PRIME MINISTER I am pleased to provide this message for the Franchise Council of Australia’s Excellence in Franchising Awards Annual. Congratulations to all the winners of the 2014 MYOB FCA Excellence in Franchising Awards. The hard work, sacrifice, passion and success of Australia’s franchisors and franchisees are often unsung, but the small businesses you run are at the heart of Australia’s economy. Franchising has steadily grown in the Australian market, and now has an annual turnover of over $130 billion. Of the more than two million small businesses in Australia, there are 73,000 franchisees and almost 1,200 franchisors employing more than 400,000 Australians. This Government will ensure your industry has the support it needs to continue to flourish. We know that making life

easier for businesses to invest, to employ, to produce and to trade is what drives national growth and prosperity. We have scrapped the Carbon Tax and its hit on small business. We will reduce red tape and, following on from the Wein Review, further amend the Franchising Code. These changes will benefit both franchisors and franchisees and, through you, all Australians. I send my best wishes to everyone celebrating at tonight’s event.

This year, like those previous, we have seen some truly inspiring stories emerge from all corners of Australia, across a range of industries and experience levels. THE PROCESS The categories, criteria and judging process for the 2014 MYOB FCA Excellence in Franchising Awards have been developed independently of the Franchise Council of Australia head office and Board of Directors. Each submission was carefully assessed by a selection of judges against a comprehensive list of criteria specific to the category and marked accordingly. ABOUT THE FRANCHISE

COUNCIL OF

AUSTRALIA

The Franchise Council of Australia (FCA) is the peak body for the $144 billion franchise sector in Australia, representing franchisors, franchisees and service providers to the sector. OBJECTIVES The Council was formed in 1983 as a not-for-profit trade association, with the following objectives: •

to establish standards of international best practice in business format franchising for Australian franchise systems to provide information and education about franchising to existing and potential franchisees and franchisors to educate state and federal governments on issues relevant to the sector.

Since 1983, these objectives have been further expanded to include the following: • •

to develop a vital, strong and financially viable franchising sector to advance the interests of members in Australia and in special interest markets such as the international franchise community, franchise advisory councils, small business forums and property leasing organisations (particularly shopping centres) to continually foster among consumers, governments and business community, a broad-based understanding of the economic importance of having a strong franchising sector in Australia to design efficient, identified value-added services to members and assist them to be more effective in franchising.

As the peak body for franchising, the FCA continues to add value to the businesses of its members by providing a range of services relevant to franchising. The FCA recognises that its members have different needs, and that different types of members should co-exist harmoniously. The success of franchising depends on successful franchisors, and this in turn, depends on profitable and happy franchisees. The FCA works constantly to ensure that all activities and

services which benefit franchising will benefit all members directly and indirectly. MEMBERSHIP Membership of the FCA is voluntary and is open to any organisation or individual involved in the franchise sector, including franchisees, franchisors, suppliers and advisors to the sector. EDUCATION FOR POTENTIAL FRANCHISEES The FCA provides a variety of different resources for people looking to buy a franchise. The FCA website – www.franchise.org.au – will provide information on: • • • • •

The franchise business model The franchise sector in Australia The Franchising Code of Conduct Buying a franchise Plus much more.

As well, the FCA holds seminars throughout Australia for people who are thinking of buying a franchise. These events provide guests with the opportunity to speak with a franchisor, franchisee and the Australian Competition and Consumer Commission (ACCC). These events, held at the Franchising and Business Opportunities Expo, have proven to be of great value to people before they make that fi nal decision. Franchisors and their franchisees can access education resources via the Franchise Academy including: •

A range of short courses via the Franchise Academy’s external education suppliers on a range of topics including establishing a franchise, site selection and territory planning, and franchisee recruitment. STRUCTURE The FCA is a nationally incorporated not-for-profit association with its national head office in Melbourne, Victoria. It provides localised member services through five state chapters - one in each mainland state of Australia. Each state chapter elects a president, who is automatically appointed to the national board. A further five national directors are appointed to the board by direct election from the membership, of whom three must be franchisor members, and three directors from any membership category, plus the executive director, making a maximum of 12 directors. The FCA is closely affiliated with franchising associations around the world, and is a founding member of the Asia Pacific Franchise Confederation (APFC). It is also a member of the World Franchise Council (WFC) and for 1999 and 2000 managed the secretariat for the WFC.

