Littleton considers changing pay for mayor, council

Littleton city council members, who have been paid the same standing stipend since 2015, may see a change

e discussion began in April, when councilmembers expressed interest in increasing the compensation for the person serving as mayor and linking other council members’ salaries to a percentage of AMI.

“As I’ve been chatting with other mayors and councilmembers from around the region, I think a lot of cities are taking a look at this, trying to gure out how to make equitable compensation to get people involved,” Mayor Kyle Schlachter said during the rst conversation.

Current compensation

Current monthly salaries for council members varies slightly based on position, with the mayor earning $1,350 per month, the mayor pro tem earning $1,225 and other council members making $1,100, according to city documents.

Annually, these numbers come out to be $16,200 for the mayor, $14,700 for the mayor pro tem and $13,200 for other council members.

Per the city charter, monthly salaries for the elected board are set by ordinance. ey cannot, however, be increased during the current term of council members enacting the ordinance – any changes made by the city’s current council would go into e ect for future councils.

Compensation based on AMI

e sta presentation on June 20 o ered one possibility of new salary options, calculating the numbers as percentages of AMI. e mayor’s salary would be 50%, mayor pro tem’s would be 30% and council members’ would be 25% of the geographic region’s AMI.

Based on the typical income established by sta during the meeting, the hypothetical new salaries showed an increase of over $9,000 for year for the mayor, about $650 for the mayor pro tem and a decrease of about $400 for other council members.

ere was some conversation about whether the calculations were based on the correct AMI.

Tracy Hooker told e Littleton Independent the city is discussing the most appropriate baseline data to use in the council compensation discussion going forward. If the city decides to use a di erent AMI number, the salary change to each council position would be di erent from the numbers presented in the meeting.

e group decided to continue the conversation regarding the philosophy of basing council salaries o of AMI, noting that they would verify the exect numbers later.

Schlachter said linking salaries to AMI would make it so future councils don’t have to address compensation. Instead, the money they make will increase with in ation

each year.

When he saw the hypothetical salaries presented by sta , Schlachter said he did not like the idea of lowering any current compensation numbers.

“ e one thing I won’t support is a pay decrease for council,” he said. “With the amount of work everyone does, it’s, you know, should be compensated better.”

District 3 Councilmember Stephen Barr said he would be OK if the council members’ stipends decreased.

“I think it’s actually more representative of the body we represent to tie it to AMI, and honestly, the numbers up there are not, like, frighteningly di erent,” he said, adding that the mayor’s salary was the only one with a large di erence.

District 1 Councilmember Pat Driscoll said he is concerned about linking council compensation to AMI.

“ is idea of a raise, a raise, a raise, a raise every year – I mean, we’re just putting ourselves in a position,” he said. “I think that can get us in trouble down the road … You start throwing these percentages out there and all of a sudden your council members are making 25 grand a year and you’re going, ‘OK, is that what this is meant to do?’”

District 2 Councilmember Jerry Valdes said he thinks the mayor deserves a raise, but all other salaries should stay the same as they are now.

Health insurance

Hooker also presented two main options for health insurance setups for city councilmembers. In one, the city would contribute to the premium as an employer. In the other option, council members would foot the entire premium.

Councilmembers Pam Grove, Kelly Milliman, and Driscoll supported the option that puts 100% of the premium costs on the councilmembers. Grove said she is against the employee contributing because, in essence, a councilmember who enrolls in the bene t would get more total compensation than those who do not enroll.

“It’s an o er,” Barr responded. “Anyone could take it, and you can turn it down.”

Valdes said he would prefer no health care option be o ered at all, but he would consider the option in which the city does not contribute.

“Being on council is something you want to do for your city, not what the city is going to do for you as a council member,” he said.

Schlachter, Barr and Rydin said they support having a health insurance option and having the employer contribute to premiums.

“I think (a health insurance option) can attract some other folks who wouldn’t be able to do this work otherwise, especially if they’re in a part-time position in other jobs or not working in other capacities so I think that could be useful,” Rydin said.

Littleton’s sales tax hike raises over $10 million in first year

In its rst year, the sales tax increase implemented by ballot measure 3A raised approximately $10.4 million to support capital improvement projects in Littleton.

Ballot measure 3A passed in November 2021, with about 59% of voters supporting the 0.75% sales tax hike. According to the ballot language, the funds from this tax support projects including street maintenance and reconstruction, street and bridge safety improvements, building replacement an maintenance, sidewalk improvements, parking improvements and more.

In August, city council approved the creation of a citizen committee to annually report on the progress of projects and expenditures related to 3A.

On June 20, the Capital Improvement Sales Tax Committee presented its rst memo to city council, outlining the use of the funds and giving advice for how the city can continue being careful and transparent in future spending of 3A dollars.

