Disputes on debit orders are an industry wide issue. We have therefore appointed attorneys, that are dedicated to collect disputed funds in an attempt to recover losses suffered not only by the PDA, but also by our DC’s. For this reason, we urge all our clients to ensure they have valid mandates for all debit order collections.

4. NEED TO KNOW - DEBIT ORDERS • All mandates should be uploaded to the consumers file on Finwise in order for DC Partner to have access to the said files in the case of a dispute.

• Voice recordings are not accepted by any of the banks. If a mandate is requested by a bank you have to supply the initialed and signed mandate within 3 working days after request.

• If a signed mandate is not received, the Debt Counselling Company / Debt Counsellor will be held liable for the debit order amount disputed.

All mandates should be sent to mandates@dcpartner.co.za within 5 days after uploading the debit order, should no mandate be received the debit order will be cancelled.

• A mandate is invalid when the agreed date on the signed mandate and the action/ strike date differs, changing of consumers strike dates and/or amount will result in the signed mandate being invalid.

• Should the consumer dispute after 40 days, the PDA will request a signed mandate from your offices. Should you be able to provide this, it will be given to the respective parties in order to attempt to stop / reverse the dispute. Should your offices be unable to provide the signed Mandate, the PDA will recover the full disputed amount from your offices.

5. SOME TIPS FOR YOUR BUSINESS START UP 1. Ensure all appointed staff are internally trained on the debt review proccess & the debt management software system. Finwise agents can be contacted to provide inhouse training free of charge for all users.

2. Prepare a detailed marketing plan, and know where to reach your consumers and through which advertising or social media platforms.

3. Create a good informative website, facebook page and link and optimize with keywords to channel consumers searching for a debt counsellor.

4. Have a budget set aside for marketing.

6. Keep track of all expenditure and income with good bookkeeping of records and receipts.

7. Don’t give up! The first 4 months is tough learning the industry and juggling your new business. Ask for help from industry peers and service providers.

7. FREQUENT ASKED QUESTIONS & ANSWERS Question: What is a form 17.1?

The Debt Counsellor is required by the National Credit Act to let creditors and the credit bureaus know that a consumer applied for Debt Review. This is done by sending a form 17.1 to the credit providers after the signed form 16 is received from a consumer.

Question: How are the creditors paid?

The consumer funds is paid directly to a accredited Payment Distribution Agent, the PDA distributes the funds to the various credit providers.

Question: How will I keep track of payments?

The PDA will, after funds have been distributed update the consumer file with a detailed statement. This will reflect all the payments made, distributed funds and outstanding balances.

Question: What is the cost to use the PDA? PDA charge only distribution fee’s on active consumers. The PDA fee’s are charged as per the NCR stipulated guidelines.