Entrepreneurs Geoff Davis and Phil Rogers opened the doors to their first Wendy’s store in a South Australian shopping centre in 1979. With more than three decades of successful franchising experience since then, the company has come a long way from those humble beginnings. Today, Wendy’s is one of the most recognised and well-loved franchise brands in Australia, delivering treats and special experiences to people of all ages across its 250 stores in Australia and New Zealand. While the Wendy’s of today is very different to the first store, the Wendy’s franchisees are still driven to deliver the ultimate treat experience to every customer.

NATIONAL FINALIST THE CHEESECAKE SHOP

The Cheesecake Shop was founded by brothers Warwick and Robert Konopacki in 1991 and commenced franchising operations in 1992. The first franchised store was opened at Baulkham Hills, Sydney, which achieved overnight success and precipitated the opening of a further two hundred stores over the next five years. The franchised structure of the business together with the disciplined procedures and tested recipes helped create a consistency of quality that has led to The Cheesecake Shop brand achieving exceptionally strong consumer awareness and preference. Today the brand is synonymous with immaculately presented and delicious cakes, loved by a generation of Australians and New Zealanders.

NATIONAL FINALIST MISTER MINIT

Established in 1957, the Mister Minit brand is one of the largest international service brands. Locally, the company operates 259 shops throughout Australia, New Zealand, and in a developing South East Asian network. Most of these are part of the wellestablished franchise system. The company lives by its motto ‘Real People Fixing Problems,’ specifically in the services of shoe repairs, key duplication, engraving, and watch servicing. This year will see over 7 million problems ‘fixed’ and will be the 14th consecutive year of comparable and total sales growth.

JAMAICA BLUE

Owned and operated by The Foodco Group, one of Australia’s most successful retail franchise companies, Jamaica Blue celebrated its 20-year anniversary in 2012. Jamaica Blue is built on two simple beliefs: sourcing, roasting, and preparing the very best coffee and using only fresh, locally sourced ingredients. Having this guiding philosophy has allowed the brand to be fl exible and creative with different café formats, from fully licensed restaurants and in-line cafés to kiosks and hole-in-thewall espresso bars. This means there are thriving Jamaica Blue businesses in a myriad of locations and styles. The business network has grown substantially over the past 22 years, with more than 130 cafés in Australia, New Zealand, China, Singapore, and the United Arab Emirates.

SUMOSALAD

SumoSalad is Australia’s largest healthy fast food retailer, with over 90 stores across the country. Luke Baylis, cofounder and owner, started the business in 2003 in response to the large portions of fried food synonymous with the industry as seen in the United States. It offered a healthy and convenient alternative for Australians, with extremely positive results. In 2013, SumoSalad celebrated its 10th birthday, having served more than 30 million salads since opening the first store. It has also seen a brand expansion into South America, with the launch of a new store in Brazil earlier this year to join nine other international stores located throughout New Zealand, Dubai, and Singapore.

SHINGLE INN

Shingle Inn was established in 1936 when the first store opened in Edward Street, Brisbane. Purchased in 1975 by the Bellchambers family, the decision to franchise the café was implemented by second-generation owners, Peter and Andrew Bellchambers. At that point, there were eight company-owned cafés and the call was made to bring in franchisees to promote business growth. Since 2009, when five franchisees entered training, Shingle Inn has grown to a network of 41 cafes throughout Australia. The strength of the network lies in the profitability of the cafes and the company’s eight overarching brand values with family culture, brand belief and exceeding customers’ expectations at its core.

Each location takes the creation of pleasurable and comfortable environments seriously and blends with the best in customer service and delivery. With 10 locations in New South Wales, Victoria, and Queensland, Coco Cubano is rapidly expanding. It has received accolades from Foxtel’s LifeStyle FOOD as part of the I Love FOOD Awards, Australia’s biggest people’s choice awards. In 2013 it was listed in the BRW Fast 100 as Australia’s 12th fastest growing company and second fastest growing food service business.

