MTS, NCTD see ridership increase on free ride day

The San Diego Metropolitan Transit System and North County Transit - San Diego Railroad today reported a double-digit increase in ridership during last week’s Free Ride Day.

The event, held Oct. 1, allowed San Diegans to ride transit free of charge on MTS buses, the Trolley, COASTER, SPRINTER, NCTD+ On-demand, and BREEZE fixed-route buses.

Combined, both agencies recorded 334,000 passenger trips during Free Ride Day, an 11.6% increase for MTS and 12.9% for NCTD.

NCTD saw an increase of 63% on its COASTER service, with SPRINTER seeing a 2.9% uptick.

This works with a client’s current irrigation system so that each time the landscaping is watered, the needed soil biology is replenished.

Covering the garden to keep out the critters

Somedays it is just a bad day in the garden. As hard as you try, the elements seem stacked against you, or an unwanted visitor invades your garden. In our case it is wildlife.

At the community garden at the Carlsbad Senior Center, I have taught a vegetable gardening class to our senior students for four years. Thirty other gardeners rent a space in the Pine Avenue Park, tending to 20-by-4-foot raised beds.

But this year, I have arrived at the garden each day to find huge holes in the bed, with soil scattered everywhere and plants ripped from the roots.

Our mission has become to find the critter and get rid of it!

WHAT IS ‘NUISANCE WILDLIFE’?

Ten years ago, when I directed the Cornell Master Gardener Program in Cooperstown, New York, a large part of our job was advising homeowners regarding garden issues.

We often had dozens of calls during the summer growing season regarding “nuisance wildlife.”

This group of animals

is so named because they often create havoc and can be destructive to both vegetable and flower beds. In New York state, suggested control methods include trapping, using smoke bombs and, if the gardener could afford it, motion sensitive lighting or sound deterrents.

ANIMAL CONTROL IN NORTH COUNTY

Since the senior garden is located in Carlsbad, we have to adhere to the rules of the city. Those include serious fines for killing nuisance wildlife, and the protocol is to use only non-poisonous deterrent substances

or live traps.

We tried to cover the hole with soil and heavy rock, poured hot pepper sauce and ammonia down the hole, but each day the hole got bigger.

After doing research and talking to a veterinarian, I found out that a number of different local rodents can be destructive in a garden, and each one has a different habit. Bunnies, for example, will eat most greens and leaves, but ground squirrels are mostly looking for a cool place to sleep.

Our squirrel had found the perfect place to sleep in our raised bed, which is 4

feet deep and has an automatic drip system. He was digging, and seemed interested in our newly planted seed beds.

PRODUCTS FOR ANIMAL

CONTROL

After researching products that would deter our squirrel, we finally decided upon a product from Bonide called Repels All.

This product, according to its label, “uses a blend of all-natural ingredients, including putrescent whole egg solids, cloves, and garlic, to deter various pests through smell, taste, and mild irritation to their eyes and nasal passages.

“The repellent is available in liquid and granular forms and is designed to protect yards and gardens from animals like rats, mice, squirrels, deer, and rabbits without harming plants, people, or pets when used as directed.”

We used the product twice a week, but our squirrel still returned to our bed. So, we decided to construct a cover for the bed.

OPTIONS FOR RAISED BED ENCLOSURES

Numerous videos and FYI sites will take you through the process of building an enclosure that will squirrel-proof your garden.

Two that I found helpful are at www.needlepointers. com and at joegardenerTV on You Tube. You can also search “raised bed garden covers” online to purchase a premade variety.

CREATE YOUR OWN GARDEN COVER

If you are a handy person and willing to make your own cover, here are some basic instructions for your DIY project.

1. Create a cover for the top of the bed using garden netting (It must be transparent). Purchase three hoops made of PVC or metal; two will be placed at each end of the bed, and one in the middle of the bed. Measure the length of the

garden to purchase yards of netting needed.

2. Pull the netting over the hoops and secure with plastic clips attached to the hoops. Secure the netting with tent stakes placed into the soil when you are away from the garden. Remove stakes when working on the garden.

3. The only difficulty with this design is that each time you need to water the bed, you will need to pull up the stakes and fold the netting back onto the top of the hoops.

4. When you are finished working on your bed, follow the process above to secure netting.

We found this method fairly easy to construct and to open when working on the garden. After three weeks using the cover, the critter has left our garden.

