Dad of cancer patient denies trip BY JOHN SEEWER Associated Press

TOLEDO, Ohio — A 4-year-old girl who went through two years of cancer treatments isn’t being allowed to go on a MakeA-Wish trip to Disney World because her father said she’s in remission and the trips should go to children who are sicker than his daughter. The young girl, McKenna May of Haskins, had the trip postponed twice while was undergoing treatment for leu-

kemia and finally was set to go in August when the father refused to sign off on the trip, the girl’s mother and grandmother said Thursday. The family said MakeA-Wish requires signatures from both parents if either have visitation rights or is listed on the birth certificate. McKenna’s parents never married or lived together. Her grandmother said the father only recently received visitation privileges. McKenna’s mother and grandmother are now collecting donations at local businesses to pay for the trip to Disney on their own.

Money has poured in since their story spread beyond northwest Ohio. They haven’t told McKenna why the Make-AWish trip was canceled. “We’ve told her we’re still going to Disney, just not when she thought it was happening,” said her grandmother, Lori Helppie. “We don’t want her to judge her father.” Her father, William May of Toledo, said donations made to the organization should help those who are terminally ill. “Spend the money on a child who this might be their last memory,” May said Thursday. “Kids who are only going to live a year or six months.”

Federal judge expresses frustration at slow pace MEMPHIS, Tenn. — A federal judge is expressing frustration at the slow pace leading to the trial of a former corrections officer charged with fatally shooting two Henning postal workers during a robbery. Chief Judge Jon Phipps McCalla bristled when a defense attorney for Chastain Montgomery said a mental evaluation of his client was not ready. McCalla expected the report to be completed by Thursday’s hearing. McCalla noted that the shooting of postal workers Paula Robinson and Judy Spray happened in October 2010. He said the case should be moving forward more quickly in the interest of justice. The 48-year-old Montgomery has pleaded not guilty to charges that he and his 18-year-old son killed the postal workers after robbing the smalltown post office of just $63.

Racial profiling trial set for Arizona sheriff PHOENIX — Arizona Sheriff Joe Arpaio’s anti-illegal immigration patrols are taking center stage in federal court in Phoenix. A lawyer for a group of Latinos who filed a civil lawsuit against his department said in opening statements Thursday that the evidence will show that Arpaio and his deputies racially profiled Hispanics. “It’s our view that the problem starts at the top,” attorney Stan Young said. Tim Casey, who is defending Arpaio, said the patrols were properly planned out and executed. He said they exceeded police standards. He said, “race and ethnicity had nothing to do with the traffic stops.” The plaintiffs aren’t seeking money damages. They want a declaration that Arpaio’s office racially profiles and an order that requires it to make changes to prevent what they said is discriminatory policing.

The lawsuit filed by a handful of Latinos will serve as a precursor to a U.S. Justice Department’s case that alleges a broader range of civil rights violations by Arpaio’s office. Although not involved in Thursday’s case, a DOJ lawyer leading the agency’s civil rights case watched the trial. Arpaio was not expected in court Thursday. For years, Arpaio, the self-proclaimed toughest sheriff in America, has vehemently denied allegations that his deputies in Arizona’s most populous county racially profile Latinos in his trademark patrols. The plaintiffs say Arpaio’s officers based some traffic stops on the race of Hispanics who were in vehicles, had no probable cause to pull them over and made the stops so they could inquire about their immigration status. “He is not free to say whatever he wants,” said Dan Pochoda, a lawyer for the American Civil Liberties Union of Arizona, one of the groups that pushed the lawsuit against Arpaio. “He will be called as a witness.” If Arpaio loses the civil case, he won’t face jail time or fines. At a late June hearing, Casey said the sheriff wanted the trial so he could prove his critics wrong and remove the stigma that the racial profiling allegation carries. “What we want is resolution,” Casey said. The DOJ lawsuit makes many of the same racial profiling allegations, but goes further to say that Arpaio’s office retaliated against its critics, punished Latino jail inmates with limited English skills for speaking Spanish and failed to adequately investigate a large number of sex-crimes cases. No trial date in that case has been set. Arpaio has said the DOJ lawsuit is a politically motivated attack by the Obama administration as a way to court Latino voters in a presidential election year. notified the sheriff of its formal investigation a few months after Obama took office. Arpaio has staked his reputation on immigration enforcement and, in turn, won support and financial contributors from people across the country who helped him build a $4 million campaign war chest. The patrols have brought allegations that Arpaio himself ordered some of them not based on reports of crime but letters from Arizonans who complained about people with dark skin congregating in an area or speaking Spanish.

‘Russia, China make ‘wrong side of history’’ A frustrated White House declared that Russia and China placed themselves on the “‘wrong side of history” and the “wrong side of the Syrian people” Thursday by vetoing a U.N. resolution pressuring President Bashar Assad to end the bloody conflict in his country. White House spokesman Jay Carney told reporters aboard Air Force One that the vote was “regrettable” and “highly unfortunate.” The 11-2 vote, with abstentions from South Africa and Pakistan, was the third double veto by Russia and China of a resolution addressing the Syria crisis. Both countries are Damascus’ most important allies. Carney said the lack of U.N consensus “will have repercussions for the countries that vetoed the resolution for a long time in terms of how they’re viewed by the Syrian people. Because there is no doubt that Syria’s future will not include Bashar Assad.” He added: “It is a mistake to prop up that regime as it comes to an end.” The vote creates uncertainty for the 300-strong U.N. observer mission in Syria, sent there to monitor a cease-fire and implementation of international envoy Kofi Annan’s peace plan. The mission suspended operations amid intensified fighting. Its mandate expires Friday. Carney says the United States does not support extending the mission “without the necessary backup.” “The United States does not support extending a mission where you send unarmed U.N. employees into Syria to try to observe the brutality of the Assad regime when there is no mechanism within the resolution to create consequences for the regime for failing to live up to its obligations, its commitments under the Annan plan,” Carney said.
