1. Introduction The City Rail Link (CRL) project comprises the construction, operation and maintenance of a 3.4 km underground passenger railway, running between Britomart Station and the North Auckland Rail Line in the vicinity of Mt Eden Station. The CRL also involves the construction of two new underground stations at Aotea and Karangahape and the redevelopment of the station at Mt Eden (refer to Figure 1-1). The design and construction of the CRL infrastructure between the Aotea and Mt Eden Stations is being delivered by the Link Alliance.

This Social Impact and Business Disruption Delivery Work Plan (SIBD DWP) has been prepared in relation to the main construction works for the new Aotea Station.

1.1 Aotea Station Overview Once completed, the Aotea Station will include platforms, lifts, escalators, rooms for housing stations and tunnel services equipment, an entrance building at Wellesley Street, two additional entrance buildings at Victoria Street, a Plenum at Kingston Street, services, internal and architectural finishings, structural fittings, utilities services diversions and connections.

The location of the Aotea Station is primarily beneath Albert Street, connecting the Contract 2 (C2) cut and cover tunnels to the north and the tunnel-boring-machine (TBM) tunnels to the south. The works are approximately 380m long by 18m wide and will be excavated around 18-20m below ground level. Additional boxes branch off from the tunnel alignment at Kingston Street (to form the Plenum), Victoria Street (for two entrance buildings to the Aotea Station) and Wellesley Street (to form the main entrance building to the Aotea Station) (refer to Figure 1-2 below)1.

Auckland Transport (AT) has obtained a resource consent for an Over Station Development (OSD) on the Bledisloe Car Park site (Council Reference R/LUC/2016/2647). The proposal involves the construction of a 24-level building comprising offices, retail and food and beverage tenancies, and public features including a plaza and a through site link. The proposed OSD is not part of the Link Alliance contract and will be progressed separately by Auckland Council and Panuku.

Social Impact and Business Disruption Delivery Work Plan Given the nature and scale of the Aotea Station construction, works will be undertaken in a staged manner, involving: •

•

Five stages of early works (canopy removal, network utility relocation and site establishment work), being undertaken from October 2019 to March 2020 (Stages 1 to 3) and December 2019 through to August 2020 (Stages 4 and 5); these works have been authorised by separate Outline Plans (Council ref. OPW60345651 and OPW60348747); Main construction works (the ‘Aotea main works’) involving construction of the station box, associated above ground structures, mined tunnels for the rail tracks, internal finishings, structural fitout, all Mechanical, Electrical, Fire and Hydraulic (MEFH) installation, and architectural finishings2. The Aotea main works will be undertaken from early-2020 through to late-2023; and Ground reinstatements (from late-2022) and urban realm improvements. These works will be described in a future Outline Plan2.

This SIBDDWP has been prepared to mitigate and manage the potential adverse effects generated by the main construction work of Aotea Station.

Refer to Section 2 of the Construction Environmental Management Plan (CEMP) for a detailed description of the Aotea main works.

1.2 SIBD DWP Staging To reflect the staged construction approach for Aotea Station, SIBD DWPs will be developed in stages.

This SIBD DWP addresses the Aotea main works, which are detailed in the CEMP, and an overview is provided in Section 3 of this SIBD DWP. An SIBD DWP will also be prepared for public realm reinstatement.

1.3 Purpose of the SIBD DWP This SIBD DWP has been prepared to identify measures that will be implemented to mitigate and manage potential adverse effects on businesses, residents and community services/facilities during construction of the Aotea Station main works. In accordance with CRL designation Condition 61.1, the objective of the DWP is: •

“to avoid, remedy or mitigate the adverse effects arising from disruption to businesses, residents and community services/facilities so far as reasonably practicable.”

It identifies mitigation measures that will be undertaken with regards to the following potential adverse social impact and business disruption effects: • •

Disruption to access for residents, community services and businesses; Disruption effects that result or are likely to result in the loss of customers to businesses as a result of the construction activities;

It is noted the architectural finishing component of works (the exterior look and feel of the Aotea Station) will occur during Phase 5 of the Aotea main works (approx. 2022 – December 2023). These finishings are still being designed and determined. Once designs are completed a separate Outline Plan and suite of DWP’s will be prepared, describing the finishings and other urban realm reinstatements, including ground reinstatement. That Outline Plan package will address the relevant Urban Design related Designation conditions (Condition 47 – 54).

Loss and / or relocation of community facilities and the catchments associated with these facilities; and Loss of amenity for residents, community services and businesses as a result of construction activities.

The SIBD DWP has been prepared in consultation with the community, business owners, affected parties and affected in proximity parties.

This SIBD DWP addresses the requirements of CRL designation Condition 61 and will be implemented throughout the construction period.

The SIBD DWP has been developed in consultation with the Aotea Community and Business Liaison Group (CLG) and has been reviewed by Independent Peer Reviewer (IPR) prior to submission to Auckland Council (as per designation conditions 7 and 11). A record of CLG consultation outcomes and IPR review comments is included in Appendix A. This SIBD DWP forms part of the CEMP for the main works.

2. SIBD Methodology and CRL Designation Conditions 2.1 SIBD DWP Authors This SIBD DWP has been prepared by John Daly (co-author) and Kim Hardy (co-author and technical reviewer).

John holds a MA (Hons) in Sociology and a MSc in Urban and Regional Planning. He is a Chartered Member of the Royal Town Planning Institute and a member of the New Zealand Association for Impact Assessment. John has 12 years of professional experience including the preparation of Town Centre Impact Assessments, Environmental Impact Assessment Screening and Statements of Community Involvement for commercial, industrial and hotel development in London, UK; community consultation and engagement for residential development and to inform planning guidance in Scotland and London, UK. Kim holds a MSocSci (Hons) in Human Geography and Resources and Environmental Planning. She has been a practising planner for 28 years and is experienced in public and stakeholder engagement, assessing social and cultural impacts of land development and infrastructure projects. Kim completed her Masters Thesis on ‘Effective Public Participation and the Resource Management Act 1991’. She has 10 years’ experience as an Independent Hearings Commissioner and Chairperson and is an experienced statutory planning decision maker. She holds full IAP2 Australasia Certification in Engagement. Kim has been a Full Member of the New Zealand Planning Institute for 24 years and is a member of the New Zealand Association for Impact Assessment.

2.2 IAIA Guidance for Assessing and Managing Social impacts of Projects (2015) To ensure effective and robust practices the ‘International Association for Impact Assessment Social Impact Assessment: Guidance for Assessing and Managing the Social Impacts of Projects’ has informed the preparation of this SIBD DWP. This states: ‘Social Impact Assessment (SIA) is now conceived as being the process of identifying and managing the social issues of project development and includes the effective engagement of affected communities in participatory processes of identification, assessment and management of social impacts. Although SIA is still used as an impact prediction mechanism and decision making tool in regulatory processes to consider the social impacts in advance of a permitting or licencing decision, equally more important is the role of SIA in contributing to the ongoing management of social issues throughout the whole project development cycle, from conception to post closure.’3

2.5 SIBD DWP Review and updates This SIBD DWP is a live document that will be reviewed at least annually, or as a result of a material change to the project, or to address unforeseen adverse social impact and business disruption effects arising from construction, or unresolved complaints.

3.

Aotea Main Works

3.1 Overview of Works The Aotea main works will involve three main phases of work. Each phase of work involves multiple construction activities which will be undertaken throughout the Aotea project site. The phases associated with the Aotea main works involve: • • •

Foundation works to form the perimeter walls of the station box and underground running tunnels. This involves diaphragm wall construction, roof construction, piling and jet grouting; Construction of the Aotea Station platforms, main station structure, concourse, entrance structures and plenum, and; Structural fitout of the Aotea Station including MEFH installation, and internal and architectural finishings.

The works require the operation of a Construction Support Area (CSA) within the Bledisloe House car park site and a portion of Mayoral Drive. Equipment used to undertake these works will be predominantly situated in the CSA. Upon completion of the Aotea main works, the area will be repurposed in preparation for urban realm reinstatement works.

The methodology for the construction of the Aotea Station is predominantly based on a ‘top down’ and ‘bottom up’ approach. The ‘top down’ approach relates to the southern end of Albert Street (south of Durham Street) and involves the installation of the ‘roof structure’ early on, which enables a limited number of traffic lanes to operate concurrently with the construction of the station, which occurs beneath. This approach reduces the construction effects on traffic flow within the city centre. The tunnel alignment on the northern end of Albert Street (north of Durham Street) will be constructed using a ‘bottom up’ methodology.

A detailed description of the Aotea main works is included in the CEMP and includes; • • •

an overview of the works including indicative timeframes in Table 2-1. the construction sequencing including equipment and earthworks volumes for the works in Table 2-2. further detail of the CSA in Section 2.6.2 of the CEMP. Drawings indicating the staging of the construction activities and proposed layout of the CSA is provided as Appendix B.

