Crescent City gets first look at Discovery Center

The public caught a glance of how the 35-acre Beachfront Park is going to be modified.

Moderated by City Manager Eric Wier, accompanied by GreenWorks Landscape Architects, the city shared the wind, water and waves vision with those attending the Saturday conference at the Cultural Center.

The public also learned State and National Parks, the Redwood Conservancy and the Del Norte Chamber of Commerce all collaborated on a feasibility study to conduct all visitor and tourist activity under one roof. The partners will serve the public under the new Del Norte Discovery Center which will replace the cultural center designed by GreenWorks.

Presently, the half-century old cultural center is seldom utilized. The city and chamber split an approximate $80,000 annual loss.

Crescent City will co-host two events acknowledging the forty-year anniversary of the film, Return of the Jedi. Much of the iconic 1983 movie was filmed in Del Norte and Humboldt counties.

Seniors lead the way on resilient Del Norte baseball team

It’s been an up-and-down season on the baseball field for the Del Norte Warriors, with the wet spring playing havoc with the schedule and affecting the team’s preparation.

A couple of team-bonding road trips and a run of much-needed games, however, has Del Norte well in contention for the North

Coast Section playoffs and looking forward to the business end of the season.

The Warriors began the season in impressive fashion, putting together an early four-game winning streak and taking six of their opening eight games.

However, they followed that with a five-game losing streak and dropped some close battles,

The Humboldt-Del Norte Film Commission is organizing the Forest Moon Festival taking place June 2-3 that will feature four screenings of Star Wars: Return of the Jedi, in both counties.

The film commission will work with the City to offer an outdoor screening at Beachfront Park, Friday evening, June 2 when full night conditions exist. The city will conduct a jedi training course in the park, Saturday June 3. These events are offered at no charge. Coming Attractions Cinema will be showing Jedi Friday, April 28 at its standard admission charge. Check with the theater for show times.

The request for funding the two-day event was $3000. Councilor Blake Inscore, in expressing his enthusiasm for the celebration, made a motion to increase the funding to $5000, and the vote was 3-0 to approve. The goal of the event is to motivate visitors to stay for both the film and Saturday’s activities.

City wastes no time in applying for beautification grant

With only three members of the city council present, councilors approved a resolution Tuesday evening authorizing the submission to the Clean California Act program. The $3 million grant application will benefit the Crescent City Cultural Gateway.

Voting unanimously to meet quorum minimum requirements were Councilor Ray Altman, Mayor Pro Tem Blake Inscore and Mayor Isaiah Wright. The sought-after funds will address the already approved $8 million, in two grants, addressing the bike pump project, Kid Town expansion, trail loop around Beachfront park, the Tolowa Interpre-

tive walk, the Amphitheatre and Water Front Plaza. The beautification project will include the following components:

• Elk Creek Cleanup, running along Beachfront Park and RV park, west of Highway 101.

• Gateway Monuments, Landscape and Public Art. This component will include two gateway monuments on L and M streets

and help establish a sense of arrival and guide visitors down Front St to Beachfront Park.

• Create entrance to the new Del Norte Discovery Center. Existing staircase will be removed and will be Americans With Disabilities Act (ADA) compliant.

• Tollowa Interpretative Walk, Tollowa basket-patterned concrete pads entering the interpre-

tive walk.

• Transit Center Relocation. Located across the street, parking will be added for easier access to Point of Honor. Parking will also accommodate Redwood Coast Transit buses. No matching funds are required for this project. The deadline to apply for Clean California funding is April

After a two-year absence attributed to COVID, the Del Norte Law Enforcement Administration (LEADN) honored its own at Crescent Elk Middle School on Thursday evening. More than 100 people, mostly family members, watched on from the audience as law enforcement officials were honored.

McGuire’s offshore wind expediting act passes first committee with bipartisan support

Senate Majority Leader Mike McGuire’s ground-breaking legislation to expedite offshore wind development to help meet the Golden State’s longterm electricity demand and extraordinary climate goals passed last week with bipartisan support in the Senate Natural Resources Committee.

“If we’re serious about bringing on desperately needed new power generation facilities and meeting the state’s nation-leading climate goals and energy needs – we must move heaven and earth to deploy new green power. This bill will expedite the state-side offshore wind permitting process eliminating 3 years off of the permitting timeline all while protecting California’s coastal environment and storied fishing fleet, it will deploy resources for offshore wind infrastructure in local communities and help get folks to work through new career training programs,” Senate Majority Leader Mike McGuire said.

