The State Coastal Conservancy Supports Two Important Del Norte Projects

The Conservancy awarded a grant of up to $1,500,000 to the Smith River Alliance to implement the Point Saint George Coastal Trail Implementation Project, consisting of cultural resources protection and construction of 1.25 miles of the California Coastal Trail, new restrooms, interpretive signage, and other improvements to the main trailhead parking area at Point Saint George in Del Norte County.

The project will extend the California Coastal Trail, protect sensitive resources, improve public safety, and provide amenities at a natural area that is an important open space destination for tourists and the local community. The project is essential to protect the resources of the site and to improve public access to the 339-acre Point Saint George property that was purchased in part with Conservancy funds in 2002.

“The project will provide multiple benefits,” said Peter Jarausch, Conservancy Project Manager. “It will fill a gap in the coastal trail, providing a continuous reach of coastal trail from Pebble Beach Drive, two miles to the south, to the mouth of the Smith River, approximately 11 miles to the north.”

Since I started writing my column almost two years ago, I have written at least seven times about the Tri-Agency Economic Development Authority.

The first column was in June 2022. At that time the City, County and Harbor were discussing their intent to settle old debts and take steps to reform Tri-Agency.

These agencies have come a long way toward giving Tri-Agency a new purpose. The final step is that all three agencies must approve a revised joint powers agreement that will define in detail what the purpose and powers of Tri-Agency are as they move forward. They are close but there is a joint powers disagreement.

Prior Steps Taken

On February 20, 2024, the Crescent City Council considered adoption of the amended joint powers agreement and City staff wrote a very informative report on the history of Tri-Agency and the actions taken to date.

“Tri-Agency was originally formed in the aftermath of the 1964 tsunami to help drive economic recovery and has also been instrumental in projects involving the sewer, airport, and Visitors

Bureau. Tri-Agency has struggled to function in any meaningful way since it defaulted on a USDA loan in 2011.”

“On October 25, 2022, a joint meeting of the City Council, the County Board of Supervisors and the Harbor Commission was held to agree on a split of the $160,000 of outstanding USDA debt.”

“On July 25, 2023, another joint meeting was held where each member agency voted to continue the Tri-Agency Economic Development Authority. They agreed that the joint powers agreement needed to be revised to allow the inclusion of tribal members and prohibit Tri-Agency from serving as a lender of last resort.”

More Recent Actions

On October 13, 2023, the Tri-Agency Board considered a draft revision of the joint powers agreement and agreed to circulate the draft for comments from the member agencies.

On November 21, 2023, the County Board of Supervisors considered the draft revision and added a few changes of their own, including Section 5.05.E which states that Tri-Agency, “shall not support or pursue activities involving the offshore generation of

Congress needs to assert its constitutional authority

In recent years, the United States has been involved in military interventions and foreign aid efforts across the globe with varying degrees of success and controversy. While it is essential for our nation to engage in global affairs and promote stability and prosperity, it is equally crucial that such actions be subject to careful oversight and scrutiny by the legislative branch.

The power to declare war and authorize foreign aid or intervention rests with Congress, as outlined in the Constitution. However, in recent decades, there has been a troubling trend of executive overreach, with presidents bypassing congressional authorization and committing our military and resources to overseas conflicts without sufficient oversight.

It is time for Congress to assert its constitutional authority and ensure that decisions regarding military intervention and foreign aid are made with the utmost deliberation and transparency. This is not to say that immediate threats to national security or humanity should be ignored – in such cases, swift action may be necessary to protect our interests and prevent harm.

However, in situations where there is no imminent danger, Congress must be given the opportunity to debate and authorize any proposed military intervention or foreign aid efforts. This oversight is essential to uphold the principles of democracy and ensure that decisions with far-reaching consequences are made with the input of the American people’s elected representatives.

On January 23, 2024, the Board of Supervisors, with Supervisor Starkey absent, unanimously approved the amended joint powers agreement, including the ban on involvement with offshore wind. This was then transmitted for ratification by the other members of Tri-Agency. But they had other plans.

