WB sued for allowing racial harassment The Western Brown School District is facing a federal lawsuit alleging a pattern of racial discrimination in the district. The suit was filed in April by Dale Fulton and KellyBishop Fulton on behalf of their son Elijah. The Fultons allege that their son was subjected to a pattern of repeated racial harassment and that the district took inadequate action to prevent it. They are asking for $327,000 in damages. The Fultons also sued the Brown County Educational Services Center and Investigator Don Raybold and asked for one million dollars in

punitive damages. Federal Judge Sandra Beckwith dismissed the claims against the ESC and Raybold in June, writing that the Fulton’s failed to demonstrate that either had a policy or history of discriminatory conduct. Beckwith also threw out the punitive damages claim because school districts are not subject to such claims under federal law. Regarding her decision to uphold the claim against Western Brown, Beckwith wrote; “Plaintiffs complained on multiple occasions to both school administrators and members of the School Board about the harassment to which E.F. was being subjected. Nevertheless, accord-

ing to the complaint, Plaintiffs complaints were essentially ignored - neither the school administrators nor the School Board took any affirmative measures to stop the harassing conduct. Discipline, with one exception, was not meted out to offending students; teachers and administrators remained uneducated and untrained on how to deal with racial harassment. Additionally, the School Board failed to appoint an anti-harassment compliance officer as required by its by-laws. Clearly, the failure of the School Board to take any steps to stop the racial harassment E.F. was experiencing, despite its awareness that such harassment was ongoing, is not reasonable and can be said to

represent an official policy or custom of the School Board...Similarly, the School Board’s failure to appoint an anti-harassment compliance officer despite its by-law requiring it do so evinces a custom or policy of deliberate indifference to the need to address claims of racial and other forms of unlawful discrimination. In summary...the School Board had a policy of deliberate indifference to the racial harassment and discrimination allegedly suffered by Plaintiffs.” The Office of Civil Rights of the United States Department of Education conducted an investigation into the Western Brown School District and CONTINUED ON PAGE 9

Dallas Hurt resigns as Coroner warned again to BC Democrat chairman stop Goldson death probe BY Wayne Gates The Brown County Press Dallas Hurt has resigned as chair of the Brown County Democrat Central and Executive Committees. In a letter to the democrat central committee dated October 12, Hurt resigned as of 3:00 p.m., October 13. The letter is reprinted below. “Committee persons: Since the Primary Election of 2006, our local Party has split into two different factions. This resulted in the vacancy of half the Committee seats in the 2008 Election. The local Party has limped along since then, trying to fill vacancies, rallying behind certain candidates, but leading no campaigns. It is a fact our Executive Committee has become dysfunctional. In January 2015, you and Ralph Quallen asked me to take the Appointment of the Secretary of State for the unexpired Bd of Elections seat of Ralph Quallen through

Spring of 2016. I have fulfilled all the positive things you asked of me to this date and I balk at the request to hobble and render the Bd of Elections tied and paralyzed so as to sabotage the Election

process. I will not let personal vendettas destroy the Elections process in this County. I, hereby tender my resignation as Chair of the Brown County Democrat Central and Executive Committees, effective at 3:00 PM, October 13, 2015.” In further remarks emailed to the Brown County Press, Hurt expanded on his comment on what he referred to as “the request to hobble and render the Bd of Elections tied and paralyzed so as to sabotage the Election process.” Hurt wrote “At recent meetings of the Committee I have been asked to use my seat on the Board of Elections to tie the votes up; use the position to "throw everything into the lap of the Secretary of State, in order to prove that an election can not be put on without Director Kathy Jones". I don't believe that is true and I resist being pushed like that.” CONTINUED ON PAGE 9

Floats already under construction for Mt. Orab Christmas parade

BY Martha B. Jacob The Brown County Press With all the hype about the November 6 release of the new “Peanuts” Movie, featuring Snoopy and Charlie Brown, the Mt. Orab Parade Committee wasted no time in resurrecting their Charlie Brown costumes from years past. “A long time ago we had the Charlie Brown characters in the parade, but we’ve had them stored in the basement,” said committee member and Mayor of Mt. Orab, Bruce Lunsford. “But now this year’s Christmas parade will be on Nov. 28, the first Saturday after Thanksgiving, which is just a few weeks after the new Peanuts Movie is released. The kids will really enjoy seeing these characters from that movie, in their hometown parade.” The spectacular Mt. Orab Christmas Parade is sponsored by the Mt. Orab Port Authority and Mt.

BY Wayne Gates The Brown County Press Brown County Coroner Dr. Judith Varnau and her staff have been warned once again to stop investigating the death of Zachary Goldson. Brown County Common Pleas Magistrate Ken Zuk granted a protective order against Varnau and her staff on October 14. Attorneys for five current and former Brown County Sheriff’s Office employees moved for the order after the

coroner’s office sent out requests for information in August that related to Goldson’s death. Brown County Common Pleas Judge Scott Gusweiler ruled in April that Varnau cannot continue to investigate the death of Goldson. Gusweiler wrote, “The court does want to make its order abundantly clear. There is one action and one action only that the Brown County Coroner, Judith Varnau may take with respect to the death of Zachary Gold-

son. She may petition the Brown County Court of Common Pleas to change the cause of death of Mr. Goldson to something other than homicide by strangulation. Any other action at all by the coroner, her staff or her investigators will be treated as a direct contempt of this court’s order and will be punished accordingly.” Zuk noted the clarity of Gusweiler’s ruling when speaking with Varnau attorney Thomas Eagle. Four of the main characters from the new ‘Peanuts Movie’ will be on hand for the children to see and visit during the upcoming 2015 Christmas Parade set for Saturday, Nov. 28 in downtown Mt. Orab. Shown in the photo is Mt. Orab Mayor Bruce Lunsford who is also a member of the Parade Committee.

The Georgetown Post of the Ohio State Highway Patrol is currently investigating a two vehicle fatal traffic crash. The crash occurred on October 12, 2015, at approximately 8:10 A.M. on US 68 at SR 123 in Perry Township, Brown County, Ohio. The preliminary investi-

gation reveals that a 2007 Kia Sorento, operated by Brittany Turner, age 22, of Gilbertown, Alabama was traveling eastbound on SR 123. A 1998 Honda Accord, operated by Tiffany Beckelhymer, age 32, of Batavia, Ohio was traveling northbound on US 68. The Kia operated by Mrs.