SB 286 – the Offshore Wind Expediting Act – will accelerate the state-side

offshore wind permitting process through the State Coastal Commission and State Land Commission. At the same time, it will ensure environmental safeguards will remain in place, California’s storied fishing fleet interests are protected, and the bill will advance resources that benefit communities and develop family-sustaining careers through workforce education programs.

In addition to desperately needed streamlining, this bill also mandates state agencies and key stakeholders come together to collaborate and develop the long-term game plan to deploy offshore wind infrastructure.

SB 286 requires the Coastal Commission to bring the California Department of Fish and Wildlife, the State Lands Commission, the Ocean Protection Council, representatives from the commercial fishing industry, representatives from the offshore wind industry, federal agencies, labor, Native American tribes and other stakeholders together over the next two years.

BY ROGER GITLIN The Triplicate Crescent Fire Protection District commissioners began a discussion on what to do with the vacant Cooper Avenue fire station, located at 500 East Cooper. CFPD Chairman James Nelson brought his colleagues up to date by stating the building itself is 4,200 square feet with an adjacent vacant lot. The building has long served the community for well over a half a century, but it has long stood vacant and unused. The building is located in the commercial district of Crescent City. Should commissioners decide to sell Cooper Station, commissioners have indicated an interest in establishing a satellite station north of the current location. The CFPD Board plans to consider selling the building at its Monday, May 8, meeting at 5 p.m., at 255 W. Washington Blvd. Interested

Harold Phillip “Phil” Carter

9/2/1941 - 3/19/2023

Harold Phillip “Phil” Carter passed away on March 19, 2023, in Crescent City, CA. He had been a resident of Klamath, CA since 1981. He was born September 2, 1941, in Burkesville, KY, the youngest son of Clarence Walter Carter and Lena Elsie Carter. He was one of 6 children: Leslie Carter, Helen (Carter) Cloyd, Kenneth Carter, Howard Carter, and Dian (Carter) Watkins. He is survived by his youngest sister Dian Watkins of Bakersfi eld, CA. Phil was a Veteran having served 20 years in the United States Air Force, 1961-1981. During his 20-year Air Force career he achieved the rank of Master Sergeant and received multiple commendations. He was stationed at the Air Force Base in Klamath from 1973 - 1975, working at the radar base on Requa. It was his time there that infl uenced the decision to retire with his family to Klamath in 1981.

This year’s roster features a core group of athletic seniors who are multi-sport athletes, including Ethan Thomas, Cole Blackburn, Willie Bommelyn, Brody Mattz and Cooper Maxwell.

Thomas has been a leader in just about every aspect of the game, batting .359 with team-highs in RBIs (12) and doubles (six), as well as impressing on the mound.

Mattz, meanwhile, leads the team with a .362 average and has 11 RBIs and three doubles, while Bommelyn has been the “prototypical lead-off hitter,” according to his coach, and leads the team with 18 runs and 20 stolen bases, twice as many as any of his teammates.

Blackburn also has 11 RBIs and five doubles, and leads the team on the mound with a 3-1 record and the only team save in six appearances, while posting an impressive ERA of 1.91.

Behind the plate, Maxwell has been one of the team’s most improved and consistent players this season.

“Maxwell’s doing a great job for us behind the

dish,” Coborn said earlier this spring. “He’s come so far. He was the quarterback of the football team and he’s becoming our quarterback on the baseball field. It’s just exciting to see.”

The Warriors came out of spring break with a record of 7-7-1, and Coborn knows there is plenty of room for improvement down the stretch of the season.

“We need to cut down on our strikeouts offensively, and on defense we need to take care of the baseball, because errors have come back to haunt us,” the head coach said.

The pitching, however, has been pretty good with a team ERA of 3.50.

“Our pitching staff just need to keep competing for us,” Coborn said. “I’m really liking what we’re getting on the mound.”

A couple of team-bonding trips to Chico and Redding also has helped with the team’s development and Coborn says that would not have been possible without the support of the community.

“I want to give a shout-out to the Del Norte community, parents, fans, friends, sponsors, boosters,” he said. “They have really helped us with fundraising this year that has allowed us to go to Chico and the tournament in Redding.”

