Builders Leave Homes Exposed to Rain

When an elderly widow asked builders to work on her property in Gran Alacant while she was back in her home country she had high hopes, and was assured, that the work would be carried out to a high standard and that she needn’t worry about anything but would return to Spain and have a nice new solarium

What she wasn’t expecting was the that the builders would end up causing damage to not only her property but her next door neighbour’s apartment too, and possibly the property below hers (which is empty at the time of writing as the owners are in Madrid and with no one with access to check).

The bungling builders arrived on Friday 20th April to start the pro-

cess of taking up the tiles on her solarium to replace them. The work continued on the Saturday morning and finished at 1.00pm when the builders disappeared having removed the tiles and left the roof with no protection from the elements. The fact that they left approximately 6 tonnes of tiles stacked in one place on the roof also caused alarm to neighbours and a professional builder, who was called in by the worried next door neighbour, to take a look at the situation from his own terrace.

However, the real problems began when heavy rain hit Gran Alacant on Wednesday the 25th of April when the neighbour was out all day and returned to find water entering his property from the exposed roof next door; destroying a laptop, a tablet and causing damage to ceilings in two rooms. Also affected were the bed in the spare room which was soaked through and the sofa which had to be stripped and was unusable until it could dry which took some three days.

After contacting the owner, who then alerted the builders, the

+34 966 699 441 neighbour began to assess the damage, which could possibly run into thousands of euros. The owner was told by the builders that somehow the damage to the properties was her fault! The building company, who operate from a website named, Scandinova.es, did not seem too phased about the damage and told her that they would turn up, ‘sometime on Friday 27th April’ – two days after the damage was reported. The heavy rain, not bringing them rushing to get the roof covered with some sort of protective cover such as a plastic sheet, was left to seep through the roof until two labourers did turn up on the Friday. When questioned by this newspaper the two workers claimed that they had done the work on the Saturday previously, which was not true, and claimed that they just ‘do as we’re told’.

A hurried clearance of the rubble on the roof then followed as the builders realised that photographs were being taken of the shoddy and unprofessional work on the roof while the worried owner, who was back home in Norway had to rely on helpful neighbours to keep her updated.

Gran Alacant News contacted the building company who are based in Torrevieja to ask them why they had left the roof exposed, why they

didn’t rush to the property when the rains began falling heavily on the Wednesday and what exactly they planned to do to resolve the situation. As of Wednesday, 2nd of May no response has so far been forthcoming.

If anyone else has had any dealings with this company and suffered like this poor woman and her neighbours in Gran Alacant please contact us here at GAN and we’ll continue to chase the company which seems to want to try and ignore the mess which it and it’s ‘professional’ staff seem to hope will just go away.

A LETTER TO THE MAYORESS....AGAIN Following our article about the placement of communal rubbish bins next to pedestrian crossings (and thank you for moving them) we would like to add that we don’t think you read it to the end, or you did but for some reason can’t see our point of view.

We’ve put it in photos for you again this time to make it absolutely clear that, while it is commendable that you listened, you didn’t listen enough. Or, for some reason you believe that a car parked next to a pedestrian crossing does not create the same sort of hazard as a large bin.

Take a look at the photo of the 4x4 parked next to the crossing in Avenida Escandinavia, which, according to the law is perfectly legally parked. This 4x4 has now been parked (with a sun screen in its front window) for six weeks now and creates exactly

the same hazard as a bin, i.e. drivers cannot possibly see a disabled person or a child (or in fact anyone under 5 feet 6 inches tall!)

It seems to us that it is just common sense not to allow vehicles to park this close to crossings, as we mentioned in the first article, and, if you drive down past the school in Gran Alacant at any time of day (including school arrival and leaving times) there will be vehicles parked either side of the crossing used for direct access to the school.

This matter really does need addressing with some urgency, it will not cost the town hall much more than a tin of paint to put some zig-zags on the road to prevent drivers from parking and could possibly save injury or worse to anyone who cannot be seen trying to cross the road. Unfortunately, as you know we do not live in an ideal world where everyone drives at a safe speed and anything that can be done to avoid accidents (and that is simple to resolve) should surely be carried out as soon as is possible?

Carry on Camping?

They may soon be on the move but locals have been contacting GAN about the increasing number of camper vans that we see parked on the beach each year throughout the winter. The complaints include many who are not happy with the camper vans parking in such a way that access to that particular part of the beach is almost cut off to anyone wishing to get to the water unless they wish to weave in and out of the parked up vans, some of which are the size of large trucks.