Julie Radulovich, a member of the committee, said the city spent about $159,000 of the over $10 million in revenue that came in from the tax in 2022.

“About $20,000 of that was on street paving projects, and then the other ($140,000) was essentially on sta time,” she said. “So not a ton spent this year, but we have about $10.2 million of funds that are going to be planned to be spent in 2023.”

e committee noted that the city has a “signi cant backlog” of capital projects in their memo, adding that they appreciate and support that sta has allocated funding prioritization to immediately needed projects.

“We also appreciate that sta has planned on using funds as part of grant matches to leverage state and federal funds towards several projects,” the memo continued. “Lastly, we noted that sta has been strategic with a plan to use future funds to perform proactive maintenance and seeding of certain asset and maintenance funds in order to make them more self-su cient.”

e committee members shared several opinions about whether information technology projects t into the intent of the ballot measure. Overall, they said they were comfortable with how all of the 2022 expenditures t with the intent.

e committee members also encouraged the city to provide more communication in 2023 regarding the spending of 3A funds to ensure citizens have transparency and clar-

ity about where their taxes are going.

“As a citizen, I really want to know, are we doing a good job of spending all the money that’s coming in the door?” John Jones, a committee member, said. “Transparency is not really a question, like, ‘Are you going to be transparent?’ It’s more of a demand … And not that everyone wants to review the budget like I do,

but I think there’s this need to do some type of infographic, a one-pager about where the money’s going.” City Manager Jim Becklenberg said a letter will soon go out to all households to inform community members of where they can nd more information about the capital improvement projects their tax dollars are funding.

Although Englewood Mayor Othoniel Sierra’s position on the city council is up for election this November, residents in District 1 of Englewood may be asked sooner whether they want to remove him from o ce.

e Englewood City Clerk’s O ce determined that residents got enough valid signatures on the recall petition against Sierra, meaning a special election for District 1 may happen unless a valid protest to the petition is led.

Sierra, who was elected in 2018 to ll a vacant council seat representing Engewood’s District 1 and was reelected in 2019, is among four councilmembers facing possible recall, along with Councilmembers Chelsea

“ e District 1 Recall Petition led with the City Clerk’s Ofce on June 16, 2023, has been reviewed and determined to be valid and su cient,” Englewood City Clerk Stephanie Carlile said via email on June 23. is is the second recall petition to be turned in and deemed valid, as the clerk’s o ce determined the petition to recall Nunnenkamp was valid on June 15. e deadline for the other petitions is July 6.

ere is a 15-day protest period for the petition. According to the City of Englewood’s Rules and Regulations for Recall Elections, any registered elector entitled to vote for a successor to the o cial may le a written protest with the city clerk that includes a “clear statement of the grounds for the protest.”

If that is done, a hearing may be held in which the protesting party must prove that an element of the petition violated the

If the protest period passes and there is not a protest led, then both Nunnenkamp and Sierra’s recall petitions will come before the city council at its next regular meeting, which is July 17.

During that meeting, the council will receive the proposed ordinance setting the ballot title for a special election, Carlile wrote.  e council will then set a date for a recall election “to be held not less than 60 days nor more than 120 days after the ling of the petition,” according to the city’s rules and regulations.

According to the city’s rules and regulations, the ballot for District 1 in Englewood would ask voters the yes-or-no question of whether Sierra should be recalled from his position, and the ballot for District 2 would ask the same question as it pertains to Nunnenkamp.

If the majority of voters said yes, these positions would be deemed vacant and would likely be lled during the city’s general municipal election in November.

High Line Canal conservation group receives $350,000

e High Line Canal, which winds 71 miles across the metro area, will soon be permanently protected as regional open space.

Great Outdoors Colorado, an environmental nonpro t, announced in June a $350,000 grant to High Line Canal Conservancy to help permanently protect the canal as a continuous recreational, ecological, historical and stormwater resource.

“Permanent protection of the canal has been a top-line goal of our board and organization since the beginning in 2014,” High Line Canal Conservancy CEO Harriet Crittenden LaMair said in a press release. “It’s extremely exciting to be actively working with Denver Water, Arapahoe County and other local governmental partners toward a permanent protection vehicle.”

e canal spans 860 acres and its associated trail system connects walkers, hikers, runners, cyclists, horseback riders and others to thousands more acres of parks and open spaces. e canal runs through parts of Adams, Arapahoe, Denver and Douglas counties, spanning a solid slice of eastern metro area from north to south.

“It’s important for the community to know that the canal is preserved permanently for them to use freely into the future,” High Line Canal Conservancy Senior Director of Programs and Partnerships Suzanna Fry Jones told Colorado Community Media.

Jones said Denver Water will maintain ownership of the canal, but has been moving its customers to more sustainable sources of irrigation water in recent years.

