Following impassioned remarks by councilors, the
Brookings City Council has voted to retain City Manager Janell Howard for the duration of her two-year contract signed in January.
During its June 12 meeting, the council voted three-to-two in opposition to Councilor Andy Martin’s motion to terminate Howard’s contract immediately and without
cause.
Noting that the community is divided “because of how the city council has handled the situation” Martin, in his remarks presenting the motion said “apparently, some, sitting up here beside me have not heard what our constituents are saying.” He pointed out that Howard’s
“no contest” plea to theft from Fred Meyer last July, for which she paid $15 for two items, and a $500 fine, has caused a loss of trust in Howard.
Recognizing that the council needs to put the matter to rest Martin said, “I would much rather be focusing our time working on solutions to workforce
housing…addressing homelessness and transient issues in Brookings and discussing economic development.”
Councilor Ed Schreiber, who voted no to the motion, in his comments on the vote, expressed the need for the council to consider the consequences of the motion.
If Howard were terminated immediately and without cause Schreiber said, citing discussions he had with the city’s human resources department, if the city were to adopt the motion it would be required to pay Howard approximately $242,000,

The roads into Sports haven Beach will be closed all day, and the Coast Guard will close the bar at 9 p.m. The show is scheduled to run 20 minutes and the Coast Guard will reopen the bar then.
Curry County man arrested for murder

A 23-year-old man is facing murder charges after local law enforcement officials launched a homicide investigation at a home on Winchuck Road.
The Curry County Sheriff’s Office received a 911 transfer call from the Brookings Police Department shortly after 1 a.m. Saturday, June 17, regarding a suspicious conditions call of a male subject on the porch at a residence on Winchuck River Road. The caller reported the
male subject’s face was cut up and that there may have been an accident.
Curry County Sheriff’s Office Sgt. Jason Thien responded within a few minutes and contacted the male subject, identified as 23-year-old Jon Bourelle.
During his contact with Bourelle, Thien learned information from Bourelle that led Thien to the residence of 59-year-old James Bourelle. Thien checked that residence and found James Bourelle deceased from an apparent homicide.

The investments will help strengthen the state’s behavioral health workforce, stabilize mobile crisis funding, and support response and recovery resources to ensure access to high-quality, affordable services for everyone who needs them, according to the legislative leaders.

CCSO K9 Deputy Nero put to rest

The Curry County Sheriff’s Office (CCSO) has announced that K9 Deputy Nero has been put to rest.
“It is with very sad news that our beloved K-9 Deputy Nero has crossed over the rainbow bridge today,” CCSO stated in a Facebook post.
Due to his increasing problems with his medical issues, it was determined that it was best to lay Nero down to rest because of his constant pain, according to the CCSO.
“Even with his medical problems, he never stopped wanting to work even though his body said otherwise,” the post states.

California came to support Deputy King and pay their respect to Deputy Nero when oit was determined that the K9 would be laid to rest.

The Curry County Sheriff’s 911 Dispatch center received a 911 call June 14, from a person reporting debris from a boat on the beach just north of Sisters Rock, close to milepost 315 off Highway 101 between Port Orford and Gold Beach.
Officials issued a call to the U.S. Coast Guard, and also asked that if any law enforcement was in the area, to get eyes on, take photographs and report back.

K-9 Deputy Nero joined the CCSO after a donation in May 2020. Nero was certified from the Redwood National Parks law enforcement.
“Nero was assigned to Deputy Tim King and they formed a bond that was unbreakable and remarkable,” the post states. “Unbeknownst to us at the time, Nero had some pre-existing medical problems but he worked hard for Deputy King and
together they took care of business”
The CCSO said one of Nero’s greatest finds was three pounds of methamphetamine during a search warrant. Nero had several apprehensions and numerous surrenders under his collar during his three years of devoted service.
“K-9 Deputy Nero had a reputation that put fear into the minds of criminals,” the post state. Deputy King is in the process of training and working another K-9.
CCSO deputy stuck on hillside gets help
earlier in that area, and the debris was more than likely from that boat that was already investigated.
A Curry County patrol deputy arrived in the area and met with the 911 caller.
Deputy John Mackenzie walked down the beach along the shoreline to reach the area where the debris was located, according to a release from Curry County Sherrff John Ward.
MacKenzie had decided to try and climb a steep embankment to get a better photo shot of the debris and found himself in a predicament where he was stuck on the hillside and could not go up or back down safely.
Mackenzie was able to radio out to dispatch for
help. The Curry County SAR rope team was asked to respond. Gold Beach Police Chief Jordan White and Curry County Sheriff John Ward responded to the area and assisted the SAR rope team.
White rappelled over the edge and attached a harness to Mackenzie and then lowered him about 50feet back down to the beach floor.
Mackenzie was uninjured except for his pride, according to Ward, who thanked his deputies and administration and the SAR members who responded, Craig Rasbury, Tad Bell, Mike Merica, Brandon McGinnis, Jesse Fletcher and Art Tarin.

