Witnesses attempt to prove irreparable harm of Rocky Flats refuge Judge to rule in next few weeks on preliminary injunction to refuge opening BY CHRISTY STEADMAN CSTEADMAN@COLORADOCOMMUNITYMEDIA.COM
Commuters honked their horns during the busy noon rush hour as they drove by the Alfred Arraj U.S. District Courthouse in downtown Denver on July 17. They were responding to a group of about 25 demonstrators holding signs that read “Test the soil before you build” or “Don’t track plutonium into my yard.” The demonstrators spent their lunch break holding signs on the corner of Champa and 19th streets amid a day-long hearing for the U.S. District Court to hear testimony from expert witnesses on an ongoing case concerning the Rocky Flats National Wildlife Refuge. The court did not make a ruling on the July 17 hearing, but is taking the motion under advisement, Judge Philip A. Brimmer said. Randall Weiner, the Boulder-based environmental attorney arguing the case for the plaintiff organizations, expects the decision on the preliminary injunction to come within the next few weeks, he said. Rocky Flats National Wildlife Refuge is a 5,000acre area of open land bordered by Broomfield, Boulder and Jefferson counties managed by the U.S. Fish and Wildlife Service. SEE ROCKY FLATS, P20