The Warriors will close out league play with backto-back three-game series against Arcata in late April and Eureka in early May, and the Big 5 is shaping up to be a battle of heavyweights with all four of Del Norte’s opponents posting winning records through the first half of the season.

The present location of State and National Parks, across Front Street at 1111 Second street will convert to a transportation center.

City Manager Wier called the Discovery Center with the new tenant base transformational to this community. If this project moves forward, all matters visitor-oriented will be situated in what is now the Cultural Center.

The protocol of funding the project now moves forward to the grant application process and a $3 million opportunity to move to phase two. All parties agreed the future is a bright one for the Del Norte Discovery Center.

GreenWorks also sought community feedback on Kid Town.

A total of $8 million has been approved to be divided into the following categories: $5 million is to be allocated for the bike pump track, improvements to and Kid Town expansion, a one-mile loop around the park, Tollowa Interpretative education, and signage.

An additional $3 million of grants has also been approved for the Amphitheater and Waterfront Plaza.

Both grants stipulate addressing all projects identified. The funding must be carefully considered to fulfill both grants’ requirements.

Passed away on Monday, April 3, 2023, in Klamath, California. A lifelong resident of Del Norte County, she was born on July 9, 1960. Private Services were held.

Earlier in the day, GreenWorks presented two concepts for a bike pump track on the east end of Front Street. One concept was a 12,000+ square-foot track, the other a 21,000-squarefoot track with jump lines.

Those in attendance joined a live YouTube presentation via WIFI device responding to select feedback questions from GreenWorks.

The bike pump track and Kid Town expansion is expected to commence in the Spring of 2024.

Will Health Insurers Keep Promises to Cut Patient Denials?

The nation’s top health insurers — UnitedHealthcare, Cigna and Aetna — announced recently that they would cut their use of prior authorizations for treatment.

It would be great news, if true.

They constantly strong-arm us, our staff and our patients. We devote hours — hours that should be spent with patients — appealing their refusal to pay for treatments or services they deem “experimental.”

So, it’s a tough sell when insurance companies suddenly decide to make our lives easier. Especially when the announcement happened so soon after an investigative publication revealed that Cigna saved millions by rejecting patient claims without reading them.

The largest insurers need congressional oversight after repeatedly betraying our trust.

The consequences are affecting our health. When was the last time you saw a doctor instead of a physician’s assistant?

The Association of American Medical Colleges projects a shortfall of up to 124,000 physicians — including specialists — by 2034. The average wait time to see one is 26 days, up from 24 days in 2017.

Commercial payors accelerate physician burnout and subsequent early retirement through secret negotiation tactics, unsustainable reimbursement models and ever-changing authorization rules.

Patients don’t often know that most commercial payors require surgeons to sign contracts with strict gag clauses. The clauses prohibit your doctor from discussing their reimbursement rates with anyone other than the insurance company.

They keep patients and government watchdogs in the dark about reimbursements for office visits and procedures. Why the secrecy? The insurance company does not want the average citizen to know how much they make off the transaction between you and your doctor.

Commercial insurance doubled its profits from $103 billion in 2012 to $191 billion in 2021. Americans faced 200 percent increases in out-of-pocket expenses while UnitedHealth, for example, reported $24 billion in profits. No insurer has ever made that kind of money in history.

The healthcare syndicate fixes physician reimbursement by tying it to ever-dropping, unsustainable Medicare rates. This reimbursement represents less than 10 percent of the total cost for the procedure, many times even less.

Doctors risk making payroll, filing for bankruptcy or, worse, refusing the low fees and terms of the contract. They can’t refuse the terms because their competitor may continue accepting the low rates and cover their loss by taking patients from physicians who opt out.

Therefore, both doctors sign on for another year of rate cuts.

Commercial insurers and the federal government put doctors in an impossible situation. They don’t consider that the falling payment rate means physicians spend less time with patients and cannot hire more staff to deliver better service. Reduced wages with long hours and high liability risk also dissuade young people from entering medicine.

Meanwhile, medical practice costs increased 39 percent from 2001 to 2021 for surgeons while payments from health insurers shrank 20 percent.

Doctors want to deliver top-quality service to their patients without bankrupting their practices. How can elected officials fix the problem?

In my prior schedule I would submit a column on Tuesday to print on Friday the same week.

