'Anchors Away' 4th launch helps disabled students cast away obstacles to success Partnership with Miami-Dade County Public Schools flourishes

BY BARI AUERBACH Just sit right back and you'll hear a tale of a very inspirational trip - growing from the idea for just one boat - to an entire fleet of ships. The fourth "Anchors Away" launch at Oleta River Sate Park was a monumental event as six new boats joined a fleet of 29 others already making it possible for children with physical and intellectual disabilities to learn to sail and set a course for success in the marine industry.

This year's Anchors Away launch, in honor of National Disability Employment Awareness Month, was attended by a dedicated crew of benefactors and community leaders uniting in efforts to teach disabled students how to sail on their own while learning, science, math and life skills - an innovative concept conceived by Dr. Jayne Greenberg, Director of Physical Education and Health Literacy for Miami-Dade County Public Schools.

Anchors Away students who are now the "captains" of their boats attend North Miami Beach Sr. High, American Sr. High, Braddock Sr. High and Jorge Mas Canosa Middle.

The Sterling Aventura resident Dr. Louis Stein celebrates 106 sterling years The Sterling of Aventura pulled out all the stops at a recent birthday bash honoring resident and veteran Dr. Louis Stein on his 106th birthday.

With the main lobby of The Sterling filled to capacity with residents and guests to share in his honor, Dr. Stein danced his way out to be received by the crowd as a band played his favorite tunes. The crowd followed immediately by singing Happy Birthday as a giant cake was brought out and Dr. Stein made a wish before blowing out the 106 candles.

"Dr. Stein's positive outlook on life makes him a joy for residents and visitors to be around," says Harry Teich, Executive Director, The Sterling Aventura.

On behalf of the City of Aventura, Vice Mayor Luz Weinberg was present to personally congratulate Dr. Stein on this momentous occasion.

When asked what has kept him going for so long, Dr. Stein cites "women, brandy and dancing."

Eric Beck returns to Madie Ives Elementary as Principal for a Day Eric Beck of IT Doctors recently paid a visit to the principal's office at Madie Ives Elementary where he was invited to sit in as Principal for a Day shadowing Dr. Tanya Brown Major.

As a Madie Ives Elementary alumni, Eric welcomed the opportunity and enjoyed a full day of activities including conducting the school's on-air announcements.

Eric was pleasantly greeted with a surprise visit from his father Les Beck who made many trips to that same office, only this time he had the pleasure of commenting that he was happy to see his son on the other side of the principal's desk.

"It was really exciting to be there again," said Eric. "It's amazing how nothing has really changed in 25 years but for some reason the tables and chairs seem so much smaller!"

Aventura Hospital welcomes Kenneth Bernstein to the Board of Trustees Aventura Hospital is proud to welcome Kenneth R. Bernstein to the Board of Trustees.

Bernstein has served as the General Counsel of Turnberry Associates since 1994. An active member of the South Florida community, he is currently Vice Mayor for the town of Golden Beach. Additionally, he has been involved in numerous charitable and civic activities in the City of Aventura and Town of Golden Beach. Wall Street finally got a boost during a recent week. Surprisingly, it looked like it was on recovery from the slow but solid growth of the summer.

Investors had more questions than answers about whether they really wanted to put money into the markets as it reached the closing bell. However, the big question on everyone’s mind is: Are there any solid positive signs about the recovery to keep investors in the mood to keep buying?

According to the payroll processor ADP, the most recent private employment figures showed that another 203,000 workers were cut from private companies. And in figures released recently, unemployment was now over 10 percent for the first time since the early 1980s. As predicted, unemployment is getting worse. However, several key non-manufacturing sectors of the economy are showing slight positive gains. That’s a good sign that the recovery, although weak, is still making progress.

So why is gold hitting new highs, approaching almost $1,100 an ounce?

Commodity markets are seeing more activity as the dollar weakens in foreign trading. Meanwhile, wholesale oil is hovering over an average of $80 a barrel.

The Federal Reserve’s latest meeting also boosted recent trading. By choosing to keep interest rates at recordbreaking lows, the Fed is apparently more worried about the recovery moving forward without tightening the flow of money, and less worried about our economy’s inflation.

The Federal Reserve reports that economic activity has continued to pick up.

