CPR seeks to help others manage conflict so that they might better pursue their purpose and lessen the costs, financial and otherwise, of disputes. Our mission is to prevent and resolve business and employment-related disputes.

2024 also marked the 20th anniversary of the Corporate Leadership Award Dinner. The CPR Institute drives a global dispute resolution and prevention culture through the thought leadership of its diverse membership of top companies, leading mediators and arbitrators, law firms, lawyers, and academics.
It convenes networks of these members — Committees and Industry Alliances — to share best practices and develop innovative tools and resources and hosts global and regional events to connect thought leaders in the field. In 2024, CPR held almost 70 events attended by over 2,100 participants.
The member-run Committees, Industry Alliances and Task Forces focus on distinct topics and sectors but also collaborate on subjects of mutual interest.
The working task forces produced a first-of-its-kind tool for arbitrators, Guidelines for Arbitrator Disclosure, and a new resource for both in-house and outside counsel, the Corporate Early Case Assessment Toolkit for European Parties

The Investment Disputes Subcommittee was formed in September as a subcommittee of the Arbitration Committee and the Banking & Financial Services Alliance. The mission of the Subcommittee is to explore ADR and generate programming and potential work product in the context of investment disputes, including those arising under multilateral or bilateral investment treaties.

CPR Africa Arbitration Day-New York
The 2nd annual CPR Africa Arbitration Day-New York was held on November 1, hosted by the New York office of White & Case.
The goals of this event are to highlight important issues in international arbitration pertinent to the Africa region, to foster greater community between North American and African practitioners, and to develop the next generation of Africa-related practitioners.

The mission of the CPR Institute’s National Task Force on Diversity is to devise practical strategies to increase the participation and inclusion of women, persons of color, members of the LGBTQA+ community, persons living with disabilities, and other under-represented groups in mediation, arbitration and other dispute prevention and resolution processes around the world. In 2024, the Task Force held two events:
After the June 2023 decision by the U. S. Supreme Court in Students for Fair Admissions, diversity initiatives, including mentoring and training fellowships designed to nurture a new pipeline of diverse legal professionals, were in peril. Author, academic, expert in education and housing Richard Kahlenberg presented his views that SFFA does not herald the end of DEI initiatives and could lead policy-makers to pivot toward more politically and legally sustainable approaches that focus on socio-economic status and disadvantage.
Legislating Diversity: How South Africa Tackled the Challenge of Diversity in Labor/Employment Arbitration
Two arbitrators from South Africa — Hilary Mofsowitz and Katy Khaduga — discussed how South Africa achieves diversity within its neutral profession. Providing a comparative look at the South African system vs the US system, the speakers showed South Africa’s results on DEI in the neutral sphere through the legislative requirement for all ADR panels to be representative of race and gender.
The CPR Institute partnered with the National Black Law Students Association (NBLSA) to hold a webinar explaining why gaining skills in negotiation and mediation is critical when entering the legal marketplace and how those skills prove useful in a variety of career paths.
CPR President & CEO Serena Lee designed and served as faculty of NAPABA’s 2024 ADR Institute, the first training program of its kind offered by this organization. The class of 17 that attended this practical career and skills development program received a substantive, hands-on training in ADR from a variety of viewpoints — ADR providers, in-house counsel, litigators and a former judge.
CPR Institute Vice President of Advocacy & Educational Outreach Ellen Waldman continued her video interview series with CPR’s Panel of Distinguished Neutrals to provide viewers with an opportunity to familiarize themselves with neutrals they may not be aware of. Lack of familiarity is often cited as a reason to not select a neutral.
GLOBAL ADR CHAMPION SPONSORS
With the theme “Freedom and Independence in ADR,” the CPR Institute brought the ADR community together in Philadelphia for two-and-a-half days of programs featuring compelling speakers, networking, and much more.
Panel topics ranged from the admissibility of illegally obtained evidence in an arbitration proceeding to sustainability disputes in the financial sector and included panels touching on cybersecurity ethics, DEI programs in light of the Students for Fair Admissions decision, and the freedom of neutrals and parties to innovate the ADR process.
The Corporate Counsel Roundtable comprised of in-house counsel from Amgen, ConocoPhillips, Eversource, and Bayer US, who discussed the dispute resolution echniques they find effective and how they use those techniques.
The Keynote Speaker was Elisabeth Eljuri, Independent Arbitrator, Chief Negotiator & Chief Legal Counsel, Westlawn Americas Offshore.

