Thanksgiving Bin Overflow at Russell Recycle Center Solved By Ann Wishart The recent overflow of bottles, cans and plastic at Russell Township’s recycling center was the result of several factors, none of which was the fault of the township, officials said. First, Thanksgiving Day and Black Friday always produce plenty of items for the recycle bins, township Trustee Justin Madden said at Wednesday’s special trustees meeting. Second, the bins, which are usually emptied three times per week, were completely stuffed over the weekend because the usual hauler did not collect it, Madden said. Third, people frustrated with the overfull bins just left their full plastic bags on the ground near the bins. Animals tore the bags open, leaving debris blowing all over the yard, said Fiscal Officer Chuck Walders said. Road Superintendent Gene Layne took care of cleanup. “Gene saw the mess was becoming a problem and closed the site,” Madden said. When the township contacted Bob Villers, director of the Geauga-Trumbull Solid Waste Management District, it was revealed the organization will be contracting with a new hauler, Rumpke Trash Inc. which has facilities in Cleveland, he said. The contractor who usually

collects the recyclables apparently found out and failed to make his rounds over the long weekend, Madden said. Other townships in Geauga County had the same problem, he said. “Russell Township had nothing to do with the mess,” he said. It took a front-end loader and a truck to clean up the bags and take them to the landfill, Walders said. The point of the recycle program is to keep the items out of landfills, but it was the only practical response, he said. The situation led to a discussion about the deterioration of the asphalt parking lot on Chillicothe Road due to traffic and the weight of the hauler truck. Trustee Jim Mueller said the site needs 8 inches of reinforced concrete. “Asphalt is not designed to take that weight,” he said. Walder said he is starting to allocate funds for the $30,000 project, but it won’t happen soon. “We have a huge sewer (installation) bill facing us,” he said. The township office building on Kinsman Road is one of several offices and businesses at the intersection of Kinsman and Chillicothe roads that will be connected to the sewage plant.

In a move considered rare among public officials, Chester Township Trustee Ken Radtke has filed a lawsuit against the board on which he sits, charging fellow trustees Mike Joyce and Judy Caputo with violating the Ohio Open Meetings Act when they met individually in 2011 with the township zoning inspector and a representative of a nonprofit land conservancy organization. The three-page complaint, filed Nov. 27 in the Geauga County Court of Common Pleas, names Chester Township, Chester Township Board of Trustees and the Western Reserve Land Conservancy as defendants, and claims that a 2011 conservation easement on a township-owned property was invalid because officials had violated Ohio’s Open Meetings Act, also called Ohio Sunshine Laws, during deliberations.

The lawsuit asks that the easement be declared invalid, the property rights be returned to the township and that Radtke be Radtke awarded damages including, but not limited to, his attorney’s fees. It requests a jury trial. According to Chapter Four of the Ohio Open Meetings Act, anyone can file an action in common pleas court to address an alleged violation, but it must be filed within two years of the occurrence. Chester Trustees approved the conservation easement agreement on Dec. 1, 2011, according to the lawsuit. “A formal action taken in an open meeting may be invalid if it results from deliberations that

Local Hunting Video Goes Viral By Josh Echt A hunting YouTube video two West Geauga graduates recently produced might beg the question, “What the buck?” The video “What Does the Buck Say?” — created by David and Dean Giarrizzo — has more than 200,000 views and is a parody of “What Does the Fox Say?” The latter video and related song, released in September, is a creation of the Norwegian comedy duo Ylvis. Although “What Does The Fox Say?” has over 230 million views, according to the Ylvis YouTube channel, the Giar-rizzos are not doing too bad themselves, with 209,291-plus views as of Monday morning. The two brothers helped found Tag-N-Brag, an online community for hunters and fishermen. They are celebrating youth deer-hunting season, which occurred at the end of November, with an online video aimed at future hunters and sportsmen. The Giarrizzos, who both graduated from Ohio State University, said social media is a way for hunters young and old to share tips, show off trophies and communicate about their hobby.