Conditions in financial markets were roughly unchanged, on balance, over the inter-meeting period.

Activity in the housing sector has increased over recent months.

Household spending appears to be expanding but it remains constrained

by ongoing job losses, sluggish income growth, lower housing wealth, and tight credit. Businesses are still cutting back on fixed investment and staffing, though at a slower pace.

Fortunately, they continue to make progress in bringing inventory stocks into better alignment with sales.

Recent gains helped the Dow get back to where it was about a month ago.

Investors seem to want to get their money back in the markets. Yet, they don’t seem to want to take any undue risks or to over extend themselves in the current, still shaky economic climate.

While the Feds’ latest move to essentially let it ride will help keep consumerlevel interest rates low, they are not helping people that are living on fixed incomes. For people who depend solely on CD’s or other interest rate-based securities, it is highly unlikely for them to see any additional monthly dividends.

On the upside, the United States Commerce Department reports that industrial production in September grew by 0.9 percent, which is much better than expected. That’s the fifth increase during the past six months.

Positive gains were posted by Ford and General Motors, following the “Cash for Clunkers” program. The problem is — without official plans for new products and dwindling inventories, Chrysler still is struggling. Ironically, production grew in machinery and military aircraft manufacturing.

Furthermore, soft sales hit Miamibased Royal Caribbean Cruise Lines. It reported that its third quarter earnings were down more than 44 percent from last year. However, it also reported $1.7 billion dollars in revenues, which is a lot better than expected. With continuing volatility on Wall Street, some investors are turning to the commodity markets, which are heating up again.

The bad news for the rest of us is that as investors continue to move into the commodities markets, the price of oil could start rising again. And that means pump prices might start climbing up as we approach the holidays.

His vast experience as a strategic analyst in the Intelligence branch as well as in the Southern Command Military Headquarters in Be’er Sheva combined with his diplomatic (Arab) experience made him one of the first line analysts within the IDF and the Foreign Service.

The JNF Campaign “Kick-off” event will heighten awareness about the mission of JNF – a non-profit organization founded in 1901. JNF set out to achieve its goal of purchasing the land that would become the State of Israel in 1948 and has since evolved to meet Israel’s most pressing needs including a water crisis and other environmental challenges.

Over the past century, JNF has planted over 220 million trees; built over 200 dams

and reservoirs; developed over 250,000 acres of land; created more than 400 parks; and educated students around the world about Israel and the environment.

Adapting priorities to those defined by the Israeli government, over the years, JNF has provided support relating to infrastructure needs, education, unemployment and has been addressing the water crisis since the mid 1980’s. Without reservoirs built by JNF, Israel would have lost billions of gallons of water that would have otherwise flowed into the Mediterranean Sea and the desert.

Encompassing all of JNF priorities is “Blueprint Negev” - a 10-year, $600 million campaign to revitalize the Negev Desert and make it home for future generations. Currently, this region makes up 60% of Israel but is home to only 8% of the population. The development of this region will also create jobs to help narrow existing social and economic gaps.

Gaining financial confidence in an uncertain world

BY MICHAEL A. SCHEAR Life can be uncertain, especially in regard to managing your personal financial affairs. Some investors find themselves overwhelmed with information and conflicting advice. Others don’t have the time or interest to manage their personal assets and liabilities with discipline.

Take, for example, planning for retirement, your children’s or grandchildren’s education, and other major financial goals in your life. How much is enough? As you answer this question, you generally should consider a reasonable rate of compounded growth, as well as principal erosion through taxes and inflation and the possible impact of ongoing market changes. But few people have the knowledge or the time to do this on their own.

Traditional planning can create an illusion of stability. But nothing happens every year exactly as predicted. Goals change with your station in life — and financial and market conditions are constantly changing as well.

And what about drawing down your wealth once it has accumulated? How much can you safely withdraw each month in your retirement? This will depend on your investment returns, the inflation rate, changes

in your health or marital status, whether you live beyond your life expectancy and other factors.

As you take inventory of your important financial goals and prioritize them, know that proper planning can help provide a picture of financial strategies.

However, past performance is no guarantee of future results. Through periodic reviews of your goals and the performance of your investments, you can assess how your actual investing and spending patterns affect your chance of success. Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments?

If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments.

Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