The 2024 Awards Dinner was especially meaningful. The Hon. William H. Webster, winner of the James F. Henry Award, accepted his award in-person the day after his 100th birthday. Judge Webster has been active with CPR for decades, providing his wisdom, integrity, and commitment.
His engagement with CPR’s mission of finding new and better ways to resolve conflicts has had an enduring impact on the organization. Judge Webster was one of the earliest proponents of the CPR Pledge, heralding its usefulness in business conflict management, and the use of standing neutrals, which he characterized as a constructive — rather than destructive — way to approach unavoidable or recurring disputes.
Currently an emeritus member of the CPR Board of Directors, Judge Webster served on the board for over 30 years, as Vice Chair for 14 years, and as Chair for 4 years.

JAMES F. HENRY AWARD for outstanding achievement by individuals for distinguished, sustained contributions to the field of alternative dispute resolution.
The former chair of Milbank’s Litigation Department, Judge Webster served in the U.S. Federal Court for the E. D. Missouri as well as on the Eighth Circuit and is Chair Emeritus of the Homeland Security Advisory Council, as well as previous Chair and Vice Chair.
Prior to joining Milbank in 1991, Judge Webster served as Director of the Federal Bureau of Investigation from 1978 to 1987 and as Director of the Central Intelligence Agency from 1987 to 1991.
Judge Webster has been awarded the Presidential Medal of Freedom, the Distinguished Intelligence Medal, and the National Security Medal.

Each year, CPR presents the Corporate Leadership Award (CLA) to a corporation and its general counsel for demonstrating leadership in the field of conflict management and institutionalizing ADR into their legal structure and corporate culture.
Attended by general counsel of Fortune 100 corporations, partners from leading law firms, and industry experts and scholars, the CLA Dinner is a critical fundraiser for CPR’s advocacy educational and outreach initiatives, as well as international programs.
On May 23, 2024, we honored Qualcomm and Ann Chaplin, General Counsel and Corporate Secretary, at Guastavino’s in New York City.
Qualcomm uses negotiation and other alternatives to litigation to resolve commercial disputes. It seeks and adopts efficient, cost-effective, and results oriented resolutions to legal disputes and conflicts.

DRS holds training programs for law firms and companies to keep them informed of the latest developments in ADR and best practices in drafting ADR clauses.
CPR Dispute Resolution (DRS) provides training and equips practitioners with innovative protocols, guidelines and rules that are developed and informed by the membership of the CPR Institute.
: DRS published new Guidelines for Arbitrator Disclosure in August, which were developed by the CPR Institute Arbitrator Disclosures Task Force.
The Guidelines were created to address an issue with the current standards in the profession, which indicate what an arbitrator should disclose, but not the method to appropriately disclose. The Guidelines fill this gap by providing clear and practical recommendations for arbitrators — including but not limited to those on the CPR Panel of Distinguished Neutrals — in maintaining records to assist in identifying interests and relationships that they may need to disclose and providing guidance in drafting an appropriate written disclosure statement.

This past fiscal year, CPR continued to provide events and programs that developed the field of alternative dispute resolution. The staff leadership changed three times during this period, culminating in the appointment of President & CEO Serena Lee. This successful evolution speaks to the strength of the organization.
CPR Institute members expanded programming, particularly in the international arena, with new events and resources relating to Brazil, Europe, and Africa. They also produced new guidelines for arbitrators and held thought-provoking committee meetings devoted to commercial mediation, arbitration, diversity and other topics.
These successful programs and events helped maintain CPR’s healthy financial status in FY24. While the CPR Institute faced some financial headwinds due to staff turnover, CPR Dispute Resolution revenue was strong. The staff reduced operating costs during a challenging inflationary period, and the organization successfully ended the fiscal year with an operating surplus.