How it Began The brothers, along with high-school ally and web developer Peter Reichert, came up with the idea after watching “The Fox” video this fall. “Peter is a very Internetsavvy person and noticed ‘The Fox’ going viral at an early stage,” David said. “At that point, he pitched the idea of making a parody of the video to gain some exposure. We all collaborated and decided to come up with our own version of the song, with its own lyrics so that it had relevance and meaning coming from hunters.”

The team recruited friends and family to participate. The brothers said they credited both their father and uncle for fostering their love of the outdoors, which they now share with other hunters, including a growing number of millennialaged sportsmen and women. David said Reichert does the voiceover work and co-wrote the lyrics. Reichert also mixed the video’s beat and performed the ending video animation. Although the video is a parody of the popular song, “we cre-

The township has the authority to take down the house at 4,656-square-foot home at 15279 Hemlock Point Road after Dec. 8. The Scott house has fire damage and the township has been working with the owner to demolish the deteriorating structure. Also included is an email from Geauga County Assistant Prosecutor Rebecca Schlag, the township’s legal counsel. The emails reflect an attempt by Rodstrom to meet individually with each trustee to discuss the first draft of a proposed conservation easement on 85 acres of land, with separate meetings scheduled at one-hour intervals on June 15, 2011. In one email, Lawrence asked Borcherds to sit in on his session to add background knowledge. There was no mention in the emails whether any meetings actually took place.

In Time for Hunting Season The brothers said the timing was perfect to release the video during the various ongoing hunting seasons. Youth deer gun season took place Nov. 23 and 24, while adult deer gun season ran from last Monday through Sunday. Bow season started Sept. 28 and runs through Feb. 2. “It’s great that Ohio offers a special youth hunting weekend right now at the peak of the seaRoad at the northern edge of the township in 2001 for about $850,0 0 0, according to comments Chester Township Park Board member Lance Yandell made at an October 20 13 trustees meeting. The land remained closed to the public for many years as trustees debated how to use the acreage, more than half of it woods and wetlands. In 2011, Borcherds presented trustees with an idea to preserve that portion as a passive park and to develop the remainder for recreational use. Borcherds left office in late 2011 to take another job. On Dec. 1, 20 11, Joyce, Caputo and Lawrence approved a conservation easement with WRLC, a non-profit, Moreland Hills-based organization that works to preserve open private and public land permanently. Both the property purchase and the easement have been controversial in the township for the last several years, a frequent subject of public discussion at trustees meetings and a major topic in a newsletter circulated anonymously in the community. Radtke defeated Lawrence in November of 2011 and questioned the easement as well as the township’s plans for the 85 acres. In October, he told Caputo and Joyce he believed the township had grounds to break the easement agreement because he had email evidence that trustees had violated the open meetings law by meeting separately with WRLC officials,

which he called a “round robin” attempt to get around the law. Caputo had said she did not recall that any such meetings had taken place. Both Caputo and Joyce stood by their decision to enter into the easement agreement and voted against Radtke’s proposal to pursue the issue with the Geauga County Prosecutor’s Office. An Oct. 18 letter sent on Chester Township stationery to Prosecutor Jim Flaiz said Borcherds had appeared to be acting at the request of the WRLC when he attempted to arrange a series of individual meetings with the three trustees. It asked Flaiz whether that constituted a violation of the Sunshine Laws, whether that could make the easement agreement invalid and whether it was necessary for the township to file an action in common pleas court to reclaim its property rights. “And would the Geauga County prosecutor take such prompt action on behalf of the Chester Township Board of Trustees?” the letter asked. The statute of limitations would expire on Dec. 1, so the letter called for a prompt response. It was signed “The Chester Township Board of Trustees.” Joyce and Caputo were defeated in the November election. Radtke filed his lawsuit three weeks later.