On February 6, 2024, the Harbor Commissioners voted unanimously to approve the joint powers agreement excluding Section 5.05.E. It is especially compelling that the two fishermen on the Harbor Commission know that fishermen should be at the negotiating table even though they are opposed to offshore wind.

On February 20, 2024, the City Council also voted unanimously to approve the joint powers agreement excluding Section 5.05 E. Council members expressed an interest in protecting fishing but understood that it is better to be engaged. It was noted that the Harbor District cares about fishing, yet they want to be involved.

It is worth highlighting that the Harbor and the

City agreed with 99.9 % of what the County approved. The only disagreement was Section 5.05.E. Now this must go back to the Supervisors to reconsider their position and go along with the two Tri-Agency member agencies or not. If they agree then Tri-Agency can move forward.

There’s More To Do

At one of these meetings someone asked why offshore wind is being discussed so much. The reason is because the agreement approved by the County would needlessly limit the powers of Tri-Agency. Offshore wind development should be monitored, but it should not be the top economic development priority.

Some people have said it is not clear what the purpose of Tri-Agency is if not for wind power. However, the joint powers agreement refers to the approved Del Norte Comprehensive Economic Development Strategy (CEDS) as a guiding plan which identifies many projects that Tri-Agency can work on.

The CEDS includes an Action Plan with a list of specific objectives and actions that will enhance economic development in our community. The CEDS

that may lead to unintended consequences or undermine our nation’s values and interests.

It is time for Congress to reclaim its rightful role in matters of war and foreign policy, and I urge our elected representatives to take action to strengthen oversight and accountability in these critical areas.

As a voter in the 2nd Assembly, and as retired Sonoma County DA, I’ve been watching the race and its candidates closely. One thing’s for sure - it’s gotten a lot of attention, and may I say, for all the wrong reasons. Negative ads and TV commercials tend to heat things up and create a lot of excitement, but they basically only tell you who not to vote for. I know something about big money and negativity in local politics and was proud to be successful in overcoming it.

It has been seven months since the Tri-Agency began the process of updating the agreement that defines their purpose and powers. They are so close to succeeding, but it is still possible to snatch defeat from the jaws of victory. If the County Supervisors do not reconsider their position, Tri-Agency could die.

Even if Section 5.05.E is removed, concerned County Supervisors do not give a blank check to Tri-Agency on offshore wind policy. There are checks and balances built into the voting structure that effectively gives the County a veto over any action. For a motion to pass at least one County representative must vote yes.

Economic Development

There is a need for more focus on local economic development in our community. Tri-Agency can start to focus on helping with this if all members agree and adopt the same version of the joint powers

agreement. Until this happens this agency is in a dysfunctional stasis.

The February meeting of Tri-Agency was cancelled with no explanation. The next meeting is scheduled to start at 3:00 PM Thursday March 28. It is possible they are waiting to see what the Board of Supervisors do.

If so, please attend and encourage the Supervisors to approve the same agreement approved by the City Council and the Harbor Commissioners. uents’ complaint about inaction by Animal Control with regards to three loose dogs in the Fort Dick area that were allegedly killing cats. Upon visiting Animal Control, she realized there was an employee shortage; however, she did not just explain that to her constituents and move on to another issue, she began volunteering at Animal Control. This provided her an opportunity to see where help was most needed. She saw the need for Animal Control to have its own supervisor (Animal Control was previously under the Department of Agriculture) and was instrumental in creating the position and getting it approved. She listened to our concerns and fixed other problems, but now we have new concerns, and hope that she listens again. With the impending closure of Four Paws Pet Hospital, many of your constituents will have nowhere to take their pet for care as it’s my understanding that the two veterinarians in Crescent City and the two in Brookings are not taking new patients. The Board should consider enticing a new veterinarian to set up practice in town who will also offer emergency services so your constituents will not have to travel to Medford to save their pet (or in some sad cases, have them euthanized when suffering from an illness).