Denver Water Senior Community Relations Specialist Jimmy Luthye said they plan to play an active role in the ongoing discussions about the canal’s future.

“ e evolution of the public’s use of the canal for recreation and stormwater management, along with its original role as a water de-

livery method is one of the reasons why Denver Water and regional partners, including cities, counties, park and ood districts and stormwater management entities, have partnered with the High Line Canal Conservancy to assist their mission to preserve, protect and enhance the 71-mile canal,” Luthye said in an email to Colorado Community Media.

e conservancy is expected to complete legal work to secure protection, gather documentation of the present conditions of the canal and assess potential future projects with the grant.

Great Outdoors Colorado’s Director of Programs Chris Yuan-Farrell said the process will likely involve a conservation easement, which is a legal agreement that limits land use to protect its conservation values.

Yuan-Farrell added that the grant is part of the environmental nonprofit’s land acquisition program, which supports urban and rural habitat protection priorities and increases access to the outdoors.

“ is is a substantial resource for Colorado to have and now it will be permanent,” Yuan-Farrell said. “Whereas before, there was always an opportunity for Denver Water to sell that property to somebody else. is grant helps take that o the table.”

He said the funding provided by Great Outdoors Colorado should last the conservancy for years to come.

“ is is a fund for the conservancy to maintain and grow,” Yuan-Farrell said. “It’s like seed funding for a hopefully larger substantial endowment with the expectation that

perhaps the municipalities and counties that have land by the canal will contribute to it.”

Great Outdoors Colorado invests a portion of Colorado Lottery proceeds to help with the preservation and enhancement of parks, trails, wildlife, rivers and open spaces, according to its website.

e nonpro t has awarded multiple grants to the High Line Canal Conservancy over the years. In 2022, Great Outdoors Colorado provided $41,100 to help rid parts of the canal of an invasive species.

“ eir funding has been so impactful to all of the work that we’ve done,” Jones said. “And this is the next big stage of our work for permanent protection.”

Jones said more details about the canal’s function as a fully conserved space are expected to come this fall.

Cherry Cricket opens in LIttleton

Serving burgers and beer

Cherry Cricket, the iconic Denver staple for burgers and beer, has ofcially opened its doors in Littleton. After breaking ground in December, the Cherry Cricket team has been working to renovate the former Crestwood Restaurant at 819 Littleton Blvd. into a space that continues the site’s legacy and matches the new restaurant’s energy.

Community members celebrated on Facebook when the restaurant made the announcement that it would open at 11 a.m. on June 22.

“Stoked,” wrote Eric Boyle, a commenter on Facebook. “Look forward to the great food, people, service,

and new place to watch hockey next season!”

e new location features indoor seating and a festive outdoor patio, where their classic burgers, beers, shakes and more will be served.

e original restaurant dates back to 1945, when the rst location opened as “Mary Zimmerman’s Bar” in Denver’s Cherry Creek neighborhood. In 2018, the group established their second Cherry Cricket near Coors Field.

e Littleton location marks the expansion of the brand, as well as a new local go-to for neighbors and visitors alike.

e Littleton Cherry Cricket’s ofcial ribbon cutting is set for midJuly, when the Littleton Chamber of Commerce and others will publicly welcome the new restaurant to the city.

Resident claims petition to stop Englewood multifamily development is invalid

First, Englewood City Council approved zoning for multifamily housing at the former Sam’s Automotive lot; then a citizen petition appeared to throw a monkey wrench in those development plans; and now a protest is challenging the validity of that citizen petition.

So now the question remains of whether a 395-unit residential complex in Englewood will be built, as a city resident — with the support of the proposed developer — has led the protest that will go to a hearing.

To determine the anti-development referendum petition’s validity, a public hearing was held on June 23. A story on that hearing will be in next week’s edition of the Englewood Herald.

If the referendum petition is found to be invalid, the proposed development would be expected to move forward, or an appeal of that decision could be led in district court.

However, if the referendum petition is still deemed valid, then the city council will decide whether to repeal the ordinance approving the development or have Englewood residents vote on the matter at the next general municipal election, which will be in November, unless the city holds a special election sooner.

e e ort to stop the proposed development

Embrey Partners, the proposed developer, aims to build 361 apartment units in a four-story building and 34 rental townhomes in seven three-story buildings on a lot stretching south and east from the intersection of West Oxford Avenue and South Navajo Street, where the former Sam’s Automotive business was located.

e Englewood City Council approved the proposed development earlier this year through a series of votes, given that the developers had to go through a planned unit development (PUD) application process to facilitate a rezoning of the property.