Walkout needs a constitutional solution

It’s time to acknowledge, after watching this year’s Oregon legislative session, that Plan B didn’t work, and Oregon needs to try Plan A.
Both plans concern the same problem: Just over a third of the state’s legislators in the House or Senate can prevent that chamber from assembling a quorum, without which it can conduct no business.
In recent years, and at present, the minority keeping the state from doing its job has been Republican. Further in the past, that has been, and possibly at some point in the future could be, Democrats. Either way, there now is no reason to believe that any discontented group amounting to slightly more than a third of the seats of either legislative chamber has any incentive to allow the state’s business to be conducted if it wants to block a proposal it opposes.
This happens because Article 4, Section 12 of the Oregon constitution says, “Two thirds of each house shall constitute a quorum to do business, but a smaller number may meet; adjourn from day to day, and compel the attendance of absent members.”
That part about compelling hasn’t worked very well.
The current setup is a recipe for destruction of a third of Oregon’s state government, since one party or the other will always be in the minority. The quorum-denying tactic now is being used so regularly –over simple differences of policy or philosophy – that it is eroding the ability of the state to operate.
An overwhelming majority of Oregon’s voters appear to see it that way.
Last November, after a string of quorum-killing walkouts in recent years, a group of petitioners offered Measure 113 in an effort to end the practice. It amends the state constitution so that any legislator who racks up 10 or more unexcused absences in a session is disqualified from serving in the Legislature in the following term. The measure got approval from 68.3% of the voters.
Probably most of those voters, and apparently most political watchers around the state, thought the penalty would be strong enough to end the walkouts. It wasn’t, as Oregonians now know: 10 senators (nine Republicans and one independent) have stayed away more than 10 working days, without excuse, thereby triggering last year’s penalty against them, barring them from serving as a legislator after their current term.
That done, there’s no more penalty to impose. The striking legislators say they are unbowed and will
allow no work this session (including on bills they themselves support) except for the state budget, and no path if the Democrats insist on maintaining certain bills, including House Bill 2002 on abortion rights and gender-affirming care, as they are now.
That so many Republicans (and one aligned Independent) proved so willing to give up their seats was widely unexpected and also remarkable. It provides the clear evidence that Measure 113 has failed.
The good news is that, all along, it was Plan B. Time has come now to take another crack at Plan A.
The right way to approach the two-thirds quorum problem from the beginning would have involved a constitutional amendment, but more directly: Change the two third requirement in the constitution section quoted above, to a simple majority (50% plus one). That would allow just over half of either chamber to conduct business.
It’s easy to understand, clear and would solve the problem.
It’s also been discussed before, at length.
In 2019, amid another walkout, then-state Senator Ginny Burdick said she would promote a proposed constitutional amendment to set the Legislature’s quorums – for each body – at a simple majority for each chamber (16 members of the Senate or 31 members of the House). Just such a resolution to amend the constitution with a popular vote was introduced early in 2020 and progressed through a public hearing and work session. Then steam seemed to run out of the effort, and it died in committee without reaching the Senate floor.
Another bill is now being proposed by Reps. Khanh Pham of Portland and David Gomberg of Otis. The idea is not radical. Oregon currently is an outlier when it comes to the quorum numbers. Among the 50 states, only four states – Oregon, Indiana, Tennessee and Texas –mandate two thirds. (Is it coincidental that all four have experienced troubled legislative sessions this year?)
The Oregon Legislature this year probably won’t be able to act to place a constitutional amendment on the ballot, but the same forces that developed the petition campaign for Measure 113 last year, and pushed through its approval, probably could. Or someone else could step forward.
Either way, if Oregonians expect to have their ballotexpressed will carried out at the statehouse, the next step is obvious.