Renowned chef opens patisserie in North City

— Michelin-trained pastry chef, U.S. Chocolate Master, and culinary TV personality Christophe Rull has brought his talents to North City with the opening of his own pastry shop, in what may be the most fulfilling phase of his career yet.

Christophe Rull Patisserie, located at 251 N City Dr. #121 in the North City area of San Marcos, opened on Sept. 13 to wide acclaim. Customers will find a pastry case filled with an array of treats, including macarons, croissants, pecan rolls, and éclairs, as well as savory options such as quiche, breakfast sandwiches, and chia pudding.

“I am an ambitious guy. I always set myself some crazy goals, and this is one of them,” said Rull, who runs the patisserie with his wife, Wilma. “Now we just opened our business, and there is so much coming our way. The sky is the limit.”

The French-born Rull, 41, has over 20 years of experience working in the pastry industry, and has gained recognition on several Food Network competition shows as well as the Netflix series “Bake Squad.”

Rull’s vocation began at the age of 15, training and working at renowned restaurants as well as at the prestigious École Nationale

Supérieure de Pâtisserie. He then left France for Las Vegas, where he helped open the Aria Casino and Resort, and subsequently worked as an assistant executive pastry chef at the MGM Grand.

He then held the role of executive pastry chef at the AAA Five Diamond Park Hyatt Aviara Resort, Golf Club & Spa in Carlsbad from 2016 to 2021. He developed a love for North County and activities such as surfing and hiking.

Rull pivoted his atten-

tion to the Chocolate Masters competition, winning the U.S. title in 2021 and advancing to the world masters in 2022, where he earned fifth place. After that, he worked as executive pastry chef at the Hotel BelAir in Los Angeles until he began focusing on his own patisserie earlier this year.

The chef said he had no interest in advancing through the corporate ranks as a chef at a luxury hotel and had long wanted to open a pastry shop where he could execute his own

vision.

“I am not limited anymore,” Rull said. “That’s a blessing, because when you work in a hotel, there is always a corporate ladder.”

Rull said he was grateful to connect with the developers of North City at Sea Breeze Properties, who helped to support him and get the business off the ground in the 1,200-squarefoot space. He and Wilma also live a short walk away.

“Bringing Chef Christophe’s patisserie to North City is a huge win not just

for food lovers, but for our whole community,” said North City Senior Manager Andy Tenn. “He’s a worldclass talent, but he’s also a neighbor. That mix of quality and authenticity is exactly what we are creating here at North City for the long-term.”

For now, Rull said the patisserie is keeping him extremely busy. He is the sole chef in the shop, focusing on small daily batches, and is focused on imparting skills to his employees, many of whom are students.

In the future, he hopes to lead pastry classes and establish a chocolate program that will highlight his artistic and competitive background.

“It’s pretty hectic right now because it’s the beginning,” Rull said. “Wanting to showcase a really beautiful pastry shop is going to take time.”

N. Hollywood taqueria nation’s best, says Yelp

LOS ANGELES — A family-owned North Hollywood restaurant is being hailed as having the best tacos in the country, according to Yelp.

Coinciding with National Taco Day on Oct. 7, Yelp released a list of the best tacos in the U.S. and not only did California rate well, with 45 of the top 100 ranked taquerias, but Birrieria Familia Castro in North Hollywood topped the list.

Terrific Tacos catering took top honors for San Diego, placing 13th, and North County was represented by Craft & Taco Lounge at 511 W. Valley Pkwy. in Escondido (37th) and Sinaloa Mexican & Seafood at 1759 Oceanside Blvd. in Oceanside (57th).

McGill’s Johnny Rad’z Pizza lands in Leucadia

I’ll start this feature with a gesture of gratitude that the former Pandora’s Pizza spot on Coast Highway and Leucadia Boulevard is back to being what it was meant to be, a pizza joint at heart with a personality all its own.

At the new Johnny Rad’z Pizza, that personality celebrates the skate culture in Encinitas via our own Mike McGill, owner of McGill’s Skate Shop, inventor of the “McTwist” aerial trick that established him as one of skateboarding’s pioneers, and part of the iconic Bones Brigade team, alongside Tony Hawk, Lance Mountain, Rodney Mullen and others.

