Cummings and James Paul Hamby, III, lived together at 202 Cook Street, Greenville, SC 29601. 7. According to the records maintained by DMV, there are no lienholders. 8. The Greenville County Sheriff’s Office, pursuant to the provisions of S.C. Code Ann. §56-5-6240, as amended, seized the subject automobile at the time Defendant James Paul Hamby, III, was arrested. The subject automobile has been in the care, custody, and control of the Greenville County Sheriff’s Office since June 17, 2013. 9. Defendant James Paul Hamby, III, was convicted of Driving Under Suspension on June 3, 2015. 10. The subject automobile was seized and confiscated by the Greenville County Sheriff’s Office in accordance with the provisions of S.C. Code Ann. §56-5-6240, as amended, in that Defendant James Paul Hamby, III, at the time of the offense: (A) Had either been convicted,

pled guilty or nolo contendere to the offense of Driving Under Suspension on at least three prior occasions within the last five years, (B) Was driving the subject automobile with the express or implied authorization of Defendant Tonya L.