The overpopulation of cats and dogs needs to get under control; the County needs a spay/neuter ordinance. At minimum, any pet owner in government housing should be required to fix their animal.

I recently moved and am now in Supervisor Starkey’s district. I intend to vote for her in hopes that she hears our concerns again and takes action.

enhance interpretative opportunities and provide responsible public access opportunities,” said Cynthia Ford, Tribal Heritage Preservation Officer, Tolowa Dee-ni’ Nation.

Approximately 0.4 miles of the new trail will be accessible to people who use wheelchairs or have reduced mobility. The project will reduce impacts from informal trails on sensitive resources by closing those trails and designating one formal trail in their place, and will protect sensitive cultural resources by capping sites that are currently being exposed through erosion and inappropriate use.

The project will include significant improvements to the parking area.

“Del Norte visitors who arrive by plane, fly over this area. Most are awestruck by the outstanding beauty of this part of the California coast and Point St. George in particular”, said Cindy Vosburg, Executive Director, Crescent City-Del Norte Chamber of Commerce. “The new trail will provide important coastal access to community members and visitors by enhancing public access to the coast very close to town. The new Point St.

George Coastal Trail Project, when complete, will become one of the gems of the California Coastal Trail and a great community amenity.”

The trail and access improvements were identified in the 2004 Point St. George Management Plan (Plan), prepared collaboratively by the County of Del Norte, Conservancy, California State Parks, the California Department of Fish and Wildlife (CDFW), the Tolowa Dee-ni’ Nation, and the Elk Valley Rancheria, with input from local residents.

Point Saint George is a scenic windswept headland located just northwest of Crescent City in Del Norte County, approximately fifteen miles south of the California-Oregon border. Del Norte is California’s northernmost county, with a population of just under 30,000 people, most of whom reside in the Crescent City area. Acquired by the County in 2002 in part with Coastal Conservancy funds, the 339-acre coastal terrace with its steep cliffs, offshore sea stacks, and crashing surf is increasingly appreciated and used by local people and Redwood Coast visitors. Ownership of Point Saint George is split between four landown-

ers, three public and one private. The County of Del Norte owns the largest portion followed by the California Department of Parks and Recreation, and the Wildlife Conservation Board.

The dramatic interaction of the ocean and rocky shore is exceptional at Point Saint George. The headland’s steep bluffs drop to rocky pocket beaches and intertidal shelves, some accessible by trail, others enclosed by towering cliffs and sea.

The State Coastal Conservancy has approved a grant to Smith River Alliance to conduct preacquisition planning activities and minor clean-up actions for beach, dune, wetland, upland, and forested parcels within and in the vicinity of the Pacific Shores Subdivision, adjacent to the Lake Earl Wildlife Area in Del Norte County, and to acquire those same parcels. This is a continuation of the Pacific Shores Acquisition Program.

“Nearly 80% of the unbuildable subdivision is in public ownership,” said Patty McCleary who has been working on this program since 2002. “We are grateful to continue this work, which allows me to speak to 2-3 lot owners a week to explain and explore their options.”

Lake Earl, the largest coastal lagoon south of Alaska, has long been identified as a critical natural resource, providing habitat for over 300 species of birds on the Pacific Flyway. Continuing the lot acquisition program will help to resolve the longstanding controversy over development in this sensitive area and advances the State’s 30X30 Executive Order goals for protection of conservation lands.

The project also reduces potential vulnerability to sea level rise. Pacific Shores subdivision has significant ocean frontage and is thus vulnerable to sea level rise. Acquiring lots from willing sellers will ensure that no development will occur. In addition, as additional lots are acquired, and entire blocks within the subdivision move into public ownership, there is an opportunity to remove existing roads and restore wetlands and dune habitat, thereby creating a landscape that may be more resilient to climate change.

Conservancy funds for this project are expected to come from an appropriation to the Conservancy from the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoors Access for All Act of 2018.

