Throughout human history, the helix (also referred to as a spiral) has symbolized evolution, growth, and resilience. It can be found in art, nature, and cultures around the globe. You will encounter many helixes throughout this publication, symbolizing the continued evolution and advancement of CPR’s efforts in 2024.

CPR seeks to help others manage conflict so that they might better pursue their purpose and lessen the costs, financial and otherwise, of disputes. Our mission is to prevent and resolve business and employment-related disputes.

We Do This By:

A Letter from Serena Lee President & CEO

In my first nine months with CPR I’ve been inspired by the passion and dedication of our members, supporters, and contributors. Every person I’ve connected with shares a vision for preventing conflict and resolving disputes in ways that empower purpose and foster better business.

One of CPR’s most remarkable strengths is its constant evolution. Founded nearly 50 years ago, this organization has continually adapted to meet the challenges of a changing business landscape. We’re committed to driving thought leadership and pioneering new approaches to resolve business conflicts effectively and sustainably.

This past year has been one of growth and renewal. With new leadership and a vibrant team bringing fresh ideas and perspectives, our members have continued to produce outstanding resources and programs, benefiting our entire community.

As we look forward, CPR is poised to deepen member connections, expand access to thought leaders beyond the East Coast and Europe, and offer even more impactful training programs. Our focus remains on guiding companies to reduce the financial and operational impacts of disputes, freeing them to focus on what truly matters.

CPR’s original mission was built on change, and your support and partnership fuel our progress. Thank you for standing with us and driving forward our shared mission. Together, we’re shaping the future of dispute prevention and resolution.

A Letter

from the Board Chair and Vice Chair

2024 was a year of forward momentum for CPR. We were handed the leadership baton by Craig Glidden, to whom we are grateful for his thoughtful leadership and tireless dedication to CPR. And, this is the first year CPR has had a female Chair.

CPR began a new chapter when Serena Lee joined as President & CEO. Her passion, energy, and deep commitment to CPR’s mission, coupled with her perspective and knowledge of ADR, have already had an impact. We are excited to work alongside her and support the bold directions CPR will take under her leadership.

Amidst this change, CPR continued to thrive, thanks to the strong and vibrant participation of members and other supporters in the community. Its reputation for thought leadership, innovation, and excellence remains rock-solid, and the initiatives highlighted in these pages are just the beginning of lasting impact.

2024 also marked the 20th anniversary of the Corporate Leadership Award Dinner. This special event was a celebration of success, and we are thankful for awardee Qualcomm and all those whose generous contributions fueled programs in conflict management, dispute prevention, international dispute resolution, arbitration, mediation, and more.

We hope you share our excitement and optimism for CPR’s future. The road ahead is filled with limitless possibilities, and we are energized by the knowledge that we have an incredible community of members, supporters, and leaders to help bring that future to life.

Continuing Progress

CPR Institute2024

The CPR Institute drives a global dispute resolution and prevention culture through the thought leadership of its diverse membership of top companies, leading mediators and arbitrators, law firms, lawyers, and academics.

It convenes networks of these members — Committees and Industry Alliances — to share best practices and develop innovative tools and resources and hosts global and regional events to connect thought leaders in the field. In 2024, CPR held almost 70 events attended by over 2,100 participants.

The member-run Committees, Industry Alliances and Task Forces focus on distinct topics and sectors but also collaborate on subjects of mutual interest.

The working task forces produced a first-of-its-kind tool for arbitrators, Guidelines for Arbitrator Disclosure, and a new resource for both in-house and outside counsel, the Corporate Early Case Assessment Toolkit for European Parties

Committee and Industry Alliance Activity

The Investment Disputes Subcommittee was formed in September as a subcommittee of the Arbitration Committee and the Banking & Financial Services Alliance. The mission of the Subcommittee is to explore ADR and generate programming and potential work product in the context of investment disputes, including those arising under multilateral or bilateral investment treaties.

The Subcommittee’s co-chairs are Caroline Richard, Partner, Freshfields; and Surya Gopalan, Partner, White and Case. The subcommittee’s secretary is Giovanni Zarra, Senior Associate, Hogan Lovells, and professor of law at University of Naples Federico II (Italy).

The European Advisory Board held two public panels:

CPR Africa Arbitration Day-New York

The 2nd annual CPR Africa Arbitration Day-New York was held on November 1, hosted by the New York office of White & Case.

