Chester BZA Appointment Tabled Until After Election By Diane Ryder

An open seat on the Chester Township Board of Zoning Appeals will remain vacant until after the Nov. 5 election, trustees decided Oct. 3. Trustees will appoint a resident to fill the unexpired term of John Gorka, who passed away April 29. There was a proposed motion placed on the trustees’ meeting agenda to appoint Cathy Cotman, wife of former Trustee Ron Cotman, to the position. Both Ron and Cathy Cotman frequently question trustees on several issues during the public comment portion of most meetings. Trustee Ken Radtke voted in favor of appointing Cathy Cotman to the BZA position; Trustees Mike Joyce and Judy

Caputo voted no, with no discussion. Joyce said he had heard from BZA Chairman Robert Leach indicating that former BZA member Barton Ziganti was interested in being appointed to the position. Trustees had asked for applications, but had received only one, from Cotman. “I have some reservations and need some advice from the board on how to proceed,” Joyce said. “I didn’t know that (Mr. Ziganti) didn’t apply,” Caputo said. “I have no issues in regards to that.” Joyce said the full zoning appeals board had requested that Ziganti be appointed to the position. Caputo moved to appoint Ziganti to the BZA, but the

Trustees Table Request for Invoice Payment By Diane Ryder A Dublin company will have to wait a little longer for payment of a months-old $4,615 bill to Chester Township, after Trustee Judy Caputo requested it be tabled during the Oct. 3 trustees meeting. For the last several weeks, both Caputo and Trustee Mike Joyce have questioned Trustee Ken Radtke on whether he authorized VocWorks to perform work without board approval, which Radtke repeatedly has denied. During discussions at earlier meetings, trustees appeared to be leaning toward agreeing to

pay the bill. The topic had been on the draft agenda for the Oct. 3 meeting, but was not on the final agenda. “I wanted VocWorks to be on the agenda tonight, but Judy said you asked to table it. Can I help you with it?” Radtke asked Joyce. Caputo said she was not ready to vote on the issue. “The main issue is we’ve gotten a prosecutor’s opinion that, if the work was done, they should be paid, but the ball got dropped at some point,” Caputo said. “I look at this a little differently from the parking lot issue.” Caputo and Joyce had

accused Radtke several months ago of authorizing additional work on the township hall parking lot without a board vote, which Radtke repeatedly denied. “This one had no scope of work agreement, no motion by the trustees and no contract,” Caputo said. “I ask for a little bit of time to make a decision.” Radtke said Caputo was being inconsistent because he attempted to table a vote on the Marilyn Drive project weeks ago, but Caputo and Joyce had pushed the vote through. “The parking lot was a fiasco to begin with,” Radtke said. “Trustees said to talk to the

prosecutor; the prosecutor said to talk to the trustees and it bounced around and around.” “The political exploitation that goes on around here is disgusting,” he added. Caputo complained that bill was not presented in a timely fashion. “Up until six weeks ago I didn’t know the bill existed. You sat on that bill for months,” she said. “I have the same rights as you do to take my time to make a decision. I’d like to pay VocWorks, but I’m not ready and I don’t want to get into an argument on this.” Radtke said he did agree to look into the matter in July but

he had spent much of his time working on township budget issues and other matters. “If you want to do more research, that’s fine,” Radtke said and Caputo said the township needs to do what’s right. “You are continually trying to turn this into a horse and pony show. You dropped the ball. You had this bill since February and if it takes me four, six or eight weeks to make a decision, that’s my prerogative as trustee,” she said. “February is not accurate,” Radtke said. “It was May.” In other discussion, Joyce

Scott House Nears Demolition By Ann Wishart The clock is ticking on the burned-out, abandoned house on Hemlock Point Road. Russell Township Trustees have been trying for about a year to resolve the many issues surrounding a 4,656-square-foot home at 15279 Hemlock Point Road owned by Annette Scott. In July, cheered on by other Hemlock Point residents, trustees agreed to start the lengthy legal process required to demolish the house and remove the abandoned cars in the driveway.