Under my new schedule I still submit my column on Tuesday, but it does not get published until the following Tuesday.

By the time you read what I wrote, it is no longer new news, it is old news. My challenge then is to find old news that’s still fit to print.

It is overwhelming sometimes how much news gets spewed at me on any given day. Sometimes there is no time in the moment to fully appreciate an issue when it is first reported. Fortunately, the internet never forgets, and it is always possible to go back and find a story.

One such story was originally reported in the Wild Rivers Outpost (3/20/23), “Del Norte County Spearheads Mobile Mental Health Crisis Response Team.” This story described a presentation to the Crescent City Council about local mental health services and the lack thereof.

I went back and read this story, watched the recording of the council meeting, and read the report prepared for the County by the Indigo Project. These are my sources.

Crisis Care

The presentation to the City Council was from Shiann Hogan, Program Manager of the Behavioral Health Branch of the Del Norte County Department of Health and Human Services. Last year they received a Crisis Care Mobile Unit (CCMU) Planning Grant from the Behavioral Health Community Infrastructure Program.

A Crisis Care Mobile

Unit (CCMU) will provide an option to respond to mental health and substance abuse crises when uniformed law enforcement may not be needed.

Here’s how it will work.

People would call into dispatch. Working in partnership with law enforcement, a mobile services van will be deployed to respond to a person experiencing a behavioral health crisis. If the crisis cannot be resolved in the field, they would transport the patient to the hospital. The over-reliance on law enforcement to respond to individuals suffering from a mental health crisis coupled with limited service options for people in crisis contribute to a revolving door in jail and large utilization of the emergency department for mental health and substance use related crises.

Collaboration

This planning grant was used to hire consultants with the Indigo Project to meet with a collaborative of stakeholders to inform the development of a CCMU Needs Assessment and Action Plan that “will guide future pre-development activities; pave the way for subsequent funding requests; and set forth plans to successfully integrate mobile crisis response into the existing system of services.”

This collaborative of stakeholders included Del Norte County Sheriff Garrett Scott, Crescent City Police Chief Griffin, Supervisor Valerie Starkey and representatives from the County Department of Health and Human Services, Sutter Health, Open Door Clinic, Remi Vista, Mission Possible, Yurok Tribe, Tolowa Dee-Ni’ Nation and others.

Within CCMU planning, the Needs Assessment led to the collaborative establishing three goals for crisis services. Goal 1: Re-

duce the number of people experiencing crisis. Goal 2: Provide crisis services to individuals wherever they are. Goal 3: Build community capacity to respond to crises. Once the Action Plan is approved by the State, Del Norte County is eligible for the remainder of their base allocation to support CCMU implementation.

Funding Available

The State of California has allocated over two billion dollars to build back behavioral health infrastructure. This represents a pivotal opportunity for Del Norte County as infrastructure funding of this size is extremely rare and unlikely to be available again anytime soon.

One of the goals of this collaborative is to improve behavioral health services at Sutter Coast Hospital which has recently been awarded a $2 million grant to create a crisis stabilization unit at the hospital. This grant will help build strategies to reduce emergency room utilization and hospitalization.

This will streamline the health assessment for mental health patients and quickly transition them out of the emergency room into a calming space designed for mental health clients in crisis. Behavioral health staff can then come in, figure out a safety plan and determine next steps outside the chaos in the emergency room.

While counties across the state struggle with staffing, these issues are especially pervasive in Del Norte County which often cannot attract staff for positions, especially when specific clinical credentials are required.

To fully implement this program, the Behavioral Health Branch must hire 8 additional staff. There is an acute local shortage of mental health clinicians who are required to

conduct the assessment of all new clients. Hogan reported that as of midApril, Del Norte County will have no clinicians.

The CCMU grant will only pay for the equipment, vehicle, and other infrastructure needed to implement the program, but will not pay for staffing.

To address this, Behavioral Health is partnering with Sutter Coast Hospital to apply for a grant that will help pay for staffing.

Services Needed

At the end of the presentation, Crescent City Council member Kelly Schellong observed, “This is probably the most needed thing in our community right now.” I agree.

This is a critical step in reimagining public safety services in our community. This Crisis Care Mobile Unit will free up our overstretched local law enforcement personnel from responding to many calls that can be handled more appropriately by mental health professionals.