The goals of this event are to highlight important issues in international arbitration pertinent to the Africa region, to foster greater community between North American and African practitioners, and to develop the next generation of Africa-related practitioners.

International Mediation Competition Builds the Future of Dispute Resolution

With conflict so prevalent around the globe, the need to enhance dispute resolution skills is more critical than ever. The CPR International Mediation Competition offers law students worldwide the opportunity to hone their mediation skills, gain valuable insights from experts, and build a network with future practitioners.

We are very grateful to Insper, a higher education institution in São Paulo, for graciously hosting us for three days of competition and related activities.

CPR’s website blog, CPR Speaks, posted 35 articles by a dozen authors in calendar year 2024. Hot topics included U.S. Supreme Court and federal circuit court arguments and opinions coverage, and some were accompanied by explanatory CPR Institute YouTube channel videos (see youtube.com/@CPRInstituteOnline.)

Additional articles covered ADR-related events, including UNCITRAL Working Group II and CPR Institute committee meetings. Others analyzed legal topics of interest to the broader public, such as the 2024 Summer Olympics controversy and Live Nation-Ticketmaster’s online mass arbitration program.

2024 ACHIEVEMENTS

Organized an online interactive Speed Mentoring program for young practitioners and law students to receive practical career advice and guidance on how to develop productive working relationships.

Partnered with the Technology Advisory Committee to host a two-part webinar series on AI and Dispute Resolution, addressing professional standards, ethics, and practical applications.

Partnered with CPR Dispute Resolution and the related Institute committee/industry alliances to host a three-part webinar ADR Skills Training Series providing advice from experienced practitioners on how to strategically approach energy, insurance, and employment disputes.

CPR’s Young Leaders in Alternative Dispute Resolution (Y-ADR) program educates the next generation of leaders on the full spectrum of dispute prevention and resolution mechanisms and offers unique networking and professional development opportunities to participants.

The Y-ADR Steering Committee, the leadership body for Y-ADR, is a global group comprised of young in-house counsel, practitioners at law firms, and neutrals who serve three-year terms.

Diversity, Equity and Inclusion

The mission of the CPR Institute’s National Task Force on Diversity is to devise practical strategies to increase the participation and inclusion of women, persons of color, members of the LGBTQA+ community, persons living with disabilities, and other under-represented groups in mediation, arbitration and other dispute prevention and resolution processes around the world. In 2024, the Task Force held two events:

Next Steps in Affirmative Action

After the June 2023 decision by the U. S. Supreme Court in Students for Fair Admissions, diversity initiatives, including mentoring and training fellowships designed to nurture a new pipeline of diverse legal professionals, were in peril. Author, academic, expert in education and housing Richard Kahlenberg presented his views that SFFA does not herald the end of DEI initiatives and could lead policy-makers to pivot toward more politically and legally sustainable approaches that focus on socio-economic status and disadvantage.

Legislating Diversity: How South Africa Tackled the Challenge of Diversity in Labor/Employment Arbitration

Two arbitrators from South Africa — Hilary Mofsowitz and Katy Khaduga — discussed how South Africa achieves diversity within its neutral profession. Providing a comparative look at the South African system vs the US system, the speakers showed South Africa’s results on DEI in the neutral sphere through the legislative requirement for all ADR panels to be representative of race and gender.

Why Enrolling in ADR Courses and Competitions Will Help You Practice Law

The CPR Institute partnered with the National Black Law Students Association (NBLSA) to hold a webinar explaining why gaining skills in negotiation and mediation is critical when entering the legal marketplace and how those skills prove useful in a variety of career paths.

National Asian Pacific American Bar Association’s ADR Institute

CPR President & CEO Serena Lee designed and served as faculty of NAPABA’s 2024 ADR Institute, the first training program of its kind offered by this organization. The class of 17 that attended this practical career and skills development program received a substantive, hands-on training in ADR from a variety of viewpoints — ADR providers, in-house counsel, litigators and a former judge.

Diverse Neutrals Interview Series

CPR Institute Vice President of Advocacy & Educational Outreach Ellen Waldman continued her video interview series with CPR’s Panel of Distinguished Neutrals to provide viewers with an opportunity to familiarize themselves with neutrals they may not be aware of. Lack of familiarity is often cited as a reason to not select a neutral.

2024 Annual Meeting

GLOBAL ADR CHAMPION SPONSORS

With the theme “Freedom and Independence in ADR,” the CPR Institute brought the ADR community together in Philadelphia for two-and-a-half days of programs featuring compelling speakers, networking, and much more.

