Chipotle Mexican Grill will be opening soon in Crescent City.
At the end of the February 21 council meeting, City Manager Eric Wier broke the news to councilors that Chipotle Mexican Grill is presenting its plans for its newest restaurant to the Crescent City Planning Department. The location of the Chipotle Grill in Crescent City is a three-quarter acre vacant parcel, between the segments of Highway 101, at Ninth and L Streets. Chipotle, founded in 1993 is noted for its fresh Mexican cuisine and famous for its wide selection of burritos and bowls. The chain has approximately 3,200 stores across the United States, United Kingdom, Germany and France. Groundbreaking will be announced pending planning and city approval.
City seeks out grant opportunities

Crescent City is becoming quite adept at seeking out and applying for all kinds of various grants opportunities. Among those applications, councilors approved grants applications seeking out Request for Proposals (RFP) for Front Street improvements from G Street to I Street, with an addition for I Street to Play Street and a police department request from the Alcohol and Beverage Control Policing Partnership Program. The G to I Street improvements request was presented by public works. This project is a standalone plan. A separate request was inserted for improvement for I Street to Play Street. The final leg of the grant from Play to the 101 was not addressed at the Tuesday meeting.
Front Street improvements include storm drain, new water lines, streetlights, sidewalk, ADA ramps and driveway replacements along Front Street with infrastructure connections at four intersections. The total project slightly exceeds $3 million with identical Measure S and matching ARPA grant funding, Del Norte Local Transportation funding and a Community Project grant via Congressman Jared Huffman.
Councilors also approved the application for the ABC grant for several inebriation calibration machines and an educational component not to exceed $30,000, a grant previously sought but declined to the city. A change in grant criteria prompted the request for a new application.
City Manager Eric Wier reported to the council, the city has applied for and awaits decisions on an estimated $13 million on outstanding grants application.
The Council meets Monday, March 6 at 6 p.m. at the Flynn Center.

BoatSmith Whitewater Festival a Huge Success

If you drove the 199 corridor President’s Day weekend and thought there was a sharp increase in the number of vehicles with brightly colored boats of all shapes and sizes strapped to the top or trailing behind, you were not wrong.
Hundreds of kayakers and rafters traveled from across the West, some from as far as New York, to attend the fifth annual BoatSmith Whitewater Festival, an event quickly gaining a reputation for being one of the best whitewater festivals on the West Coast.
“We really enjoy hosting the whitewater boating community and the positive energy they bring to the area,” said Terry McNaught, partner/operator of Patrick Creek Historic Lodge, which hosts the event’s non-race festivities. Terry and his wife Tina, who took over the operation of the lodge in January 2022, said the turnout was even better this year, and the event was a real success with smiles all around. But they were sincerely ready to rest by Sunday. “It’s a big weekend,” Terry said.
At the lodge, thousands of dollars in raffle prizes were given away on Saturday night, prizes donated by the whitewater gear industry with the largest prize of the night being an 11-foot raft from Merlin-based raft builder SOTAR. After recouping costs, raffle ticket revenue is used to get local students on rivers and other outdoors field trips

Local rock band Corner Market kept the crowd moving with nearly three hours of original music between raffle drawings, followed by Gasquet-based DJ Mike Winner to close the night. Thursday, Woodpile rocked the early crowd at the lodge with “Songs from the Woodpile.” Friday night featured films and presentations about projects on local rivers, with Smith River Alliance highlighting the most recent efforts to block nickel strip-mining in the headwaters of the North Fork Smith River and American Whitewater highlighting the imminent schedule of dam removal on the Klamath River.
On the water, paddlers of various crafts tackled the rapids of the South Fork Smith River, with Surprise Falls being the crux rapid of the class III race and the narrow class IV South Fork gorge being the venue for the more advanced race. Race results can be found on the BoatSmith Whitewater Festival Facebook page.
On Sunday, Smith River Alliance organized a river clean-up with about 400 pounds of trash collected. The organization also provided trash bags to paddlers, encouraging everyone to leave the land better than they found it. The BoatSmith Whitewater Festival was held in the Smith River National Recreation Area, part of Six Rivers National Forest, which has been supportive of the event.