It is noted that public realm reinstatement works and details of architectural finishings for the Aotea Station (Condition 47 – 54 of Designation 2500-1), will form part of separate Outline Plan packages to be prepared in the future prior to the commencement of the respective works6*.

3.2 Programme The Aotea main works are anticipated to take approximately 45 months to complete, occurring from April 2020 to December 2023 (approximately) as detailed in Table 2-1 in Section 2.2 of the CEMP. Some construction activities outlined in each phase of the Aotea main works will occur in parallel.

3.3 Construction Methodology The Aotea main works will be divided into stages as described in the CEMP.

4. Social Impact & Business Disruption Assessment & Community Profile 4.1 CRL NOR Social Impact Assessment Summary A Social Impact Assessment6 (SIA) was submitted in support of the Notices of Requirement (NoR) for the CRL designations and is referenced in designation Condition 1. The purpose of the NoR SIA was to provide an assessment of the likely social consequences (benefits and dis-benefits) that may arise due to the CRL project.

The four key areas of potential adverse social impacts arising from construction of the CRL were identified in the NoR SIA as including: 1. Loss or disturbance of community facilities and social services as a result of the proposed works could disrupt people’s way of life and community cohesion.

2. Severance between communities, facilities, residents and businesses, particularly during construction, could impact on people’s way of life and community cohesion.

3. Physical impacts of construction works could impact on people’s health and wellbeing (e.g. as a result of nuisance or disturbance from construction noise, vibration or other discharges, or from the uncertainty/frustration arising from changes in accessibility for people living and working in the areas affected by the construction activity).

4. Impacts on individual tenants and landowners, resulting from issues associated with property purchase, relocation and/or displacement.

Additionally, the Traffic Impact Assessment (TIA) referred to in the NoR SIA identified that the adverse temporary effects all relate to the management of the existing road transport network during construction.

For the mitigation of potential adverse effects, a number of mitigation methods were identified. For several specifically identified social impacts, the development of a ‘Social Impact Management Plan’ (this SIBD DWP) was recommended, in conjunction with on-going consultation with key stakeholders and communities of interest.

The NoR SIA also identified a number of positive effects associated with CRL once the line and stations are operational, including: • • •

Increased train capacity improving accessibility and connectivity for people.

Increased commuter access stimulating economic development and enhancing commuter well-being.

Being a catalyst for inner city redevelopment, resulting in land use intensification and regeneration of central city areas. With positive effects including improved quality of environment, economic opportunities and opportunities for increased community development in the city centre area.

It is acknowledged that these effects may not be apparent and will not necessarily be tangible to the affected community during the Aotea Station main works construction.

4.2 The Community Profile 4.2.1. Description of the Social Environment NoR SIA Environment A desktop scoping and profiling exercise was undertaken as part of the NoR SIA. The findings are summarised below, and a further profiling exercise was undertaken for this SIBD DWP as discussed below.

The NoR SIA characterised the land uses adjoining and within the wider CRL designation corridor as comprising commercial and office buildings; apartments and visitor accommodation; warehouses and storage facilities; entertainment centres and restaurants; civic buildings and community centres; and residential accommodation.

A summary of the NoR SIA Land Use Survey results characterised the Aotea area as follows: • • •

The most commonly occurring land use identified was Retail (predominantly due to shopping precincts, such as the (then existing) Downtown Shopping Centre) Commercial accommodation and ‘Other’ (such as car parks, and open space areas) were also identified within this area.

Specific social infrastructure was also identified.

SIBD Environment The NoR SIA description of the social environment is generally consistent from a land use perspective with the affected community area for the Aotea main works. However, for the purposes of preparing this SIBD DWP, a fresh assessment was undertaken to ensure that the potentially impacted community profile is sufficiently detailed, any changes are identified, and the assessment is specific to the Aotea main works. The assessment revealed: • • • • • • •

• •

The area is predominantly in commercial use consisting of office accommodation on upper floors of buildings with ground floor uses including retail, cafes and restaurants; Tourist accommodation is a key land use and business activity in the area reflects the location within Auckland’s CBD and accessibility to city and regional tourist attractions; Residential activity is predominantly located in the above ground levels of either mixed use or dedicated apartments buildings, such as the Manhattan Apartments; Institutional uses in the area include Auckland Council and Auckland District Court.

Griffiths Gardens (a temporary space) has been removed, with the former activities and equipment ‘going to new homes around the City Centre and Wider Auckland’7.

The Media Design School is located in the area and there is a childcare centre and Wilson’s carpark located at the corner of Durham Street and Albert Street; Cultural uses, including the Aotea Centre and Civic Theatre are located close to CRL construction works at Wellesley Street West and Mayoral Drive. It is noted that one cultural use occupier referred to the area as a ‘cultural quarter’.

The SIBD team noted that Victoria Street has a high number of pedestrians with the pavement area less crowded along Albert Street.

A homeless population is evident in the area.

Public transport routes pass through the affected community.

The Aotea Station area has a mix of activities which typically service an inner-city urban environment. The mix of uses include office blocks occupied by a range of occupiers including large corporates to smaller scale Auckland based companies, visitor accommodation from hostels to international chains, and residential apartments. The wider street frontage is naturally dominated by business activities. A large proportion of these appear to comprise small independently run retail stores and restaurants.

Institutional uses in the area include Auckland Council and the District Court, being both a source of employment and civic/statutory activities. Cultural uses are located on the southern end of the affected community area. Other uses include the childcare, further education facilities and social infrastructure.

The vast majority of the businesses consulted with have been in the area since prior to commencement of the CRL construction works, and for some prior to the CRL designation process.

However, some are more recent arrivals.

The community is experiencing change with the CRL construction works on Albert Street that have been underway since 2015 and the recent commencement of early works for the remainder of CRL construction south of Wyndham Street. There are also a number of construction sites within the affected community including: • • • •

The Indigo Hotel – 51 – 53 Albert Street New Zealand International Convention Centre Holiday Inn and EVEN Hotel - corner of Wyndham and Albert Streets Mission HomeGround, Auckland City Mission

4.3 Demographic and Business Profile Desktop research was also undertaken, drawing on the Waitematā Local Board Area Demographics Report Card 2016, Statistics New Zealand 2018 Census data, and the Heart of the City website to further inform the Link Alliance’s understanding of the community profile. Data will act as part of the baseline for future monitoring of construction impacts.

Waitematā Local Board Area Demographics Report Card 2016 The key facts contained in the Waitematā Report include: • • •

It is a significant centre of employment which is mostly concentrated in the City Centre; The area accounts for 24 % of all employment and 15% of all businesses; and More than a third (43%) of local residents were born overseas, and of that group, 63 per cent had been in New Zealand for less than ten years. The largest group born overseas was from the People’s Republic of China and the United Kingdom, with smaller groups from India and Korea commerce and the area is home to a large tertiary and private education sector8.

The most localised data is at a Statistical Area 2 (SA2) level (approximately the size of a suburb) which is larger than the affected community area. The data however is the most current and provides a good source of information to inform the demographic context for the Aotea Station works. Local Board and Auckland wide data has also been included for the purpose of comparison (refer Figure 4-1 and Table 4-1).

Auckland’s Homeless Count Report (2018) Auckland Council and Housing First Auckland undertook a point in time count of the homeless population in the Auckland Region in 2018. This found that a total 336 11 people were living without shelter on the night of the count. The largest concentration were in central Auckland in the Waitematā Local Board area (128 people).

Heart of the City Heart of the City (HOTC) is the business association for Auckland’s City Centre. The Heart of the City website12 has been reviewed for information on the wide range of business within the area (which are reflective of the affected community’s CBD location), an overview of transport and parking, and events happening in the City Centre.

Spending data has been collated from the HOTC website (refer Table 4-2), which corresponds to the business association area but provides useful insights for the affected community profile and for monitoring of wider trends.

Auckland Transport Pedestrian Counts Auckland Transport has undertaken pedestrian counts at Victoria Street – Albert Street (May 2019) and Wellesley – Albert Street junctions (November 2019). The graph in Figure 4-2 demonstrates the high level of pedestrian footfall at these junctions, which was also observed by the Link Alliance SIBD team during observational site visits.

Link Alliance Vacancy Rate Count The SIBD team undertook a vacancy rate count of ground floor retail / food and drink / small commercial units with a street frontage on 30/11/2019. This found a limited number of vacant units within the affected community. Vacant units were spread across the area: • • • •

Four empty units on Wellesley Street with signage on three stating that the properties were now leased.

One empty unit on the ground floor of Bledisloe House.

Four empty units on Victoria Street (one is understood to be undergoing a re-fit).

