While the impact of inflation and supply chain issues has been felt by all, it may be argued that the construction industry has been particularly vulnerable to its effects. Work depends on the availability of equipment and parts, as well as the ability to transport equipment and materials to the job site.

According to Tri-State Trailer Sales’ Pat Smrek, the trailer dealership gained important insight into the potential for supply issues impacting construction trailers during the initial Covid lockdowns.

“The dry van market was the first to see shortages mid 2020,” said Smrek. “The dry van market is extremely volatile and, when the pandemic drove a substantial increase in e-commerce, there was a subsequent increase in demand for box trailers. Within a month’s time, deliveries went from six weeks to six months and people were paying up to $70,000 for a dry van that had typically sold for $30,000.”

Recognizing that a similar situation could happen in the construction marketplace, TriState Trailer Sales went into action toward positioning itself to stay ahead of the curve to meet the needs of its customers. Along with building up purchases of new trailers, the company also dedicated itself toward locating available quality used trailers.

With the variety of manufacturers that TriState Trailer Sales represents, including Dorsey, Eager Beaver, Landoll, Manac, Transcraft and specialized trailers from Fontaine and XL Specialized, the dealership has a lineup capable of meeting the needs of small and large construction operations as well as those with unique hauling requirements. Depending on the manufacturer, lead times can vary widely for new trailers.

With used trailers in inventory, the dealership can often address a contractor’s more immediate needs. A high percentage of the used trailers acquired by Tri-State Trailer Sales are from end users with large fleets. The company also will occasionally purchase from auctions and wholesalers. Regardless of the source, every trailer the company brings in is run through service and receives a DOT inspection to ensure the trailer is ready to go to work when its sold. Smrek claims the new trailer market, used trailer market and trailer rental business are all interrelated. Strong demand and rising materials costs along with the increasing value of used trailers have been a doubleedged sword in the trailer market.

“The challenge in sourcing used trailers has been compounded by the fact that the lead time has increased significantly for new trailer purchases, so some companies are holding on to their trailers longer than the might otherwise,” said Smrek.

At the same time, some companies view the high value of used trailers as an incentive to trade in or sell their existing trailers.

“In many cases, owners are getting as much or more than they originally paid for their used trailers,” he said. “Because of worker shortages, a lot of companies don’t have the manpower needed to fix or properly maintain trailers so new or rented trailers are a viable option.” Because of the long lead time on new trailer orders, companies also are relying on Tri-State Trailer Sales’ rental division — TSTL Inc. — for short-term rentals to bridge the gap between ordering and receiving a new trailer. Additionally, This Fontaine Magnitude 60-ton modular beam trailer is typically used for hauling cranes, rock trucks and wheel loaders. some companies prefer rentals because the trailer is then not an asset they’re tied to. “Some companies view trailers almost as an afterthought, they’ll pay hundreds of thousands of dollars on a crane or excavator and then hire a freight company to transport it,” said Smrek. “Over time, those charges can add up. If they had invested in a trailer, they’d have greater flexibility in transporting their equipment while ultimately saving money in the long run.”

Slowing Its Roll

The association was happy when in May the DOT proposed slowing rollout of the Buy America requirements to allow for development of enforcement and compliance guidance.

Suspension of provisions was intended to “provide for strengthened enforcement over time,” according to the DOT.

During negotiations of the infrastructure legislation, AGC secured exemptions for concrete, asphalt and aggregates from the definition of ‘construction materials,’ the association reported.

“AGC supports this move by the department and will voice that during the comment period.”

At a time when transportation contractors are still facing historic disruptions to the material supply chain, “it is self-evident that more time and collaboration among industry partners is needed to be able to meet these new requirements,” said AGC.

Smolen and Park attribute the waiver to the inclusion of construction materials, which have not been previously subject to these rules.

“USDOT sought comments from affected industry participants as to whether to provide a broad, temporary waiver.”

The industry responded and the waiver came about. In doing so, the agency noted it would allow implementation of the Buy America requirements in a way not overly burdensome.