It’s potential economic impact is transformational. The PAC’s performances and location will contribute to Del Norte’s tourism and position Crescent City as a central hub. There is no reasonable venue for hundreds of miles, suitable for hosting touring musicians, dancers, theater ensembles or other people who are shaping our world.”
A panel of four community trendsetters from local business and government shared their views on the economic impact of the PAC. The panelists were Jen Schmidt of House of Jambalaya and Del Norte Association of Cultural Awareness, Michael Sullivan of Edward Jones company, Cindy Vosburg, Director of the Chamber of Commerce / Del Norte Visitors Bureau and Crescent City Manager Eric Wier. The city manager evoked the composite sentiment for the quartet panel of the Performing Arts Center, saying the PAC will
be “transformational and praised the resiliency of the community.”

Wood introduces bill to regulate broadband providers as a public utility
Assemblymember Jim Wood (D-Healdsburg) has introduced AB 1714, legislation that will define and
regulate broadband service providers as a public utility.
The California Constitution authorizes the Legisla-
ture to prescribe additional classes of private corporations or other persons as public utilities. “Public utility” currently includes every common carrier, toll bridge corporation, pipeline corporation, gas corporation, electrical corporation, telephone corporation, telegraph corporation, water corporation, sewer system corporation and heat corporation, where the service is performed for, or the commodity is delivered to, the public.
“Broadband has become an essential service in the daily lives of 21st century consumers and we know Americans agree,” said Wood. “If we didn’t understand this before, we have certainly realized how much everyone depends on this service since 2020, when we entered the COVID-19 pandemic.”
A 2020 study from Consumer Reports found that 80 percent of consumers believe broadband service is as important as water and electricity. People rely on an internet connection to

Colorado conflicted about cutting its water use

In Colorado, farmers must enroll in a four-state program by March 1, if they want to get paid for fallowing their fields — perhaps the best option to plump up the Colorado River’s giant reservoirs, Mead and Powell.
Not everyone is a fan, including Andy Mueller, director of the Colorado River District. He doesn’t like programs that pay farmers to stop farming.
Mueller also didn’t ask for the Inflation Reduction Act’s $125 million to pay the farmers he represents. Mueller’s organization exists to keep Western Colorado’s rural water away from growing cities across the Rockies.
State Sen. Dylan Roberts, D-Avon, who chairs the Committee for Agriculture and Natural Resources, has a more nuanced view. He says he understands that rural communities fear a “buy and dry” scenario. Where annual leases become routine, and once-verdant fields and farms wither. He insists that any water leasing must be temporary, voluntary and well compensated.
A water-leasing program called demand management was created for Colorado irrigators under former Colorado Gov. John Hickenlooper — it was tested, but never used. It would have allowed farmers to lease and store their water in a Lake Powell account under state control. Under Gov. Jared Polis’ administration, however, demand management was quietly shelved.
Now, this new, multi-state program for leasing agricultural water, called a “system conservation pilot program,” isn’t getting much traction. The program was announced two and a half months ago by Utah, Colorado, New Mexico, and Wyoming.
Its major drawback, says Tom Kay, an organic farmer in western Colorado, is that the Upper Colorado River Commission is offering a “stupid price of $150 an acre-foot.”
“Farmers like to farm; you have to pay them more than they make farming to interest them,” Kay adds. He gets around $650 per acre-foot of water growing mostly organic corn and dry beans on his 350-acre farm near the town of Hotchkiss.
Kay says he recently toured California’s Imperial Valley, where farmers are getting $679 an acre-foot. They sell their 200,000 acre-feet of Colorado River to the San Diego County Water Authority and consider the price reasonable.
Water prices are also rising. In California last summer, when the Bureau of Reclamation was looking hard for water, large irrigation districts in the Lower Basin were asking $1,500 per acre-foot to lease their water to cities, reported Janet Wilson of California’s Desert Sun.
If farmers got more money for their water under the new pilot program, says State Sen. Roberts, Colorado “could get more participation (and) show the federal government we are doing our part.” He also says that many state legislators think California and Arizona should bear the brunt of water cuts.
Getting farmers to fallow their land could build resilience in the Colorado River Basin, says Aaron Derwingson of The Nature Conservancy. A few years ago, he worked with grower Kay and Cary Denison, formerly of Trout Unlimited, to develop an “organic transition” program whose concept was simple: Lease two-thirds of your water for three years so pesticides and fertilizers leach off the land, then apply for organic certification. The demand management trial was largely funded by the Bureau of Reclamation.
So the question remains: Why is the Upper Colorado River Commission offering farmers so little for their irrigation water? The commission’s executive director, Chuck Cullom, explains: “$150 per acre-foot was chosen to discourage drought profiteering.”
Kay guesses that the low price was set to discourage participation. While $150 is the floor, and farmers can negotiate for more, commission representatives haven’t gone to agricultural communities to beat the drum for its program.
Kay says, “That $125 million is a lot of money, and it belongs to Upper Basin farmers.”
Meanwhile, in mid-November, 30 western cities agreed to cut “non-functional” turf grass by up to 36%, including big water guzzlers such as Utah’s Washington County, which wants to siphon more water out of Lake Powell.
What’s unclear is how much water from not watering grass stays in the river. Mueller points out that Aurora, a fast-growing Denver suburb, “is cutting water to sell more water taps. They’re building more houses.”
Kay admires Mueller’s rural leadership but thinks the way forward is clear: “Denver has a junior water right. Why isn’t it paying us in western Colorado to fallow ground, just like what Los Angeles and San Diego are doing?”

