in training for a space trip to Mars. Driven by the impeccable characterization of Sarah Loreau by Eva Green, the film is a pre-blast-off excursion into the delicate balance between Sarah and her seven-year-old daughter Stella, beautifully rendered by talented Zélie Boulant-Lemesle, who makes her film debut. Unlike the “Hollywoodish” superficial character and relationship development in the Netflix series “Away” starring Hillary Swank, Winocour’s script delves deeply into the changing family dynamic, which is spot on and intriguing, illuminating the roller coaster of emotions that mother and daughter experience during the pre-flight training process. Sarah sits quietly with Stella, explaining that she has been chosen to be an astronaut and that her training will commence shortly, after which she will be gone for a year. In a very poignant moment, her child asks, “Will you die before me?”

Sarah tries to skim over the answer and as she’s tucking her in casually says, “That is customary.” In order to move forward, Sarah must enlist the aid of her ex-partner and Stella’s dad Lars Eidinger to become the primary caretaker. Nicely played by Thomas Ackerman, at first Lars is reluctant to be a full-time dad and can’t understand why his “ex” wants to do this. She tells him that being an astronaut has been her dream ever since she was a little girl and put a lampshade on her head. Being in the space business himself, Lars agrees and his daughter moves in along with her cat Laika. Sarah is the only woman selected for this special mission, the training of which will take place at the European Space Agency in Cologne, Germany under the supervision of team commander, and somewhat sexist Mike Shannon, aptly played by Matt Dillon. On occasion, he tries to pull her off parts of the training that he thinks might be too daunting, citing that she might not have the core skills. Offended, she insists that she can do it, and does as well as the male astronauts, including the grueling 9G Gravity machine. The training scenes are intense

and beautifully captured by cinematographer Georges Lechaptois, who lingers on a frame before cutting to the next shot. Leisure time is given to the astronauts who, one night, sat around a campfire reciting poetry: “Give me a garden of beautiful flowers where I can walk undisturbed.” As the training nears completion, Stella and her dad are moved to housing in Cologne for families of the astronauts. Supervised by astrophysicist Wendy, played by Sandra Hüller, she takes Stella under her wing and becomes her surrogate mother. In between training sessions, Sarah spends time with her daughter and there is a sweet scene of them ice-skating together. But, Stella is quite unhappy as being dyslectic, she is having trouble keeping up with the other kids and can’t do the multiplication tables. Throughout the film we see Sarah’s devotion to her training, as well as her deep concern for her daughter’s well being. As the time allowed to spend with her daughter shortens, Stella begins to withdraw and forms a strong bond with Wendy. Blast-off is nearing and reality of the potential danger of the mission is setting in and each astronaut is asked to write

a “just in case” letter to their families. They are also allowed to bring a few mementoes on board to remember their earth connections, such as favorite family photos, shots of water, forests, and even ladybugs. They can bring enough stuff to fill a shoebox – no more than that. Being so close to takeoff, and to avoid any contamination, the astronauts can now only see their families through a glass partition and you can see the pain Sarah is feeling in not being able to hold her child one last time before she leaves for outer space. It is about here that she takes what is an implausible dramatic action that endangers not only herself, but also the mission. Perhaps it was to heighten the drama and to hammer home Sarah’s devotion to her child. However, taking that action flies in the face of all her training

and leaves you doubting her commitment. Not a good message as breaking serious rules doesn’t shine a positive light on Sarah and brings into question the ability of a woman to walk the line between parenting and career. Despite this contrived dramatic moment, the schedule is maintained, and all the astronauts are suited up. ‘Mario’s Birthday Bash’

always leading by example. With the vibrant passion that only a real New York Italian seems to possess, Mario approaches every day with the vigor of a much younger man. Although his daily routine includes visiting every one of his seven restaurants to oversee quality control and other issues, Mario can be found most mornings at his Bermuda Dunes restaurant, preparing the homemade sauces and pasta for which all of his restaurants are known for. His two sons, now in their 50s, work alongside Mario and his wife, Karen. “My sons have been involved in the business since they were 8 and 9 years of age,” states Mario. “I have two wonderful sons. They are my business partners and partners in my life!” Mario became aware of Desert Arc’s mission of enhancing the quality of life and creating opportunities for people with developmental and intellectual disabilities in the early 1980s. A former Desert Arc Board member solicited him for a donation. Mario, at the age of 12, as part of detention for being disruptive in his 5th-grade class, was forced to work with some handicapped kids at his school in New York. That experience had a profound impact on Mario, as he developed an appreciation and respect for the work ethic and joy he saw in those youngsters he worked alongside. So, when the chance came to contribute to the Desert Arc mission, Mario knew he needed to take it! Since that beginning, Mario

has found numerous ways of helping Desert Arc and its clients to succeed. One of the most profound ways has been his training program. He has opened the doors of his restaurants to Desert Arc clients, and on a 5 dayper-week basis, Mario has taught them different aspects of the restaurant business. Mario declares, “Giving back to the less fortunate is a feeling you simply cannot buy.” Today, he employs four Desert Arc clients every week while at the same time actively seeking other ways to generate visibility for the organization’s mission. While he maintains good relationships with all of his employees, one employee brings a smile to Mario’s face whenever he sees him. Luis, who Mario refers to as his “Shining Star” employee, has been a part of Mario’s Italian Café family for 19 years. Mario considers him just as much a part of his immediate family. Despite his challenges, Luis immediately grasped many nuances of the restaurant operations, and as Mario will tell people, “Luis knows where everything is in the building, and I don’t! “Every time Luis does a job, I make an effort to say thank you. He works six days a week and gives me back twice with loyalty and love.” Luis came to Mario’s Italian Cafes through Desert Arcs’ Pathways to Employment Program. Over the years, Mario has been involved with two key Desert Arc client events, which include the Christmas Celebration and Mario’s Birthday Bash, where Mario underwrites 100% of all the