DOT issued the waiver in light of ongoing supply-chain issues and other regional challenges in sourcing domestic construction materials.

“The de-facto transitional period affords USDOT the time to develop the Biden administration’s enforcement and compliance mechanisms,” said the Ballard Spahr partners.

“It also provides state DOTs the time necessary to update their standards and specifications, allows contractors and industry participants to incorporate the relevant Buy America contract provisions and better informs the FHWA in addressing its noncompliance and oversight processes.”

Gauging Industry Hardship

AGC expressed concerns with the Buy America provision back in January, warning that Biden’s regulation could delay infrastructure projects funded by the law itself.

“The IIJA provides funding for physical infrastructure like roads, water systems, the electric grid, and more,” said the association. “The new and expanded Buy America requirements apply to all federally funded programs and include manufactured products, like iron and steel, and also construction materials used on projects within those programs.”

The AGC pointed out, too, that federal agencies had voiced concern over whether project sponsors would be able to complete projects with these requirements as they stand.

The association said at the time it was working with various agencies as well as other industry stakeholders in addressing this issue.

“Many products manufactured in the U.S. do not meet the requirements because some component or material used in production is globally sourced,” said AGC. “For instance, a pump manufactured in the U.S. that includes an impeller produced overseas does not satisfy the requirements.”

AGC considered EPA’s model “successful in getting funds out the door through its state revolving fund programs for drinking water and wastewater projects and still abiding by similar requirements since the Recovery Act of 2009.”

In July, DOT published a request for information on the provision requirements that specified construction materials be produced domestically.

The agency wanted to know how the requirement should be interpreted and implemented.

DOT wanted to gauge present availability of U.S.-produced construction materials commonly used and how the requirements might impact DOT-funded projects.

“AGC helped lead an effort with 41 other national organizations calling on the administration to extend the 180-day waiver to ensure that projects are not needlessly delayed,” the organization said. “AGC continues to be concerned about the current availability and pricing of construction materials and the unintended consequences that this new provision could have.”

The National Law Review noted that various federal agencies have historically implemented their own domestic materials provisions over the years.

Those have included standalone provisions that apply to particular grant and infrastructure projects.

The new guidance, however, is applicable to all federal financial assistance programs where funds are available for infrastructure projects, according to the Review.

This, regardless of whether the funding comes from the IIJA, although limited exceptions might be available for emergency response expenditures, said David Gallacher and Ariel Debin.

New rules and further updates are likely to be formalized in the coming months, they reported.

But if an agency has existing Buy America requirements that are more stringent than these new requirements, then these new requirements may be superseded by the more restrictive requirement.

“Interpreting the government’s various requirements can be tricky, especially where compliance with one does not necessarily mean compliance with another,” said Gallacher and Debin.  CEG

Battle Motors Picks T-Mobile to Connect New Software

T-Mobile announced on May 9 that Battle Motors has selected the Un-carrier as the preferred provider of IoT connectivity and management for thousands of new Battle Motors battery electric trucks rolling off the Ohio-based production line. These trucks are getting smarter, due to Battle Motors’ all new factory installed RevolutionOS EV software, according to the company.

Like consumer automotive, the commercial truck industry is moving swiftly to embrace EV technology. RevolutionOS, powered by T-Mobile’s nationwide network, delivers actionable data and information to drivers and fleet managers that they can use to enhance efficiency, safety and security, according to T-Mobile.

As part of this long-term agreement, TMobile for Business will deliver 4G LTE connectivity to Battle Motors trucks for near real-time sharing of battery range and usage information; historic and near real-time location and trip data; timely preventative maintenance warnings; over-the-air software and firmware updates; and the truck’s full bill of materials, such as VIN-specific information, parts and manuals.

Every new Battle Motors class seven and class eight heavy-duty EV truck — like those that haul garbage, dirt and freight — will come with a factory installed, ruggedized digital instrument cluster that runs RevolutionOS. The power and reliability of T-Mobile's nationwide network, Battle Motors’ RevolutionOS, will let customers view and update critical information directly from the truck, or remotely from a desktop computer or mobile device, just by scanning a QR code.