The People Who Show Up
I attended the monthly meeting of the Tri-Agency Economic Development Authority last Thursday (2/23/23) in the middle of a blizzard. I had to put my truck into four-wheel drive just to drive downtown, but felt it was important to attend this meeting.
When I arrived at the County administrative building, it was all locked up. The County staff got a snow day and it appeared that there was no one there.
I made calls to a few TriAgency Board members to see if the meeting was cancelled. I got a response from Tri-Agency Chair Wes White who assured me that the meeting was proceeding as scheduled.
I knocked on the door and was let into the building by County Counsel Joel Campbell-Blair who came in on a snow day to help with the meeting. This was a good sign since Joel has been diligently serving as Tri-Agency staff because the agency has no staff of its own.
The two Harbor District representatives Brian Stone and Wes White showed up before the 3 pm start time. Unfortunately there were no representatives from Crescent City or Del Norte County. For a meeting to have a quorum to conduct any business there must be at least four members including one from each of the member agencies.
Undeterred, Chairman White got on the phone to try to roust a few more members to attend the meeting. Eventually Supervisor Darren Short and Councilmember Blake Inscore arrived. I applaud the dedication of these four responsible Board members for showing up in the middle of a snow storm to take care of business.
There is an old saying, “The world is run by the people who show up.” Besides the four Board members and staff, there were only two members of the public in attendance, economic development consultant Mike Bahr and me.
Sad and tragic
Generally, this Board only meets once per month, so it would have been unfortunate if this meeting was cancelled. There is a lot of work to do to put this agency on a good course to drive economic development in our community. Last year, the City, County and Harbor District reached agreement on how to share the cost of paying off an old debt that accrued because some businesses defaulted on loans.
Moving Forward Tri-Agency is now positioned to plan for future activities. Once the meeting got started this was the main topic of discussion. The Board talked about the possibility of inviting local tribes to become partners or members of TriAgency. There is a history of successful cooperation between the City and County and tribes to work on regional projects that are a benefit to all. This led to a discussion of a possible name change and then a recognition that the joint powers agreement needed to be amended and updated. The original agreement was adopted in December 1975, nearly 50 years ago. As you can imagine, there are many sections of this agreement that are outdated or irrelevant.
It was recommended by County Counsel that it would be most effective to dissolve the original agreement and create a new joint powers agreement from scratch. At a prior meeting, it was the consensus of all members in attendance that this economic development agency should continue, so there were no disagreements with this proposal to reform the agreement.
The other major topics discussed were how to fund the agency and what projects the agency should focus on. Clearly offshore wind energy is a potential future source of funding, businesses, and jobs, but there was an acknowledgement that this is a medium-term prospect.
They wanted more near-term projects.
The original purpose of the Tri-Agency Economic Development Authority was “to provide a united, coordinated, orderly, positive and more effective means for implementing and carrying into execution an Economic Development Action Plan and Strategy for the general benefit of all the people of Del Norte County.” This premise is still valid.
In the spirit of this original intention, I recommend this reformed agency identify projects in the updated economic development plans that have been adopted by each of the respective member agencies.
The Crescent City Harbor District has a 10 Year Strategic Plan 2018-2028. Del Norte County has an approved Comprehensive Economic Development Strategic (CEDS) Plan 20192024. In 2021 Crescent City adopted an Economic Development Strategic Action Plan (EDSAP).
All these plans have been vetted through an open public process and include many projects of value to the community. Each of the individual agencies can continue to develop the projects that they can do by themselves, but this regional economic development agency can focus on some of the projects that require or would be strengthened by multijurisdictional collaboration.
Actions Speak Louder
In previous meetings, I have heard a lot of talk and not much action but that seems to be changing. I was pleased that Chairman White exercised his authority to appoint some of the members to ad hoc committees to work on these topics in between meetings. In this way progress can be made and reported back to the full Board for action at future meetings.
One committee will work with the County Counsel to begin drafting a new joint powers agreement. Through this effort the mission can