On April 7, the o ce of the city clerk received a letter initiating a referendum regarding the proposed development from residents Davon Williams and Gary Kozacek.

e letter cited infrastructure issues that some residents felt were not considered and asked for studies

regarding tra c density, noise quality, air quality and soil contamination on the site.

e referendum petition stated that those who signed it are protesting the ordinance that approved the planned unit development.

It stated, “By signing this petition, you are protesting this ordinance going into e ect and — if su cient signatures are obtained — causing Englewood City Council to reconsider this ordinance, by either repealing it in full or calling a special election to submit it to a vote of the electors of this city.”

e referendum petition needed at least 1,466 valid signatures of Englewood registered electors by May 4.  e city announced in a June 6 news release that the city clerk’s ofce determined the petition “to be valid and su cient.”

City Clerk Stephanie Carlile said via email that 1,747 signatures were submitted and, after review by the city clerk’s o ce, 254 signatures were rejected. e total number of valid signatures was 1,493, she wrote.

Honor hometown heroes

If feels like a normal year in planning for the Fourth of July celebrations. Communities are not worried about dry conditions due to all the rainfall, so reworks are a go for several areas. Parades and community gatherings are all moving forward nicely. I have to admit, growing up and in early adulthood, the Fourth of July has been one of my favorite holidays. We had huge family gatherings, heading to the smalltown parade, and going to the park for the annual re ghters’ water ght. And, just before the reworks, we had our annual football game. I will admit, I tore the meniscus disc in my knee one year blocking my dad so my nephew could score. Yes, my team got the touchdown.

I am also a bit sentimental about the American holiday. My kids give me a hard time each year as I make them listen to songs such as “God Bless the U.S.A.” and “Where Were You When the World Stopped Turning.” I believe they too should have respect and pride in their country. I understand this country is far from perfect. e last few years of seeming insanity proves that point. However, we live in a country where that insanity is allowed to happen.

Finally, another reason I get sentimental about the Independence Day holiday is a tradition that started in Tucson. My company would often recognize what we called “Hometown Heroes” just before Independence Day.

I loved those special sections because we called to the community to not just tell us about the members of the military we would be thanking, but also those in the community who volunteer, work hard and do so many things to make a di erence in the lives of others. To those who work tirelessly to make the communities in which they live and the world better.

I haven’t quite got to the point of a special section, but over the last year as editor, I have been able to

get out into our communities and meet great people, and through my reporters read about amazing organizations and groups who are indeed community heroes who often do the work without expecting recognition or a return.

Some of my favorite organizations are the local American Legions and VFWs — these groups are more than just veteran organizations. ey are people who work to give scholarships, provide support to struggling veterans and, in Littleton recently, repurpose veteran wreaths to become sh habitats.

Local historical societies — these members work to preserve and celebrate important moments in a community’s history. ey also protect and preserve important structures.

To the local food banks that have struggled over the last few years to keep the doors open and residents fed — every administrator and volunteer deserves a pat on the back.

To companies like Howdy’s Ice Cream, which opened in Centennial o Parker Road this year, giving adults with disabilities an opportunity to work. I will also recommend going and getting a summer treat there — the lemon crunch is superb. e people and organizations who work each year to help people move into and a ord homes. In Colorado, that alone is a tireless and likely thankless job these days.

In Highlands Ranch – It’s heartwarming to see the continued photos and responses as the community comes together to clear debris and help neighbors after a tornado touched down recently.

I should also give a shoutout to volunteers I see at the VA when I take my dad for care. ey are helpful, friendly and wonderful people. People, groups, churches and organizations do more in our local communities than we realize year after year. I hope to keep getting to know all of them and start recognizing them more often in our local newspapers because at the end of the day, honoring these heroes is part of what Independence Day is about.

Do not enter the comfort zone

She was very comfortable running 5K and 10K races, and usually placed well. She often thought about stretching herself to run a half marathon and then one day, a full marathon. As her dreams about training harder and running longer races took shape, she found herself returning to her comfortable training regime and settled once again for training to run in those 5K and 10K races. en one day, she decided to go for it. She made a commitment to break free from her comfort zone and train harder and run farther. She woke up earlier and each day that she ran, she pushed herself just a little bit farther until she could comfortably nish a half marathon. And after that, she left that comfort zone and began training even harder to compete in a full marathon, and last year successfully ran in the NYC Marathon.

When asked if she had plans on returning to her former routines of running in shorter races and giving up the long runs, her response was that she would never allow herself to enter the comfort zone ever again. In her mind she created an image of a “Do Not Enter” sign followed by “ e Comfort Zone.”

For many of us we have reached some type of pinnacle or achieved a sought-after goal only to nd ourselves slowly backsliding and reentering our former comfort zone. We reach a certain level of success and then allow ourselves to get comfortable there instead of wondering what we could do if we pressed ourselves a little harder, taking a new or di erent path, and maybe even taking a little risk. It’s like breaking free from one comfort zone only to enter another comfort zone.

