WHEREAS, the County Engineer of Cowlitz County has investigated and found that vehicular parking along portions of Willow Grove Road in the vicinity of Willow Grove Park is a risk to the safety of the traveling public and has recommended “No Parking Zones” be established thereon; and,
WHEREAS, it appears to this Board that it is in the best interest of public safety and in compliance with the laws of the State of Washington, pursuant to RCW 36.32.120(7) and 46.61.560 through 46.61.575; and
WHEREAS, it appears as if the “No Parking Zone” list on file with the County Engineer should be amended to include portions of Willow Grove Road in the vicinity of Willow Grove Park; and
NOW, THEREFORE, IT IS HEREBY RESOLVED that a public hearing will be held on the day of August, 2024 at the hour of ____ a.m., in the chambers of the Board, Third Floor, County Administration Building, 207 Fourth Avenue North, Kelso, Washington to hear all concerned in the matter of the proposed amendment to the “No Parking Zone” list on file with the County Engineer; and,

1 . On June I I , 2024, Public Utility District No. 1 of Cowlitz County, Washington (licensee) filed its 2024 annual wildlife habitat management plan (annual plan) for the Swift No. 2 Hydroelectric Project No. 2213.r The annual plan was filed pursuant to Article 403 of the License Order and section 10.8.3 of the settlement agreement for the project. The project is located on the North Fork Lewis River in Cowlitz and Skamania counties, Washington.
2. Article 403 of the License Order requires the licensee to file annual plans each year, for Commission approval, outlining the proposed wildlife measures and costs for implementing the annual plan. Settlement agreement section 10.8.3 requires the licensee to annually submit a written plan to the Terrestrial Coordination Commiuee (TCC) to use the funds available to implement the wildlife habitat management plan on their lands.2
3. The purpose of the annual plan is to describe the proposed wildlife measures and anticipated costs for work to be completed during 2024 on the 525 acres ofproject lands within the Swift No. 2 Wildlife Management Area. The annual plan proposes to conduct follow-up surveys at sites where weed control efforts have been implemented, treat high

priority weed infestations, and inspect accessible land to evaluate public access activity and identifo habitat concerns or changes in habitat conditions.
4. The licensee provided a draft annual plan to the TCC for review on trday 1,2024, and requested that written comments on the annual plan be provided by June 6,2024. The licensee received comments from the Washington Department of Fish and Wildlife (Washington DFW). The Washington DFW commended the licensee for the creation and maintenance of the forage patch cuVmeadow and the inclusion of invasive plant and public access inspections for this area. The Washington DFW also stated that it supports saving and accumulating funds for a meaningful forestry action in the future while maintaining invasive plant species control and public access in the present.
5. The annual plan provides specific schedule and budget information so that members of the TCC are fully informed regarding specific actions implemented to eniance wildlife habitat on project lands duing 2024. The annual plan meets the requirements of Article 403 and the settlement agreement and should be approved.
The Director orders:
(A) Public Utility District No. I of Cowlitz County, Washington's 2024 ann:ual wildlife habitat management plan, filed June 11,2024, pursuant to Article 403 of the license and settlement agreement section 10.8 for the Swift No. 2 Hydroelectric Project No. 2213, is approved.
(B) This order constitutes final agency action. Any party may file a request for rehearing ofthis order within 30 days from the date of its issuance, as provided in section 313(a) of the Federal Power Act, l6 U.S.C. $ 825/, and the Commission's regulations at 18C.F.R.$385.713(2023). Thefilingofarequestforrehearingdoesnotoperateasa stay ofthe effective date ofthis order, or ofany other date specified in this order. The licensee's failure to file a request for rehearing shall constitute acceptance of this order.