In other Harbor business, the Tri-Agency Joint Powers Authority remains on shaky ground. The Commission tepidly approved the Joint Powers Authority by-laws for the Tri-Agency Economic Development Authority after deleting the political paragraph on wind power, within the by-laws.

The Harbor deposited $10,000 for its share in Tri-Agency. The City’s portion is $30,000 and has

yet to approve its contribution pending today’s Harbor vote. The County continues to mull over its share of $70,000 to fund the Agency for the upcoming year. The Harbor voted 5-0 but reserved its right to withdraw from Tri-Agency at anytime. Linda Sutter, long-time critic of Tri-Agency and candidate for 5th District Board of Supervisors cautioned Commissioners the by-laws of the Joint Powers Authority have no mechanism for oversight. “ Del Norte County is in crisis mode with no one conducting any due diligence. We cannot afford to squander precious resources.” Commissioners approved the independent auditor ‘s Financial Report for year ending June 30, 2023. While admitting mistakes and omissions were noted, Commissioners approved the audit with a promise to increase oversight and vigilance in conducting its business.

City Planner Ethan Lawton apprised Councilors of the details of the Roosevelt Estates phases and the proposed changes to the General Plan Map. Public Speaker / Realtor Kevin Hawkins praised the proposed changes and shared his opinion of the critical need for additional housing units. Hawkins told councilors that his office receives at least 10 applications for each rental unit placed on the market. Mayor Blake Inscore shared his concern the housing shortage prevents Certificated teaching staff seeking to fill vacancies from moving to Crescent City due to lack of suitable housing. The Mayor welcomed the proposed ordinance. The Planning Commission recommended approval of the split-zoned parcel at its regular meeting February 8. 1405 California St is partially developed with a 7,050 Sq. Ft. commercial building (formerly California Auto Image) and currently being developed with 16 residential units (Phase 1). With the zone change, the mix will comprise of 36 two-bedroom units and 20 three-bedroom units. Prospects look promising for completion of paving project

The City Council directed the City Manager to sign the Community Development Block Grant (CDBG) application seeking $3.3 million to complete Front Street paving from Play St to 101 South.

The CDGB is a federally-funded program through the Department of Housing and Urban Development (HUD).

As a entitlement jurisdiction ( cities with populations of less than 50,000 and counties with populations of less than 200,000, Crescent City has applied for CDBG funding through the California Dept. of Housing and Community Development (HCD).

Last September, a Notice of Funding Availabity (NOFA) was released with approximately $19 million in funding to be awarded to wait-listed Over-the-Countet (OTC) projects only.

Crescent City is one of those eligible entities. The City submitted an application for a $1,065,485 for a Storm Drain Improvement project on F St.

In October, the City held a public hearing for the 2024 NOFA. As a result, Council directed staff to prepare an application for an OTC Public Infrastructure ProjectFront Street Play to L Street (101 South).

The 2024 NOFA has been postponed until late Summer / Fall, 2024.

If awarded, the impact on Crescent City could be significant. The grants issued are on a reimbursable basis, therefore the City will need to upfront the project’s cost and then request reimbursement from HCD.

It is unknown whether this CDBG application will be successful but if granted, the City will need to take steps to make certain there is adequate cash flow to meet all the necessary expenses. The City will be meeting with financial advisor Urban Futures to evaluate all options.

Artificial Habitats for Freshwater Fish

one reservoir. Crews also place different types of habitat structures along the shoreline when reservoir levels are low, providing a good area for fish habitat once the waters rise. About two dozen reservoirs contain artificial habitat, from Sutherland in San Diego County to Whiskeytown Lake in Shasta County.

One example is the use of large PVC piping in several Southern California lakes. CDFW places circular pipes, 12 inches in diameter and three feet long, in water hoping to attract catfish. Catfish are known as cavity-nesters and once the males have prepared the pipe for spawning by clearing out any debris, females follow and lay their eggs. The males then return to guard the nest and use their fins to fan the eggs to oxygenate them.

