How to Know about NO OBEJECTION CERTIFICATE for Any Vehicle

WHY N.O.C IS REQUIRED ?

Who ever wants to shift his vehicle from one state to other state needs a ‘ No Objection Certificate ’ for getting his Vehicle and Registration Certificate transferred to other states. As per the rules, R.T.Authority insists on N.O.C before issuing clearance to the candidate.

Moving states is a tedious task especially if you have commodities that are state specific like vehicle registration You have to register, de-register. While we loathe the fact that India still behaves like a country of countries, the legislature might just be considering the creation of yet another state!!

Before looking for packers and mover Hyderabad you need to get an NOC, more ominously "No Objection Certificate".

If you have a vehicle registered in one state and planning to move to another here are the things you need to look for: When do I need NOC ?

If you are planning to stay in the new state for more than a year, you will be required to register your vehicle with the new state RTO – and for this, you will require an N.O.C from the state where it was registered earlier this will get you a new vehicle reg.

How to get N.O.C ?

The N.O.C for Bike or Car is issued by the RTO (Regional Transport Office) of a specific region/state. This confirms that there are no dues on the vehicle and no criminal records registered against it in NCRB (National Crime Records Bureau).

There are 3 Steps to be followed.:

Step 1. The Documents Make sure you have these documents –

    

Driving License Certificate of Registration (RC Book/ RC Card) Valid Vehicle Insurance Policy Local Address proof Clearance letter from the Financier (only in case you had bought your vehicle on

loan).

Visit the Asst. Commissioner of Police’s office in your city and ask for a clearance. Most places give you an Enquiry form which you fill in with your personal particulars, vehicle number,

Chassis no, engine no. etc. – All details will be present in your RC Card. In some cities, you might have to request through a written application letter (handwritten or printed on plain paper).

Following documents need to be submitted here:

       

Requisition/Request letter addressed to AC, CRB (Only if required) Completed Enquiry form (will be provided to you there).

A copy of RC book/card.

Copy of Vehicle Insurance (valid).

Copy of Driving Licence of the RC owner A copy of Local Residential proof (Ration card/DL/Passport/Letter from HR (original)/Bank Passbook).

Copy of Vehicle purchase Invoice (not mandatory).

Clearance letter from the Financier (only in case you had bought your vehicle on loan)

Important: Make sure you carry an original of all these documents for verification. If HR Letter is provided as address proof, original will need to submit (also carry your company ID card, just in case).

After all these documents are submitted, they will provide you with a receipt and you would be asked to visit the next day (or as directed) to collect your clearance certificate (Vehicle Enquiry report). The Current address need not be same as the one in RC – just need to be in the same city/state.

Step 2. PUC Certificate Meanwhile, Get a PUC Certificate (Pollution under control) This is usually issued at major petrol pumps in the city after inspecting the vehicle Step 3. The RTO Office Get a Form 28 – either from vendors near RTO or you can download it for free from the internet. Also, make a pencil trace of the Chassis number on all the three forms (For bikes this is embossed on the neck of the chassis just below the handle).

Following documents are required:

      

Completed Form 28 and Chassis pencil print on all.

Vehicle enquiry report (Clearance from CRB – the one you got from Step 1).

A copy of RC book/card.

Copy of Vehicle Insurance (Expiry date will be checked) Original RC book/card (Yes you need to submit this – will be returned when you collect the NoC grant) Copy of the PUC Certificate ( from step 2) Reason for moving to another state (not mandatory, depends on RTO)

Apart from these, they are few questions our customers asked us quite a few time. We have formulate them below.

How many days does an NOC is valid?

It is generally valid for 1 year but in few states it is 6 months.

What if NOC is expired?

There is no other way you have to go back to origin RTO office to get the NOC Do I need to pay life tax in the new state for getting my vehicle registered?

Yes on the pro data bases you have to pay life tax .

Can I claim my life tax from the origin state ?

Yes you can claim the life tax for this you need to fill Form 16 rule 20 along with proper reason for state transfer you can submit offer letter from your new company.

What if there running bank loan on your vehicle?

RTO won’t give an NOC if vehicle is financed by a bank and it is under loan they ask you to present the consent document (no objection certificate) from the financier of the vehicle.

For this you need to approach the bank and get the letter few banks transfer the loan account to nearest branch of the moving city few banks just asks for the new address proof and issue the certificate.

The bank will ask for following documents:

Application New Address proof Loan letter Form-28 Identity Proof

Just ask your bank loan department for the documents, it may vary.

The bank will verify the New Address mentioned by you in the application and issue the NOC letter to you.

Just remember after taking the NOC letter from the bank just get the sign of the bank officer along with the bank stamp on back side of each of the three form-28(Back side first section). Attach the duly stamped form-28 in triplicate and bank NOC letter along with the other documents to the RTO to get the NOC.

What are the provisions relating to Inter State transfer of vehicles?

When a Motor vehicle registered in one State has been kept in other State for a period exceeding twelve months the owner is required to obtain a new registration mark to be assigned by the registering authority within whose jurisdiction the vehicle then is in terms of section 47 of the Motor Vehicle Act 1988.

What are the provisions relating to refund of one time tax paid in respect of non transport vehicles?

Taxes on Motor vehicles is a State subject and hence the Motor vehicles Act 1988 and CentralMotor Vehicle Rules 1989 do not contain any provision there on. However while you apply for the new registration mark the State authorities would demand a N.O.C. for the original registration authority ( from the earlier State).

N.O.C. is normally issued by such authority after ascertaining that all taxes/dues have been paid.

In case of a non transport vehicle normally one time tax for 15years in the first instance ( and 5 years thereafter ) is paid in most of the States. In case of transfer to another state the new state would demand pro rata tax for the remainder of the one time tax period. Such taxes are to be paid.

Corresponding refund can be applied in the earlier State.

Certain States exempt certain categories of transferable Govt. employees from payment of such taxes on transfer. You need to check with the concerned RTO authorities or Transport Commissioners.