Four empty units on Albert Street, three of which are currently being re-fitted.

Festivals and Events The affected community area occupies a central location and is close to the Aotea Centre and surrounding cultural venues, the Auckland Waterfront and Queen Street. 4.3.1. CRL News Articles A selection of recent news articles have been reviewed that discuss the CRL works for Aotea Station.

The articles provide an insight into the impacts facing the affected community. However, issues such as the hardship fund and the design of Aotea station are outside the scope of this SIBD DWP. Examples of selected articles include: • • • •

4.4 Local Community Planning 4.4.1. City Centre Masterplan The City Centre Masterplan 2012 was developed by Auckland Council in consultation with key stakeholders and the public. This vision is made up of many projects, centred on eight transformational moves to unlock the potential of the city centre. Of particular relevance is transformational move 5: 5. CITY RAIL LINK - new public transport stations and development opportunities at Karangahape Road, Newton and Aotea Quarter This transformational move shows that CRL forms a key part of the 20 year vision. The Masterplan builds on the significant benefits CRL will provide in terms of accessibility and views it as an impetus for change and growth in the City Centre. It envisions: • •

“New City Rail Link station precincts offering a range of housing and work opportunities.

They are places Aucklanders want to live, work in and visit Each new City Rail Link station precinct is a distinct neighbourhood, building on its existing heritage character and particular strengths.”

The CCMP is currently undergoing a refresh so that it better reflects Auckland’s growth since 2012.

Public feedback on the refresh closed on 18 October 2019. The refresh presents a vision of a city centre that is more family-friendly, more pedestrian-friendly and more environmentally-friendly19.

The development opportunities around new City Rail Link stations are identified as a key move.20 15

4.4.2. Waitematā Local Board Plan The Waitematā Local Board Plan was developed by the Waitematā Local Board in 2017 in consultation with the community. It is the Waitematā Local Board’s strategic three-year plan, outlining the communities' priorities and preferences. It guides local board activity, funding and investment decisions, influences local board input into regional strategies and plans, including the Auckland Plan, the council’s 10-year Budget and the annual budgets.

The Local Board Plan identifies six outcomes to guide the Local Board’s work. Outcomes 5 and 6 are of particular relevance, and make specific reference to the CRL project: •

Outcome 5: An accessible, connected and safe transport network with well-designed streets Our transport network is integrated and gives people options for moving about, with accessible, sustainable and reliable public transport and safe, pleasant walking and cycling routes. Our pedestrian-friendly streets are great public spaces.

Outcome 6: An innovative, productive and resilient local economy Waitematā’s local economy is thriving and benefits from growth and change. Empowered local businesses, social enterprises and start-ups drive growth and local economic development.

The Plan notes that major projects such as CRL will impact much of Waitematā, and that the Local Board will support initiatives to assist businesses to remain economically viable during the construction of transformational transport projects.

4.4.3. Heart of the City Heart of the City aims to promote and activate businesses and the city. It does so by delivering a comprehensive programme of marketing and events, networking opportunities and advocacy to local bodies. It is a partner with Auckland Council in its city-wide Business Improvement Programme and derives its income from a separate rate collected by council from business and property owners within its precinct boundary and returned to the Heart of the City.

The Heart of the City’s key programmes as set out in their Annual Plan 2018/1921 are: • • • • • • • • • • 21

Consultation and Engagement 5.1 Introduction Consultation and engagement was undertaken to inform this SIBD DWP, particularly the Mitigation Implementation Plan (refer to Section 8 of this SIBD DWP). This engagement was structured and informed by the CRL designation, the proposed works, the community profile and previous engagement. A desktop assessment of the site to establish the ‘affected parties’, i.e. those with direct impacts on their residence or business, and the ‘affected in proximity parties’, i.e. parties affected by wider issues, such as transport.

2. A detailed review of the parties consulted, and feedback received for the SIBD DWPs for the Aotea Early Works (utility relocations).

3. Refinement of the parties affected by the works occurred during the door knocking exercise, mainly discounting parties not within the vicinity of the works.

Engagement has focused predominantly on the affected community as shown in the purple area in Figure 5-1 below. Additional engagement with members of the public was undertaken via the Information Sessions / ‘Coffee and Chat’ events.

Copies of the Aotea Station information brochure and a flyer prepared by the Link Alliance’s Communication and Engagement Team (both attached in Appendix D) were left with affected parties. The flyer included details of: • • •

The ‘Coffee and Chat’ events, Drop in information sessions, and Contact details of the CLG meetings.

A copy of the meeting response recording sheet with questions is included in Appendix E.

5.3.3. Information Sessions/ ‘Coffee and Chat’ Events The purpose of the information sessions and the ‘Coffee and Chat’ Events was to provide the affected community, members of the public and commuters with additional opportunities to engage with the project team and SMEs, including the SIBD SMEs. SIBD SMEs sought to explain the works and to gain an understanding of how the works will impact on them as residents / business owners / employees or as visitors to the area.

5.3.4. Business Forum A business forum was established by City Rail Link Limited to bring the businesses together to provide an update on the works, to discuss issues and potential mitigation measures. Link Alliance SIBD SMEs attended the business forum to listen to the views of the affected community. Refer to 8.16.1 for further details.

6. The Affected Community’s Feedback Feedback, via a door knocking exercise in November 2019, was received from 34 members of the community with a further 40 not available at the time of the visit. All 74 parties were provided with details of the ‘Coffee and Chat Event’ as follow up to the SIBD door knocking with additional parties notified by email and flyer drop.

This feedback provided a geographical spread of the experiences and sentiments across the affected community area. It built upon the feedback received as part of the earlier engagement for the Aotea early works, which is also relevant to the main works. Additional feedback was gained from the information sessions / ‘Coffee and Chat Event’, business forum and CLG. Figure 6-1 below provides an overview of the key concerns and the location of the parties consulted.

The majority of affected parties are concerned about combinations of issues. Appendix B identifies the affected parties and summaries the individual feedback received.

Social Impact and Business Disruption Delivery Work Plan The concerns and issues raised by affected parties are discussed further below. Note not all issues raised, are within the scope of this SIBD DWP or the requirements of Condition 61 but are recorded below.

6.1 Heart of the City Heart of the City representatives have been involved in the CRL project since prior to work commencing in 2015 and have provided the SIBD SMEs with their insights into lessons learned to date. Recommendations put forward in previous discussions with Heart of the City were that the Link Alliance should: • • • • • • • • • • •

• •

Prepare clear and simple communications that local businesses and residents can readily understand and respond to (remove technical jargon); Clarify the process for joining and participating in the CLG. Some perceptions that the CLG is an invitation only group and that strict terms of reference are to be adhered to.

More innovative approaches to addressing issues of concern e.g. loading zones – how can these be provided to businesses when works are underway; Provision of up to date timelines so businesses can plan ahead and understand how the delivery works are expected to change (either increase or decrease over time); Talk to impacted parties about the overall package of work and not just the early works as the overall area of impact is much greater than the area of construction activity; Businesses have been frustrated by lack of face-to-face communication to date; Be more responsive to issues as they arise on site; Disappointment that the level of baseline monitoring that was previously proposed in relation to pedestrian movements has not occurred; Timely removal of hoardings and other equipment and storage facilities when no longer required on site; Need to plan for and recognise other large-scale development works in the CBD and coordinate where practicable; A number of business operators have experienced a high level of anxiety associated with the works to date and their lack of understanding of the works yet to come. Consideration needs to be given to community health and wellbeing; Ongoing communication and updates; Comprehensive understanding of timeframes (including start and finish dates and overall duration of works). This is of particular relevance to hospitality and food businesses that rely on seasonal trade (some businesses make their profit in the summer season).

SIBD SMEs met with the HOTC on the 19/11/2019, as part of the most recent SIBD engagement, and also attended the CLG meeting on the same date. Key issues discussed: • • • • •

Impacts on businesses from future public realm works.

6.2 Neighbourhood Police The Neighbourhood Police team were briefed on the CRL works on the 26/09/2019 and made recommendations in terms of: • • • • •

Keeping passageways well lit; The use of CCTV Cameras; Keeping sites secure from opportunists and targeted thefts; Awareness training / messaging in relation to crime / anti-social behaviour prevalent at certain locations within the area for staff; The extent of engagement and communication with the affected community was welcomed.

A meeting with the Neighbourhood Police, Storewatch and HOTC was held on 19/11/2019. This included discussion on the expansion of Storewatch to include properties within the affected community. A crime prevention focused business forum was also organised.

6.3 Residential, Visitor Accommodation and Noise Sensitive Properties Residential and visitor accommodation properties within the affected area include: • • •

Apartment blocks located on Kingston Street, Albert Street, Victoria Street West and Wellesley Street West.

Serviced apartments and hotels on Albert Street, Wyndham Street, Durham Street West and Wellesley Street West.