If we are on a path of personal or professional growth, we might all do well to have that same mental image top of mind, “Do Not Enter e Comfort Zone.” Whether it’s a physical achievement we are seeking, a business breakthrough, quitting a

Littleton announces new district boundaries

In the coming days, 877 Littleton households will receive notice that their city council district has changed.

Members of Littleton’s election commission have decided on new city district boundaries, as a result of the redistricting process that happens every 10 years after the U.S. Census.

Since November, they have been working with city geographic information system professionals to determine options for the new boundaries, City Clerk Colleen Norton said at the June 20 council meeting where the election commission presented their decision.

e process, which usually starts earlier, was delayed due to a delay in Census results.

e new boundaries will mean new districts for approximately 4% of the households in the city. e new map will mainly change the districts of households in the following areas:

• e area between West Maplewood Avenue and West Ridge Road, west of South Spotswood Street is changing from District 4 to District 1;

• e area between West Caley Avenue, West Peakview Avenue, South Elati Street and South Windermere Street is changing from District 3 to District 2;

• e area between South Spotswood Street, South Windermere Street, West Peakview Avenue and South Sterne Parkway is chang-

bad habit, starting a new and positive habit, or maybe setting our sights on breaking the company sales records, once we break free from what has been holding us back, leaving our comfort zone, we need to commit to never going back or settling ever again.

Here is something to watch out for, it’s called the neutral zone. It’s that place where we have decided to break free from our comfort zone but haven’t taken any action yet. Something is still holding us back. Maybe we haven’t fully committed to where it is that we want to go. Maybe we have some head trash that’s getting in our way. Whatever it is, it has us stuck in the neutral zone. How do we get unstuck? We take the rst step in the pursuit of our new goals and dreams. We don’t have to go beyond that, we are not going to go from running a 10K to running a marathon, but we are going to take the rst step and maybe run an extra half mile, and then each day slowly build to our ultimate goal.

e election commission used criteria from state law and the city charter when determining the new boundaries.

“ e criteria that we used was, again, contiguous, compact, rectangular in shape and approximately the same population in all, hoping to get to a half a percent of deviation between all districts,” election commission member Noah Welshans said at the June 20 study session.

e commission presented three main district boundary option maps at community engagement opportunities throughout May. ey called these options A, B and C. e commission received a total of 51 comments on the options throughout the process and hundreds of views on webpages that showed the maps. Based on the comments received from citizens, option B is the most popular. is feedback, along with the way option B t the criteria of the city charter, inspired the commission to choose it.

“Options A and C, they impacted fewer households, however, they cut through census blocks and they did not as closely meet the rectangular shape requirement as well as option B,” Welshans said. “We felt option B was the best one to go forward with because it would maintain, at the

The brain is overrated, according to Kadam Lucy James at the Kadampa Meditation Center.

“Have you ever felt peaceful in your head?” she asked.

She put her hands over her heart and said that’s where the mind is, adding that while the brain has conceptual reality, the mind exists in the heart, where we feel peace, love, joy and wisdom.

“If we can get into our heart, we automatically start to feel more peaceful,” she said.

James is temporarily living in Arvada and teaches meditation at the Kadampa Meditation Center. She started practicing about 41 years ago after she saw a “very peaceful person” in college.

“He was a student meditating on the end of his bed and I asked him what he was doing, because this was back in 1981, and meditation, no one had heard of back then,” she said.

Ever since, she’s been practicing and has taught all around the world, including England, San Francisco, New York City and now Denver. She hopes to one day achieve enlightenment, or in nite happiness and peace.

It takes a lot of hard work, but she said it’s the only thing where the more she does it, the happier she is.

It’s because, with meditation, the mind becomes naturally peaceful. Each person has a natural source of peace and happiness inside them, she said, and instead of seeking it elsewhere — relationships, ful lling jobs or material things — it’s already inside the body waiting to

be found.

e evidence lies in the random moments of peace and happiness everyone feels. It could be a torrential downpour and the mind is peaceful, settled and calm.

“What those moments show is that our mind is ne. And then what unsettles the mind is actually all our uncontrolled thinking,” she said.

Coming from the teachings of the Buddha, she compared the mind to a vast ocean. e waves are turbulent while below them is a vast, in nite, calm place. Waves of anxiety and negative emotions distort the brain but below those waves rests an incredible sanity.

“When our mind is settled, when we can let go of our troubled thoughts, and our turbulent thoughts, uncontrolled thoughts, then we naturally feel good. We naturally feel peaceful and we start to get a sense of our potential and who we really are, which is this person who has limitless potential, limitless happiness,” James said.

e rst step to unlocking that potential and happiness is to breathe.