Additionally, T-Mobile Control Center will give Battle Motors the ability to view and manage the connectivity of their trucks. Battle Motors can easily accelerate deployment of their growing line of trucks with the automation and provisioning capabilities of T-Mobile’s IoT platform. Battle Motors will have near real-time visibility to all its commercial trucks with the ability to monitor network conditions and device behavior with T-Mobile Control Center.

In the near future, Battle Motors expects to leverage the Un-carrier’s 5G network to meet industrial-sized challenges for years to come as their trucks’ capabilities advance and the demands on connectivity increase. TMobile is poised to push IoT to its full potential and catapult adoption — paving the way for new electric vehicle applications that rely on low-latency, high-speed data, and realtime location and proximity-based services.

He said R&T’s acquisition of the machine was a lengthy process that began with him bringing a group from Doosan to the contractor’s facilities in late 2019 to help answer questions about the new dozer — at that time still in the conceptual phase.

“Ratoskey & Trainor owned a lot of other brands of dozers,” Cencetti said. “Doosan officials asked if they would consider a Doosan dozer. At that point, R&T had 15 to 20 Doosan excavators, wheel loaders, haul trucks, etc., so they said, ‘Of course, we would.’ Ray and Rob are equipment nuts, and since then they asked me about every month or two, ‘When is the Doosan dozer coming?’”

He added that the equipment maker launched the DD100 prototype in November 2021 at the Doosan dealer meeting, which Cencetti said, “amped up Ray and Rob even more.

“Finally, in the late spring I let them know [the DD100] was coming, that I had an opportunity to sell it. They pretty much took it sight unseen because they trust in both Doosan and Best Line. They also wanted to be the guys with the first of this line of dozers.”

New Doosan Dozer Built to Be Durable

The 122-hp DD100 dozer has proven during testing to deliver robust pushing performance, excellent fuel efficiency and allday operator comfort. It also is built to handle the most demanding conditions and features a dual/single flange-type roller with several track guard options, Doosan noted in a news release in May 2022 to announce the machine’s manufacture.

Cencetti noted that Best Line also is very happy about the DD100’s Doosan-built engine.

“For Doosan, it is always nice to be the manufacturer of your own powerplant when you are selling a new piece of equipment,” he said. “That engine has been in other Doosan equipment that we have been selling to our customer base, so Best Line has a book on it and how it performs. The dozer has Rexroth pumps and a Rexroth drivetrain — a common manufacturer that most people are very comfortable with.”

In addition, the Doosan DD100 comes in both a standard track and a low ground-pressure model.

Cencetti also noted that Best Line Equipment, with seven branches in Pennsylvania and one in New Jersey, is a repository of all Doosan parts, filters and other accessories, including those for a DD100 dozer.

Ratoskey & Trainor’s operators will find the Doosan dozer easy to run as it offers an 8-in. Smart Touch display, giving them complete control from a convenient touch screen. It also has enhanced visibility with minimized front pillars, maximum glass area, and a standard rearview camera — plus LED lights and front, rear and side wiper blades.

“There are a lot of nice features on the Doosan, including a blade shape feature, speed controls, and a great camera,” Cencetti said. “Ray Trainor has run [dozers] for the last 40 years, and he has been very impressed with what he has seen from the DD100.”

Trainor, a self-described “old-school guy” has, indeed, been excited with the Doosan; for instance, he likes the buttons on the machine that when pressed shake the dirt off the blade.

“That’s just one of the many neat things on it that makes it more operator-friendly,” he said. “The angle of the blade used to be controlled by a joystick, but now you just hit a button. There are buttons to lift it, another to drop it, and one to shake it — all great options.”

Keeping Costs Low a Prized Commodity

Trainor added, though, that he and Ratoskey were intrigued enough with the new dozer’s potential for helping to improving R&T’s fuel efficiency and its ability to hold down costs.