Backpacker accommodation on Albert Street and Wellesley Street West.

Residential and visitor accommodation properties within the affected community were engaged with via a door knocking exercise and the drop-in information sessions and with two residential members of the CLG. Issues of concern relating to residential and visitor accommodation included: • • •

• •

Construction noise impacts on habitable rooms and conference/meetings areas on visitor accommodation.

The loss of pedestrian and vehicular access to properties, and changes to the Sky Bus service and bus stop location.

The need for on-going and regular communication so that affected parties are able to plan ahead and make alternative arrangements when access and/or travel routes are disrupted due to the works.

Concerns around availability of access to loading and/or deliveries, including residents moving in/out of apartments.

One building manager noted that to date residents in the building had not raised particular concerns regarding the project and another considered the transport disruption to date to be well managed.

A meeting was also held with the District Court and noise sensitivity was raised as a key concern.

6.4 Commercial and Businesses Community / Business Forum Commercial businesses, including retail, offices, pubs, cafés and restaurants, within the affected community were engaged with via a door knocking exercise targeted at the business manager or owner available at the time of door knocking.

Businesses raised a range of issues due to the proximity, scale and nature of the works. Issues included: • • • • • • • • •

The proximity of hoardings and their impact on visibility and wayfinding.

The need to retain pedestrian access and private car parking.

The impacts of changes to bus routes and bus stop locations (both public buses and the Sky Bus) The impacts on volumes of foot traffic.

The need to maintain convenient loading bays.

The impact of noise, vibration and dust on business from construction work and traffic.

The need for ongoing communication to enable forward planning.

The impacts on business viability and the vitality of the area and the associated impact on mental health.

Delays and issues with odour from the current CRL construction works in lower Albert Street.

City Rail Link limited has established a business forum for businesses located along lower and upper sections of Albert Street (covering all of the CRL construction work areas). SIBD SMEs attended the business forum on the 16/10/2019 to observe feedback from the approximately 15 attendees representing a range of businesses.

The business forum covered: • an update on the CRL works on Albert Street; • a discussion session on development response measures; • questions from businesses relating to business viability impacts and financial hardship; • an update on the current early status of the hardship fund.

6.5 Community, Educational and Cultural Organisations The Cathedral of St Patrick and St Joseph and St Matthews Church are located on the edge of the affected community and provide support and organise events for the community. The concerns raised by these churches related to noise, traffic and communications; •

• • • •

Construction noise may cause disruption to their activities. In addition to usual Church services St Patrick’s also host weddings and funerals. Noise disruption for funerals which are difficult to plan for are a particular concern.

Maintaining parking and access is important – large numbers attend Sunday Services.

Need to be made aware of changes to bus routes.

Effects on the setting of the Church, particularly for wedding photos.

The Cathedral is a venue for the World Symposium on Choral Music 2020.

Representatives of Auckland Live and a festival organiser attended the information sessions and raised similar issues in relation to: • Page 34

Access for pedestrians and also goods/deliveries and the need for wayfaring signage.

Noise concerns were a key issue due to the impact on performances.

The Media Design School raised similar issues with impacts from the construction works. They also noted that they have an open day which attracts a number of students and that communication is important to plan ahead.

6.6 Drop-in Information Sessions The Drop-in Information Sessions, including the ‘Coffee and Chat’ events, were attended by twenty individual parties.

Questions from attendees related to the scope and timing of the works, traffic management, noise and vibration. Two attendees raised issues on business viability, the hardship fund and the associated impacts on mental health. Other attendees accepted the works were happening but needed them to be as smooth as possible, requested on-going information or were positive about the delivery of the new stations.

6.7 Community and Business Liaison Group The Aotea CLG has a total of 38 members who were invited to the CLG meeting on the 19/11/2019.

A total of 5 CLG members attended, which included a Local Board Member, a HOTC representative, a property manager/resident, a business owner and a resident. A range of SMEs were available to answer queries. The key comments related to: • • • • •

The construction programme; Noise impacts on residential properties; The impacts on transport, access and car parking/loading; The communication strategy for transport disruption; and Mitigation measures to support local businesses with one CLG member outlining the impact that the work is having on their business.

6.8 Summary of Key Issues and Mitigation The following is a summary of the key issues raised by the affected community. It has been compiled with reference to the feedback for the Aotea early works stages (Stage 1 – 3 and 4 and 5) engagement: • • • • • • • • • • Page 35

Rates relief was suggested as one method of providing compensation; Regular communications on construction staging and timing and what to expect on a weekly, monthly and longer-term basis; Consideration of timing of works to avoid peak tourist season, lunchtime trade for restaurants and noise impacts on a Sunday; and Minimise impediments and changes to pedestrian access and the existing pedestrian flow and routes along and across the Albert Street network.

8. Mitigation Implementation Plan 8.1 Introduction This section sets out the SIBD mitigation actions to be implemented in relation to the Aotea main works and responds to the requirements of designation Condition 61. These actions have been developed in part from feedback from the affected community. Additionally, mitigation of the specific concerns raised by individual affected parties is set out in Appendix B.

8.2 Roles and Responsibilities The key Link Alliance personnel responsible for the delivery and monitoring of the actions and recommendations in this SIBD DWP are identified in Table 8-1 below.

8.3 Designation and Resource Consent Conditions The Link Alliance is required to comply with all relevant CRL designation and resource consent conditions. This will be achieved via the implementation of the CEMP, DWPs and MPs and the ongoing compliance with conditions.

An important tool for keeping the affected community informed are the Planning pages of the CRL website. These include an explanation of key planning terms, the designation and resource consent decision notices and documentation for the Aotea Station area.

The Aotea Community Manager will be responsible for sharing this information and also promoting the CRL website. Responses to queries will be provided by the appropriate SME, via the Aotea Community Manager.

8.4 Continuous Up to Date Engagement Continuous and up to date engagement will be provided by the Link Alliance, with the Aotea Community Manager being a point of contact for the affected community. This will include:

Social Impact and Business Disruption Delivery Work Plan a) Courtesy visits and /or email updates to businesses to check in with parties regarding the project. The purpose being to share information so residents and business can plan ahead, and also to obtain feedback on issues of concern and to identify pathways for their resolution in liaison with the appropriate SMEs. b) Project progress meetings undertaken with businesses, to confirm project programme and when scheduled works will take place. c) Provision of advance notice to businesses on the scope of works on a regular basis in line with the Communication and Consultation Plan. This is necessary to ensure businesses can plan ahead and advise customers in advance of their arrival. Longer term programme of works (and therefore potential for disruption) will also be particularly important for hotels – for example, in terms of managing future conference and event bookings. d) Engagement with the affected community, via: • • • • • • •

Works notification letters Local drop-in sessions Monthly email newsletters On-site signage for key traffic shifts Project update information sheets Digital communications including website updates and social media updates to CRLL’s channels on Facebook and Instagram Advertising and campaigns for major traffic shifts.

8.5 Construction Team Briefings The Aotea Station Project Manager will brief all construction staff prior to their arrival on site and ensure they are fully aware of the project obligations to stakeholders within the area of the construction works. This will include a requirement to treat adjoining businesses, residents and community groups as ‘project neighbours’ and ensure that, as far as practicable, the day to day construction actions around the periphery of the site and the interface with the public areas is respectful and as considered as possible.

The construction staff briefings will be updated to respond to feedback from the continuous engagement with the affected community and following discussions with community organisations which represent and/or support vulnerable groups in the community. Refer to 8.13 for measures relating to vulnerable groups.

8.6 Collaboration The Link Alliance will work proactively with Auckland Council, council-controlled organisations, including Auckland Transport and the Local Board to mitigate the impacts of construction within the affected community. This includes working with Auckland Live and other event providers in relation to events and festivals to be held within and in proximity to the affected community area.

The Link Alliance will meet regularly with HOTC and discuss initiatives, such as Storewatch, #LoveAlbertStreet and opportunities for joint working, such as the crime prevention and anti-social behaviour discussion at the business forum.

8.7 Noise and Vibration Disruption A Construction Noise and Vibration DWP (CNV DWP) has been prepared to manage, monitor and mitigate the effects on receivers of construction noise and vibration. The CNV DWP will be implemented throughout the construction period. Site Specific Construction Noise and Vibration Management Plans (SSCNVMPs) will be implemented for properties, where the construction noise or vibration limits are predicted to exceed the limits specified in the CRL designation conditions.

In addition to the CNV DWP and SSCNVMPs the Link Alliance will proactively engage with the affected community to allow businesses and residents to plan ahead for noisy activity. This engagement will also explain the need for mitigation measures, such as noise mats, which may result in temporary impacts on visibility. This engagement will be led by the Aotea Community Manager in conjunction with the Acoustic SMEs.