be updated, new members can be considered and a new name can be contemplated. One name suggestion is Redwood Regional Economic Development Authority.
The other committee will look at the economic development plans of the City, County and Harbor then suggest possible projects that the Tri-Agency or successor can work on.

Wood Introduces Two Bills to Expand Regulatory Oversight of Health Care Mergers and Acquisitions
Assemblymember Jim Wood (D-Healdsburg) has introduced two bills, AB 1091 and AB 1092 to address mergers and acquisitions in health care.
“A majority of studies show that mergers and acquisitions in health care are not lowering costs for anyone but the entities doing it,” said Wood. “We are led to believe that mergers and acquisitions in health care will save money and that it’s good for consumers, but what we are actually seeing is that it reduces competition and results in higher corporate and shareholder profits.
I also have real concerns about how these mergers and acquisitions could reduce or limit access
to certain health care services, like reproductive care.”
AB 1091 expands the authority of the state Attorney General (AG) to review and approve or deny any merger or acquisition of a nonprofit health facility to for-profit changes in ownership and control. The bill also requires the AG to hold one or more public hearings before issuing a decision on a major transaction and prohibits health care entities from engaging in specified unfair contracting practices brought to light by the recent Sutter Health settlement.
The Medicare Payment Advisory Commission (MedPAC), in its report, “March 2020 Report to
the Congress: Medicare Payment Policy,” concluded that a majority of these mergers led to higher prices. A New York Times article reported that an analysis looking at 25 metropolitan areas with the highest rates of hospital mergers from 2010 through 2013 found that the price private insurance paid for the average hospital stay increased in most areas between 11 and 54 percent after the mergers.
“Our Attorney General plays a critical role in reviewing and approving or denying health care mergers or acquisitions by being the very last stop to assure that the needs of the community and health care consumers are protected,”
said Wood. “This process requires that a thoughtful balance exists between the needs of the health care consumer and the hospital providing the care, but the AG’s process is one that absolutely must be maintained.”
AB 1092 expands regulatory oversight over health plan transactions, building on prior legislation (AB 595, Wood, Chapter 292, Statutes of 2018), which requires an entity that intends to merge with a health plan to give notice to, and secure prior approval from, the DMHC Director. This bill applies to health plans that merge or acquire other entities, like a physician group, for example. The bill also
permits the Director to forward to the AG information related to a disapproval when the transaction would have substantially lessened competition in a health system or among a particular category of health care providers.
“Although opponents have tried to argue that consolidation helps integrate care and control costs, it appears that only their studies show that – not the many objective studies that show these types of transactions in health care have, in fact, resulted in higher health care costs and profits for the corporations rather than lower costs for patients and health care consumers,” said Wood.