Biologists will return to the spots where they’ve placed habitat structures to deter-

mine their effectiveness. With two strong rainy seasons in California, many of the state’s reservoirs are filled to historic water levels, which lessens the need to install artificial habitat. Heavy rains raise reservoir water levels which in turn inundates natural habitat along the shoreline. Although this is beneficial for now, our biologists are planning future projects to continue to improve fisheries habitat in times of drought to ensure fish populations stay healthy.

Identifying Duck Species Q: As a new waterfowl hunter, how do I learn the difference between duck species?

A: This is a common question among beginning waterfowl hunters mostly because they don’t want to run afoul of the law, but some hunters with good identification skills also select preferred duck species

to harvest, or they may try to harvest primarily males vs. females.

California hosts 39 species or subspecies of waterfowl, so it can be challenging to learn to identify them. Experience is the best teacher and February is a great time in California to learn duck identification by direct observation.

Our recommendation is to visit any of CDFW’s wildlife areas or national wildlife refuges that are managed for waterfowl habitat, or perhaps wherever there is access to hunt waterfowl during the waterfowl season. Visit those places after the close of waterfowl season while the birds are still around. Bring a good pair of binoculars, a waterfowl identification book and maybe a knowledgeable friend who can help. Not only can you help learn to identify the birds from

looking at them, but you’ll also begin to learn to distinguish the birds by their flight patterns and sounds they make.

Fun fact, most waterfowl don’t quack, they whistle or chirp in some form or another.

Hibernation Adjustments

Q: Do bears adjust their hibernation location when heavy weather conditions arrive?

A: Researchers throughout North America have reported that black bears

can awaken and travel to new locations when disturbed and the same can be said for black bears that inhabit California. Sows with cubs can move the tiny young into an alternate den if the disturbance is at an unacceptable level or if there is some danger – like a flood or landslide.

Hibernation is an adaptation for some mammals and reptiles, which allows them to survive the winter season. In many areas, winter can be unforgiving. Food is hidden beneath the snow, water sources are frozen over and frigid temperatures can have deadly consequences. By hibernating, an animal’s body temperature, heart rate, breathing and other metabolic activities slow down significantly to conserve energy. In areas with mild winters, such as in Southern California, most bears do not hibernate, because they

have adequate resources and the ambient temperature is survivable. Biologists have found that only pregnant sows (female bears) den up for the entire winter.

Black bears are thought to hibernate for about four months in other parts of California. They can hibernate for many months because their body temperature reduces to approximately 88 degrees Fahrenheit, which is within 12 degrees Fahrenheit of normal. By contrast, the body temperature of smaller animals such as marmots, chipmunks and ground squirrels may drop below 40 degrees Fahrenheit. Small mammals must awaken every few days and raise their body temperatures to normal levels so they can eat stored food, and pass waste. Bears can maintain their suspended state because their warm fur allows them to retain body heat.

Why does CDFW build artificial fish habitat in California lakes? A: There are several reasons for CDFW to install artificial habitat in reservoirs around the state. Structures can be placed next to spawning areas to provide protective cover for juvenile fish. These constructions also attract larger fish, providing prime fishing opportunities for anglers. Artificial fish habitat come in all shapes and sizes, whether orange trees, wood structures or other artificial man-made materials. Manzanita shrubs, Juniper trees and even used Christmas trees have been used for habitat purposes. Softwood like avocado trees are avoided because they deteriorate faster in the water. Coastal Conservancy announces Two Del Norte Projects

“The project will extend the California Coastal Trail, preserve sensitive resources, improve public safety and provide amenities in a natural area that is an important open space for visitors and the local

community, ” states Project Manager Peter Jaraush.

The Conservancy purchased the 339 acre Point St. George area in 2002.

The project will provide continuous coastal access from Pebble Beach Drive, approximately 11 miles north to the Mouth of the Smith River.