Coincidentally, and as you all know by now, Tony Hawk has his own skate-fo cused joint across the street at Chick & Hawk that has been in the works for the past few years — more on that venture coming soon.

And while my skate boarding adventures growing up in Royal Oak, Michigan, starting with metal-wheel 15 Toes boards, never advanced beyond cruising mellow parking structures, we did follow the adventures of the McGills and Hawks of the world from afar as they were all around our age.

Those skateboard ses sions also laid the founda tion for our surfing obses sion, beginning with the Great Lakes and eventually leading us to Encinitas. So yeah, there is a very loose connection to this scene, and I’m stoked to have two of its legends owning restaurants I can walk to.

crust. I sampled most of their offerings via slices, and they were all spot on; again, they passed that “next day cold” test as well. The slices ate like a New York City slice, pliable and easy to fold down the middle for that epic bite, a perfect slice can provide.

Historic local bar site sold

— The property that houses one of Encinitas’ longest-running businesses has sold for more than $6 million.

Neighboring bars, The Saloon and Shelter Bar and Lounge, located at 540-546 South Coast Highway 101, were purchased by a local private investor for $6.1 million in a deal announced Sept. 24.

James Bengala, director of brokerage services at Urban West Ventures, who represented the seller, said the historic businesses are part of what makes downtown Encinitas vibrant and unique.

“When we originally took this to market for sale a year ago, we had a good feeling that we were going to see just a handful of strong, local investors that really appreciate and understand the value of commercial real estate up and down the coastline and along the 101,” Bengala said. “The authenticity of the community is really felt in something like the Saloon.”

The buyer was represented by Cushman and Wakefield. A spokesperson could not be reached for comment.

The history of The Saloon property goes back several decades.

Maurice DeLay opened the Village Rendezvous at the site in the 1930s before it became the Grand Café in 1942 and the Daley Double Saloon in 1956, when Ruby and Frank Daley purchased the property, according to research by Kenneth Holtzclaw and Diane Welch.

The bar once hosted an illegal poker parlor upstairs and an outdoor smoking patio — now the location of the upscale Shelter Bar, which opened in 2013 — that featured Friday night boxing matches. Winning fighters received a $5 reward, according to Holtzclaw and Welch.

“It’s a place that has a lot of stories to tell,” Bengala said.

The 6,188-squarefoot property, which went on sale in September 2024, recently sold with a pricetag that Bengala said aligned with industry expectations. He added that the deal “further establishes viability and value in Encinitas.”

The property is fully leased to Saloon Entertainment LLC to operate both bars through February 2036, according to the press release. It is one of five businesses in Encinitas with a Type 48 liquor license, according to state records, which means food does not need to be sold on-site to serve alcohol.

San Marcos riders embrace microtransit

NCTD+ pilot hailed as success, program expands

Fifteen months after its launch, North County Transit District and San Marcos officials are calling the pilot year of the city’s on-demand microtransit program a success, touting growing ridership, a larger service area and cheaper fares.

The microtransit service, known as NCTD+, was launched in June as a 12-month pilot program, featuring a fleet of 10 vans that each seat eight people. San Marcos was the first of four cities chosen for the program, followed by a rollout in Vista in May.

Service in the 14-mile zone is available weekdays from 6 a.m. to 8 p.m. and weekends from 8 a.m. to 8 p.m., with trips able to be reserved via the NCTD+ app.

Transit officials updated the San Marcos City Council on the use of NCTD+ during a Sept. 23 meeting.

“We've been in service now a little bit over a year. It's going very well,” said NCTD CEO Shawn Donaghy. “I think the thing that we're seeing is a very positive trend, not only in ridership, but just in the excitement around what it means.”

NCTD+ San Marcos has had over 25,700 boardings since its launch, with an average monthly ridership of 2,150. During that time, NCTD made two crucial adjustments to the program: reducing fares and expanding the service zone.

The program began with a 10-mile zone, providing access to multiple areas, including several parks, Cal State San Marcos, Palomar College, shopping centers, the Boys and Girls Club, the San Marcos Civic Center, Kaiser Per-

manente Medical Center, and several transit stops.

Following residents’ feedback, the zone was expanded to 14 miles, to include more retail options, such as Costco and Target, as well as the San Diego Food Bank, and additional residential areas.