NATIONAL FINALIST SALTS OF THE EARTH

Salts of the Earth founder David Lindsay has been relentless in his search for high calibre businesspeople to join him in his quest to assist the many sufferers of asthma, hayfever, emphysema, eczema, psoriasis and other breathing and skin conditions in finding relief from their ailments. The Salts culture is so strong because their franchisees share David’s passion in this regard and the high level support delivered by David and his team has been influential in assisting his current franchisees to achieve their goals. It is a credit to David that he has introduced a new therapy to Australia and achieved such success in franchising so quickly; 11 franchises have been established to date, with a further 20 scheduled to open by June 2015.

SPECSAVERS

Specsavers opened its first stores in Australia in February 2008 and since that time has grown quickly to become market leader for eye tests and prescription eyewear, with more Australians choosing Specsavers than any other optometrist. Starting from a zero base in 2008, the franchise’s 295 stores recorded annual sales of $611 million in the year to 28 February 2014. In 2006 he won the Ron Gillespie Award for Excellence in Baking and in 2007 he completed his baking trade qualification. Since then he has continued to win awards for excellence in baking. Throughout his professional development, he has been encouraged and assisted by his wife Isla. He leased his first bakery in 2008 at Thornton, which he eventually purchased. He became a multi-site operator in 2012 after purchasing the Marketown bakery.

Meanwhile, Antonio Gagliardi received a Diploma in Teaching and taught in Melbourne and Adelaide for twenty years before giving it up to run two popular Gametraders franchises in Port Adelaide and Salisbury. When Gino decided to join the franchise in 2007, he teamed up with Antonio to open the first Gelatissimo in Adelaide. In 2009 they opened another store on Gouger Street. After selling their original store, they opened an outlet in Norwood in 2013.

Salon Express Rockingham and Colour Express Rockingham Karen Walsh Karen Walsh has been a franchisee of Salon Express for 12 years, five of those as a multi-unit franchisee. Karen has been a pioneer within the system by opening the first salon under a complementary brand name, as well as being the first franchisee to open two salons within the same shopping centre. Ben has an outstanding focus on delivering great service to the ever-increasing number of customers at Crown Central and more recently at Miranda. Cairns David Price David Price is a Franchise Partner at Grill’d Cairns, which he opened in September 2010 to fulfil his ambition of business ownership. With an interest in learning what makes things work, David completed a Science Degree at the University of Melbourne in 1989. After 17 years learning sales, marketing, and leadership at GSK, he was ready to succeed in his own business. Grill’d is a brand that he loves, as the business has the integrity to stick to its values. David believes that serving locals both inside and outside the restaurant is why Grill’d Cairns is succeeding. He feels that businesses owe it to the community to give back because local support is vital and that it is the right thing to do.

Fig Tree and Shellharbour Mick and Patty Fuller Mick and Patty Fuller started in Bakers Delight 15 years ago and opened the first Bakers Delight in the Illawarra region. Their bakery in Dapto operated for a year before the couple opened a second store at Figtree. During that time, they trained four franchisees, who all opened bakeries in the area. This helped form the good relationships they have with their fellow franchisees. After 10 years, Dapto was sold and they concentrated on Figtree. Earlier this year they opened the Shellharbour location. They now employ 40 local staff between the two bakeries and, over time, have taken on 20 apprentices.

St Agnes Silvestro and Meredith Capurso For 25 years, Silvestro Capurso worked in the juvenile justice system across Queensland and South Australia after training as a teacher. Having had such a fulfilling career, he was looking to set his family up for retirement. His wife Meredith Capurso joined him in this venture and together they purchased Bakers Delight St Agnes in 2007. Now they are happy to be their own bosses and their success is leading to an enviable retirement plan.

Brent and Ann Howard have owned and operated Grill’d Elsternwick for seven years, and Grill’d Carnegie for almost three. During this period they have won many awards from a number of organisations, including the Grill’d local marketing and customer experience awards. As locals, they are passionate about giving back to their community. The restaurants have been home to a number of significant fundraisers, such as donating $5 from each burger sold over a nominated weekend to charity. At Carnegie, this resulted in $5,000 being donated to the McKinnon Basketball Association and two major fundraising weekends at Elsternwick raised $25,000 for the Y-House Foundation. They also support in excess of 75 local junior sporting clubs and a number of other youth programs.