During the Oct. 2 trustees meeting, trustees Secretary Melissa Palmer said efforts to serve notice to Scott have been unsuccessful, so another legal path was followed. “Yesterday we posted a note on the door” of Scott’s abandoned house, Palmer said. If Scott doesn’t take any action in the next 30 days, the township is free to demolish the structure. Notice also was sent to the bank that holds the primary lien on the property. Within seven to 10 days, Palmer said she expects to receive a receipt the notice

was received, whereupon the bank has 30 days to respond. Scott was served notice of the township’s intent by way of a legal notice placed in a local newspaper published on Sept. 23, said Trustee Justin Madden. “That clock is ticking,” he said. Caputo said some appointments had been made without any advertising; Joyce said reappointing someone without advertising for other applicants was “perfectly legal.” “It’s a matter of consistency in how we treat people,” Radtke said. Caputo again moved to appoint Ziganti. Again, no one seconded the motion. “My personal feeling is we should re-advertise and open it up,” Joyce said. Radtke accused the other two trustees of each having a candidate in mind. “Advertising would be just providing cover, in my opinion,” he said. what. The administrative staff knows nothing about it. I will cross-check with the security system to see who had access when the copies were made.” Joyce said he probably would seek reimbursement to the township from the person who made the unauthorized copies. He later added the township is charged seven cents for each copy, which would mean the copies cost the township about $231. “This is the first I’ve heard of it,” Radtke said, adding he welcomed the investigation. In other business, trustees approved spending $5,000 to make modifications to the Sherman Road/Wedgefield Lane intersection at the recommendation of the road superintendent and the Geauga County Engineer’s Office. “We will add several inches of blacktop to the intersection

Four people are challenging Caputo and Joyce in the Nov. 5 trustees’ race. Radtke said, “The only other candidate is Cathy Cotman. She’s a professional engineer and has a pretty good service record. Is she in your opinion unqualified?” “My vote is no, period,” Joyce replied. “Move on.” to alleviate a safety issue there,” Joyce said. Radtke asked to allow public comment before the vote was taken. “It’s an unusual situation. I go along with that,” Joyce said. Wedgewood Drive resident Bill Rodgers told trustees he believed the plan to add six inches of pavement will help visibility, but asked that the material be added to taper further back and to shave off some pavement from the other lane. He added the engineer’s plan will solve most of the visibility problem, but could still be a problem for people turning into a driveway near the intersection. Trustees passed the issue.

Carl and Joan Roth Fund Helps Eye Clinic, Doctor Says By Josh Echt

An eye doctor with Chester Township ties is asking local residents to help support a fund that honors a well-known West Geauga couple. Gary Roth, a West Geauga High School graduate, said earlier this month the community should support the Carl and Joan Roth Fund, which helps fund the importation of special eyeglass lenses for a charitable eye clinic in Jerusalem. The practice, the Bliss Eye Clinic, was established in 1983 in memory of South African optometrist Samuel Bliss. It began as a free clinic in a Jerusalem neighborhood and later expanded to a larger neighborhood. The clinic contains volunteer ophthalmologists and optometrists, who administer to patients at little or no cost. Roth is the son of Joan Marcs Roth and her husband, Carl Roth. The Roth couple lived in Chesterland for 40 years before they both passed away in 2011. Gary said his parents were activists in the community – even serving on the West Geauga Recreation Council – and supported the eye clinic at a high level by helping fund the importation of the eyeglass lenses. “The number of needy people requesting eyewear has increased significantly as of late, and supply is not keeping up with demand,� Gary Roth said. “Recipients are always very grateful,� he said. He said his mother was an inspiring teacher who taught at

Westwood Elementary for over two decades, adding she later served as a supervisor of student teachers at Kent State University upon her retirement. Gary also said Joan was recognized by the state of Ohio for her efforts.

“Joan looked at people, but she looked for the good in them, not the bad.� – Carolyn Marcs Carol Marcs, Joan Roth’s sister-in-law, said Joan was remembered as someone who always saw the positives in others. “Joan looked at people, but she looked for the good in them, not the bad,� said Marcs, a Pepper Pike resident. “She was a positive person, a people person.� Marcs said Joan mentored Robyn Marcs, Carol’s daughter and Joan’s niece. Joan and Robyn would dress up and go to the theater together at Playhouse Square. “She was all about family,� Marcs added. Carl Roth, a Cleveland Heights High School alum, was a long-time educator at several area institutions, including Mayfield High School, Hebrew Academy and Lakeland Community College, among others. Carl was also involved in the nationally recognized Shoes for Kids program. His experience as a history