8.8 Traffic, Access and Parking Disruption Disruption to traffic, access and parking during the Aotea main construction works will be managed, monitored and mitigated through the Transport, Access and Parking DWP (TAP DWP). The TAP DWP will be implemented throughout the construction period and forms part of the overall CEMP for the Project. Long term Temporary Traffic Management Plans (TMPâ&#x20AC;&#x2122;s) will be implemented for the works with evolving requirements.

8.8.1. Property Access Access to all properties on Albert Street, Victoria Street West, Wellesley Street West, Kingston Street and Mayoral Drive will be maintained, including on streets where through traffic is diverted.

If any pedestrian accesses (to properties) are to be closed for short periods of time for critical work, then property owners and leaseholders will be consulted with at least two weeks prior to the closure. This will be undertaken by the Aotea Station Manager with the agreed arrangement and timing conveyed to the business at least 48 hours before the closure.

8.8.2. Pedestrian and Cyclist Pedestrian facilities in the vicinity of the works is primarily in the form of footpaths with Albert Street, Wellesley Street, Victoria Street West, Mayoral Drive and Kingston Street all having footpaths along both sides of the road.

Pedestrian access, with a minimum footway width of 1.5m, around the construction work areas will be maintained, albeit with diversion around construction areas. TMPs will be implemented to ensure that all routes meet accessibility requirements, with appropriate ramps and gradients for all users. Accessibility auditing will be undertaken by the Development Response Manager in conjunction with Auckland Transport and stakeholders.

Wayfinding signage will be provided to guide pedestrians requiring access to properties, alongside proactive communication by Link Alliance.

8.8.3. Public Transport Due to the closure of the Wellesley Street - Albert Street and Victoria Street â&#x20AC;&#x201C; Albert Street intersections, a number of bus routes and/or stops will be disrupted and will require rerouting or relocation. This will be communicated to the public by AT. The Link Alliance will liaise with AT to agree the signage on site and the information to be provided on the AT website and the CRL website. The Link Alliance will also communicate to the affected community via its Disruption Management Communications Plan.

8.8.4. Construction Traffic Construction vehicles which can be expected as part of the works include heavy vehicles (trucks), concrete trucks, material delivery vehicles and other contractor vehicles. These vehicles and their movements have the potential to result in disruption to business and impact on the wider community.

The key impacts of construction traffic will be on the operation of the overall transport network (particular from heavy truck movements) as well as potential conflicts between pedestrians, private vehicles and construction activity at access points. To minimise disruption construction access points will be managed by a Traffic Controller (during active site hours). Construction traffic movements will be guided by the overarching TMPs which will be implemented for each stage of the works, in order to as far as practical minimise disruption.

8.8.5. Parking and Loading The TAP DWP identifies eleven loading zones and two shared spaces located in the vicinity of the Aotea Station work area (refer to section 3.1.3 for a summary of loading and parking provisions).

Across all the stages of the main works, the work zones will at various stages occupy areas on Albert Street, Kingston Street Wellesley Street West and Victoria Street West. The primary impact on parking and loading will result from the closure of Wellesley Street West and Victoria Street West intersections, and works occurring in Kingston Street, with some further impacts as the works progress along Albert Street.

Link Alliance will notify affected businesses of the closure of loading bays and of the location of alternative available loading bays. Wayfinding signage will also be developed in conjunction with the affected businesses and HOTC. Notification and communication regarding on-street car parking changes will be undertaken in conjunction with AT.

8.8.6. Transport Disruption Communication Plan Link Alliance will implement a Disruption Management Communications Plan for Wellesley Street West and Mayoral Drive intersection closure. The Plan will clearly identify and effectively communicate how disruption will impact on all stakeholders, such as public transport users and motorists, businesses, residents and visitors to the area.

Social Impact and Business Disruption Delivery Work Plan Link Alliance will work with Auckland Transport to develop and implement proactive communications for all transport users notifying them of the disruption and planned mitigations, including details of ATs accessible travel23 and travel plan24 resources.

Wider communication and engagement will be led by the Aotea Community Manager with input from SMEs as appropriate. This includes regular meetings with major employers and visitor accommodation to ensure that they are aware of the works and the impact on the traffic network and can pass this information on to staff, visitors and employees.

8.9 Air Quality An Air Quality DWP (AQ DWP) has been prepared for the Aotea main works. The AQ DWP identifies various activities located within the vicinity of the works which may be sensitive to dust nuisance including residential, accommodation, commercial (inclusive of bars, restaurants, retail ,office etc), community facilities, and public access and parking (refer to section 3.3 for further details).

In order to minimise and avoid impacts on the surrounding community, dust and odour mitigation measures will be implemented in conjunction with ongoing monitoring and engagement with the community. The measures are set out in detail in the AQ DWP.

8.10 Utility Disruption Feedback from the SIBD consultation identified that for a number of parties (both residential and businesses) the loss of, or disruption to, electricity, water and/or other utility usage can result in significant disruption. Disruption to utilities has the potential to not only be an inconvenience but, in some case, also have a significant impact on the ability for a business to operate, and potentially result in increased operating costs.

8.11 Visual Amenity and Landscape The Aotea main works will impact on the amenity values of the affected community, through the presence of construction works, the removal of trees (11 pĹ?hutukawa trees - at the southern end of Albert Street Hotel) and the impacts upon the setting of heritage buildings.

The Link Alliance will address impacts on the contribution of the trees and heritage of the buildings to the character of the area through its DRP by identifying and implementing activation opportunities along the corridor (not necessarily involving replacement trees or alternative soft landscaping), where practicable and safe, during construction.

A Trees and Vegetation Delivery Work Plan and Historic Character Delivery Work Plan (Built Heritage) has been prepared in relation to the Aotea main works.

Social Impact and Business Disruption Delivery Work Plan Matters such as lighting, the placement of construction hoardings, access control at site entrances, installation of CCTV and maintaining public footpaths that are free of obstructions and trip hazards will primarily be the responsibility of the construction teams. These matters are addressed in the 'Construction Environmental Management Plan' (CEMP) for the Aotea main works but will be implemented in line with CPTED and with the objective of maintaining visibility and connectivity within the area.

CPTED audits will be completed following major changes to layout and recommendations implemented as far practicable.

The Link Alliance will support HOTC and the Neighbourhood Police in their initiatives, such as Storewatch25, and will meet regularly throughout the construction period to discuss issues relating to anti-social behaviour, crime and opportunities for further collaboration.

8.13 Vulnerable Groups The Link Alliance will discuss the measures needed to assist any homeless person displaced as a result of the works and to ensure the construction sites are safe and secure, with appropriate bodies, such as with the Neighbourhood Police, Auckland Council or Auckland City Mission.

In response to issues raised in the course of SIBD engagement across the CRL project area, briefings will include information on how to handle a range of issues/situations, including: • • •

how to approach rough sleepers; how to deal with illegal activity; or dealing with an emergency situation on site.

Alternatively, the briefing will include details of available training.

8.14 Health and Wellbeing The Link Alliance will support the health and well-being of the affected community by providing proactive communication on construction timing and scope of work to minimise risk of anxiety and stress around uncertainty.

Link Alliance will provide information on how to contact practical help agencies - including external helplines, local mental health services, counselling and support agencies. This information will be made available in pamphlet form using multiple channels such as info@cityraillink.govt.nz, the CRL project website, and local project information centres.

Link Alliance will continue to work with the affected community, and through the CLG and the CRL 'Business Forum' it will offer workshops for affected parties to address topics such as coping with stress, resilience, staying positive through difficult times, looking after self, and strategies for managing challenging situations. These workshops would be facilitated by appropriately qualified professionals such as counsellors, psychologists, and business advisors.

8.15 Development Response Plans (DRP) In response to feedback from the affected community, the Link Alliance will, when practicable:

Stage work to minimise disturbance, including co-ordinating works on an area basis so that re – work and consequential additional disruption is not required.

Remove hoardings and fencing when no longer required and safe to do so.

Use Perspex on hoardings to create visual interest.

A range of DRP measures are set out in Appendix F and the responsibilities of the Development Response Manager are set out in Appendix E. The DRP measures will be implemented alongside the construction works, where appropriate and practical, to mitigate SIBD impacts on affected parties.

The DRP will link to the DRP for the current CRL works in lower Albert Street where practicable.

The DRP measures have and will continue to be developed in consultation with HOTC and the affected community.

8.16 Businesses Disruption The NoR SIA stated that the CRL project will generate both economic opportunities and impacts. The Assessment of Environmental Effects for the CRL NoR process, prepared in 2012 stated that “a key purpose and driver of the CRL is to make the city centre more accessible, resulting in an anticipated increase in economic performance, and create changes in land use, development opportunities, and intensification (particularly around stations)”.