“The nice thing about this service is that it's really flexible, so we have this ability to expand service to where it's needed while also maintaining operational balance,” said Senior Transit Planner Ioni Tcholakova. Initially, one-way trips cost $5 for the first person and $2.50 for all additional riders in the same booking as well as for trips to or from an NCTD transit center. However, NCTD officials quickly learned that this cost was a barrier to entry for many riders.

Fares were reduced to $3 per one-way trip for the first person and $1.50 for each additional person on the same booking, as well as $1.50 for rides to or from an NCTD transit center. NCTD also expanded the Youth Opportunity Pass, making the microtransit service free for those 18 and under.

The majority of trips in San Marcos are to Palomar College and the Palomar College Transit Center, Tcholakova said. Other popular destinations are Cal State San Marcos, the Boys and Girls Club, various retail locations, and the Sprinter station.

City Council members said they are grateful to see the program flourishing, noting that this is something the city has been wanting for a long time.

“It's really great to see that we have this as an option, where we can actually put some money into something that we know is working and fitting in people's lifestyle. So, we really appreciate that,” said Mayor Rebecca Jones.

The City Council on Oct. 1 extended its citywide moratorium on battery energy storage projects, known as BESS, for a final time, carving out an exception for one proposal moving through the California Energy Commission.

The council first adopted an interim urgency ordinance about a year ago, halting permits for new battery energy storage system projects citywide. BESS facilities collect and store electricity from the grid for discharge during periods of high demand.

“I haven’t heard from one constituent clamoring to get a battery storage unit in Escondido,” he said.

Deputy Mayor Consuelo Martinez, who supported the extension, said she looked forward to adopting workforce standards and ending the moratorium. “We’re the only city that has a ban,” she said.

Councilmember Joe Garcia also noted unanswered question,s but said he wants a resolution soon.

“We’re also getting to the point where we should make a decision,” he said.

Data also shows that most riders are using the service repeatedly. Within the first year, each rider took an average of 25 trips, according to NCTD.

Donaghy said the service can also help more people to use other transit, due to the opportunities for connection to and from train and bus stations.

“Being able to get into those sort of landlocked pieces of the communities that are built around the 78 or built around some of our major corridors, I think is a huge win to those communities, to either get them to the Sprinter line, get them to a fixed route bus line, or just within San Marcos in general,” said Donaghy.

NCTD is also planning to launch the microtransit program in Fallbrook and Oceanside, although identifying funding for this service has been a challenge.

Councilmember María Nuñez said she receives numerous questions from residents about when the service will be expanded to other areas of San Marcos and about possibilities for making the fare more affordable, especially for senior citizens.

Donaghy said they always appreciate feedback about the microtransit program. Feedback can be provided by calling NCTD at (760) 966-6500.

When considering expanding the service in San Marcos, Tcholakova said they need to be mindful of wait times and avoid making them too long. Currently, riders can typically expect pickup within 30 minutes.

“We don't want to expand it so much so that we impact the customer experience and then actually discourage people to use the service,” Tcholakova said.

The move followed a summer 2024 decision to oppose large-scale BESS facilities in or near city limits and a fire at an existing local BESS site. The council extended the pause last November and again in May; it was set to expire Oct. 5. Staff said a full 12-month extension would be the last allowed.

A council majority chose to extend the ordinance for up to 12 months, but could lift it sooner. Whether that happens will depend on county rules now in the works, possibly including a project cap and siting maps that designate where BESS can be built.

In May, the council directed staff to study a potential cap, fold BESS rules into the city’s fire code update, set minimum workforce-safety standards for projects of 70 kilowatt-hours and above, and require C-10-licensed electricians for all electrical work with at least 15% holding ESAMTAC certification.

For now, the city aims to align its standards with those of the county.

“I would like to be in alignment as closely as possible,” Mayor Dane White said.

City Manager Sean McGlynn said he expects to brief the council as early as December on the county’s progress. Staff plans to return after the new year with workforce-standards options.

The mayor also proposed an exception for a California Energy Commission-backed BESS project at the Enterprise Peaking Plant.

Jon Boyer of Middle River Power said the company, working with the CEC, seeks to hybridize the existing thermal site to convert its gas power into backup energy. The project has been paused since the moratorium began.