operable or be removed from acute care service by January 1, 2030.
“These hospitals are literally lifelines to Californians in our more rural communities and most do not have the financial resources nor the ability to acquire funding from other sources to meet seismic requirements,” said Wood. “There has to be a way to move forward to keep these hospitals open as they work to meet these standards.”
Existing law established the Small and Rural Hospital Relief Program administered by the Department of Health Care Access and Administration (HCAI), which provides grants to small and rural hospitals to assist planning efforts to meet seismic requirements.
AB 869 will require HCAI to provide grant funding, when appropriated by the Legislature, to financially distressed small rural and
district hospitals in order to meet these seismic requirements and would provide the ability to delay the requirement. When funds are not available for small rural hospitals and estimated seismic costs exceed the larger of $1 million or 2 percent of hospital revenue, the hospital will not be required to meet the 2030 requirements until funds are available. In addition, financially distressed district hospitals more than 30 minutes or 30 miles from the nearest hospital would also not be required to comply with 2030 requirements until funds are available.
“The hospitals covered by this legislation are often the only hospital in the county with the next hospital many miles away and any closure would jeopardize the health of the community and its ability to respond to emergency situations and just cannot be allowed to happen,” said Wood.

Yurok Tribe, US Marshals Partner on Missing and Murdered Indigenous Persons initiative
The Yurok Tribe in northern California has been selected as the first pilot location for the U.S. Marshals Service Missing and Murdered Indigenous Persons Initiative, as part of the agency’s plans to develop tribally-led collaborative partnerships to proactively examine public safety issues – particularly those involving missing endangered children.
Utilizing virtual and in-person meetings beginning in January 2023, the initiative brings together personnel from Yurok Tribe and USMS to share information, identify goals, and develop strategies for improving public safety for Yurok Tribe, its members, and the broader community.
“It is my sincere hope that by dedicating resources in Indian Country and partnering with the Yurok Tribe, U.S. Marshals will help address the problem of missing children from the Yurok Tribe and assist with other public
safety initiatives, such as ensuring that registered sex offenders in the area are compliant with their statutory requirements,” said U.S. Marshals Service Director Ronald L. Davis. “We are fully committed to supporting the Yurok Tribe’s efforts to keep their communities safe.”
“The Yurok Tribe is extremely grateful to partner with the US Marshals Service on this important and timely initiative,” said Joseph L. James, the Chairman of the Yurok Tribe. “The knowledge and tools we will gain from this unique partnership will significantly increase our capacity to keep our community safe.”

Redwood Parks seeking applicants for Youth Corps
Redwood National and State Parks is seeking enthusiastic local youth aged 15 to 18 to apply for Youth Conservation Corps jobs this summer. This highly successful program offers local teens a chance to participate in conservation work throughout Redwood National and State Parks.
This year’s eight-week
program begins on June 26th and ends on August 18th. A total of 10 enrollees, five young men and five young women will be selected from Humboldt and Del Norte counties at a public drawing.
Participants will be paid the California minimum wage of $15.50 per hour for a 40hour work week, M – F, 7:00 AM to 3:30 PM. All partic-
ipants must bring their own lunch and provide their own transportation to and from either the parks’ headquarters building in Crescent City or the National Park Service’s Arcata office. Housing is not available.
Specific work projects include construction & maintenance of trails and bridges; invasive vegetation species
removal; maintenance around historic structures; assisting the prescribed burn program and wildlife biologists. Participants will be required to do hard physical work, hike long distances, and may be exposed to insects, poison oak, adverse weather, and difficult working conditions. Natural and cultural resource education is incorporated into the eight-week program. No prior experience is needed, just an eagerness and willingness to make a difference and
try your best.

John F. Barnum, 63, passed peacefully February 7, 2023.
John was born in Crescent City and grew up in Smith River. He attended Del Norte High School. His first job was at Dahlstrom & Watt. In 1977, he relocated to Santa Maria, worked in the oil fields, sold cars for local dealers and later the grocery industry.
John owned and operated Early Bird Landscape before his retirement in 2017. John had a strong work ethic and provided a good life for his family. John enjoyed cigars, owned classic cars, was an avid sports fan and animal