“Naturally, fuel is the big question on the minds of all equipment owners, so that will be one of ours as well,” he said. “Fuel, speed and serviceability are what we are concerned about in this business. The Doosan DD100 has greater visibility, which is nice, but we hope to see excellent speed and cost per hour from it too.”

“We also prefer having the latest technology,” Ratoskey added, “plus being able to use different power modes, and be as efficient as possible because we are going to be using this Doosan [machine] on a daily basis. [Ray and I] are excited to see what its actual fuel consumption is, the power of the machine and how well it will work.” New Doosan Likely Ideal for Topsoil Business

As Ratoskey and Trainor integrate the Doosan DD100 within their company’s latest service, a topsoil business that it acquired in the last year, the thinking is that the dozer will be the ideal machine for handling dirt and other materials.

“We need to be able to turn the topsoil, and a dozer is required to do so every day,” said Ratoskey. “We were looking for the machine that was going to work best for us there, and we feel this is it.”

At the company’s site in East Norriton, Trainor pointed to a large hill on the property, explaining that it used to be a berm that extended around the entire property.

The Doosan DD100, like a soldier, needs to be able to take that hill.

“There is so much big wood in there that the logs just sweat all the time, keeping [the mound] saturated,” he said. “Before we screen it, the material needs to be dry, so in the morning I will get up there and push out 800 yards and maybe flip it one more time before we pile it up to dry out. With rocks that have wet topsoil on them, it is hard to remove the dirt, but when the topsoil is dry — naturally — it bangs off. Once it is dry, we use a pair of screens, and our finished product comes out of a trommel.”

Likewise, he believes the size of the Doosan DD100 will work well in R&T’s grading service, particularly as the company performs a lot of finished grading around houses as well as the occasional parking lot project.

“Mainly, though, that machine is going to roll and dry topsoil, and then, as the trommel goes, you tend to the piles,” Trainor said.

For that reason, the two company owners do not consider the Doosan dozer to be a support machine to their operations, but a primary piece of equipment because it will be running eight hours a day just like the screener.

“Depending upon the weather, it will be a five-day-a-week machine,” Trainor said. “We have a lot of material to work through.”

Now, R&T is open for both homeowners and contractors to buy its topsoil, and so far, business has been booming.

“We just had a builder working on a school over in the Wissahickon [Pa.] area that bought about 150 loads,” he said, adding, “Contractors that haul up dirt and dig basements in Philadelphia, build neighborhoods and perform demolition jobs before turning those sites into parks, all need topsoil. Before, we would sell five to 10 loads a week, but now we are selling 75 to 100 loads of topsoil.”

Connection to Best Line Leads to Success

Ratoskey said that R&T began in the late 1980s as a demolition and excavation contractor before branching out into triaxle work and using lowboys to move equipment. From there, he and Trainor opened a yard in King of Prussia, Pa., as a site for recycling concrete and grinding wood to make into mulch.

“That grew our company to the point that in 2016 we bought Gill Quarries Inc. and moved our operations here, where we now do mining, crushing, and concrete recycling, along with continuing the grinding and mulching business,” Ratoskey said.

The two partners also credit much of their company’s success to the relationship it has with Best Line Equipment and the close ties they have with Cencetti, who was one of their first contacts at the dealership.

“Since then, Armand has dropped off each machine we got from Best Line, and I think we have probably bought one of every piece of equipment that Doosan makes,” said Ratoskey.

He also has been impressed with Best Line’s commitment to service and it being available whenever R&T has needed it.

“They make sure that we do not have much downtime,” Ratoskey said. “If there are any critical issues, they find the answers quickly. They have given us loaner machines while they were working on making fixes to our equipment, and their parts availability has been great.”

When asked if he saw any risks in buying the first dozer to ever be produced by Doosan, Trainor said he and Ratoskey have felt no unease whatsoever.

“After all the Doosan products we have purchased, and the utmost confidence we have in Best Line and Armand Cencetti, that has never been a concern,” he said “Best Line has been good to us, and we have had five years of a good, solid relationship. Why not try the first Doosan DD100 dozer?” 