I commend the staff of the Behavioral Health Branch and the group of collaborators for going above and beyond the call of duty to seek funding for this ambitious new program. We should encourage our law enforcement agencies, elected officials and the general public to embrace this program.

Some people just like to get things done

Although I’ve lived in a small Western town for 30 years now, I have never known much about one of its fundamental institutions, the service club. Many small-town residents still center their lives on Lions, Elks, Rotary or similar organizations.

Not me: I’m not a joiner. Yet as our national culture moves farther away from such settings for broad discussions, I worry that I’m part of the problem.

A while ago when I was asked to speak at our local Rotary Club, I hesitated, picturing white guys networking with each other and complaining about newcomers. But I had published a book, and publishers instruct authors to market wherever you can.

Upon arrival, I cataloged the changes since my last Rotary visit decades ago: The president was a 20-something woman, we ordered off a menu, and people seemed less guarded.

Our local Rotary, I learned, was known as relatively liberal, and some of the older men seemed pretty vigorous. The fac-

es reflected the town’s lily-white complexion, but I noticed that the room contained Republicans and Democrats, evangelicals and atheists, entrepreneurs and socialist-leaning nonprofit workers, feminists and fans of traditional gender roles.

Of course we didn’t talk about any of that. As one man said, the point of the club was to avoid ideology in order to focus on projects that help people. Perhaps that’s why they’d invited an author — to be supportive of local literature.

So we talked about something close to my heart, and as it turned out, to theirs. My book, Natural Rivals, chronicles a 1890s collaboration between Sierra Club founder John Muir and U.S. Forest Service founder Gifford Pinchot. The two men are often seen as enemies: Muir’s preservation philosophy dictated a hands-off policy to nature, while Pinchot advocated aggressive management of natural resources to provide for human needs.

side Montana’s Lake McDonald in what would later become Glacier National Park, did they argue about whether to cut trees or dam valleys? No. They set aside their ideological differences to focus on a bigger threat.

The then-new idea of public lands — national parks, national forests, and other lands held collectively and managed with public involvement by our democratic government — was controversial. While disagreeing about the priorities for those lands, Muir and Pinchot were united in believing that public lands mattered.

ately connected with this message. That’s what lively small town folk do: Set aside differences to get things done.

By contrast, in metropolitan areas, I’ve found that people resist the message about collaborating on common goals, especially when I suggest it could work today. Surely the 1890s were different, they say. Ideologies were different, or personalities were different, or the stakes were not as high.

To me, the difference is that today we cluster in like-minded neighborhoods. Our stores, restaurants and media are all ideologically segregated. We wrap our identity in ideology. And we forget how to find common ground.

I say “we” because I do it, too. My attempted justification is the one I mentioned: I’m not a joiner.

But John Muir wasn’t a joiner either. The individualistic mountaineer wasn’t even an official member of the blue-ribbon commission visiting Montana’s Lake McDonald. He just decided to tag along so that he could

converse with — and listen to — people who disagreed with him.

In the dramatic results of those conversations, Muir’s essays and interviews of 1896 and 1897 merged his ideas with Pinchot’s to help persuade citizens of the value of public lands.

If we still think of today’s Rotarians as old-fashioned, maybe it’s because they attract members of all stripes who embrace idealistic values about helping people help themselves. I learned, for example, that they work to end the scourge of polio internationally while providing scholarships to high school kids. And they don’t have a political test for pitching in.

They just pick their causes, and then they fight for them.

Redwood National and State Parks update reservation, permit system

Redwood National and State Parks (RNSP) has made changes to their reservations and permits to increase visitor access and satisfaction. The park is increasing the number of reservations available for many areas. For the first time, reservations will be available for booking the day before and allow for visitors to access areas like Fern Canyon Trailhead and Tall Trees Trailhead without planning too far ahead. Computers will also be available in park visitor centers to help visitors make online reservations.

The park uses what is called “adaptive management strategy” to address this complex issue using real world experiences and data to inform decision making. Information was gathered during the last year which helped park managers make these im-

Soroptimist Club awards scholarships to local women

Soroptimist International of Crescent City, a global volunteer organization providing women and girls with access to the education and training they need to achieve economic empowerment, presented a $1,000 Live Your Dream: Education and Training Award for Women to help a local woman improve her economic situation.

The award ceremony took place at House of Jambalaya on April 13.