lover. He had an amazing rose garden and delighted spending time at his BBQ pit with family. His laughter and charming sense of humor will be greatly missed. John’s memory will live on in the lives of his survivors, daughter Lauren, lifelong partner Tami, sisters Pam Johnson (Joe), Marsha Robinson & family, niece Christina Codazzi (Eric, son AJ), nephew Jeff Johnson (Melissa & children), extended family and friends. Stanley Ray Tow was brought into this world by Christine Splitstone and Jim Tow. Stanley was also blessed with a loving parent named David Splitstone who is married to his mother Christine Splitstone. Stanley, age 55, born on August 31, 1967, in Sacramento, California, and left this world on February 1, 2023, peacefully in his sleep at his home in Crescent City, California.
Stanley was a loving son, father, grandfather, and devoted partner. He loved working on things with his hands like cars, and bicycles, working in the yard, and putting anything together that was put in front of him. Stanley was a kind and gentle man; he loved being around the kids and loved his man cave. There wasn’t anything Stanley wouldn’t do to help others. For fun, Stanley
would take his fiancée Lazell out for dinner and spend a little time at the casino, or just sitting together to watch a movie. Stanley was a man of many accomplishments and had many friends including Sonnie, Diego, and others. He also had a very special bond with his son-in-law Terry, his cousin Bert, and his friend Wendy. He loved coloring, talking, and doing housework with Dianna, his mother-inlaw. He was loved by so many and will be missed by more than can be named here.

Wanda Shafer
Wanda Shafer passed away on February 22, 2023. She was 99 years old. Wanda was graceful, giving, caring, thoughtful and kind to all. She enjoyed every moment she could with family and friends.
Wanda was and always will be the center of her large family. She was born in Nephi, Utah on September 09, 1923, to Deon and Al Hansen. She grew up in Goshen, Utah. She graduated from Payson High School in 1941. She moved to Salt Lake City, Utah where she met the love of her life Harold Shafer. They were married in Monahan, Texas on June 29, 1943. She rode a train alone from Utah to Texas, so they could be married before Harold was deployed to WWII. He returned in 1945 and they began their life together in Klamath, California. They ran a logging truck business for 40+ years.
Joshua David, Callie, Jacob, Jordan, Romeo, Terry Jr, and Noah Ray. The mothers of the children are as follows Kelly, Melissa, and Lazell. Stanley was and will always be a loved man and will be missed and never forgotten.
Yurok Tribal Law Enforcement, data analysis, public outreach, or other efforts with the USMS Sex Offender Investigations Branch, regional missing child coordinator and local deputy U.S. marshals.
Tribal and USMS personnel recently met to discuss the newly formed partnership and potential collaborations on projects pertaining to sex offender registration and enforcement, missing children and fugitives from justice. After the in-person meeting, USMS connected the Tribe

They raised three boys.
In 1970 they moved to the home where they spent the rest of their lives. Wanda’s home was the family gathering place. It was filled with sunshine and beautiful flowers. She brought beauty and light to the world. She had very close bonds with her sons and grandchildren. She loved her family and her life. She loved gardening, ceramics, and painting. Wanda spent her retirement enjoying her flowers, grandchildren, and great grandchildren. She was never too busy to visit. Wanda was an example of a great American life.
She was preceded in death by her husband Harold Shafer, daughter-in-law Carol Shafer and grandson Gabriel Shafer.
She is survived by her sons

with staff from other Department of Justice components, including the Office of Justice Programs, the Office of Community Oriented Policing Services, and the Office on Violence Against Women.

Against Women Act roundtable meeting in late September 2022 attended by Yurok Tribal Court Judge Abby Abinanti, who provided valuable feedback about the MMIP Initiative that USMS was already planning. USMS personnel then attended the 1st Annual Northern California Tribal Policy Summit on Missing and Murdered Indigenous People, hosted by Yurok Tribe, and had the opportunity to interact with Yurok Tribe personnel about their ongoing efforts. The longstanding work of Yurok Tribe, combined with these newly-forged relationships, led to the selection of Yurok Tribe as the first pilot site.

CR presents: RedWoodshop: A Showcase of CR Woodworking
The College of the Redwoods Art Gallery will present an exhibition of exceptional furniture creations by CR woodworking students and faculty from Feb. 28 to March 23. The show includes fine handcrafted tables, chairs, dressers, and wall cabinets - some with elaborate marquetry detail - all made in the modern woodshop on CR’s Eureka campus. A public reception will take place at CR Art Gallery on Wednesday, March 8, from 3-5 p.m.
The CR woodworking
program features both introductory and advanced instruction. Students with no prior knowledge or experience can learn to safely use both hand and power tools in the Survey of Woodworking Technology course. The woodworking program at CR is furniturefocused and offers students an opportunity to be creative, while learning valuable life skills that have both professional and community applications.
Visitors to the gallery show will have an opportunity to try out a