Asking for full transparency
After reading former Curry Commissioner Sue Gold’s response in your paper last week, I think the best way to determine the facts and truth is to have a healthy Town Hall Debate.
Anyone who has been on a Public Payroll has a responsibility to defend their decisions, their record, and their votes. I’m anxious to go before the citizens, answer any questions and explain what happened to their hardearned Taxpayer Dollars during the six years I served. The colossal waste could have easily been avoided and I made every effort toward that end. Unfortunately, I was almost always outvoted.
I can plainly show the damages since early 2017 to our county finances, largely due to the horrible Gold decisions and the messes she created and left. We should all be willing and have the honor to be held fully accountable. Granted, we may never get many documents returned that were recently ransomed, however there is substantial data still on file to prove my claims. The Commissioner YouTube Archived Meetings are likewise a good place to start.
I doubt Sue Gold will accept. Likely instead, she’ll file another lawsuit, but I am hopeful we can immediately set up an important cordial debate forum. Curry County deserves to be defended!

Utter frustration
As a longtime Brookings property owner and full-time homeowner and resident for the past four-plus years, I’ve written several letters to the editor on a variety topics of concern to me personally.
Am writing now to express my complete and utter frustration with our elected city council for the permanent reinstatement of Janell Howard as city manager. This individual, by virtue of her arrest and no contest plea to a charge of shoplifting at our critically important Fred Meyer local store has foisted division and uncertainty within our community.
Police officers and no doubt other key staff members have resigned while public confidence in city government is at an all-time low. I wrote to the mayor and city council, following Ms. Howard’s previous restatement stating: “If you’re incapable of competently running our city government, then at least do the right thing and resign now. I’m reiterating that suggestion at this time with the exception of the two council members on the losing end of a recent 3-2 vote to terminate Ms.Howard’s employment without cause.
The decision appeared to be based solely on money, claiming that it would cost taxpayers - of which I’m one - $240,000 to retain her. This raises the obvious question: What will it cost to continue to pay her at her current salary of $150,000 plus annually? Do the math, folks.

Gas pumping and recycling
If it hasn’t happened already, I hope that the law will change in Oregon allowing motorists to pump their own gas, including dispensing it into 1 gallon plastic containers - walk up. I’ve read that in San Francisco police are earning $200,000/year, even some retired cops that retired at younger-than-60 ages. Yet their high pay is not translating into better average behavior per citizen.
Yesterday I went to the Chetco Library to return a book and turn in some cardboard for recycling and walk over to get gas at the nearby gasoline station. I got that all done then went and bought some groceries leaving my car in
the library parking lot which is legitimate. Cities ought to provide free parking lots so people do not have to stop and go to and from about 5 errands they have planned at various close to each other businesses or government services. Anyway, at the library parking lot were some people loitering. Of course it was a federal holiday yesterday but this happens all of the time at the library. Why not have steel can recycling at the library area, where people would have jobs weighing and inspecting what you bring there and giving you money in return? Oregon is not that poor of a state. More could be spent on recycling instead of paying gas pumpers and as in California police making, I do not know how many multiples of what people at Dollar Tree stores earn — minimum wage.

Impact of court ruling
First the Clean air Act and now, sigh, the Clean Water Act is abused by Supreme Court decisions.
The EPA is our “we the people” agency responsible for ensuring we follow these 50 year old critical laws. They are the people that study and understand the latest watershed research. Underground and ephemeral waters are important watershed components not just the water adjacent to lakes, rivers and streams. Wetlands and drainage areas filter our water at no cost to us.
This Supreme Court ruling will damage water flow with fill that will take lots of money and generations to restore. Why are we not erroring on the side of caution with our water sources? When was the last time any of the Supreme Court justices had a course in watershed management?
The Supreme Court could have ruled on the Sackett vs EPA case without adding the ‘adjacent ‘ verbiage to their decision. What in holy crayolas was their agenda for that? These rulings aren’t something that can be fixed in the next political cycle.
These rulings are generational in their consequences. Please, for our grandkids sakes listen to the experts