GREG NATHAN After qualifying as a registered psychologist in 1982, Greg Nathan decided to take a different career path. He became a multi-unit franchisee with Brumby’s. He learned how to make dough as a small business operator and joined the franchisor team in senior marketing and operations roles, contributing to many of the systems that have enabled the company to become one of Australia’s longest standing franchise brands. In 1989 Greg founded the Franchise Relationships Institute (FRI) to apply what he had learned in franchising and psychology. FRI is today widely regarded as the global leader in providing tools and education programs to help franchisors and franchisees achieve profitable partnerships and operational excellence. Greg is the author of six popular franchising books that have sold over 110,000 copies. He has also mentored over 10,000 franchisor executives in 15 countries using FRI’s proprietary models and systems, such as The Franchise E-Factor, the Franchising Wheels of Excellence, the Group Scoop, and the Nathan Profiler.

Franchise executives all over the world enthusiastically read Greg’s fortnightly Franchise Relationship Tips and his work has been particularly popular in the USA. In 2007 he was named one of the top 20 thought leaders by Franchise Times Magazine and he is one of the few people without a legal qualification to deliver the opening keynote address for the American Bar Association’s franchising conference. Between 2002 and 2013 Greg travelled annually to the USA to attend the IFA conference and earn CFE educational credits, making him the first Australian to be awarded the International Certified Franchise Executive qualification. Through his research, writing, and participation in numerous franchising committees and conferences, Greg has been an active contributor and a global ambassador for Australian franchising.

CONGRATULATIONS. If you’re considering going into business for yourself and you have picked up the MYOB FCA Excellence in Franchising Awards annual, you’ve taken your first steps towards success. If the idea of starting a business from scratch doesn’t appeal to you, there are other ways. You can invest in a proven concept, brand and product, one that your future customers will already know.

If the idea of being your own boss, with the added benefit of a support network, training and a recognisable brand sounds appealing, then franchising might be for you. The most important thing you can do before investing in any business is research. On franchising as a business model, on the type of business you’d like to invest in, on your brand of choice, and most importantly, on yourself. But how do you go about it and what resources are available to you? Franchising in Australia is worth an estimated $144 Billion in annual revenue to the Australian economy, which is a sizeable portion of GDP, and something the Government takes seriously.

As such, it is a regulated way of doing business. The Franchising Code of Conduct, monitored by the Australian Competition and Consumer Commission, ensures that while Australia is the most regulated place to franchise on the planet, it also boasts best practice and therefore the most fertile breeding ground for franchisee success in the world. What should you know before signing up? The above mentioned Franchising Code of Conduct, while heavy source material, is essential reading before committing to a franchise business. By gaining an understanding of the Code, you will be well placed to ask the right questions during the recruitment process. It is essential you understand the mechanics of a franchise agreement and exactly what you’re signing up for. Research from

the Asia Pacific Centre for Franchising Excellence at Griffith University in 2013 cited a lack of contractual understanding as one of the key reasons franchisees fail. If the Code is too much to digest at the beginning, Griffith has developed a free online franchise pre-entry education course. Consisting of five modules and sponsored by the ACCC, this course is a key part of any prospective franchisee’s due diligence. Having the support of loved ones is very important. Owning and running your own franchise business can be very rewarding, but it can also have tough times. It is very important to have

supportive loved ones to help you do your best and to provide support if things do get tough, so you can have thetenacity to work through the rough times.

What should you ask for from a potential franchisor? Apart from the obvious, like investment amount and inclusions, length of term and training, you will also need to know renewal arrangements, end of term obligations, territory restrictions and marketing plans. This is by no means an exhaustive list. The pre entry course mentioned on the previous page features a module on questions to ask franchisors. A good franchisor will also put you in touch with multiple current franchisees so you can discuss their experience with the brand and get a feel for what day-to-day life would be like. Attending events like the Franchising and Business Opportunities Expo (www.franchisingexpo.com.au) provides an excellent opportunity to ask those questions face to face. Should you be in a position to attend, the FCA strongly recommends visiting as part of your initial research and due diligence.