Jolene Reynolds is the Live Your Dream award recipient for this year. She will use the cash award to continue her goal to obtain her licensed clinical social worker degree. Jolene is currently working with abused and neglected children, attends college as she can and is the prima-

ry support of her family. She is the mother of two children and believes that completing her education will show her children the value of an education.

Additionally this year, Soroptimist International of Crescent City also awarded two S500 Live Your Dream Awards to two outstanding women. These awards were presented to Jaclyn Stockham and Ciara Garcia. Jaclyn is currently at College of the Redwoods and is working towards a degree in psychology. Jaclyn has one child and is also working full-time.

Ciara is working toward her goal of becoming a labor and delivery nurse.

Your Dream award provides women who serve as the primary wage earners for their families with the financial resources to offset costs associated with their efforts to attain higher education or additional skills and training.

Soroptimist International of Crescent City also honored Charleston “Charley” Tygart, a student at Del Norte High School, with the Violet Richardson Award.

The Violet Richardson Award recognizes young women who make the community and world a better place through volunteer efforts. Charley is being recognized for her work with Interact Club, Door of Faith Organization, and several other volunteer efforts.

Jay Mosby Watercolor

Studies Exhibit Manley Art Center, 433 Oak Street, Brookings The exhibit, on display from April 4th through 29th, features several of Jay Mosby’s recently recovered watercolor studies. Jay Mosby, an accomplished watercolorist, was an important part of the Brookings-Harbor art scene. The rest of the exhibit features a variety of art created by the Manley Art Center members. Proceeds from the sale of artwork are shared between the artists and the Manley

Art Center. The Manley uses its portion to further its mission to promote, through education, the appreciation, distribution, and enjoyment of fine arts.

Hearing: The Board of Commissioners will hold a special de novo public hearing to hear an appeal of Curry County Planning Commission’s decision on the Arizona Ranch Recreation Vehicle (RV) Park land use proposal described further in this notice. The special de novo public hearing will be held at 10:00 AM on Wednesday, May 17, 2023, in the Board of Commissioners chambers on the upper level of the County Courthouse Annex in Gold Beach located at 94235 Moore Street.

The proposed project is located on Assessor’s Map 34-14-20 tax lot 201 within the Rural Commercial (RC) zone. It is located approximately 0.2 miles east on Arizona Ranch Road (just north of Prehistoric Gardens) at 37015 Arizona Ranch Road.

Proposal: Application AD-2228 is a request for conditional use approval for a 31 fullservice connection RV Campground, onsite manager’s quarters, laundry facility, recreation room and general store.

Background: On February 16, 2023, the Curry County Planning Commission approved the proposal based upon the evidence in the record. A public hearing was held before the Planning Commission as a matter duly set upon the agenda of a regular meeting on February 16, 2023, after giving public notice to affected property owners and publication in the local newspapers as set forth in ORS 197.797 and Section 2.070 of the Curry County Zoning Ordinance (CCZO).

Applicable Criteria: Curry County Zoning Ordinance section 2.170(7c and 7d): Every Notice of Appeal shall be on a form supplied by the Director and contain the following information:

(c) A statement explaining the specific issues being raised on the appeal(s). The applicant has identified the specific appeal issue as follows: “The specific issues include but are not limited to the following:

i. Failure to comply with CCZO Section 3.252(10) re Natural Hazards’

ii. Failure to comply with CCZO Section 7.040(2) re septic system;

iii. Failure to address fire prevention access and fire restrictions on lands adjacent to Forestry lands, and comply with the Curry County Comprehensive Plan Section 4.6, policy #5, for forests;

iv. Failure to require the applicant to take measures to protect groundwater from drawdown which would lead to loss of stabilizing vegetation, loss of water quality, or intrusion of salt water into water supplies as required in the Curry County Comprehensive Plan, section 15.10; and

v. Failure to contact Oregon Department of State Lands (DSL) regarding this application re the impact to adjacent wetlands, given the prior knowledge of high groundwater and septic system failures at this site, and failure to work with DSL and the applicant to require a Wetlands Determination and Delineation on this tax lot.

(d) A statement demonstrating that the appeal issues were raised during the public comment period. The applicant has stated the following in regard to the issue being raised during the public comment period: “These issues were raised in both

written and oral comments provided to the Director and Commission”.