Private and federal trusts
I have completed an interesting analysis regarding the Social Security (“Trust Fund”), brought on by the continued threat from Congress to cut back or end the program.
After studying the “GAO January 2001-Federal Trust FAQs documents, I now have a better understanding of the difference between Private and Federal Trusts.
I do take exception to the fact that as stated in GAO Q1.2/A1.2 “the federal government does not have a fiduciary responsibility to the trust beneficiaries, and it can raise or lower future trust fund collections and payments or change the purposes for which the collections are used by changing existing laws.”
Since the funds are taxed on wages with the understanding that their purpose is to help meet the long-term financial needs of the elderly I believe the federal government does have a fiduciary responsibility to the Trust.
The government’s own documents specifically state in GAO Q2.4/A2.4 that “One rationale for earmarking revenues to finance long-term commitments is that the benefits are financed by the contributions made by the beneficiaries.”
I too have considered some solutions to the growing problem within the Social Security program and agree that there is clearly a need to increase the FICA and SECA rates and to remove the cap for the high earners to make the program viable in the 21st and 22nd centuries.
There is much still to be done for the future of the program, but the program must continue for the sake of our nation’s long-term financial health.

Joyce Hand
Joyce Hand, a long-time resident at Sea View Senior Living, passed away on 6/3/23. She was a great neighbor and friend. Staff members recall her loving smile and her kind and friendly nature. “She made our work moments feel good”.

Michael J. Hanscam
Michael J. Hanscam passed away peacefully from liver cancer while at home in Alaska on June 11, 2023, surrounded by family. He was 72. Born on May 16, 1951, in Eugene, Oregon, he grew up in Brookings with his mother, Marian, older brothers Charlie and Norm, and many extended family. He loved the beaches and rivers of southern Oregon, from a young age delighting in fishing with his grandfather and exploring the coast. He played football and ran track for BrookingsHarbor High School, achieving a school record in the long jump that still stands today. He attended Lewis & Clark College in Portland, graduating in 1973 with a BS in English. While in college, he had the opportunity to spend a semester

He expressed concern about the position being vacant upon Howard’s termination, necessitating the hiring of a city manager pro tempore, a position Oregon law limits to
abroad in Afghanistan where he made life-long friendships, reporting on the experience for the local Brookings paper. He went on to get a MS in Education from Southern Oregon State College in 1976, while also building his first boat, the Mowgli. He taught elementary school in Florence, and later in Brookings from the late seventies to early eighties, taking a year off to go lobster fishing. In 1984, Mike traveled to Anchorage to visit a friend and ended up being offered a teaching job at O’Malley Elementary, leading him to promptly move to Alaska. Named a BP Teacher of Excellence in 1999, he spent the rest of his teaching career at O’Malley, retiring in 2012 after 28 years of encouraging 3rd through 6th graders to be curious about the world, love science and value the outdoors. He treasured the times students returned to visit him over the years.
In 1985, Mike met Alice Gould, a nanny for one of the children in his classroom. Together they went winter camping, mountain biking, and commercial fishing, and by 1988 they were married. Their eldest daughter Emily was born in 1990, with her sibling Beck three years later. Mike continued to build boats throughout his lifetime, commercial fishing in both Oregon and Alaska, and relished taking his family out to Prince William Sound on extended camping and fishing trips. Their time together in the Sound created incredible memories his family will always delight in, especially that one time when he flipped the zodiac and that other time, he caught a halibut well past midnight. He went dipnetting on the Kenai every summer and was constantly experimenting with new smoked salmon recipes. He loved to watch bears, birds, and whales (except when they were scaring away his fish!). Mike adventured often and far, traveling three times to join Emily’s archaeology dig in Romania, touring the Outer Hebrides, and hunting cool rocks in Iceland and Norway. Later in life, he and

six months. During that time, he said, the city would be searching for a replacement; a difficult task in today’s labor market, when local firms are having great difficulty recruiting, the cost of housing is high, and if an out of state candidate were available, he or she would likely not be familiar with Oregon law. Mike took life in stride with a wonderful sense of humor, could hold you captive by his storytelling and was a devoted 12th Man (Go Seahawks!). Everywhere he went, he made life-long friends. Mike is survived by his wife Alice Hanscam, children Emily Hanscam and Beck Hanscam of Anchorage, mother Marian Rambeck and brother Norm Hanscam of Brookings, Oregon, his step-mother, Sharon Hanscam and her family, a number of nieces and nephews, and one grandniece. He is preceded in death by his father, Elmer Hanscam Jr. and his brother Charlie Hanscam. In lieu of flowers, we encourage donations to go to the ‘Michael Hanscam Science Education Fund’, which is being created to support the outdoor education of elementary school children in the Anchorage area. A party celebrating Mike’s life will be held on Sunday, July 9th at the Turnagain View Lodge in Indian, Alaska, followed by another later, on July 15th in Brookings, Oregon at Loeb State Park. Police issue Green Dot fraud alert

