Kentucky Senate Honors Professor Bob Lawson

On March 11, 2015 the Kentucky Senate honored Professor Lawson with a resolution in recognition of his upcoming retirement from UK Law. The month of May was an especially busy month at the law school. We celebrated with the Class of 2015 on their remarkable achievements throughout their law school careers and wished them well as they embark on their life journey. We enjoyed seeing students and alumni alike at the fifth annual golf tournament that raises money for student scholarships and public interest opportunities. Thank you to the teams and sponsors who helped make this year’s tournament a success. We also hosted the fifth annual Developing Ideas Conference. Law professors from across the nation were able to discuss their emerging research and writing. You may have noticed an upgrade to the UK Law website (law.uky.edu) which launched recently. Please visit the website often to stay up to date on law school activities and the accomplishments of our students and faculty. The end of this academic year had us saying goodbye to beloved and retiring faculty members, Professor Bob Lawson and Professor Richard Westin. The UK Law Alumni Association will host a special retirement party for Professor Lawson on September 18th. L AW N OT ES ONLINE FACULT Y NE WS Albertina Antognini (Left) presented her work-inprogress titled When Cohabitation Ends at the Thomas C. Grey Fellows Workshop hosted by Stanford Law School. Her article, Family Unity Revisited: Divorce, Separation, and Death in Immigration Law, which was originally published in the South Carolina Law Review in 2014 will be reprinted in the Minnesota Family Law Journal. Richard Ausness recently published an article, “Sherlock Holmes and the Problem of the Dead Hand: The Modification and Termination of “Irrevocable” Trusts in the Quinnipiac Probate Law Journal. Scott Bauries co-authored a Civil Procedure casebook entitled, Civil Procedure: A Context and Practice Casebook. Tina Brooks (Left) was promoted to Librarian III in the Law Librarian title series. Biff Campbell was cited substantially in a final rule published by the SEC, Amendments for Small and Additional Issues Exemptions Under the Securities Act (Regulation A), 80 FR 21805, 4/20/15. The citations were taken from his letter to the SEC, Proposed Regulation A Amendments Implementing the Jobs Act: Please, SEC, Revise Your Proposed Amendments in Order to Promote Small Business Capital Formation. Allison Connelly received the KBA’s 2015 Donated Legal Services Award. Jim Donovan (Left) as lead author, co-wrote The Open Access Adventure for American Law Reviews with Carol Watson and Caroline Osborn. This article won the ALL-SIS Outstanding Article Award given by the Academic Law Libraries Special Interest Section of the American Association of Law Libraries. His article, Law Legitimacy, and the Maligned Adverb, was published in the Mississippi College Law Review. Donovan was also granted tenure in the University’s Regular title series. Josh Douglas (Left) placed his article, State Judges and the Right to Vote with the Ohio State Law Journal. He also presented his article, A Checklist Manifesto for Election Day: How to Prevent Mistakes at the Polls at the Florida State University Law Review Symposium and ACS Voting Rights Symposium. Douglas was interviewed by WNPR, a Connecticut radio station,

for a program entitled Is It Time to Reform Connecticut’s Electoral System? He was also interviewed and quoted for an ABC WTVQ36 article entitled Recanvass for Two Republican Primary Races Set for Thursday. Douglas was also quoted in a Washington Post article Kentucky’s GOP Primary for Governor Could Head to Recount. Bill Fortune (Left) was featured in a Volunteer Spotlight article by the Kentucky Refugee Ministries. He also received the 2015 Outstanding Service to Young Lawyers Award by the Young Lawyers Division of the KBA. Chris Frost published an article, Bankruptcy Appeals: Flexible Finality, Interlocutory Appeals, and Circuit Splits, in the Bankruptcy Law Letter. Brian Frye presented a paper on copyright issues at a conference about Billy Joel held at Touro Law School. He was also selected as one of the artists included in the Whitney Museum’s inaugural show, “America is Hard to See,” for the opening of its new building. Frye also published a new article, Andy Warhol’s Pantry, in the Akron Intellectual Property Journal. His book chapter, A Revolution in Favor of Television: WCVB-TV and Robert Gardner’s Screening Room, will appear in a forthcoming book on Robert Gardner to be published by SUNY Press. Finally, Frye has several articles picked up for publication including Copyright as Charity by Nova Law Review, IP as Metaphor by Chapman Law Review, Social Technology & the Origins of Modern Philanthropy by Georgia State Law Review, Scenes From the Copyright Office by Touro Law Review, Eldred & the New Rationality by Kentucky Law Journal Online, and Three Great Phonographers: Nixon, Warhol & Kaufman by INCITE: Journal of Experimental Media. Michael Healy (Left) was reappointed as the University of Kentucky’s academic ombud for the 2015-16 academic year.