A judge could decide merely to issue a warning, a reprimand or a fine. That could be the case, agreed Chardon attorney David Ondrey, who serves as village solicitor in South Russell and has dealt with issues related to the Sunshine Laws for many years. According to Ondrey, courts have given some leeway to smaller boards of trustees when determining whether an informal discussion violated the law. “It’s not clear cut and could be a close call,” Ondrey said, adding the court will usually try to determine whether officials tried to get around the law when they met with someone or discussed an issue privately, but had later held formal discussions and voted during public sessions. Courts have recognized it is difficult for two members of a three-trustee board to completely avoid discussing an issue outside a public meeting, he said, adding he could not comment on any specific case. WRLC officials declined comment, but issued a press release Thursday through their general counsel, Bob Owen. “We never discuss pending litigation,” the statement read, in part. “However, what we can tell you is this: “We are deeply concerned about any challenge made to

our legal standing with respect to this or any of our conservation easements.” The statement said the purpose of the WRLC is to take responsibility for protecting natural resources forever, and it is the largest land trust in Ohio, protecting 37,500 acres on 500 properties in Northeast Ohio. “And we have never lost a conservation easement,” Owen concluded.

Deep Pockets Because one township trustee is suing the other two, the county prosecutor’s office will not be able to defend the lawsuit. Wickliffe-based attorney David Lynch, brother of state Rep. Matt Lynch (R-Bainbridge Township) is representing Radtke. The township will have to hire outside counsel. Depending on whether the issue is resolved or goes to a jury trial, attorneys’ fees could easily run into five figures, according to Ondrey. If the township is found in violation, it may be ordered to pay Radtke’s attorney fees as well. If the court does not issue an injunction and deems Radtke’s lawsuit frivolous, it could order him to pay all of the township’s court costs and reasonable attorney’s fees. Another source said that he believes the WRLC has access to big-name law firms to represent their side. “This could get very expensive,” the source said.

Chesterland Chamber of Commerce ‘Bright Stars’ for 2013

By The Chesterland Chamber of Commerce Board of Trustees Upon joining the Chesterland Chamber of Commerce over three years ago, Frank and Terri Arko, owners of Rise and Dine Cafe, located at 12769 Chillicothe Road, Chester Township, have never once said the word “no” when asked for their time, help and support. Frank and Terri had yet to open their restaurant, Rise and Dine Cafe, and the first words out of their mouths were, “What can we do to help the community?” Shocked as most chambers would be, we started listing all of our upcoming events. Much to our surprise, they said, “Yes, sign us up for everything. We want to get involved and have a positive impact on the community in which we live and do business.” From that point on, they have held pancake-eating contests for the football team and stayed open late on home games to serve the starving players, cheerleaders and fans. Three years in a row, they have participated in our annual community picnic, “Chesterfest,” offering up their award winning ribs and other delights, always being the first to sell out. Frank and Terri have contributed to the design and construction of our Fourth of July Parade float as well as marched in the parade to toss out popcorn balls and candy to the awaiting masses along the route.

As the annual Night at the Races event approached, Frank and Terri offered not only their time and services, but also supplied financial support by promoting the event, donating prizes, selling tickets and securing sponsorships. For the annual Golf Classic and Clambake, Frank and Terri personally created, organized and ran the new “Putting Contest,” which generated additional monies for our scholarship fund. Their restaurant, Rise and Dine Cafe, has also donated a wonderful breakfast for the last two years. Additionally, Rise and Dine Cafe was showcased in the first

ever “Chamber of Commerce Ribbon Cutting Ceremony” and has hosted three chamber luncheons. Frank and Terri are very active in recruiting new members to the Chesterland Chamber of Commerce and have helped in the organization of the chamber’s Christmas party and Welcome New Members night. As stipulated above, this is not just for the past year — even though their recent contributions stand on their own merit — but they have excelled for the last three years. Thank you, Frank and Terri. It is because of people like you that Chesterland is a great place to live and do business.

Miracle in a Manger Dec. 15-24 While some churches worry that Baby Jesus may be taken from the outdoor nativity scenes, the folks at Ledgewood Christian Church in Russell Township are giving away Baby Jesus this Christmas season. The manger of the outdoor nativity displayed on the church’s front lawn will be filled with free ornaments featuring the Baby Jesus. Community members at large are invited to come and take one or more home with them. “Jesus is the reason for the Christmas season” and Ledgewood is bearing witness that a miraculous and free gift of grace and joy is waiting in the manger. Anyone may drive in, walk up to the nativity and take an ornament out of the manger, day or night. The church hopes to give away 400 ornaments this season.