The Brookings Police Department (BPD) has issued an alert to local residents concerning ongoing scam attempts involving Green Dot cards.
Bona fide government agencies and utility companies do not request payment via Green Dot, the Brookings Police alert states.
“A recent common scam is a phone call indicating the victim has won a large sum of money but needs to go and buy a Green Dot
card to pay the taxes and/or fees in order to receive the award,” according to BPD
Once the victim supplies the scammer with the Green Dot card, their money is gone.
Here are other common scams involving Green Dot cards: Scammer claims to be with a law enforcement agency and Green Dot card money is needed to “pay off” a warrant. Law enforcement will not call and request money if you have a warrant. Scammer claims to be a family member in need.
Fire season brings caution
Scammer claims to be with the IRS and Green Dot money is required to pay back-taxes. Scammer claims to be with the power company and Green Dot money is required to prevent disruption in service.
“Be immediately suspicious if someone calls you and demands payment via untraceable electronic means,” the BPD alert states.

The Fire Season officially began June 9 and fire agencies are urging public caution and placing restrictions in local timbered areas.
The Coos Forest Protective Association (CFPA) said the start of fire season activates restrictions for both public and industrial forest use on all public, private, county, state, and Bureau of Land Management (BLM) lands within CFPA’s District
boundaries.
The start of fire season means the end of unregulated, outside burning for rural Coos, Curry and western Douglas Counties. The outside burning of debris piles and the use of burn barrels will be prohibited until fire season is terminated.
Residents living within an incorporated city need to contact their local fire department for burning restrictions and permit details.
Under Oregon law, the use of tracer ammunition
and exploding targets is prohibited during fire season, and the use of sky lanterns is prohibited yearround.
Regulated Use restrictions will also be implemented, putting restrictions on public activities based on daily fire danger levels. As fire season progresses, additional closures and restrictions may be imposed.

Legislation increases housing options in rural Oregon

During the final days of the Oregon Legislature, the Oregon Senate approved Senate Bill 1013, a measure to allow siting of one recreational vehicle (RV) on a rural residential zoned property, increasing housing options in rural Oregon.
Current regulations limit rural residential properties to a single dwelling and define “rural use” as one dwelling per ten acres. Recreational vehicles (RVs) are defined in statute as vehicles with or without motive power that are designed for use as
temporary living quarters. Current law restricts local governments from prohibiting the placement or occupancy of an RV, or from imposing any limit on the length of occupancy of an RV as a residential dwelling, provided the recreational vehicle is located in a manufactured dwelling park, mobile home park or recreational vehicle park, a release from the Oregon Senate Republican states.

responsibilities the Legislature was tasked with this session was finding ways to increase the supply of housing and stabilize Oregon’s workforce,” Hayden said. “We often struggle to find employees to fill essential jobs in rural communities in part because there is nowhere to rent. Senate Bill 1013 is a low-cost opportunity to provide suitable housing options for people looking for employment while boosting Oregon’s rural workforce. I appreciate the efforts of Commissioner Tootie Smith who brought this concept to my office.”

Union takes accountability issues to voters

The United Food and Commercial Workers Union (UFCW) Local 555 has filed five statewide measures for the Oregon 2024 General Election designed to expand transparency and accountability of public officials, as well as encouraging financial responsibility in hospitals and protecting the rights of workers in the growing cannabis industry.
“UFCW 555 is fighting to restore accountability and create transparency, as well as bring about smart campaign finance reform and much needed worker protections,” UFCW 555 Communications Coordinator Miles Eshaia said. The ballot measures filed June 9 are summarized below.
IP-31: The Lawmaker Accountability ActRestructures the Ethics Commission (which is currently selected by the lawmakers which the Commission is meant to oversee) to be independently appointed by the Chief Justice of the Oregon Supreme Court. The act also includes a provision requiring lawmakers to report misconduct that they are aware of and would provide for greater transparency of records with regard to elected officials’ misconduct.
IP-32: The Legislative Transparency Act - Closes the loophole that allows lawmakers to meet and deliberate in secret, requires that partisan caucus rules be made public, and prohibits the “selling” of public committee positions through political contributions.
IP-33: Hospital Transparency - Prevents hospitals and health care systems from playing the stock market with their funds and requires hospitals and health care systems to publish certain information about their income, costs, and investments.
IP-34: Smart Campaign Finance Reform - Creates contribution limits for donations to candidates and other political committees, ensures that voters can see who is responsible for political communications, and sets up a matching fund system for smalldonor-powered campaigns. (This measure avoids the loopholes and unanticipated drawbacks that are in other similar measures.)