Mark Walton, a long time resident in the area was furious and wanted to know what right they have to take over the coast when they pay no rates and ‘contribute nothing to the local economy.’ And, upon investi-

gation it seems to be true as, after speaking to many local businesses, including bars, restaurants, shops and traders we could not find one business that could say that had benefited from the arrival of the convoys of campers that arrive each year. Another local, Les Haynes, said ‘they spend their money in the big supermarket chains but nothing in the area to help local businesses but seem happy to park the campers in supermarket car parks taking up five car parking spaces at a time. The other day there were four of them parked in Lidl car park at the bottom of GA which left no parking spaces for anyone else.’

It does seem a little unfair on residents who have to pay for their rates and wa-

We’ll see if Elche Council respond to our article but in the meantime we have just one question...where are they emptying their toilets?

Avoiding Inheritance Tax in Spain About between Spouses and their Children

Most of us British ex-pats will fall under the UK Inheritance tax thresholds and not have to pay UK Inheritance tax on our Estate. As we are all aware in the UK

there is no Inheritance tax spouse to spouse which is why Ken Dodd married his very long term partner two days before he died.

However if you are a Spanish resident (or deemed to be one) then there are Inheritance taxes between spouses. In Spain it is known as Succession Tax (ISD) and is payable by the beneficiary and not the Estate (as in the UK).

Granted, spouses and children ( natural or adopted, not step-children) get a €100,000 allowance so, simply (and I mean simply because in reality it gets very complicated), if you have joint assets sited in Spain worth over €200,000 then there will be Inheritance tax to pay by the surviving spouse of a married couple. But anything over could be subject to ISD and not only does the tax need to be paid by the surviving spouse but there will be the huge inconvenience of half of the joint assets being frozen until the tax is assessed and paid.

The ISD rates for a spouse and /or child in the Valencian region run from 7.65% to 34% depending on the amount over €100,000 being inherited, but remember there is a 50% discount on the calculated amount of ISD (as current rules stand).

Please note if you are not married even if you have been partners for many years under the current rules in the Valencia region of Spain you are entitled to NO allowances and NO discount, ISD tax can go as high as 80% for the remaining partner.

So what can you do?

You can contact me and depending on your financial situation I would be likely to recommend: A Spanish tax compliant investment bond written as a joint life assured bond between both spouses/partners. When a spouse/partner dies first the bond continues as if nothing has happened, there is no taxable event, nothing gets frozen and there are no liabilities to the Tax department. It continues in the survivors name, tax free.

Once you have both died, if your children (natural or adopted) are resident in the UK and you have a UK law of succession clause in your Spanish Will, they can inherit the proceeds of the bond tax free (certain exceptions can apply).

Other benefits of the bond are of course that they can give you a proper return on your money, unlike bank deposits. Currently, for example, a Prudential Bond is netting 3.8%p.a. return which is applied daily. These, and/or other products can only be purchased from regulated advisers because they are required to assess the right product for you and your family´s circumstances. For this reason they cannot be bought off the shelf directly from product providers. The minimum bond size is £20,000 or €25,000.

Spain seeks 3 years for the half a million people affected The Spanish government has completed an internal report which will be distributed to all affected regions and which will set the framework for each ministry’s position, especially in the new transitional period which will continue until the final exit from the EU. The European Council has begun work on it, and its main priority is to maintain the current status quo of the existing agreements until the situation concludes at the end of 2020, especially for the almost 200,000 Spaniards living in the United Kingdom and the 300,000 Britons living in Spain.

NON-RESIDENT TAX

If a person resides more than 182 days in any calendar year in Spain, then that person will be deemed a resident in Spain for tax purposes. Persons spending less than this period, will be deemed non-resident for tax purposes. That said, it is impossible to establish exactly ones tax situation, without detailed knowledge of the personal circumstances.

The Spanish taxation management authorities do not work to the same standards as the English ones and mistakes on your tax bill are frequent which can leads to serious problems if not addressed.

The amount of notional letting to be declared in the form is 1.1% of the valor catastral. You will then have to pay tax at 24% of that 1.1%. Thus, if you have a property worth in reality £150,000 but which has a valor catastral of £50,000, the taxable notional rent of the property will be £550.00 (1.1% of £50,000), and you will have to pay £132 in tax (24% of the taxable amount).

Tax collection in Spain The authority responsible for the collection of taxes is the “Agencia Estatal Tributaria” (AEAT-Hacienda), which is organised on a provincial basis. In each province there is a main office of Hacienda, and in many provinces there may be one or more sub-provincial offices.

There is an important difference between the way in which the Spanish and the British pay their taxes, because in Spain it is a personal responsibility and obligation to complete a tax return each year, by making a self assessment of the amount to pay, and submitting the form to the Hacienda together with the amount due.

Appeals As in most countries, if you disagree with the amount of tax that you are required to pay you can appeal against the decision of the Tax Authority. We can advise you on this.

