Rankings Reveal Lawm
To help North Carolina citizens evaluate their le Conservative Effectiveness Ranking of North Carolin This set of Civitas Action Rankings provides insight on votes in the 2013 session, which produced landmark advances for conservative policies. “The General Assembly had great success advancing conservative reforms in its 2013 session,” Civitas President Francis De Luca said. “But more needs to be done to ensure people here enjoy the benefits of prosperity and freedom. And success can lead to complacency. We will continue to urge our elected officials to stick with proven, successful conservative solutions to the challenges facing North Carolina.” The average score for Senate members is 71 percent, while House scores averaged 60.7 percent. Scores suggest that the Senate voted more conservatively than the House in 2013, with more than half of the Senate members earning an “A”, while no House members garnered such a high mark. Five House members earned a “B+”, the highest grade awarded in that chamber. The Civitas Action Conservative Effectiveness Ranking is the only rating system in North Carolina that allows the citizens of North Carolina to gauge how effective their state legislator actually is in votes in the legislature. Civitas Action has been producing its annual legislative ranking since the 2008 legislative session. “These rankings will increase the transparency of the legislative process by allowing citizens to see how their representatives ranked when scored on votes,” De Luca added. “The scores and rankings should be helpful to citizens in evaluating if their elected legislator is truly representing them.” The Civitas Action Conservative Effectiveness Ranking is modeled on a similar system of scoring Congressional votes. Civitas Action tracks and reports on a wide variety of issues before the North Carolina General Assembly, ranging from taxes and spending to social issues. We then select bills and amendments based on a commitment to conservative ideals based on free-market economic policies, limited government, personal responsibility and civic engagement. Civitas Action analyzes each member’s vote on relevant legislation, amendments and motions to create a clear picture of his or her ideological stance. In the end, our rankings provide a balanced, comprehensive picture of each individual member based upon recorded votes. For the 2013 session, actions that were ranked included key legislation such as the state budget, tax reform, setting up a state Obamacare exchange/Medicaid expansion, election reform and unemployment insurance reform. HB 4 Unemployment Insurance Fund Solvency & Program Changes Reformed NC’s unemployment insurance program to facilitate repayment of more than $2.5 billion borrowed from federal government to cover benefits. Reform reduced duration and maximum benefits for UI benefits (among other alterations). Bill also slightly increased UI tax on employers, but kept rate lower than would have been under original repayment plan. Reform will save the state millions in interest payments on the borrowed money, and has noticeably reduced unemployment. Civitas believes the conservative position is to save taxpayers millions through the more rapid repayment of debt and to reduce the incentives for people to remain unemployed. HB 74 Regulatory Reform Act of 2013 Attempts to scale back onerous state regulations by requiring fiscal impact statements for significant rules changes and mandating review of rules every 10 years. Rules that go unreviewed automatically expire. Bill includes numerous changes to other regulations impacting commerce. Civitas believes the conservative position is to limit government intervention, and to actively seek to undo bureaucratic red tape. HB 998 Tax Simplification and Reduction Act Makes numerous changes to NC’s state tax code, resulting in the largest tax cut in state history. Reduces and flattens income tax rates, reduces corporate tax rates, slightly expands the sales tax base, caps the gas tax for another year and repeals the state death tax. Civitas believes the conservative position is to lower taxes and to work toward eliminating biases in the tax code. SB 76 Domestic Energy Jobs Act This bill seeks to establish a more streamlined permitting process for onshore energy exploration, assigns royalty and revenue from future energy exploration activities to specific purposes, and urges the Governor to negotiate a pact with Virginia and South Carolina to develop a unified strategy for expanding on- and off-shore energy sources. Civitas believes the conservative position is to reduce government obstruction to access to safe, affordable energy sources that will create thousands of jobs. HB 683 Commonsense Consumption Act Bars local governments from regulating the size of soft drinks. Includes tort reform measures to limit liability from lawsuits over free will food consumption (i.e. suing McDonald’s because their burgers made you gain weight.) Civitas believes the conservative position is that government has no businesses regulating food and beverage intake, and that individuals bear responsibility for what they willingly eat and drink. SB 4 No NC Exchange/No Medicaid Expansion Obamacare represents a government takeover of the medical care and health insurance industries. This bill kept North Carolina government from partnering with this act. With this bill, North Carolina did not set up a State-based health exchange and was not forced to expand the already bloated and inefficient Medicaid program. HB 817 Strategic Transportation Investments Alters the DOT’s outdated and inefficient equity formula to allow for more prudent use of