Senate approves bill to assist small businesses

The Oregon Senate passed Senate Bill 1048 during the last few days of the Oregon legislative session. The bill directs the Oregon Department of Transportation (ODOT) to establish a small business development program.
The program is designed to aid qualified small businesses to compete for ODOT public improvement contracts.
“This bill will make sure that Oregonians’ hard earned tax dollars are wisely used to repair our essential transportation
infrastructure and boost our small businesses, which will support and create jobs in communities around the state,” Senator Aaron Woods (D - Wilsonville) said. “Oregon’s small businesses are always a smart investment.”
Oregon Senate Democrats’ 2023 Oregon Works agenda prioritizes investing in and growing Oregon small businesses,
which support thousands of family-wage jobs around the state.

I grew up in Livingston, Montana, where the Yellowstone river flows fast and strong out of Yellowstone National Park. Being the largest volcano on the planet, and having erupted many times, this region is filled with many examples of the wondrous geological goodies vulcanism creates, such as Agate, Jasper, Petrified Wood, crystals, and fossils. Oregon shares this type of geological activity and also produces similar minerals. Rockhounding for these magical specimens has been my favorite hobby for many years, and now I’ve brought this passion with me to Brookings.
After remodeling the old Post Office space in the Harbor Shopping Center, my dream of opening a rock shop materialized at the end of January when we opened our doors! I’m pleased by the wonderful reception I’ve received and am encouraged by the level of enthusiasm expressed by everyone here who also loves rocks. ODOT issues data breach alert

A data breach has put the identities of 3.5 million Oregonians who hold ID cards or drivers licenses at risk, according to the Oregon Department of Transportation ODOT.
The agency states in a release that it is among many organizations affected by a data breach inflicted by a global hack of the data transfer software MOVEit Transfer.
Since 2015, ODOT has used MOVEit Transfer, a popular file sharing tool created and supported by Progress Software Corp that allows organizations to securely transfer files and data between business partners and customers.
On Thursday, June 1, 2023, the Cybersecurity and Infrastructure Security Agency issued a zero-day vulnerability alert stating that PSC had released
a security advisory for MOVEit Transfer, and that the software had a vulnerability which could allow an attacker to “take over an affected system.”
“We moved immediately to secure our systems and are confident that they are working safely,” the ODOT release states.
ODOT officials said the agency worked closely with state cyber security services and engaged a third-party security specialist for analysis.
“Our analysis identified multiple files shared via MOVEit Transfer that were accessed by unauthorized actors before we received the security alert,” ODOT Officials said.
On Monday, June 12, ODOT confirmed that the accessed data contained personal information for approximately 3.5 million Oregonians. While much of this information is available broadly, some

Scams targeting the elder population are on the rise according to the Oregon Division of Financial Regulation (ODFR). Financial abuse can happen to anyone at any time, but seniors are often the target.
According to estimates from the University of Southern California’s Center for Elder Justice, every year 5 million older Americans – or 1 in 10 –experience elder abuse, neglect, or exploitation. Of those, 1 in 24 cases of abuse are reported and total losses are between $2.6 billion to $36.5 billion.
The ODFR asks everyone to be on the lookout for the financial exploitation of seniors.
The purpose of World Elder Abuse Awareness Day is to provide an opportunity for communities around the world to promote a better understanding of abuse and neglect of older people by raising awareness of the cultural, social, economic, and demographic processes affecting elder abuse and neglect.
Scammers use several tactics to gain trust from seniors in order to steal their finances. Unfortunately, some of these offenders are the guardians who are responsible for acting in the person’s best interest.
Guardians are often a person the senior trusts and is granted control of the person’s assets. Financial abuse or exploitation often occurs when the guardian improperly uses the financial resources of a senior.