Peaking plants, such as the Enterprise Street facility, were added statewide about 20 years ago during the energy crisis to restore power during outages quickly.

The council voted 4-1 to extend the moratorium, with Councilmember Christian Garcia opposed. Garcia agreed it made sense to wait for county regulations, but said earlier concerns re-

“We need to make sure we’re looking deeper in order to make the best informed decision because health and safety is our top priority,” she said.

City, county sue over disaster relief

The city and county of San Diego have filed a lawsuit along with more than two dozen local governments across the nation that challenges alleged Trump administration attempts to place unlawful conditions on emergency and disaster preparedness funds.

The lawsuit filed in federal court in Northern California alleges the federal government has threatened to withhold more than $350 million in Department of Homeland Security and Federal Emergency Management Agency grants unless the municipalities assist in the Trump administration’s immigration enforcement efforts, as well as abandon their own diversity, equity, and inclusion initiatives.

The San Diego City Attorney’s Office says that locally, those funds support wildfire and flood prevention projects, counterterrorism emergency response efforts, port and transit security infrastructure, and fire department staffing.

The lawsuit seeks a court order preventing the federal government from imposing any such conditions and a declaration that states those conditions are unconstitutional.

The complaint states that the local governments “now face a choice that is not only untenable and unlawful, but also urgent: either accept conditions that are unconstitutional and contrary to law, or lose millions of dollars in federal grant funding used to keep their residents safe and ensure continuity of government.’’

“The most important duty government has is to keep the public safe. The actions of the Trump Administration are not only wrong, but they will make us less safe,’’ San Diego Mayor Todd Gloria said.

Cuyahoga Valley National Park celebrates river reborn

n the trail to Beaver Marsh in Cuyahoga Valley National Park, I see two gentlemen engaged in a conversation about something they see with their cameras’ telephoto lenses. Without a request, one of the men offers me his binoculars and tells me where to look to find two wood ducks perched on a log across the creek. It takes a minute because the ducks are so well camouflaged. I manage to locate only one.

The marsh, once a junkyard of polluting car parts, old mattresses and miscellaneous trash, is today a thriving, biodiverse home to beavers, frogs, snapping turtles, and local and migrating birds. This watery habitat is blanketed by cream-colored water lilies that bloom fully in the summer.

We can’t help noticing the number of hikers and cyclists traversing the boardwalk that crosses the marsh. It’s a popular, well-used route, mostly because of the park’s proximity to metro Cleveland, Ohio, population 2 million-plus.

Cuyahoga (pronounced ky-a-HO-ga) Valley National Park (CVNP), 20 miles

long and six miles wide, was created expressly as an accessible resource for a large urban/suburban population. Its unique history includes many milestones and developments. Zoom to 1974 when a patchwork of 33,000 acres was designated a national recreation area; in 2000, the area graduated to national park status.

On today’s map, CVNP’s green expanses are sprinkled with white patches that represent private residences, housing tracts and the town of Peninsula, location of a storybook depot for the Cuyahoga Valley Scenic Railroad.

Features like the Beaver Marsh are not hard to find, as most are not far from

Riverview Road, the main artery that bisects north and south the park’s 51 square miles. The thoroughfare roughly follows the path of the Cuyahoga River, responsible for creating the valley and many of the park’s other features — waterfalls, rock formations, geological layering, flora and fauna.

About 25 miles of the 100-mile river flow through the park. Looking at it now, it’s hard to imagine that this river once bore the dubious designation as the country’s filthiest, so polluted that it caught fire 14 times. The last time, June 1969, spearheaded the country’s environmental movement and spawned the Environmental Protection Agency and

Clean Water Act.

Thanks to both public and private efforts, the river enjoys new life that benefits a variety of species, including the human kind. It also has been designated an official Ohio Water Trail.

“The Cuyahoga is one of the most kayakable rivers in the country,” says an energetic, gray-haired volunteer guide at the park’s Boston Mill Visitor Center, who adds that he has “been with the park since the beginning.”

He pulls out a newsprint map and points out some of the park’s most popular stops in the southern portion: Beaver Marsh; Everett Covered Bridge; Hale Farm & Village; The Ledges; the

Village of Peninsula, which prides itself on its sustainable policies that “remove the sources of pollution (like sewage) from entering the Cuyahoga River”; and Brandywine Falls.