transportation dollars. Civitas believes the conservative position is for state government to more efficiently allocate existing taxpayer dollars, rather than just continue to spend more. HB 248 Taxpayer Debt Information Act Requires bond referendums to include information on the ballot of both the principle and interest that would need to be repaid on the debt in question. SB 129 Limit State Facilities Finance Debt Act Places limits on the amount of “special indebtedness” the state can issue. This “special” debt does not require voter approval and carries a higher interest rate, the most common form is Certificates of Participation (COPs). HB 177 Amend Certificate of Need Laws Amends existing CON law by allowing for new free standing surgery centers be built without CON approval. Civitas believes the conservative position is that all CON laws should be repealed because they restrict competition by forcing medical care providers receive permission from the state to expand or build new facilities. HB 18 Youth Skin Cancer Protection Act Bans all North Carolinians under the age of 18 from indoor tanning. Civitas believes the conservative position that it is the parents’ responsibility to determine whether or not to expose their children to the risks of indoor tanning. SB 18 Amend Locksmith Licenses/Raise Fee Ceiling This bill severely limits the conditions under which a non-locksmith can open a locked door, and also triples the yearly fee for the issuance of a license or renewal from $100 to $300. Civitas believes the conservative position is that occupational licensing is an unnecessary government intrusion into industry, and primarily benefits existing professionals by raising barriers to entry. HB 269 Special Education Scholarship Grants for Children with Disabilities Provides parents a grant of up to $3,000 per semester to help pay the costs of educating a special needs child in an eligible private school. Civitas believes the conservative position is to support educational choice initiatives that give parents more control over their children’s education. SB 353 Health and Safety Law Changes This bill included several provisions, most notable of which were limiting abortion coverage in insurance plans offered on the insurance exchange, prohibiting abortions when the sex of the unborn child is the main reason, and to study the conditions of abortion clinics. HB 695 Family Faith & Freedom This bill included several provisions, including prohibiting the use of foreign laws from being applied to family court actions, expands the conscience rights of medical providers who object to abortion, bars sex-selective abortions and requires a doctor be physically present for the full procedure during an abortion. SB 306 Capital Punishment Amendments Repeals the remaining statutes in the Racial Justice Act, and includes other efforts to end the moratorium on the death penalty. Civitas believes the conservative position is the RJA used very flawed methodology to allow convicted murderers to escape their death sentence (while their guilty verdict is never in doubt), and the death penalty for the most severe crimes is appropriate and effective. HB 392 Warrant Status/Drug Screen Public Assistance Requires social services to verify that welfare applicants are not fleeing felons or parole violators, also requires drug screening for some welfare applicants. HB 589 Voter Information Verification Act Broad-sweeping reform to NC’s election laws, most notably: requiring valid ID at the time of voting, end of same day registration, reducing number of days of early voting, end of registration for 16-year olds, end of straight party voting, and many other provisions. Civitas believes the conservative position is that voter ID is a commonsense measure to reduce the potential for voter fraud, and other sensible measures included in this bill are important to preserve the integrity of elections. HB 17 Gun Permits Confidentiality This bill ensures personal information of legal permit gun owners is accessible by law enforcement but not the public in general. Civitas believes the conservative position is to ensure the privacy of those gun owners exercising their right to bear arms. HOUSE ONLY House: 2R, RCS #152 (97-20)
SB 402 2013 State Budget State budget bill kept year-over-year spending increase under the rate of inflation plus population growth, included no new state debt, set aside nearly a quarter billion dollars into Rainy Day Fund. Also featured major education reforms including statewide opportunity scholarship program for low-income students and largely eliminating career status (teacher tenure) in favor of short-term contracts. Civitas believes the conservative position is that the state budget represents a net positive. While not perfect, the budget displays significant fiscal restraint while including a major educational choice initiative. HB 930 Dog Breeding Standards/Law Enforcement Tools This bill outlines 13 specific requirements of people who own ten or more female dogs primarily for the purpose of breeding. The requirements include specifications ranging from daily access to exercise and food to flooring that provides “solid footing” and a “regular lighting cycle” for the dogs. Such requirements would be in addition to existing state laws that make it a misdemeanor for any person to intentionally “wound” or “deprive of necessary sustenance” any animal. Civitas believes the conservative position is that regulations targeting a specific group rather than applying standards equally is unjust. This law establishes care standards applicable to only a narrow category of dog owners. HOUSE ONLY House: 2R, RCS #551 (101-14)