Panel topics ranged from the admissibility of illegally obtained evidence in an arbitration proceeding to sustainability disputes in the financial sector and included panels touching on cybersecurity ethics, DEI programs in light of the Students for Fair Admissions decision, and the freedom of neutrals and parties to innovate the ADR process.

Awards 2024

At every Annual Meeting, we honor those who exemplify the potential and purpose of alternative dispute resolution, dispute prevention, and dispute management through thought leadership and action.

The 2024 Awards Dinner was especially meaningful. The Hon. William H. Webster, winner of the James F. Henry Award, accepted his award in-person the day after his 100th birthday. Judge Webster has been active with CPR for decades, providing his wisdom, integrity, and commitment.

His engagement with CPR’s mission of finding new and better ways to resolve conflicts has had an enduring impact on the organization. Judge Webster was one of the earliest proponents of the CPR Pledge, heralding its usefulness in business conflict management, and the use of standing neutrals, which he characterized as a constructive — rather than destructive — way to approach unavoidable or recurring disputes.

Currently an emeritus member of the CPR Board of Directors, Judge Webster served on the board for over 30 years, as Vice Chair for 14 years, and as Chair for 4 years.

JAMES F. HENRY AWARD for outstanding achievement by individuals for distinguished, sustained contributions to the field of alternative dispute resolution.

The former chair of Milbank’s Litigation Department, Judge Webster served in the U.S. Federal Court for the E. D. Missouri as well as on the Eighth Circuit and is Chair Emeritus of the Homeland Security Advisory Council, as well as previous Chair and Vice Chair.

Prior to joining Milbank in 1991, Judge Webster served as Director of the Federal Bureau of Investigation from 1978 to 1987 and as Director of the Central Intelligence Agency from 1987 to 1991.

Judge Webster has been awarded the Presidential Medal of Freedom, the Distinguished Intelligence Medal, and the National Security Medal.

Qualcomm Honored at 2024 Corporate Leadership Award Dinner

Each year, CPR presents the Corporate Leadership Award (CLA) to a corporation and its general counsel for demonstrating leadership in the field of conflict management and institutionalizing ADR into their legal structure and corporate culture.

Attended by general counsel of Fortune 100 corporations, partners from leading law firms, and industry experts and scholars, the CLA Dinner is a critical fundraiser for CPR’s advocacy educational and outreach initiatives, as well as international programs.

On May 23, 2024, we honored Qualcomm and Ann Chaplin, General Counsel and Corporate Secretary, at Guastavino’s in New York City.

Qualcomm uses negotiation and other alternatives to litigation to resolve commercial disputes. It seeks and adopts efficient, cost-effective, and results oriented resolutions to legal disputes and conflicts.

Evolving the Practice of Alternative Dispute Resolution

DRS holds training programs for law firms and companies to keep them informed of the latest developments in ADR and best practices in drafting ADR clauses.

CPR Dispute Resolution (DRS) provides training and equips practitioners with innovative protocols, guidelines and rules that are developed and informed by the membership of the CPR Institute.

: DRS published new Guidelines for Arbitrator Disclosure in August, which were developed by the CPR Institute Arbitrator Disclosures Task Force.

The Guidelines were created to address an issue with the current standards in the profession, which indicate what an arbitrator should disclose, but not the method to appropriately disclose. The Guidelines fill this gap by providing clear and practical recommendations for arbitrators — including but not limited to those on the CPR Panel of Distinguished Neutrals — in maintaining records to assist in identifying interests and relationships that they may need to disclose and providing guidance in drafting an appropriate written disclosure statement.

A Letter from the Chairman of CPR’s Finance Budget & Audit Committee

This past fiscal year, CPR continued to provide events and programs that developed the field of alternative dispute resolution. The staff leadership changed three times during this period, culminating in the appointment of President & CEO Serena Lee. This successful evolution speaks to the strength of the organization.

CPR Institute members expanded programming, particularly in the international arena, with new events and resources relating to Brazil, Europe, and Africa. They also produced new guidelines for arbitrators and held thought-provoking committee meetings devoted to commercial mediation, arbitration, diversity and other topics.

These successful programs and events helped maintain CPR’s healthy financial status in FY24. While the CPR Institute faced some financial headwinds due to staff turnover, CPR Dispute Resolution revenue was strong. The staff reduced operating costs during a challenging inflationary period, and the organization successfully ended the fiscal year with an operating surplus.