Inheritance Tax As in most countries the State likes to take a chunk of your assets when you die. How much they will receive depends largely on how well you plan your affairs.

N.I.E. (Numero de Identificacion de Extranjeros) This is an identification number for use by foreigners in Spain.

If you have dealings within Spain – even if you are not full time or tax resident – you are required to have a number.

This is obtained from your local Police Station at the foreigners’ department. However tempting it may be not to bother obtaining this number you will find that it will cause you great inconvenience in the future if you do not have one.

Fiscal Representatives The Spanish Law until recently required any person who had dealings within Spain but who was not a full time resident in Spain to appoint a fiscal representative. Although this is no longer strictly necessary, we still consider that it is a step well worth taking.

A Fiscal Representative is a person who undertakes on behalf of the taxpayer all dealings with the Spanish Tax Authorities. The appointment of a Fiscal Representative is the only way in which you can be sure that the Spanish Tax Authorities, unable to con-

Personal Taxes Impuesto sobre Patrimonio (Wealth Tax) : Spanish wealth tax for non residents has been abolished since the 1st January 2008.

Impuesto sobre la Renta de las Personas Fisicas (lncome Tax) A person non resident in Spain for tax purposes must still make an annual declaration for income tax. The Spanish Authorities are only concerned with income derived from activities in Spain, not your world-wide income. A typical example of this would be the income derived from renting your apartment or house. (See also, “Tax on the Notional Letting Value of Your Property” below).

As this income is part of your worldwide income it would also have to be declared to the British Tax Authorities, however double taxation relief does exist, as a result of a treaty between the two countries.

Tax on the Notional letting value of your property In addition to the ordinary income tax return, which you must submit in appropriate cases, you are required to make a tax return in respect of the notional letting value of your property. This tax return has to be made whether you have actually let the property to anybody or not. If you have actually let the property and received money for it, then the money you have received will have been declared in your ordinary income tax return. The amount of tax is calculated by reference to the valor catastral (see above) of your property.

VAT As in England, most transactions in Spain involve the payment of VAT. The normal rate is 16%. Transactions involving basic necessities carry VAT at a rate of 4%. Certain items are VAT exempt.

The whole system of taxation on death is very different from the English system and so poses a real danger to English people who assume that similar provisions will apply and thereby arrange their affairs accordingly. Some differences are: In Spain there is no automatic inheritance by a wife or other joint owner of the deceased joint owner’s share in any property. If it is left by will or on intestacy to the other joint owner, the gift will be taxable.

The amount of tax payable is determined not by the size of the whole estate, as in England, but by the size of each individual inheritance. The tax is progressive; the more you inherit, the higher the rate of tax you will have to pay.

Close relatives pay tax at a lower rate than more distant relatives who in turn pay less tax than total strangers. Close relatives are also entitled to receive a sum tax-free. More distant relatives and strangers are not.

An estate of, say, £100,000 can therefore produce a large tax bill if it is all left to one person – especially a non relative – and little or no tax bill if it is divided amongst a number of beneficiaries who are close relatives.

Those who are already wealthy when they inherit pay more tax than those beneficiaries who are poor. In the case of foreigners the only wealth taken into account is their Spanish wealth.

There is great scope for minimising inheritance tax. In general terms, dividing your assets between your husband/wife and children tends to produce the lowest tax bills. Take as an example a typical case where the estate comprises a villa and a

small bank account – a total estate valued at, say, £50,000. If the estate was left to a stranger – including, for this purpose, a non-related executor and trustee – a tax of about £5,000 would be payable. If the same estate was left in equal shares to a wife and 3 children, no tax at all would be payable.

Those who do not have spouses or children can use the same principles to make savings using other classes of beneficiary.

But of course if you put the property in other person’s names you are not longer the owner of your own property. Penalties are imposed if the tax due is not paid within 6 months of the date of death.

In many cases where sizeable tax payments are going to be a problem, it is possible to dispose of the assets during the owner’s lifetime much more cheaply than at his death. In many regions there are important allowances when both the deceased and beneficiaries are residents in the region.

When beneficiaries are close relatives there could even be no payment of inheritance tax.

LA TOMATINA FESTIVAL

INFORMATION, ACCOMMODATION & TOURS LA TOMATINA 2018

La Tomatina is a food fight festival held on the last Wednesday of August each year in the town of Bunol near to Valencia in Spain. Thousands upon thousands of people make their way from all corners of the world to fight in this ‘World’s Biggest Food Fight’ where more than one hundred metric tons of over-ripe tomatoes are thrown in the streets.

Prior to 2013 anywhere from 40,000 to 50,000 (reported to be 50,000 in 2012) people crammed into this huge tomato fight, greatly expanding Bunol’s normal 9,000 person population. Since 2013 official ticketing has been in place limiting the number of participants to just 20,000 lucky people.

