HIGH COURT WIN The PSA has fought and won a High Court challenge over entitlements. “This is a fantastic result,” PSA General Secretary Jan McMahon said. “It shows Government again that the PSA will not tolerate unethical conduct by the employer. “Now we have taken the matter to the highest court in the land, and won. “The message must be loud and clear in Government circles now – if you act inappropriately, you will be in for a fight and we will throw everything we have at it and win.” This battle started in January 2010 when a new Enterprise Agreement guaranteeing protection of existing conditions was certified in the Industrial Relations Commission. That Agreement required Government approval before being 'approved' by the Chief Executive, Department of Premier and Cabinet. ... continued page 5

Enterprise Bargaining “Parity” Offer PSA sought a good outcome for members, including a fair and reasonable pay increase, job security, protection of existing conditions and improvements to others. PSA also required a process for the Industrial Relations Commission to deal with any future breach of the Agreement, whether by Parliament or by Agencies. We also needed to deal with ever increasing workloads being experienced by members arising from increased demand for services, from job cuts and through jobs being left vacant. The offer does not pick up all that PSA would

have liked in an Agreement, but overall it represents a fair and reasonable outcome. It contains an acceptable pay increase, with benefits for lower paid members. Conditions are protected. We have an increase to Paid Maternity Leave, Work Level Definitions for Allied Health Professionals and Medical Scientists are improved, there is a review of the technical grades structure and we have new career paths for Corrections Officers. The offer has been considered by PSA’s Executive and Council, and by Worksite Representatives in both metropolitan and regional locations, and while it does not satisfy all expectations, PSA is prepared to recommend the offer to members.