Focus on the nostrils

Carol O’Dowd, a Trauma and Transition Psychotherapist and Spiritual Counselor assists her clients by meeting them where they are and o ering them acceptance through breathing.

“If you focus on your breath, you cannot simultaneously focus on all your internal dialogue. It cannot be done. e human brain is not wired that way,” O’Dowd said.

It creates a space between the thoughts. e stress and anxiety stored in the body don’t go away, but the practice of noticing the emotions and putting them on pause to breathe helps

calm the body down.

Breathing is a function of the body that automatically happens all the time. Focusing on that breath, O’Dowd compared it to a spectrum. What happens when the body stops breathing — death — is one end and the other is when the body pays attention to the breath — peace.

“It can be as simple as just experiencing that ow of air, and in and out of your nostrils. If you can place your attention there, that’s giving yourself a mini vacation,” she said.

O’Dowd encourages her clients to practice treating uncontrolled thoughts like a salesperson trying to sell them. Instead of buying, make them sit in the corner and return to them in 20 minutes after taking time to check in with the body.

It can also let go of stress. Pain, like what the ngers feel after working at a computer all day, can be a physical manifestation of stress. Holding on to that stress can lead to other health conditions.

“It’s not rocket science,” she said.

Escape to reality

James said achieving enlightenment is extremely di cult, and while the teachings she studied laid out di erent steps and pathways, she simpli ed it down to three. e rst is focusing on the breath to relax. e second is identifying delusions.

A delusion can be jealousy, greed, competitiveness or other unpleasant thoughts. Most of the time, those thoughts aren’t controlled by the mind and enter the brain randomly. It’s the root

of many problems, she said, and they destroy happiness.

“It’s completely unnecessary. Which is the whole purpose of meditation, to show us how unnecessary it is,” she said. “We’ve been so busy trying to control everything outside of us.”

She compared it to anger with someone else. It may last for a few days and then one day, those angry feelings leave.

“If you can do that deliberately (getting rid of negative feelings), which we can, then you can see we stopped the grasping or stopped the delusions, we just experience deeper and deeper levels of happiness,” she said.

Identifying delusions is the rst part of the equation. e other half is universal love and caring about others. It comes from understanding everyone wants to be happy, and that there isn’t much di erence between people.

It can be a city councilor running for o ce, understanding their opponent wants the same things, but sees di erent ideas on how to move forward. ey aren’t always bad people.

Realizing that leads to the next step: wisdom. at takes understanding reality. It means turning away from the anxiety, sadness and other negative emotions and escaping to the reality within the body that possesses in nite happiness and peace.

“We can train in wisdom. Understanding that things are not as real as they appear,” James said.

Grateful Dead would be relaunching with many of the original members and pop/blues guitarist John Mayer. But since  Dead & Company  began touring in 2016, they’ve shown an admirable dedication to the original band’s ethos and have introduced new generations to the music in a live setting.

But all good things must come to an end and the group announced their 2023 tour would be their last, which means their performances at 7 p.m. on Saturday, July 1, Sunday, July 2 and Monday, July 3 at  Folsom Field , 2400 Colorado Ave. in Boulder, will be your last opportunity to catch the group in-person.

Sinkhole in Englewood closes eastbound Oxford Avenue

e hailstorm that raged across the Front Range June 22 caused a sinkhole in Englewood. It’s the latest sinkhole in the south metro area to pop up amid June’s heavy rains.

e sinkhole on Oxford Avenue opened just east of where several vehicles became submerged under an overpass during the June 22 storm, which saw a small tornado rip through nearby Highlands Ranch.

Eastbound Oxford Avenue is closed from Santa Fe Drive to Windermere/Navajo streets. And, southbound Windermere/Navajo street are closed in the area, the Englewood Police Department tweeted.

ere were no injuries or vehicle damage related to the sinkhole, said Lauren Riddle, a spokesperson from

the police department.

e city has hired a contractor to repair the sinkhole and work will begin immediately, according to a press release from Englewood. ey expect repairs to be completed within one to two weeks.

Barricades are in place in the area and the police department asks that local and regional ldrivers take alternate routes.

Other sinkholes have appeared across the south metro area. For instance, on June 11 heavy rainfall in the Parker area on the evening left a large sinkhole when a drainage culvert failed under Bradbury Ranch Drive west of Jordan Road. Days later, Greenwood Village o cials closed westbound Arapahoe Road between Yosemite Street and Greenwood Plaza Boulevard because of a sinkhole.

CU Denver teacher prep program wins state approval

e University of Colorado Denver has won full state approval for three teacher preparation program tracks after addressing problems in how it trains aspiring educators to teach children to read.

e State Board of Education unanimously voted to reauthorize the elementary education, special education, and early childhood education programs nearly a year after granting only partial approval because of weaknesses in reading coursework.