Senior financial exploitation can be difficult to identify. Here are six examples to watch for:
A new and overly protective friend or caregiver, especially if the senior is considering surrendering financial control to the person.
Fear of someone or a sudden change in feelings about them.
A lack of knowledge about financial status or reluctance to discuss financial matters.
Sudden or unexplained changes in spending habits, a will, trust, or beneficiary designation.
Unexplained checks made out to cash, unexplained loans, or unexplained disappearance of assets (cash, valuables, securities, etc.).
Suspicious signatures on the senior’s checks or other documents.
If you believe someone is being financially abused call 855-503-SAFE (7233). You can also visit the division’s protect yourself from fraud website for resources to prevent, report, and recover from financial abuse.
Oregon’s Senior Safe Act makes securities industry professionals mandatory reporters for suspected elder financial exploitation. Securities professionals, such as broker-dealers and investment advisors, should use the division’s file a suspected financial abuse report webpage when they suspect potential financial abuse of an Oregon senior.
50 cent surcharge on alcohol for mental health services nixed

Gov. Tina Kotek has dropped her request for the Oregon Liquor and Cannabis Commission to add another 50-cent surcharge to bottles of alcohol to fund mental health and addiction services. She asked for the surcharge in her February budget. But on Wednesday, she sent a letter to the commission’s board, saying the tax was no longer needed.
“Since my recommended budget was originally released, there have been two revenue forecasts indicating there will be sufficient resources to fund essential services in the next biennium without the surcharge,” she wrote.
“Additionally, I have been clear that I only support a new surcharge if the funds are directly allocated
to behavioral health services. Without further specific action by the Legislature this session, any surcharge approved by the commission would go into the general fund with no designatedpurpose, undermining the purpose of the recommendation.”
The Legislature has yet to pass a budget due to the continuing Republican-led walkout in the state Senate, which has brought floor votes to a halt. They object to a bill to expand access to gender-affirming care and guarantee abortion rights for minors. The session has to end by June 25, and a continuing stalemate will leave hundreds of bills on the table.
The surcharge would have doubled the tax on bottles of hard alcohol, raising $90 million over the next two years for behavioral health care and addiction services. The proposal was supported by advocates, primarily
Oregon Recovers, a Portland-based group that supports people in recovery. The group’s executive director, Mike Marshall, said in a statement that Oregon Recovers was disappointed by the decision.
“Oregon must change its destructive relationship with alcohol and raising the price of distilled spirits is the single, most effective action the OLCC can take to end Oregon’s alcohol addiction crisis,” Marshall said. “The Liquor Control Act empowers and mandates the OLCC protect Oregon taxpayers from the economic damage caused by alcohol consumption and protect Oregon consumers from the devastating health consequences due to the current industry-friendly pricing structure. OLCC commissioners must stop prioritizing their personal financial interests over what is in the best interest
of all Oregonians.”
The tax was opposed by many in the liquor industry, who said it would have a major impact on their revenue.
The commission had been gathering public comments on the tax and was due to vote on it on Thursday, June 15. A spokesman also did not respond to a request for comment by mid-afternoon Thursday.
The pullback drew praise from the industry. Tom Burkleaux, president of the Oregon Distillers Guild, released a statement thanking Kotek for her decision.
“We appreciate the governor’s office has listened to Oregon’s craft distillers about how this proposed increase would disproportionately hurt our local producers that make higher-cost, premium products,” the statement