We make a beeline to the upper viewpoint for this 60-foot-high, cascading falls via a sturdy boardwalk that takes visitors on a short, verdant journey. Those who can navigate multiple stairways can follow the longer, lower boardwalk, which provides the best photo viewpoint. (There also is a wheelchair-accessible route to the upper viewpoint.)

The falls’ bridal-veil effect is created by shale, soft rock that was formed from mud found on the floor of the

sea that covered this part of northeast Ohio 300 million to 400 million years ago. Today the waterfall attracts tourists because of its beauty, but early settlers viewed it as a source of power. Visitors can see the remnants of a grist mill just beyond the end of the upper-falls boardwalk. The falls also powered a woolen mill and a sawmill.

Local environmental enthusiasts say that CVNP should serve as a national model for protecting, restoring and transforming open spaces and waterways near urban areas that once were considered beyond saving.

It is with great sadness that I report the passing of my brother Howard Cuney.

He was born in Long Beach Ca. on Sept. 13 1948, he passed away on June 26 2025 in San Marcos Ca.

He died after a long battle with cancer, he beat the cancer but could not recover from the damage done to his health.

School in 1957, served in the U.S. Army and attended San Diego State College, where he pitched on the baseball team.

In 1966, he married Donna Maria Lopez at The Immaculata in San Diego. They were married for 50 years and had two children, Matthew and Alexa.

Together, they were a natural hub for family gatherings, and over the years they welcomed many family and friends to their beautiful homes in Hermosa Beach, Clovis, and nally in Encinitas, where they enjoyed beach life and were devoted parishioners at St. John’s Catholic Church.

Following in Donna’s footsteps after her death, Hilbert volunteered weekly at the church Food Pantry, collecting and providing food to those in need, and he continued to nurture family traditions and support his six grandchildren, attending school functions and sporting events whenever he could.

Howard graduated from San Dieguito High School in 1967.

He was an outstanding musician. He started out as a drummer but later switched to guitar. He could as we say, “rip your heart out with three chords”!

We played professionally for many years with some of great musicians in the Encinitas area, including our life long friend Skip Coash (RIP).

Howard was also a talented carpenter and even built a boat or two.

Fishing in Mexico was his favorite hobby. It actually went way beyond hobby, he was a serious sherman and very good at it. If poles didn’t measure up to the task he would make his own, they were beautiful.

Howard was also very proud of his service in the Merchant

Hilbert was the rst Mexican American hired at Xerox Corporation, where he worked for many years before going into commercial real estate with Coldwell Banker and CB Richard Ellis.

Hilbert was preceded in death by his parents, Manuel and Ida; his wife, Donna; and his brother, Raymond. He is survived by his son, Matthew (Bianca) of San Diego; his daughter, Alexa (Thorsten) of Willow Creek; his six grandchildren, Matthew, Jacob, Nevaeh, Jaiden, Aysiah, and Gavin; three nephews, Dan, Manuel, and Joseph, and his brothers and sisters-in-law.

He will be missed by all who knew him, including many loving cousins and devoted lifelong friends.

Memorial Service will be held on Wednesday, October 22, 2025 at 11:00 AM St. John the Evangelist Catholic Church, 1001 Encinitas Blvd. Encinitas

Growing up in Encinitas and Leucadia in the ‘60s was heaven. Our older sister Roberta Hart passed in 2023, our two younger sisters “Tinka, (Katherine) Hines and Heidi Beaver passed six and seven years ago. They are missed.

A Celebration of Life will be held at a future date. I would like to thank the many new and old friends that were with me at his bedside, that came to say goodbye, he loved you all. The Ors and nurses at Kaiser were tops in their care and compassion in this di cult time.

In loving memory: Walter Beljean and Magdalena “Miti” Ruth Beljean each died at their home in San Luis Obispo, after prolonged periods on hospice. Walt passed away on August 22nd and Miti only ve days later.

They celebrated 70 years of marriage together on July 24th.

Walt grew up on the Ho er Diary in Imperial Valley, and Miti in Encinitas on the Paul Ecke Poinsettia Ranch, owned by her aunt and uncle.

Walt worked on the ranch over forty years and they raised their four daughters there before moving to San Luis Obispo in 1997.