State o cials praised the university for improvements that ensure aspiring teachers understand and can apply key components of science-based reading instruction and don’t receive con icting information about how to teach reading.

e decision, which came in June, is the latest step in an ongoing state e ort to hold Colorado’s teacher preparation programs accountable for properly training future educa-

tors how to teach reading. e state began cracking down on teacher prep programs — speci cally their approach to reading instruction — in 2018 as part of a broader push by lawmakers, state education o cials, and parents of children with dyslexia to get more students reading at grade level.

e state’s outgoing education commissioner Katy Anthes received praise for leading the push for more oversight of reading instruction in teacher prep programs.

“ ese educator preparation

reauthorization items have you written all over them,” Colleen O’Neil, associate commissioner of educator talent at the Colorado Department of Education, said to Anthes during the meeting. “Because what you did was ensure every student knows how to read.”

Also, the state board has granted full approval to all majors in the teacher prep program at Colorado Christian University and an alternative prep program o ered through East Central BOCES. Both programs were reauthorized on their rst try.

e University of Colorado Denver is one of several teacher prep programs that revamped reading coursework in recent years following poor state reviews. e state’s two largest prep programs, the University of Northern Colorado and Metropolitan State University of Denver, also made changes.

e reading coursework overhauls seem to have paid o .

Earlier this week, a national organization gave Colorado major kudos for how its teacher prep programs cover reading instruction, ranking it No. 1 in the country. Just a few years ago, Colorado was in the middle of the pack.

In that report from the National Council on Teacher Quality, most of the state’s teacher prep programs earned an A or A+ for elementary education, including the University of Colorado Denver’s undergraduate program, Colorado Christian University’s undergraduate program, and the University of Northern Colorado’s undergraduate and graduate programs. e report didn’t analyze reading coursework in alternative teacher prep programs.

If you were served outside of the State of Colorado or you were served by publication, you must file your Response with the clerk of this Court within 35 days after this Summons is served on you to participate in this action.

You may be required to pay a filing fee with your Response. The Response form (JDF 1103) can be found at www.courts.state.co.us by clicking on the “Self Help/Forms” tab.

After 91 days from the date of service or publication, the Court may enter a Decree affecting your marital status, distribution of property and debts, issues involving children such as child support, allocation of parental responsibilities (decisionmaking and parenting time), maintenance (spousal support), attorney fees, and costs to the extent the Court has jurisdiction.

If you fail to file a Response in this case, any or all of the matters above, or any related matters which come before this Court, may be decided without further notice to you.

This is an action to obtain a Decree of: Dissolution of Marriage or Legal Separation as more fully described in the attached Petition, and if you have children, for orders regarding the children of the marriage.

Notice: §14-10-107, C.R.S. provides that upon the filing of a Petition for Dissolution of Marriage or Legal Separation by the Petitioner and CoPetitioner, or upon personal service of the Petition and Summons on the Respondent, or upon waiver and acceptance of service by the Respondent, an automatic temporary injunction shall be in effect against both parties until the Final Decree is en-

tered, or the Petition is dismissed, or until further Order of the Court. Either party may apply to the Court for further temporary orders, an expanded temporary injunction, or modification or revocation under §14-10-108, C.R.S.

A request for genetic tests shall not prejudice the requesting party in matters concerning allocation of parental responsibilities pursuant to §14-10124(1.5), C.R.S. If genetic tests are not obtained prior to a legal establishment of paternity and submitted into evidence prior to the entry of the final decree of dissolution or legal separation, the genetic tests may not be allowed into evidence at a later date.

Automatic Temporary Injunction – By Order of Colorado Law, You and Your Spouse are:

1. Restrained from transferring, encumbering, concealing or in any way disposing of, without the consent of the other party or an Order of the Court, any marital property, except in the usual course of business or for the necessities of life. Each party is required to notify the other party of any proposed extraordinary expenditures and to account to the Court for all extraordinary expenditures made after the injunction is in effect;

2. Enjoined from molesting or disturbing the peace of the other party;

3. Restrained from removing the minor children of the parties, if any, from the State without the consent of the other party or an Order of the Court; and

4. Restrained without at least 14 days advance notification and the written consent of the other party or an Order of the Court, from canceling, modifying, terminating, or allowing to lapse for nonpayment of premiums, any policy of health insurance, homeowner’s or renter’s insurance, or automobile insurance that provides coverage to either of the parties or the minor children or any policy of life insurance that names either of the parties or the minor children as a beneficiary. PETITION

According to the city’s news release, electors who wished to protest the validity of the referendum petition had until June 13 to file their opposition. When a protest is filed, a hearing must be scheduled to make a final determination of the validity of the petition.

