TOP NOTCH MUSIC PERFORMERS ANNOUNCED FOR WEST SPARTA OLDFASHIONED DAY Historical music will dominate the program and the final schedule includes four top notch performers from the region who have signed up to appear at West Sparta Old-Fashioned Day on July 30, 2011 at the West Sparta Town Hall grounds. Much of the music will relate to the Genesee Valley and several performers who are music historians will relate the music to local history. All performances at West Sparta Old Fashioned Day are Free, and will be held in the tent sponsored by the Farming Families of West Sparta and are paid for in part by funds provided by the New York State Council on the Arts Decentralization Program administered by the Genesee Valley Council on the Arts. Entertainment and admission is free at West Sparta Old-Fashioned Day. It runs from 10am to 4 pm. Other things to see and participate in include 140th NY Volunteer Infantry Civil War encapment, pony rides, old time equipment and tools, antiques show, arts and crafts vendors, children’s games, gifts, balloons, child car seat safety check, door prizes, food vendors, West Sparta Volunteer Dept. INVESTMENT In tough economic times like these, most people cut back on major purchases and try to make what they already own last longer. In fact, a survey of ASE-certified master automotive technicians indicated that motorists could expect a wellmaintained vehicle to last up to twice as long as one that’s neglected. “Putting off maintenance and service or, worse -- neglecting ongoing problems, is penny-wise and dollar foolish,” says ASE’s Editorial Director, Martin Lawson. “Today’s vehicles are designed for years and years of reliable service.” Among the items motorists frequently neglect are oil changes, tire and brake service, wheel alignment, and air and fuel filters. Some even ignore engine lights and warnings, which, if left unattended can cause a relatively minor problem, such as a problem with the air and fuel mixture, doing damage to more expensive components. To help consumers choose a repair shop that fits their needs, ASE offers the following checklist advice: * Look for a neat, well-organized facility, with vehicles in the parking lot equal in
value to your own and modern equipment in the service bays. * Look for a courteous staff, with a service consultant willing to answer all of your questions. * Look for policies regarding estimated repair costs, diagnostic fees, guarantees, and acceptable methods of payment. * Ask if the repair facility specializes or if it usually handles your type of repair work. * Look for signs of professionalism in the customer service area such as civic, community, or customer service awards. * Look for evidence of qualified technicians: trade school diplomas, certificates of advanced course work, and certification by ASE. * Look for the ASE sign or logo; it means the shop employs certified technicians. That’s Outrageous! Sometimes I cringe when I read about the lousy cases some lawyers bring into court in an effort to make a quick buck for themselves and their clients. Unfortunately, it seems that oftentimes the junk cases that are filed in court are brought by injury attorneys. This raunchy conduct has the effect of coloring the public view of all injury attorney and all injury cases. A case I read recently, Perez vs. New York City Housing Authority, really has me fired up on this point. Shortly after midnight, while descending an interior stairwell in a Brooklyn apartment building, Ms. Perez was injured when she allegedly slipped on a small puddle of what she claims was urine. She sued the building owner, and the owner then asked the judge to have her case thrown out. In order for a property owner to be found responsible in a slip and fall case like this, the person doing the suing must prove that the property owner either knew that the puddle of urine was present on the stairs and then did nothing about it (this is called “actual notice”), or that the urine was visible and apparent and existed for such a long time that the property owner should have discovered it (“constructive notice”). Fortunately, after much wrangling in court and after an appeal, the case was thrown out as Ms. Perez could not prove that the building owner had notice of the puddle of urine. But how much did that process cost the property owner in lawyer fees, loss of productive time and other expenses? Tens of thousands for sure. The reason these cases bother me is because they make it harder for people with legitimate injury cases to get justice in court in front of a jury. The good news is that a skilled trial lawyer can overcome this prejudice and get results for deserving clients.