Both Miti and Walt were preceded in death by all of their parents and siblings, in addition to their daughter Heidi Beljean. They are survived by their daughters Joleen, Elisse “Honey,” and Kristin, 5 grandchildren and 8 great-grandchildren, besides many other relatives and friends.

A celebration of their lives will be held on Monday, November 10th beginning with a Mass at 11:00am at the St. John The Evangelist Catholic Church in Encinitas with a reception to follow.

39th Fur Ball raises over $1.5M for Humane Society

— More than $1.5 million was raised at the San DiegoHumane Society's 39th annual Fur Ball gala last weekend, the animal assistance group said this week.

More than 600 guests and about 200 pets attended Saturday night's event, which was held at the SDHS’s San Diego campus in the Morena neighborhood.

“We’re celebrating but we also have a very daunting task to take care of the thousands of animals that need homes here in our county,” San Diego Humane Society CEO Gary Weitzman said.

“We are over capacity on dogs and we have been for well over a year.”

Some of the evening’s festivities included red-carpet arrivals with dogs dressed in formal wear, a gourmet vegetarian dinner, silent auctions and an after-party with live music.

Officials said the SDHS is expected to help some 40,000 animals this year. More information can be found at sdhumane.org.

County home sales up in August

Home sales increased in San Diego County in August, the California Association of Realtors announced last month.

Closed escrow sales of existing, single-family detached homes in California totaled a seasonally adjusted annualized rate of 264,240 in August.

Last month’s home sales edged up 0.9% from the 261,820 homes sold in July and slipped 0.2% from a year

ago, when 264,640 homes were sold on an annualized basis, according to CAR.

The statewide annualized sales figure represents what would be the total number of homes sold during 2025 if sales maintained the August pace throughout the year. It is adjusted to account for seasonal factors that typically influence home sales.

Localized data is not seasonally adjusted.

San Diego County’s sales figure was up 1.3% from July, but down 0.6% from August 2024.

Home prices declined in San Diego County in August.

The median sale price of an existing, single-family home in San Diego County was $1.02 million in August, down from $1.04 million in July, and an increase from $1.01 million in August 2024.

August’s statewide median home price $899,140, a 1.7% increase from July and up 1.2% from $888,740 one year ago.

The highest median price in California in August was San Mateo County’s $1.98 million. The lowest was Lassen County’s $221,000.

O’side hit-run victim identified

Authorities have publicly identified a man who was killed last month in a hitand-run accident in Oceanside.

Josiah Baker, 43, was walking in the roadway in the 3000 block of Oceanside Boulevard shortly before 10:30 p.m. on Sept. 25 when a pickup truck struck him

from behind, according to the San Diego County Medical Examiner’s Office.

Following the fatal impact, the motorist drove off, the agency reported. Baker died at the scene from bluntforce trauma to the head, neck and torso.

The medical examiner released no community of residence for Baker.

Officers responded around 10:20 p.m. to reports of a male pedestrian who was struck by a woman behind the wheel of an eastbound 2020 Ford Ranger on Oceanside Boulevard just west of El Camino Real, according to Oceanside police.

Investigators identified Oceanside resident Yolanda Orozco, 65, as the suspect and registered owner of the Ford. Police said Orozco showed signs of intoxication and admitted to being the driver of the vehicle at the time of the crash.

She was arrested on suspicion of felony hit-and-run, with additional DUI-related charges pending the outcome of the investigation, OPD stated.

Fatal San Marcos crash victim ID’d

Authorities this week publicly identified an octogenarian who lost her life last week to a traffic crash in her hometown of San Marcos.

A passerby made a 911 call at about 3:15 a.m. last Monday to report finding 80-year-old Jean Stickel’s car overturned in a vacant lot alongside West San Marcos Boulevard, near state Route 78, according to the Medical Examiner’s Office.

Oceanside greenlights 401 Mission project

Controversial project to replace Regal Theater

OCEANSIDE — After postponing its final decision over the summer, the City Council has unanimously approved a revised version of the controversial 401 Mission Avenue project, which will replace downtown’s Regal Theater.

The project, previously presented to the council on Aug. 6, initially proposed 332 residential units and 18,682 square feet of commercial space on a 2.72-acre site along Mission Avenue in the downtown district. The original plan would have replaced the existing 15,462-square-foot public plaza in front of the theater with two smaller outdoor plazas totaling 9,449 square feet.