The project is situated on Tolowa Dee-ni ancestral land. Cynthia Ford Tribal Heritage Preservation Office praised the Conservation grant. “ We look forward to continue the collaborate work with our partners while providing Indigenous input to protect cultural landscapes, enhance interpretive opportunities and provide responsible public access opportunities.” The trail and access improvements were identified in the 2004 Pt. St. George Management Plan prepared by Del Norte County, the Conservancy, California

State Parks, California Dept.of Fish and Wildlife, the Tolowa Dee ni Nation, the Elk Valley Rancheria, and input from the private Mavris residence situated within the property. In another Coastal Conservancy action, ap-

proval was granted to the SRA to conduct pre-acquisition planning activities and Minor clean-up for beach, dune, wetland, upland and forested parcels within the Pacific Shores Subdivision adjacent to the Lake Earl Wildlife area and to acquire those

same parcels as a continuation of the Pacific Shores Acquisition Program. “80 percent of this unbuildable subdivision is in public ownership,” says Patty McCleary of the Smith River Alliance. McCleary expressed appreciation to continue the work,

allowing her to speak to speak with private property owners regarding their options. The $1.3 funding is divided $500,000 for pre-acquisition and cleanup efforts and $800,000 to acquire the parcels.

Three Del Norte Warriors advance to state championships

The Del Norte Warriors enjoyed an historic season on the wrestling mats.

In addition to winning a first-ever North Coast Section dual meet championship in early February, the Warriors retained their boys H-DNL championship a week later and went on to claim two individual section crowns and advance three of their grapplers to the state championships.

All in all, it was a memorable February for the team.

The league championships took place at Eureka High School and the Del Norte boys had five individual champions and four runners-up in the 14 weight classes, while outscoring second-placed Arcata by an impressive 84 points in the final team standings.

Chulhs Bates (113 pounds), Isaac Lopez (132), Curtis Bartley (138) and Colton Schaad (165) each won their second individual league championship for Del Norte, while teammate Braydan Johnson also was crowned champion at 175 pounds.

Alex Osborne (106), Soren Lewis (150), Reynaldo Martinez (157) and Aaron Burger (190) each also placed second for the league champions.

“I was pretty happy with the overall performance,” head coach Clinton Schaad said after the tournament.

“Everybody held their seeds or did better than they were seeded, and when that happens it’s usually a pretty successful day. So it was pretty exciting.”

The team’s success continued the following weekend, with juniors Bartley and Colton Schaad winning their first-ever NCS championships at James Logan High School in Union City.

“He has had a great season,” Clinton Schaad said of Bartley, who had a goal of winning a section crown and qualifying for the state championships this year. “He’s been getting better every tournament.

“He’s very goal oriented, and one of his goals this season was to reach state.”

Colton Schaad also had his eyes set on state qualification and put in a lot of work in the offseason, traveling all over the West Coast to compete in several big tournaments in order to prepare for the high school season.

“Much like Curtis, he set his goals early on and hasn’t wavered,” coach and father Clinton Schaad said of Colton. “He’s been training hard all year and doesn’t miss many days.

“He’s a very focused young man and won’t let things distract him.”

Colton’s cousin, Channey Schaad, also qualified for the state championships after placing third in her weight class at the NCS championships and first in league.

After placing eighth at the NCS meet as a sophomore two years ago, she improved to seventh last year and third this year, defeating Amador Valley’s Eliana Caro with a pin in the third-place match after battling back from a semifinal loss.

“She had a fantastic tournament,” Clinton Schaad said. “She dropped down, but kept her head up and kept right on going to third. She had a great tournament.”

At the state championships, which is one of the most competitive high school tournaments in the nation, Bartley won two of his four matches before bowing out, while both Colton and Channey Schaad each finished 1-2.

In addition to Channey Schaad, who is now a three-time league champion, Del Norte freshman Elizabeth Hernandez also won a league title in her first year competing at the high school level.

“I thought they went out and competed the best they could,” Clinton Schaad said of his girls team after the league championships. “And they represented the school really well.”

Karlye Dodson, Aubry Dodson and Bailey Fox each also placed second for Del Norte at the league championships, while teammate Golden Rule placed third.

The Del Norte girls placed second as a team to Arcata at the league championships.
