Do YOU need a specialist Will? HAVE you ever considered what the effect might be on our savings and investments (or even our home), if the probability arises of us requiring residential care later in life? If not, you are in the majority; however, consider that it has become increasingly apparent that the State will only provide for those with little or no savings or assets, meaning that everyone else is expected to pay at least part (if not all) of his or her costs. Even if you don’t have the cash readily available, the Department of Social Security can still place a charge against the family home, which enables it to recover the monies owing, when the property is sold!

But there is a solution - Property Trust Wills. A ‘Property Trust’ is based around three, basic elements: the basis on which you own your property; the Trust terms; and your Wills, which contain the Trust investment. The Property Trust can only be created while both partners remain alive, and the property must be owned as Tenants in Common (the Trust instrument is, then, included in both Wills, but does not come into force until the death of the first). Upon the first death, their share of the property (typically 50%) is placed into the Trust to be adminstered by the Trustees nominated in the Will, and this, usually, includes the surviving

spouse. The Will also specifies who is to be the ultimate beneficiary of this share in the property, and the Trustee’s duty is to protect the property for the beneficiaries’ benefit. The surviving spouse, under the Trust’s terms, has the right to remain living in the property for the rest of his or her life; on the death of the second spouse, the Trust comes to an end, and the property passes absolutely to the beneficiaries. So, Why Bother Making A Will?! THE answer is that there are MANY reasons why you should make a Will! If you die without a Will (Intestate), all your money and possessions (your Estate) will be distributed, according to strict, legal rules and regulations; called the Laws of Intestacy, these distribute an Estate in a way the deceased would not have wanted - sometimes with disastrous results! And the time to write your Will is (without doubt) NOW! There may be plenty of life in you yet, but accidents and illness have absolutely no respect for age; also, bear in mind that a modern Will is written in such a way that it shouldn’t need much changing, so it’s not something you have to think about often (only in the event of a major change in circumstances [such as marriage, birth of a first child or divorce]). If you die Intestate, your circumstances will fall into one of the following categories: MARRIED, COHABITING and SINGLE. MARRIED: In the event of the death of a married

person, the Intestacy rules divide the Estate into shares, with a share going to the surviving husband or wife (the spouse). The popular belief that a spouse automatically inherits everything is SIMPLY NOT TRUE, because your nearest blood-relations (children, parents, brothers, sisters etc.) are also entitled to take a share under the Intestacy Rules, and the spouse’s share could be the smallest one. COHABITING: If you live with another person unmarried (including single-sex couples), with respect to finance and inheritance, you do not have the same rights as a married person, so the following information applies more to you:SINGLE: If a singleton dies without a Will, the line of Inheritance can be complicated, and can often involve relatives you have never even seen! It will take months (possibly even years) to sort out your affairs, and the solicitors who sort this out will charge THOUSANDS OF POUNDS for their work money, which for the sake of making a Will (£89), you could have left your children!

Triumphant tappers overcome tentative terpsichore DODGY dancy features prominently in Congleton Players’ next production at Daneside Theatre in October. For, they are staging Richard Harris’s acclaimed comedy, ‘Stepping Out’, a warm, funny play about the lives of a group of women (and one man) attending a weekly tap-dancing class in a dingy church hall.