After hearing pushback from residents, the developer requested a continuance to address concerns. The council postponed its final decision until Oct. 1.

The developer returned with several changes, including reducing the total number of units to 326 and expanding the commercial retail space to 26,490 square feet. The revised plan also includes a new 15,439-square-foot public plaza.

“Even before that, they were trying to downsize and make the theater smaller,” Rivas said.

Rivas said the developer explored other potential theater operators but found no interested parties, citing easier access points at other regional theaters.

He said the existing theater is “on life support.”

Deputy Mayor Eric Joyce raised concerns about a proposed amendment to the public plaza easement. The plaza will remain open to the public until 2064, but the amendment clarifies the developer’s right to use the area for special events and pedestrian passage. Joyce worried this could restrict public access, but Rivas assured the council the plaza would continue to operate as it has for years.

However, many cities throughout the state, including North County specifically, have registered their opposition, stating that the bill would supersede local land use planning, fail to produce any affordable housing, and impact multiple neighborhoods near the North County Transit District’s Coaster and Sprinter lines.

Cities in opposition include Oceanside, Encinitas, Vista, Solana Beach, Carlsbad and Del Mar, as well as the San Diego Association of Governments, or SANDAG.

“It’s bad policy,” said Solana Beach Mayor Lesa Heebner. “I think it’s over the top, because it obliterates the planning that we have done.”

Heebner said she hopes the governor will veto SB 79 and clarify that these kinds of drastic measures should only be in place for cities with out-of-compliance Housing Elements, the state-approved housing production plans adopted by each municipality.

Encinitas leaders also requested that Newsom veto the bill.

“SB 79 doubles down on the recent trend of the state overriding its own mandated local housing elements. This latest overreaching effort forces cities to approve transit-oriented development projects near specified transit without regard to the community’s needs, environmental review, or public input,” Encinitas Mayor Bruce Ehlers wrote in a Sept. 18 letter.

Allowable project sizes vary depending on their distance from a transit stop, as well as the type of transit stop.

The largest projects would be allowed near the busiest rail stations, known as Tier 1, specifically those served by heavy rail or very high-frequency commuter rail, equivalent to at least 72 trains per day, excluding long-distance Amtrak service.

Tier 1 projects within a quarter mile of these stops would be allowed a height of 75 feet, density of 120 dwelling units per acre, and a floor area ratio of 3.5:1, and projects within a half mile would be allowed heights of 65 feet, density of 100 dwelling units per acre, and a floor area ratio of 3:1.

Tier 2 transit stops are

those served by light rail or high-frequency commuter rail with 48 to 71 trains per day. Projects up to 65 feet tall would be allowed within a quarter mile, and those up to 55 feet tall within a half mile.

In an attempt to curb concerns from smaller jurisdictions, bill sponsors made an 11th-hour decision to carve out an exception for cities with fewer than 35,000 residents, thereby limiting the application of SB 79 to projects within a quarter-mile zone of applicable stops.

A project within 200 feet of a transit stop would be eligible for further size increases, including an additional 20 feet in height, a density of another 40 dwelling units per acre, and an increased floor area ratio.

State Sen. Catherine Blakespear (D-Encinitas) was one of eight senators to vote against the bill. The former mayor of Encinitas said she could not support legislation opposed by so many of her constituent cities.

“The fact is that we have a process that distributes local land use decision making to local officials. This goes around the established process,” Blakespear said. “In Encinitas, I was extensively involved in that, and

we wouldn’t have wanted those decisions made for us.”

According to an Oct. 6 newsletter from Blakespear’s office, transit stations, specifically in Oceanside, San Diego and Vista, would be affected by the legislation.

The bill also allows projects on land owned by transit agencies if it is located within a half-mile of a qualifying stop. At least 50% of the total square footage for these projects must be residential, and at least 20% of the total number of units must be deed-restricted for lower-income units.

The agency’s board of directors can also adopt its own zoning standards governing uses on this land, and must involve public comment in the process.

Outside of SB 79, North County Transit District (NCTD) has already been working for several years to develop mixed-use projects on its properties. A major project planned for the Oceanside Transit Center will bring 500 apartment units, a boutique hotel, expanded retail offerings, and over $100 million in transit improvements.

NCTD leaders did not respond to requests for comment from The Coast News.
