Section 12.1 of the Declaration contains various dispute resolution procedures that generally pertain to the (a) Declarant, (b) Association, (c) all Owners, and (d) any other person or entity not otherwise subject to the Declaration who agrees to submit to this Article and defines the enumerated classes of person or entity as (“Bound Parties”). 2. Section 12.2 of the Declaration enumerates five classes of claim that are exempt from the dispute resolution procedures of Article 12. 3. Declarant, as that term is defined in Article I, Section 1.4 (j) of the Condominium created the Declaration. 5. Declarant included a means for the Owners to amend the Condominium Declaration. 6. Any provision, covenant, condition, or restriction or equitable servitude contained in the Declaration may be amended, revised, removed, or repealed from time to time upon written approval of Owners holding at least sixty-seven percent of the votes in the Association. 7. The Association and the Owners, representing a group of at least sixty-seven percent of the allocated interests within Brownstone Row Owners Association approve and support the decision to a) delete the “Declarant” and “any other person or entity not otherwise subject to the declaration” from the defined term “Bound Parties” , b) add construction and design defects as a “Exempt Claim” and c) invalidate the Dispute Resolution Procedures regarding claims for construction or design defects contained in Article 12 of the Declaration. 8. The proxies and ballots of the Owners are kept as records of the Association. Therefore, upon the recording of this Amendment, Section 12.1 of the Declaration shall define only the Association and the Owners as “Bound Parties”. Section 12.2 shall include construction and design defects as “Excluded Claims”. Section 12.3 (i) shall be repealed, rendered null and void, and no longer of any effect for construction and design defect claims, controversies or disputes on part of the Association; its past, present or future Members.