There is limited accommodation for people who come to La Tomatina, so many people take the easier option of staying in nearby Valencia just 38km to Bunol by bus or train. In preparation for the dirty mess that will ensue, shopkeepers use huge plastic covers on their storefronts in order to protect them from the carnage.

Where: Takes place in Buñol, a little village near Valencia, Spain. Population around 10.000 people. Located 40 km from Valencia by bus, train or car.

Why: In 1945 some young boys decided to get a place among the retinue of a parade during the town festivities. The energy of these teens made that one participant fell down. The participant got mad and started to hit everything in his way. Casually nearby there was a vegetable stall that fell victim of the furious crowd: people started to pelt each other with tomatoes. Here you can read more about the origins of this world famous festivity.

What: What’s your ammunition? 120 tons of red tomatoes.

Who: Locals and people from all over the world. Maximum capacity: 22.000 participants. Just for adults at least 18 years old.

How: Tomatina Festival begins at 11am with a bang. Trucks loaded of tomatoes proceed to drive through the fight area while some locals in the back of the trucks are throwing tomatoes at all of the festival goers. As soon as the truck passes, everyone dives on the ground scooping for tomatoes to get themselves armed for the battle…that’s when the fun begins! The following hour will be one of the most intense and hilarious experiences of your life.

A LOAD OF BALLS...

The England and Wales Cricket Board wants to introduce an innovative ‘100 balls’ format into its new eight-team, citybased tournament.

The concept could see innings consist of 15 traditional six-ball overs, and a final 10-ball over.

That would be 20 balls shorter than traditional T20 matches.

Those devising the competition believe a 100-ball ‘countdown’ would attract new audiences and be popular with broadcasters.

The proposed approach was presented by the ECB to the chairmen and chief executives of the first-class counties and MCC on Thursday.

ECB’s chief executive officer Tom Harrison said: “This is a fresh and exciting idea which will appeal to a younger audience and attract new fans to the game.”

The new competition’s board unanimously supports the development of the 100-ball concept.

‘The players should wear clown outfits’ - fans and players react to new ECB proposals. Southampton, Birmingham,

Leeds, London, Manchester, Cardiff and Nottingham have been selected as venues for the five-week competition, which starts in 2020.

Both Lord’s and The Oval will host newly-created teams in the competition with the Ageas Bowl, Edgbaston, Headingley, Old Trafford, the Swalec Stadium and Trent Bridge the other grounds chosen.

The BBC and Sky Sports will broadcast live TV coverage of the new men’s and women’s domestic tournament each summer from 2020 to 2024.

The new competition will take place alongside the existing T20 Blast which is expected to be unaffected by the proposed format changes.

The ECB believes the concept will help to appeal to families and a more diverse and younger audience, and provide some distinction from the T20 Blast.

It will feature aligned competitions for both men’s and women’s teams, with the same format and team identities.

The 100-ball concept will now be further developed but it has been welcomed by the broadcasters and player representatives - both men and women - that have been consulted.

STOP MUCKING ABOUT!

Okay, so I’m old and grumpy, and a Yorkshireman to boot, which means – in my case at least – that the nearest thing I have to religion is…………Cricket. Back in the day, not that long ago, you could guarantee that there would be a county match going on any weekday, up to and including Saturday, and then a Sunday league match. And the county championship was always ‘real’ cricket, with no gimmicks, day/night games, funny coloured balls, coloured kit, and all that stuff. Now I know the T20 matches have their place, and can draw in big crowds, and that they are fun, but there is nothing to match the drama of a hotly-contested county match, or a test match if you are a proper cricket fan. They (the ECB) have cut the County Championship to the bone already, so that we are left with whole summer weeks when absolutely nothing is going on, and the one-day knock-out tournaments mean that most counties are idle for big chunks of the latter part of the season. And now they are going to have ‘City’ matches in

county competitions we all know so well.

Just stop mucking about!

WHITHER RESPECT?

Inevitably, as we awaited the equally inevitable spectacle of multi-millionaire Barcelona thrashing Sevilla in the final of the Copa del Rey, we were treated to the distasteful whistling of their politicized fans as the national anthem sounded. Earlier, Tebas, president of the Spanish football federation had gone on record as saying that if such a demonstration were to take place, the match would be suspended.

It did, and it wasn’t. There are of course precedents for political demonstrations at sporting events. One remembers the ‘black power’ salutes of American athletes in the Mexico Olympics in 1968, and even further back, Hitler’s infamous refusal to acknowledge Jesse Owens’ great feats in the Berlin games of ’36. There have been numerous boycotts of the Olympics by one nation or the other, also, but a mass demonstration by a section of the public against its own national anthem is an ugly spectacle.