The CRL project will in the longer term generate positive outcomes both locally and regionally, and may give rise to short-term positive impacts during the construction process which will be supported where practicable and feasible. The affected businesses, however have identified a number of concerns with the impacts of the construction works on them.

The issued raised by affected business parties are summarised in Table 8-2 below together with the actions.

9. Issues and Public Enquiries 9.1 Introduction Public enquires are the responsibility of the Communication and Engagement Team and will be handled in line with the CCP. SMEs, including the SIBD SMEs will be consulted for input to answer public queries as appropriate.

9.2 Queries and Complaints Process Any party is able to make general enquiries via the CRL email info@cityraillink.govt.nz and freephone 0800 CRL TALK (275 8255). Additionally, parties affected by the works will be able to make enquiries via the aotea@linkalliance.co.nz email which was provided during the consultation exercise undertaken for this SIBD DWP. A record will be kept by the Link Alliance of queries and complaints received. This record will include: •

A description of the complaint;

•

The relevant DWPs the complaint relates to;

•

Mitigation measures undertaken in response to the complaint;

•

Who is responsible for mitigation of the complaint;

•

Timeframes for addressing the complaint, including when the complaint is resolved; and

•

Any affected parties.

Complaints and queries will be reported in the annual report of this SIBD DWP (see Section 10.2 Annual Reporting and Monitoring).

In addition, an update meeting will be held with the CLG at least every three months, through which social impact and business disruption concerns can be raised with the SIBD SMEs and other SMEs (refer to Section 5 of the CCP).

9.3 Disputes resolution Disputes may arise where a stakeholder affected by an issue considers their complaint has not been resolved. In the context of this SIBD DWP, disputes may arise relating to: • •

With respect to SIBD related complaints/disputes these will be handled in line with the complaints process set out in Section 7 of the CCP.

9.3.1. Public Works Act Feedback in the course of SIBD engagement related to financial impacts and compensation, however, this is outside of the scope of this SIBD DWP. Financial compensation is a matter under the Public Works Act, however any claims received by the Link Alliance will be forwarded to CRLL. A claim for financial compensation under the Public Works Act 1981 is a possibility for affected parties who are significantly affected by the project. The Public Works Act entitles affected parties to compensation for ‘substantial injurious affection’, which may include damage to property or losses to a business.

10. Monitoring and Reporting 10.1 SIBD Monitoring Plan Link Alliance will monitor SIBD impacts throughout the construction process through ongoing engagement with the affected community via the CLG, business forum, direct engagement, and from a variety of primary and secondary sources as detailed in the SIBD Monitoring Plan (Appendix G).

SIBD Monitoring will collect data to: • • • •

Monitor the affected communities experience and perception of SIBD impacts Monitor the effectiveness of the identified Mitigation Measures.

Monitor for any changes in the community profile of the area.

Complaints and Public Enquiries Monitoring

Wider monitoring will be undertaken in accordance with the relevant designation condition and DWP. There will be ongoing collaboration and discussion amongst the project team to address issues and impacts on the affected community.

10.1.1. Community and Business Liaison Group Reporting The CLG will meet regularly, at least every three months, over the course of the construction works and will be an opportunity for the CLG member to ask question or to raise social impact and business disruption concerns.

SIBD SMEs will monitor feedback received at CLG meetings to measure SIBD impacts and the effectiveness of the mitigation measures. Mitigation measures will be reviewed in light of CLG feedback.

10.1.2. Regular Engagement Regular engagement will be carried out in line with the CCP but will include the Business Forum and the weekly drop-in information session and ‘meet the project team’ events. These events will provide an opportunity for the affected community to comments on the construction works and the mitigation measures.

In addition, the Development Response Manager and Aotea Community Manager will liaise with affected parties on a frequent basis in relation to the DRP and wider mitigation and will seek to resolve issues with the construction team.

An SIBD focused engagement exercise will be carried out to inform the preparation of an annual report in accordance with CRL designation Condition 61.8. This will collect feedback from the affected community on their experience and perception of SIBD impacts. The feedback will be measured against the feedback received as part of the engagement for this SIBD DWP.

10.1.3. Data Sources A range of sources will be reviewed to monitor for changes in the profile of the affected community, the extent of impacts and the effectiveness and need for additional mitigation measures. These measures include: • Page 50

10.3 Annual Report The SIBD SMEs will prepare an annual report on the identification, monitoring, evaluation and management of the effects outlined in this DWP, along with a summary of any comments or complaints raised by the community, including how these have been addressed.

Appendix A: Record of CLG, Independent Peer Review and Auckland Council Feedback A1. CLG Comments HOTC Comment 4.1 CRL NOR Social Impact Assessment Summary Taxis and other rideshare operators should be mentioned in the list of transport providers adversely impacted by the works.

4.2 Community Profile Emergency services: This section needs to be updated as the Auckland Downtown Police Station (corner Jean Batten Place and Fort Street) is no longer operating, and the Auckland Central Police Station is now located on College Hill and not on the corner of Cook Street and Vincent Street.

4.3 Demographic Profile We suggest that now that partial results of the 2018 NZ Census have been released, it would be appropriate to update the references to Waitemata Local Board demographics 2016 and NZ 2013 Census data in this section. Auckland Council’s website helpfully provides summary profiles for the City Centre and all local boards (refer: http://knowledgeauckland.org.nz/publication/?mid=2998) which provide a more up-to-date current state overview of the social and economic environment within which the CRL works will take place.

5.2 Extent of Impact and Affected Parties Heart of the City understands the extent of the CRL designation, and that the scope of this DWP focuses in on the Aotea Main Works. It is our view that the CRL project has an economic, social and environmental impact that goes beyond the borders of the CRL designation, and that multiple construction activities, including the C1 and C2 CRL contracts will have a cumulative impact on the communities identified in the Aotea Station DWP (and the C1 and C2 DWPs).

The SIBD Aotea Station does not address the above point, and offers no recognition of the current impact that the C2 contract is having on the street environment and on businesses in the area.

The SIBD should also acknowledge what has worked well and what has not worked well (“learnings”) in both the C1 and C2 works, and identify how the Main Works contract will address these/take these on board.

Response No taxi stands will be impacted by the works, however taxi and rideshare operators will be notified of diversions and construction works in line with the CCP. These details were based upon the NoR SIA, however the change of address is noted. Note this section has been amended to delete reference to specific social infrastructure. Refer to the NoR SIA for details.

This SIBD DWP has been prepared by the Link Alliance for the Aotea Main works in line with Condition 61 of the CRL designation.

8.2 Resourcing/Roles and Responsibilities There are no responsibilities included under section 8.2 (only the role and the person associated with the role is documented). Whilst some responsibilities are elaborated on in the CEMP DWP, some roles such as the Development Response Manager, a key role in ensuring the planning, delivery and evaluation of the overall development response plan for the Aotea precinct is not included in the CEMP. The absence of any definition about responsibilities makes it difficult to understand what specific roles are responsible for.

Unlike the earlier Utility DWPS, where both a Street Response Manager and a Development Response Manager were identified, there is also no reference to a Street Response Manager in this section. The functions of this role are critical to the successful delivery of the planned Development Response plan and we would like to understand how the functions of this role are proposed to be delivered for the Aotea Main works.

We are seriously concerned about the ability to successfully deliver on the mitigations that are outlined in the SIBD, as well as the Development Response Plan based on what appears to be the current resource allocation for these functions.

We also note that in the CEMP, Revision 1.0, Draft November 2019, under 4.1.2 Specific Roles and Responsibilities that there is no specific reference to Development Response. This is a serious omission, which raises a key question: What role out of the ‘key Link Alliance roles and responsibilities’ is responsible for planning and implementation of Development Response activities, and where does this function sit in the framework of the environmental management of the project during the construction period?

8.5 Development Response Plan and Specific mitigations: CRL sponsors Auckland Council and the Government have recently announced that a hardship fund will be established for businesses who have experienced significant hardship as a result of CRL project delays.

Heart of the City would like to see reference of the Hardship Fund as one of a suite of tools to impact to businesses.

The outline of the DRP in this section hints at specific actions that focus on good street environment, wayfinding, accessibility audits, and business support through activations, events and business information.

Refer to Section 8.2 for details of the key roles and responsibilities and Appendix E. Since the Stage 1 – 3 SIBD DWP Addendum the roles and responsibilities have been updated. In the Link Alliance there is no Street Response Manager, only Development Response Managers for each precinct.

The Development Response Manager will be supported by subject matter experts and the wider Aotea Communications & Engagement team to deliver DR initiatives.

Given the significant scale and impact of the CRL project, other areas that should be addressed by the Development Response Plan should also include Travel Demand Planning, which will relate to specific activity identified in the TAP DWP related to construction staff travel, and make reference to wider Auckland Transport Travel Demand Planning activity.