Although he looks forward with much anticipation to the annual Christmas Celebration, Mario truly relishes the Mario’s Annual Birthday Party, usually held on his April 6 birthday. Mario provides all the food for this celebration, with his wife Karen making all the dessert offerings, including an immense cake for the over 700 Desert Arc clients who attend. Harpo, the Clown, regularly looks at both these events, and a DJ is present to get everyone out on the dance floor. Mario swears that his birthday bash with the Desert Arc clients leaves him feeling 25 again. “When I come to Desert Arc and underwrite

these two events, everyone gives me so much love.” When asked what motivates him, Mario replies, “the love of my family, friends, and what I do because I love what I do. My wife, Karen, works alongside me in my seven restaurants each week and is so supportive. I could not do this today without the love and support of my two sons and my wonderful wife.” Considering the pandemic that we are all going through, Mario decided to give back yet again, launching a brand new idea called Mario’s Community Mondays, which now feeds over 2,000 first responders, homeless individuals, National Guardsmen, as well as local nonprofits and hospitals. Since the program’s inception, Mario’s Italian Cafés have served over 11,000 meals. Additionally,

Mario’s Italian Cafés has seen that over 100,000 surgicalgrade gloves have been donated to local area hospitals. Mario’s connection with the Community is evident not only through his Community Monday’s meals program and his extensive work with Desert Arc but also through his work with 11 local high schools. He also contributes to the American Cancer Society and the American Red Cross. “The Coachella Valley has given me so much success,” he beams. “I feel fortunate I have the chance to give back.” Giving back is in Mario’s DNA. The company will stop using bisphenol S and bisphenol A, which give a shiny coating to thermal paper, used for many airline tickets and receipts from stores and ATMs.

Leah Segedie, a consumer watchdog with the website Mamavation. com, said the move will make millions of Americans safer. “A lot of health impacts have been linked to bisphenol, like diabetes, weight gain, asthma, infertility, hyperactivity in children, and lots of cancers like breast cancer and prostate cancer,” Segedie outlined.

Mamavation gathered 51,000 signatures to petition Target to make the change. CVS, Whole Foods, Trader Joe’s and Best Buy also have stopped using the chemicals, known as BPA and BPS, which are known to be endocrine disruptors. BPA has received a lot of negative attention in recent years, yet it is still widespread, November 18, 2020

embedded in food and beverage cans, polycarbonate plastic, children’s toys and garden hoses. Some companies responded by replacing BPA with BPS. However, Segedie noted multiple new studies warn BPS is also hazardous, mainly because the powder rubs off and can be easily

Coconut Popcorn Snowballs

Yield: 8 balls (4 inches) 2 cups shredded or flaked sweetened coconut nonstick cooking spray 3 quarts popped popcorn 4 tablespoons (1/2 stick) butter or margarine 3 cups miniature marshmallows 1 teaspoon coconut or vanilla extract 8 candy canes or candy cane sticks (about 3-4 inches) Place large sheet wax or parchment paper over work surface. Spread coconut on paper. Spray large mixing bowl lightly with nonstick cooking spray and place popcorn inside. In medium saucepan, melt butter over low heat. Stir in marshmallows until melted and mixture is smooth. Pour over popcorn and mix well until coated. Spray hands with cooking spray and press mixture firmly to form into balls. Place balls on coconut; roll and press coconut to coat. While holding popcorn balls, gently press candy cane into each ball. Serve immediately or wrap individually in plastic wrap for storage.

gum drops (optional) cinnamon candies (optional) In large saucepan, melt marshmallows and 1/4 cup butter. Remove from heat and stir in vanilla. Let stand 5 minutes. Pour marshmallow mixture over popcorn and stir. Butter hands well and form into balls. Decorate with sprinkles, licorice, gum drops and cinnamon candies, if desired.

Jingle Balls Yield: 12 cups Nonstick cooking spray 12 cups popped popcorn 6 tablespoons butter or margarine 3 cups mini marshmallows 1/2 teaspoon peppermint extract assorted colored sugars

Spray large mixing bowl lightly with nonstick cooking spray. Add popcorn. Spread plastic wrap on cookie sheet; set aside. In medium saucepan, melt butter and marshmallows; stir until mixture is smooth. Stir in peppermint extract. Pour over popcorn, mixing until well coated. Let cool 2 minutes. Spray hands with nonstick cooking spray and form popcorn mixture into 3-inch balls. Gently press colored sugar onto balls. Let sit on prepared cookie sheet until cool and set.

Servings: 8 8 cups unsalted, unbuttered, popped popcorn 2 1/2 cups mini marshmallows 1/2 cup chopped dark chocolate or dark chocolate chips 2 tablespoons butter or light olive oil 1/4 teaspoon salt 16 pretzel sticks 16 eyeball candies 8 red candy-coated chocolate candies Place popcorn in large mixing bowl. In saucepan over medium heat, heat marshmallows, chocolate, butter and salt, stirring often, until smooth. Toss marshmallow mixture with popcorn until well combined. Scoop 3/4 cup popcorn mixture into ball. Repeat with remaining mixture to make eight balls. Place each ball in paper muffin cup liner. Insert one pretzel stick on each side of ball to resemble antlers, attach two eyeball candies for “eyes” and one red chocolate candy for “nose.” Repeat with remaining balls. Let cool completely.