Christmas at Christ Presbyterian Church This Christmas Eve, Christ Presbyterian Church celebrates Jesus’ birth with candlelight services at 5 p.m. and 9 p.m. The 5 p.m. service is a traditional and family-friendly, with Christmas carols, the Nativity story and opportunities for kids to move around during the service. Message From Chester Road Dept. Ice and Snow Removal From Roads The following is a message from Chester Township Road Department Superintendent Rob Pealer: Even though winter does not officially begin until Dec. 21, the weather associated with the season has already begun to invade our area. The following information outlines some of Chester Township’s winter season policies and procedures. Please take a moment to read through this information or clip and save it for a future reference. I would first like to point out that Chillicothe Road (Route 306) and Mayfield Road (Route 322) are state roads. The snow plowing on these two roads is performed by the Ohio Department of Transportation, not the Chester Township Road Department. To report a snow plowing issue on either of these roads, call the ODOT Office for Geauga County, 440834-4441. The township has once again entered into a contract with the Geauga County Commissioners to plow snow off the county roads. The county roads include Mulberry Road; Wilson Mills Road; Sperry Road, south of Mayfield Road; and a portion of Caves Road, from Russell Township to Wilson Mills Road. To report a snow plowing issue on these roads or any township road, call the Chester Township Road Department Office, 440-729-9110. The township uses seven trucks to plow snow off the 183 lane miles of county and township roads. It takes approximately three hours to complete this process. If continuous heavy snowfall is encountered, the response time is generally increased by an additional one to two hours depending on the caliber of the storm. So, it can be several hours after a road is plowed before the truck returns for another pass. These trucks also throw blinding snow off the plows, make sudden stops and often turn around at various intersections to plow the return lane of a road. Please keep the front of vehicle at least 100 feet away from the back of these trucks to avoid any potential accidents. The township does not have a “bare roads” snow plowing policy. However, we will be applying a mixture of about 90 percent road salt and 10 percent ice grit. We will also be using a liquid called Ice-Bite, which is

an environmentally safe agricultural bi-product of the sugar beet plant after the sugar has been extracted. It enhances the salt’s ability to work for longer periods of time and at temperatures to -25 degrees. Additionally, we pretreat or trouble shoot roads with brine for added melting power and salt activation. This application aids to keep the roads open longer and saves overtime hours by not allowing the ice to bond to the pavement. These products will generally be applied on hills, curves and intersections. The township is not responsible for the removal of snow thrown into any driveway by the township snow plowing equipment. Residents or snow plowing contractors should avoid plowing, shoveling or blowing any snow onto the road surface. Piles of snow left on roadways can create dangerous obstacles for motorists and the township snow plowing equipment. If a person is reported leaving snow in the roadway, he or she could be subject to a possible citation. Residents should stress to children to say out the path of snow being thrown off the township snowplows. The snow thrown off the plows travels at a high rate of speed and may contain rocks or pieces of ice which could injure a child in its path. Children also should not dig tunnels in the snow or build igloos near the roadways or in roadside ditches. Residents should not set garbage containers on or near the roadway during a snowfall event. The thrust of the snow coming off the plows does have the capability to topple these containers even if they are full of garbage. Set containers at least six feet back from the edge of the road. This will help to

reduce the possibility of containers being toppled. Mailboxes should be kept in good condition so they can withstand being hit by the force of the snow being thrown off the township snow plows. If a mailbox is damaged or the post is broken because of thrown snow, the township will not repair or replace it. The township will only repair or replace a mailbox that has been hit directly by the snow plowing equipment. If the township does have to replace a mailbox post, it will be done with a post that is no larger than a 4feet-by-4-feet. This is due to the fact that mailbox posts are required to be break away if they are struck by a vehicle. The Federal Highway Administration has determined that a post no larger than a 4-feet-by-4-feet meets that requirement. The township does not recommend the use of one piece plastic mailboxes structures such as “Step 2” because the twisting that occurs when these boxes are hit by the thrown snow tends to break the plastic. If a plastic mailbox structure is physically hit by the equipment as stated previously and damaged beyond repair, it will be replaced with a conventional box and wood post.