10.2 Monitoring and reporting We note that the annual report on the identification, monitoring, evaluation and management of the effects outlined in the DWP will be made available on the CRL website. This must include how effects and impacts are being addressed through the implementation of the Development Response Plan.

We would ask that the ‘annual report’ be presented to CLG members for feedback and discussion.

There must be an effective a mechanism put in place to proactively seek feedback from the community on how the project is impacting them and how well the project is managing effects throughout the lifetime of the construction programme.

There is inadequate commentary in relation to the approach to monitoring and metrics in relation to business impact. There is no visibility of whether intended monitoring (such pedestrian counts and ongoing retail spend monitoring), outlined in other SIBD DWPS for the project, has been carried out. There has been no reporting of this to the CBLG, or publication of this on the CRLL website. This is despite the published intention to do in other SIBD DWPS. The Draft SIBD Plan does not articulate any clear accountability or responsibility to ensure that this monitoring occurs.

Recommendation and Comments 1) Compared to the SIBD DWP for Karangahape Station Main Works, I find the overview of works (S3) to be an improvement. However, I still believe it is necessary to include further description by including the following either in the main body of the text or in an appendix: - Table 2-1 of the CEMP - Table 2-2 of the CEMP - Further detail of the CSA (as provided in Appendix B of the CEMP).

Response 1) The SIBD DWP is not a standalone document but is rather a sub -plan of the CEMP. An overview is provided in the SIBD DWP, however reference should be made to the CEMP for a more detailed description of the works.

The issue is that, to a lay person, there is very little clarity providing what the timing, hrs of construction, methodology and type of works involved that will have an impact on the receiving community. For example, what activities will take place, where and when; how much of this activity will be above or below ground; to what degree will ongoing Stage 3, 4 and 5 works overlap and have a cumulative impact alongside the main works; and how will these activities be received by the affected community. This is a significant gap that should be remedied so that there is context to understand the type of SIBD effects that have been identified by SMEâ&#x20AC;&#x2122;s and affected parties, as well as the strategies for their mitigation.

7) The Marketview data provides an area wide insight into spending and informs the community profile. It is not intended to provided business specific data. It can also inform the future monitoring of construction impacts.

The Auckland Transport Pedestrian Counts data demonstrates the level of pedestrians per hour. This peaks at over 3,500 pedestrians at 17:00 which is a high level of use. It also corresponds with the observations of the SIBD SMEs during site visits. It can also be used in future monitoring of the site.

8) The data informs the profile of the area, has informed the development of the SIBD mitigation measures (refer to Section 8.6) and will inform the implementation of the measures during the period that the events are

9) I find the inclusion of three news and social media stories regarding the CRL Project and affected communities’ issues to be selective and lacking validity and analysis. They are far from representative, and it would be more beneficial to provide a quantitative and qualitative breakdown of all news and media stories as pertaining positive or negative representations of the CRL Project.

I do not understand what purpose such selective evidence serves.

This and data mentioned in recommendations 7 and 8 above appear to be presenting a biased perspective that represents the positive impacts of the CRL project, particularly when the creation of a hardship fund and the HOTC’s #LoveAlbertStreet campaign has occurred as a result of the negative impacts and concerns raised by Albert Street businesses.

10) Whilst I agree that there are significant positive, future impacts or CRL and that Auckland Council planning is well-aligned and supportive of the transformational outcomes it will likely create, the SIBD DWP’s purpose is to provide a balanced analysis of both the positive and negative impacts of the works on the affected community. The community and council aspirations for the local area, as represented by the Waitemata Local Board Plan, the refreshed City Centre Masterplan and HOTC Annual Plan, for example, should be referenced for the purpose of ensuring CRL project works’ impacts align and support the outcomes that are sought, not as a means to justify the CRL Project, regardless of impact.

Selected articles are referenced to provide an indication of the stories that have been published in the media. It is an appropriate level of detail for the SIBD DWP. The level of media analysis proposed by the Independent Peer Reviewer is not proportionate or necessary.

This section has been updated to more recently published articled to reflect the date of SIBD DWP. Note, however, that the draft SIBD DWP contained 3 links to articles. One article referenced the CRL ‘Walk the Tunnel’, which was a significant event, one discussing the hardship fund and financial impacts on businesses and one on the level of disruption on businesses in 2020. There are a number of variations in the CCP’s “Affected Community and their feedback” such as different listings of affected parties and some 96 affected parties and their feedback that is listed in this document.

15) I acknowledge the integral role HOTC is playing to support the SIBD DWP process and its implementation. However, I find that the bullet points on p.30 should be clarified as comments made previous to this SIBD DWP (they are listed in previous SIBD DWP’s for Aotea project works) that continue to have relevance to the identification of impacts, their management and monitoring. It would be useful to understand whether and how, and with what success, these points have been addressed in the mitigation implementation plan (Section 8).

15) Section 6.1 provides an overview of the issues raised by HOTC and this has informed Mitigation Implementation Plan (Section 8). Mitigation measures will be monitored as set out in Section 10.

19) Section 6 provides an overview of issues raised in the course of SIBD engagement, but not all issues raised, are within the scope of this SIBD DWP or the requirements of Condition 61. Comments on the hardship fund were largely limited to the Business Forum (detailed at 6.4) and ‘Coffee and Chat’ events (Section 6.6). It should however be noted that the hardship fund is not a SIBD mitigation measure as stated at 9.3.2.

20) Whilst this SIBD DWP has built on all previous engagement, I generally feel that engagement with residents could be improved (as is the case throughout all local areas of the CRL Project). According to the SIBD DWP there are some 657 households in proximity) to the Project area (according to census mesh block statistics that are now 6 years out of date). There is a need to provide clarity on how many residents, rather than residential buildings and property managers,

It is necessary to ask whether the invitations to the coffee and chat sessions are a successful engagement strategy for residents if we cannot establish attendance by residents at these events.

21) As I mentioned in my peer review of Karangahape Station Main Works SIBD DWP, residential engagement is an ongoing issue, and whilst I acknowledge it is difficult to engage with residents of apartment blocks through door knocking exercises, it is suggested that other innovative ways of eliciting engagement and feedback may be required. For example, household surveys via letterboxes or strategically placed at residence’s lifts and entrances (or an advertised link to an online survey) should be considered with incentives provided for completing, such as vouchers for local (in proximity businesses) cafes, restaurants and shops. Such a strategy would have a positive secondary impact of building local community cohesion and patronage.

22) As I also noted in my peer review of Karangahape Station Main Works, the economic opportunity/ impact discussion in S. 8 has disappeared from this SIBD DWP. This is an important piece of SIBD analysis and must be re-instated. For example, the SIBD DWP should at the least address the following: a)

However, I would consider there to be downstream impacts on the potential cost and turnover of residential and business leases as a result of the Project, including the redevelopment and construction phases over the life-time of the CRL Project.

However, opportunities do exist as illustrated by the DRP, to create positive economic and livelihood impacts, such as for the potential increase in patronage of dairies, cafĂŠs and food outlets on Karangahape Road being in easy walking distance for construction workers from the works site. However, not all businesses are shaped by the same context. Some businesses, depending on access and location/ proximity to the works, will be affected differently (i.e. more positively) than those businesses where noise, dust, access, seating and visibility are issues. These potential SIBD impacts should be assessed and monitored.

b) The potential for positive effects from the construction process are noted, such as an alternative customer base resulting from the CRL construction workforce based in the area.

23) I welcome the emphasis upon collaboration as a mitigation strategy in S 8.6.

24) I continue to stress that the DRP, as an impact management plan, remains a cookie cutter list of activities, rather than a well-resourced and managed plan for Aotea Station area. It is stated throughout the SIBD DWP engagement that affected parties, including the Business Association are eager to co-design the DRP for Aotea. This needs to happen immediately and a tactical approach to specific activities (for mitigation of negative and enhancement of positive impacts) outlined that should be aligned with the Monitoring Plan.

24) Examples of development response measures have been included in Appendix F. Note the measures are subject to the nature and timing of construction works and where the implementation of the measures is practicable.

25) On p.45 of the SIBD DWP its states that â&#x20AC;&#x153;the hardship fund is outside the scope of this SIBD DWPâ&#x20AC;?. I disagree, it is a mitigation strategy that complements the DRP to specifically address negative impacts on business viability. It clearly has not yet been developed and needs to be as a matter of urgency. It is my opinion that the need for a hardship fund indicates a level of ineffectiveness of other mitigation and management strategies to remedy the specific causes

25) This SIBD DWP has been prepared to respond to CRL Designation Condition 61 and the matters listed within the condition. Financial compensation is a matter under the Public Works Act 1981 with separate processes and criteria. In addition a hardship fund has been established however the purpose of this is not to mitigate the planned construction works for Contract 3 but is rather to help small businesses in the C2 Albert Street Contract area that have been impacted by delays

It suggests that the approach taken to date via the DRP, wayfinding and signage is not mitigating against the lack of visibility, access and amenity value required by small businesses to attract customers during the construction works. A hardship fund is now a mitigation strategy to address the negative impacts attributed to the CRL Project and should be implemented as part of the suite of mitigation strategies.