On May 5, 2023, Rye Development, LLC, on behalf of Neptune Pumped Storage 1, LLC (the Applicant), filed an application for a preliminary permit, pursuant to section 4(f) of the Federal Power Act (FPA), proposing to study the feasibility of the Elephant Rock Pumped Storage Project to be located in Curry County, Oregon, near the Sixes River, approximately 12.5 miles east-northeast of Port Orford, Oregon. The sole purpose of a preliminary permit is to grant the permit holder priority to file a license application during the permit term. A preliminary permit does not authorize the permit holder to perform any land-disturbing activities or otherwise enter upon lands or waters owned by others without the owners’ express permission. The project would require constructing new water storage, water conveyance, and generation facilities at off-channel locations where no such facilities exist. It would consist of the following: (1) an upper reservoir with a surface area of 51.5 acres and a storage volume of 3,605 acre-feet at a maximum water-surface elevation of 2,070 feet mean sea level (MSL); (2) an 820-foot-long, 24-foot diameter vertical shaft that connects the upper reservoir to a 4,200-footlong horizontal power tunnel, having a horseshoe-shaped cross section approximately 450 squarefoot in area, leading to the powerhouse; (3) a 60-ft high, 40-foot-diameter steel surge tower connected to the power tunnel upstream of the powerhouse; (4) a 100-foot-wide, 500-foot-long, 100-foothigh reinforced-concrete powerhouse with four 79.5 megawatt (MW) Francis pump-turbine units, with a combined installed capacity of 318 MW, that discharge into the lower reservoir; (5) a lower reservoir, located adjacent to the powerhouse, with a surface area of 51.5 acres and a storage volume of 3,605 acre-feet at a maximum water-surface elevation of 1,150 feet MSL; (6) and a 15-milelong, 230 kV overhead transmission line extending from the powerhouse to the existing substation on Elk River Road, approximately 3 miles northeast of Port Orford. Both the upper and lower reservoirs would be created by zoned rockfill embankment dikes approximately 70 feet high and 7,200 feet in circumference. The project would have an annual generation capacity of 929,000 megawatt-hours.

On May 8, 2023, Neptune Pumped Storage 2, LLC filed an application for a preliminary permit, pursuant to section 4(f) of the Federal Power Act (FPA), proposing to study the feasibility of the Soldier Camp Pumped Storage Project (or project). The project would be located on Lobster Creek in Curry County, OR, approximately 4 miles north of the Rogue River. The sole purpose of a preliminary permit, if issued, is to grant the permit holder priority to file a license application during the permit term. A preliminary permit does not authorize the permit holder to perform any land-disturbing activities or
otherwise enter upon lands or waters owned by others without the owners’ express permission.

2, LLC has proposed to construct: (1) an upper reservoir with a surface area of 50 acres and a storage volume of approximately 3,000 acre-feet created by a 5,600-foot-long, 70-foothigh rockfill embankment ring dike; (2) a lower reservoir with a surface area of 50 acres and a storage volume of approximately 3,000 acre-feet created by a 5,700-foot-long, 70-foothigh rockfill embankment ring dike; (3) a 1,825 footlong steel and concrete penstock with a diameter of 22-feet; (4) a 550-footlong, 120-foot-wide concrete powerhouse/ pump station located on the lower reservoir shoreline containing 6 generating/ pumping units for a total generating capacity of 550 MW; (5) an approximate 13-mile, 230-kilovolt (kV) transmission line from a proposed substation near the powerhouse to an existing substation on Nesika Beach Dump Rd that would interconnect to
the regional transmission grid; (6) an approximately 1.7-mile-long underground pipeline with a 100 cfs capacity and a diameter of 2.5-feet diverting water from Lobster Creek for initial fill and annual maintenance fill; and, (7) appurtenant facilities. The proposed project would be operated as a closed-loop system and generate an estimated annual average of 1,606 gigawatt-hours.

State unemployment rate continues to fall

Oregon’s unemployment rate dropped to 3.7% in May, down from 4.0% in April, according to the latest Oregon Employment Department survey.
This was the fourth consecutive monthly drop in the unemployment rate, down from a recent high of 4.8% in January.

Over-the-month gains were largest in financial activities (+1,200 jobs), leisure and hospitality (+1,100), and transportation , warehousing, and utilities (+1,000). Declines were largest in retail trade (-500 jobs) and government (-300). Since May 2022, Oregon has added 39,100 nonfarm payroll jobs (+2.0%).

“This is a multifaceted challenge that requires the commitment of many stakeholders, including those in Oregon’s craft alcohol industries,” the statement said.
Additional funding will be set aside for increased Medicaid reimbursement rates for behavioral health services to support the rising costs and high demand for care, with the goal of increasing access to high-quality services throughout Oregon. By leveraging an existing and steady stream of funding, the legislative leaders said the can ensure certainty for providers, and in turn, for patients and their families.
“Oregonians are calling out for greater investment in behavioral health,” Senator Wlnsvey Campos (DAloha) said. “This package will provide meaningful relief to Oregonians with behavioral health needs and their families, by improving access to life saving and life changing care.”
A December 2021 nationwide survey showed that Oregon has the fifthhighest rate of alcohol addiction in the country, the second-highest rate for drug addiction and the second-highest rate of mental illness.
