WHATDOESTHISEXECUTIVEORDERDO?
Thisorderestablishespolicyprotectionsthatdefinesex-basedrightsin accordancewithbiologicaldistinctions.Itassertsthatpoliciesprioritizing genderidentityposeriskstowomen’sprivacy,safety,andfairnessinareas suchassports,education,andpublicaccommodations.
Theordermandatesthatfederalagenciesandemployeesshallusetheterm “sex”insteadof“gender”whenactinginofficialcapacities.Thisincludesall formsandgovernmentidentificationdocuments,includingpassports,visas, andGlobalEntrycards.
. Theordermandatesthatagencyheadsnullifyguidancedocumentsthatare notconsistentwiththeorder’srequirements,includingTheWhiteHouseToolkit onTransgenderEqualityand2024TitleIXRegulations,amongothers.
Theordermandatesthatindividualsdesignatedmaleatbirtharenothoused inwomen'sprisonsordetentioncentersandthatfederalprisonsrevisetheir policiesregardingmedicalcareinaccordancewiththisorder.Effectively,this orderprohibitstheuseoffederalfundsforgender-affirmingprocedures, medications,ortreatments.
Theordermandatesthatintimatespacessuchasrestroomsandprisonareas designatedfor“women,girls,orfemales,”aredesignatedby“sex”andnot “genderidentity.”
Allpreviousordersthatareinconsistentwiththeserequirementsaretobe rescinded.
HOWWILLTHISEXECUTIVEORDERBEENFORCED?
TheSecretariesofStateandHomelandSecurity,andtheDirectorofthe OfficeofPersonnelManagement,shallimplementchangestorequirethat government-issuedidentificationdocumentsaccuratelyreflectthe holder’ssex.
TheAttorneyGeneralandSecretaryofHomelandSecurityshallensure thatmalesarenotdetainedinwomen’sprisonsorhousedinwomen’s detentioncenters.
TheAttorneyGeneralshallensurethattheBureauofPrisonsrevisesits policiesconcerningmedicalcaretobeconsistentwiththisorder.
Throughthisorder,theterms“men,”“man,”“boy,”or“boys,”aretobeused toreferto“adultandjuvenilehumanmales.”Conversely,theterms ”women,”“woman,”“girl,”and“girls,”aretobeusedtoreferto“adultand juvenilehumanfemales,”asdefinedbytheExecutiveBranch.The SecretaryofHealthandHumanServicesshallprovideguidance expandingonthesex-baseddefinitionssetforthinthisorder.
Schools,organizations,oremployersthatviolatetheseprovisionsriskloss offederalfundingandpotentiallegalactionbythefederalgovernment.
Theorderencouragesstategovernmentstopasslawsreinforcing protectionsforsex-basedrightsandaccommodations,consistentwith federalpolicies.
HOWDOESTHISIMPACTBLACKCOMMUNITIES?
ThisorderwilldisproportionatelyimpactBlacktransgenderand nonbinarypeople,whoalreadyfacehigherratesofhomelessness, unequalaccesstoresources,andmentalhealthissues.
Theordervilifiestrans,intersex,andnon-binaryindividuals,dismissesthe validityoftheirlivedexperiences,andfalselyimpliesthattheythreaten thesafetyofcisgenderwomenandgirlsinspaceslikebathrooms.
Potentialrestrictionsongender-affirmingpoliciesinschoolsand healthcarecoulddisproportionatelyaffectmarginalizedcommunities withlimitedaccesstoresourcesandadvocacy.

TheCongressionalBlackCaucus(CBC)hasconsistentlyopposedactions thatunderminecivilrightsprotections,particularlythoseaffecting marginalizedcommunities.