Nicole Huberfeld was selected as the new AshlandSpears Distinguished Research Professor. She published several articles including The Supreme Court Ruling That Blocked Providers from Seeking Higher Medicaid Payments Also Undercut the Entire Program (forthcoming) and The Universality of Medicaid at Fifty in the Yale Journal of Health Policy Law & Ethics, and An Empirical Perspective on Medicaid as Social Insurance in the University of Toledo Law Review (forthcoming, with J.Roberts). Huberfeld has also been a two-time guest on The Week in Health Law, a new health law podcast.

Richard Westin co-authored the book, Guia Fiscal para Inversiones Mexico-E.U (Tax Guide for Investment Between Mexico and the United States), which will be published by Do Prosecutor Editors.

Diane Kraft (Left) recently published her article, CREAC in the Real World, in the Cleveland State Law Review. Bob Lawson was featured in an article in the HeraldLeader entitled After 50 Years at UK the Man Who Wrote Much of Kentucky Law and Investigated UK Athletics is Retiring. Cortney Lollar had her article Moral Compensation picked up for publication in the Tulsa Law Review. Her article, What is Criminal Restitution?, was cited in an amicus brief filed with the U.S. Supreme Court in Johnson v. United States and in the latest supplement to the Federal Practice and Procedure treatise. Karen Nuckolls will have her article LC Subject Headings, FAST Headings, Apps: Diversity Can Be Problematic in the 21st Century appear in Rethinking Technical Services, v.6 in the series Creating the 21st Century Library. Melynda Price (Left) was promoted to Professor in the University’s Regular title series.

Rick Underwood submitted a paper on Billy the Kid at a conference held at Touro Law School.

Andrew Woods (Left) recently published his article The Limits of Moral Intuitions for Human Rights Advocacy in the peer-reviewed journal The Law & Ethics of Human Rights. His report, Data Beyond Borders, was published by the Global Network Initiative.

UK Law Students Deliver Strong Community Impact In the UK Law Legal Clinic, 29 third-year law students handled 92 cases for a total of 2,732 hours devoted to classroom and client casework, or approximately 94 hours of free legal aid provided by each student. For the 2015 tax return season, 19 law and 12 accounting students volunteered in the UK Law Volunteer Income Tax Assistance (VITA) program to assist 475 taxpayers complete their returns. Logging a total of more than 600 hours over the course of six and a half weeks, UK Law students saved taxpayers about $95,000 in return preparation fees.

Franklin Runge was promoted to Librarian III in the Law Librarian title series. Paul Salamanca received the 2015 Duncan Teaching Award at the law school. He was also quoted in the Courier-Journal article, Gay Marriage Briefs Both Wacky, Profound. Collin Schueler (Left) will have his article, An Administrative Stopgap for Migrants from the Northern Triangle, published in the Michigan Journal of Law Reform. He was also recognized by the University of Kentucky as a “Teacher Who Made a Difference.” Robert Schwemm was cited in Justice Kennedy’s majority opinion in the June 25, 2015 Supreme Court decision, Texas Department of

A Trip Down Memory Lane

Rick Buchanan (1985), recently retired as Senior Assistant Commonwealth’s Attorney for the County of Roanoke in Roanoke, Virginia. Prior to his time with the Office of the Commonwealth’s Attorney, Mr. Buchanan clerked for the Kentucky COA, worked for the Kentucky Cabinet for Natural Resources and Environmental Protection, became a reference librarian at the Marshall-Wythe School of Law at the College of William and Mary, and had a criminal defense practice in Roanoke, Virginia. Bill Geisen (1982 - Left), was named a Fellow by the Litigation Counsel of America (LCA). Membership in LCA is limited to 3,500 Fellows, representing less than one-half of one percent of American lawyers. Ronald G. Polly, Jr. (1991), was re-elected as Managing Parter of the national litigation firm, Hawkins Parnell Thackston & Young LLP. Mr. Polly will continue to lead the labor and employment group. Bridget Sharphorn (2008 - Left), recently accepted the position of Housing Manager in the Civil Rights Division of the State of Texas. Ms. Sharphorn will oversee investigations and alternative dispute resolutions of all claims filed with the state under the federal and state Fair Housing Acts.