If not, a clear statement by CRLL/ Link Alliance should be made explaining the reasons why.

26) It is welcome that this SIBD DWP begins to outline a SIBD Monitoring Plan (S 10 and Appendix H). I agree that a monitoring plan is essential and should include the four areas, data sources and timing summarised in the tables included in the Appendix. However, I repeat the comments I made in my peer review of Karangahape Station Main Works that also lists the same information as is in this SIBD DWP. At this stage, the Monitoring Plan lacks the following details: a)

A clear, integrated framework of impacts or effects to be monitored that are being managed and mitigated through the SIBD (DRP and other strategies) and other DWPs, as well as the CCP (I am referring to the impacts and mitigation strategies outlined in Section 8 (and what should be detailed in the DRP). It is essential that the monitoring plan is based on these so as to understand their effectiveness to enhance positive and mitigate negative impacts. b) The co-design of the DRP strategies, specifically for the Aotea Station Project Area c) Clarity regarding the resources, processes, roles and responsibilities of the Project Team for implementing and analysing the findings of the Monitoring Plan, such as the relationship between the Aotea Community Manager, DRP Manager and SIBD DWP authors, including the roles of those responsible for data gathering and how this data will Page 63

27) As I have noted previously, one of my main concerns as a peer reviewer of this and other SIBD DWPs regards the issue of knowing whether implementation and monitoring stated in the SIBD DWP is carried out and to what effect. For example, whilst it is evident that a number of my recommendations from previous CRL Project SIBDs have informed this document, I am interested to understand what the learnings combined from all projects regarding social impact and business disruption has been since the beginning of the CRL Project. I acknowledge that an ‘annual report for social impact and business disruptions’ is noted in all SIBD DWPs, yet there is no evidence of these annual reports and what they contain, and their influence upon CRL and its contractors’ approach. For example, who writes this report? Does it refer to all projects on an annual basis, or is there an annual report for each project? Where is this report available to the public, interested parties or peer reviewer?

27) SIBD SMEs were briefed on the key learnings and experiences from previous contracts and has also discussed the impacts of previous stages of work as part of the SIBD engagement.

28) A similar issue of transparency and accountability to affected parties or complainants is highlighted by the complaints process. It would be beneficial if annual reports and complaints activity are reported to the CLG as an agenda item. However, there is no evidence that this is conducted, or what feedback from the CLG has been raised.

28) The Link Alliance will prepare Annual Reports for C3 works as required under the relevant conditions. As stated in Section 10.3 the Link Alliance will make Annual Reports available on the CRL websites and will be a CLG agenda item. Complaints will be handled in line with the process set out in the CCP.

29) These issues raise a broader issue regarding the peer review purpose and process. Whilst the IPRP have a responsibility to review the draft DWPs, the review loop remains incomplete as there is no stipulated process to review what happens as a result of implementing the CEMP and DWPs. Maintaining accountability throughout the CRL Project, through monitoring plans and mid or post-project reviews would be beneficial to supporting CRLL/ Link Allianceâ&#x20AC;&#x2122;s ongoing social licence to operate, not just at the beginning of each staged project.

SIBD engagement has been extensive across the affected community allowing a geographical spread of data to be collected. This is evidenced in Figure 6 – 1. Text at 5.4.3 has been amended to refer to geographical spread.

The SIBD engagement team have provided opportunities for all demographics within the affected community to engage with SIBD SMEs. Feedback on demographic collection has been forwarded to the CCP SME for collection as part of future engagement activities.

The business forum is inclusive and open to all affected businesses in the lower and upper Aotea area. Approximately to 8 - 15 stakeholders attend the forum.

As stated in Appendix B reference should also be had to the engagement summaries contained within the Aotea Stage 1 -3 and 4 – 5 SIBD DWP addendums. Feedback was received from the Crowne Plaza, East Day Spa and Auckland Council and is recorded within the Stage 4 – 5 SIBD DWP addendum.

Note additional meetings have taken place with East Day Spa to discuss noise issues and monthly meetings with Crowne Plaza and associated businesses to update them on works.

Alongside door knock engagement invites to the ‘coffee and chat’ sessions were issued by email, by hand to businesses and via social media. In the case of 129 -135 the ‘coffee and chat’ invite was displayed in the ground floor reception area creating opportunities for feedback from all occupiers.

Whereas this information was collected on the Manhattan Apartments. Was this ad- hoc? Monitoring who is in these sessions and cross tabbing them back to both the community profile and the identified directly affected parties is an essential step in understanding whether the consultation process is representative of all affected parties and community members.

Compensation requirements are a direct reflection of the failure of the SIBD DWP, so should not be set out of scope, but be directly linked, and enabled through monitoring of the SIBD. Rerouting of these buses has the potential to reduce passing trade by customers considerably and needs to be evaluated as part of this SIA DWP. P33 Sec 6.8. and Sec 7-P34 & 35. Mental wellbeing is not captured in the key issues, despite being specifically mentioned in the feedback.

Loss of business viability has many knock-on impacts so specific assistance with metal health wellbeing needs to be set out within the SIBD DWP. Sec 7-P34 & 35 refers to the CNV DWP. I did not get access to this prior to submitting feedback.

8.8.6 Transport Disruption communication plan â&#x20AC;&#x201C; when is this going to be made available? P63 The lack of information about the bus impacts is a large omission in this SIBD DWP. This is a significant impact for a large proportion of workers in this area, including those with mobility and disability needs and the businesses that rely on passing trade from the buses. The plans for the bus route changes should be well advanced by now, as the changes will be happening in the next few months, businesses and residents alike, need to get access to the planned alterations ASAP, and not rely on a separate engagement by AT. P46 It is recommended that the monitoring plan includes monitoring of the effectiveness of the consultation and engagement process, not just the mitigation strategies.

Appendix F: Development Response Measures The Link Alliance will implement the following measures in conjunction with the affected community and as far as they are practicable. The DRP is a live document and opportunities for additional mitigation will be sought from the affected community from future engagement and in response to SIBD monitoring.

Business Support package A free of charge business support package which includes: • • •

12 months with a Business Mentor from Business Mentors NZ, a 12-month membership with the Auckland Business Chamber, and free social media training.

Trader Directory An online directory promoting businesses to the 1600+ CRL workers expected at peak construction, encouraging them to shop local and to use local services and facilities. Also accessible by Auckland’s wider community. The Trader Directory will be printed and available at all construction sites, handed out to cruise ship passengers and will be promoted using established social media channels. It is free to list local businesses and Link Alliance has received strong interest in the Trader Directory already.

Social Impact and Business Disruption Delivery Work Plan Meet the Neighbours Series A ‘meet the neighbours’ series which profiles local businesses providing insights into business owners and the challenges and opportunities that exist neighbouring the CRL project. The series is included in the CRL project newsletter ‘CRL Connection’ which is disseminated to more than 4000 people. The profiles are also promoted on our existing social media channels and have been shared

by Heart of the City in their e-newsletter also.

Business, Venues and Community Organisation advertising Link Alliance will work with businesses to include advertising where possible on hoarding structures.

Additional temporary signage has also been created to help further emphasise that these businesses are open.

Wayfinding and Business, Venues and Community Organisations Signage Link Alliance will display wayfinding signage at key points to help pedestrians navigate their way through diversions and to find businesses and community organisations within the affected community area. Signage will also be displayed for major events within the affected community area.

On-street Business Directory Map A hardcopy designed business directory map is placed in highly visible areas at key entrance points to Albert Street to help people understand what businesses are located along Albert Street. This promotion will use the Albert Street Eats Facebook page and will be linked to CRL’s Trader Directory.

The Link Alliance implement other promotion opportunities from ideas generated at the business forum as practicable.

Activations and Events Working with our partners to leverage key events and festivals and promotional opportunities. As well as this Link Alliance will implement activation opportunities along the corridor. Link Alliance also undertakes a number of tours along the project corridor each month.

Street cleaning and maintenance A daily cleaning and maintenance service along the entirety of Albert Street works including priority street cleaning along Albert Street and its intersections.

Loading Bays and Car Parking Proactive communication regarding the closure and changes to loading bays and on-street car parking to allow businesses to plan ahead.

Hoardings and Fences Hoardings will be required throughout the construction programme for Aotea Station. However, hoardings will be removed when no longer required if practicable. Additionally, low rise or open mesh fencing, ‘perspex’ windows and lighting installed to maintain visibility.