The protest to the referendum petition

On June 13, resident David Lee Carroll filed a protest to the referendum petition, claiming the petition got fewer than 1,466 valid signatures.

According to the protest filed with the city clerk’s office, personnel at the real estate and land use law firm Otten Johnson Robinson Neff + Ragonetti P.C. reviewed the petition and prepared a “petition rejection summary table” which lists out the signatures it found to be invalid.

Andrew L. W. Peters of the Otten Johnson law firm is named as an attorney for Carroll in the protest.

In an interview with the Englewood Herald, Carroll said he is not paying for the law firm’s services.

On June 22, Peters said via email that developer Embrey Partners is paying for the representation.

“Even though it’s Embrey’s project at stake, the law requires a registered voter to file a protest. David has been a long-time champion of Embrey’s project, so he volunteered to take on that role,” Peters wrote on June 22. “We’re glad he did and look forward to an opportunity to present our arguments at tomorrow’s hearing.”

Carroll, who previously served as the executive director for the Greater Englewood Chamber of Commerce, was among those who spoke in favor of the development during a March 6 city council meeting.

The filed protest stated that “irregularities and deficiencies” within the referendum petition “total to at least 530 invalid signatures, to be deducted from the total 1,747 collected.”

According to the protest, one of the reasons for invalidating signatures is, “Two petition pages were ripped from a petition packet or were missing a packet number, indicating improper disassembly and invalidating all 10 signatures on those sheets.”

“Six different petition packets, totaling 178 otherwise-valid signatures, appeared to have been disassembled and re-stapled. Along with the ripped page, missing sheet number, and other circumstantial evidence, this suggests improper tampering that disqualifies those signatures,” the protest added.

The protest claimed that “many signers” were not registered electors in the city at the time of signing and that others omitted their signature or the date. It also alleged that “Gary Kozacek allowed multiple people to sign on behalf of others.”

“In all, and considering circulator misconduct, Proponents secured no more than 1,217 valid signatures — well short of the 1,466 required,” the protest stated.

“I recognize that there are opponents, too, for different reasons, but that is the reason that I and others … were willing to be more supportive of this project,” he said.

“We, as neighbors, were trying to, in some ways, encourage or incentivize the developer to do some projects that we couldn’t get the city to do for us — or at least pay for the project, (since) the city would still have to approve those,” he said. “And they were willing to do that.”

When the Englewood Herald asked Carroll if he has any connection to or financial interest in the proposed development, besides being a resident who is interested in the walkability components of the project, he said, “I do not. I mean, other than that they would possibly fund a crosswalk and a bridge.”

“And that they would provide, you know, sidewalks,” he said, adding that it does not currently feel safe to walk along Navajo.

Carroll said that after he heard the referendum petition was approved, he reached out to the city clerk to look at who had signed the petition and where they lived in Englewood.

“What I was told by the folks that were against this project is that there were a lot of people on Lipan Street, which is the street right behind where the project would reside, that … were disappointed in the project because it was going to be much higher than they had expected,” he said.

When Carroll looked over the signatures, he said he saw that about six out of the roughly 31 homes on that street had signed. He also saw a lot of signatures from people who live “on the far edges of Englewood” and not near the proposed development, he said.

“I put out on, kind of, social media (that) it was disappointing to me that there was so many people that didn’t live in our neighborhood that had signed this referendum,” he said, adding that he got a lot of different responses.

responses from some people who expressed frustration with how the referendum petition was presented to them, he said.

Based on what he has heard, Carroll said he thinks some residents were told if they signed the referendum petition that “it wasn’t the end of the project. It was going to force the city to create a traffic plan or environmental plan or whatever.”

Carroll said he was not asked to sign the petition, so he did not have any basis to know whether that was true, but he had gotten messages from people claiming that happened to them.

“And so that’s where … the nature of that protest came out,” he said.

During the June 20 city council meeting, Kozacek spoke during public comment and thanked the people who helped circulate the referendum petition.

“When I applied for that referendum, it stated traffic study, air quality, noise — and then there was a sideline at the end that there should be an additional consideration of the possible … pollution,” Kozacek said.

“That’s what the petition was all about. I’ve been accused, I’ve been subpoenaed in for Friday, right here. And they’re telling me that I lied to the public,” he continued, before being stopped by Mayor Othoniel Sierra who told Kozacek that his allotted time to speak had ended.

Regarding the June 23 protest hearing, Carroll said he thinks there is a case to be made.

“I think that it’s been laid out well, on what is, you know, what — not necessarily that anybody was malicious or intentional, but there were rules to be followed. And possibly, those rules were not followed so there should be additional signatures that would be invalidated,” Carroll said.

“I don’t really know … how this will go, but I think it’s worth the effort,” he continued.