teacher also benefited Robyn, a history major at Miami University of Ohio in Oxford. “She’d call him and ask questions, and he’d always help my daughter,� Marcs said. Larry Marcs, Joan's brother and Carol’s husband, said the pair were the kind of people who were quickly admired because of “their engaging humility and wonderful attitude toward everyone who were blessed to have met them.� “It was a tragic loss of two bright stars who devoted their lives to teaching,� he added. “Joan was more than a sister, she was the catalyst who strongly contributed to keeping our family together.� At the end, Carol Marcs said the Roths’ loving attitude toward family members carried over into their passion for charitable work, such as helping the eye clinic and other local causes. Gary Roth said contributions would go toward maintaining and upgrading the eye clinic, as well as for enabling indigent Jerusalem residents to obtain eyewear. “The need over there is greater than the need over here,� he said. “The demand is greater than the funding.� U.S. tax-deductible donations can be made via P.E.F. West G Answers Most Open Enrollment Questions By John Karlovec West Geauga Schools Superintendent Geoff Palmer provided answers to questions residents submitted regarding open enrollment in West Geauga Schools last week. The information, right, is also posted on the district website at www.westg.org. But resident Anita Zurcher’s main concern still is not answered; namely, the number of students in each classroom. “That is the one question that was not answered,” Zurcher said in an email reply to Palmer on Thursday. “I would think that would be the easiest question to answer since you must have class rosters at each school.” Zurcher told Palmer she is “hearing of class sizes up to 30 students at the high school,” which she finds disturbing. “Increasing the number of students per class in order not to cut positions is not benefiting our students and it certainly will not allow them to reach academic and ethical excellence,” she added. Palmer explained information regarding the average class size per school since 2007-08 currently does not exist and the district is continuing to research the issue. Zurcher said she is not trying to argue with school board, but would like the information

provided in a timely manner, before the November elections. “I am just trying to move the school board to take a step back and analyze the current OE (open enrollment) policy so the students of West Geauga taxpayers get the education they deserve,” she told Palmer. “We need to keep our school system strong and, in turn, keep our community and property values strong. The residents of this community made whatever sacrifices were necessary to move to this wonderful community and we want to keep the community strong.” School board members Bill Beers, Mike Kilroy, Sally Gillmore, Jackie Dottore and Ben Kotowski were all copied on Zurcher’s email.

Bainbridge Township Driver Charged with Eighth DUI By Cassandra Shofar A 50-year-old Bainbridge Township man faces his eighth DUI charge after failing a field sobriety and breathalyzer test on Oct. 4. Timothy Norquest, of 8160 Washington St., was seen staggering out of Panini’s Bar & Grill in South Russell Village, said officer Michael Cardaman in his incident report. “The male saw me, then went to the passenger side of the car, then staggered back into the bar,” he wrote. “A short time later, I observed the male driving out of the parking lot in the red car and east on Washington Street. The car made a very wide turn and went from the right side of the road back to the center line.” Norquest turned into a parking lot at 551 Washington St., pulled into a parking spot and exited the vehicle, at which time Cardaman asked him to stay in his vehicle, the officer said. Norquest denied driving and said the woman he was with had been driving. He said he didn’t have an ID on him, but provided a Social Security number, Cardaman said, adding the

number came back as another person from Cleveland. Both Cardaman and a Geauga County Sheriff’s Office deputy who stopped to help saw Norquest hand the woman an item while trying to conceal the transaction. “I saw the item as a wallet and it containted the driver’s state of Ohio ID card. I was then able to get the positive ID on Norquest,” Cardaman said. Norquest was unable to complete field sobriety tests, couldn’t follow directions or keep balance, had slurred speech and a strong odor of alcohol on him, the officer said, adding he was taken into custody for felony DUI. Among his misdemeanor charges were falsification and failure to wear a seatbelt. Norquest has had seven prior DUI convictions, the most recent in 2010. On Friday, he waived his preliminary hearing, said Chardon Assistant Prosecutor Dennis Coyne. His case will be bound over to the Geauga County Court of Common Pleas and and presented to a county grand jury within 60 days.

L etters to the Editor Observer is Fake Thank you Chester for the response and correspondence regarding the activity of a small group of citizens that create chaos with their actions at meetings and publish their fake newspaper called the Observer. Please keep the correspondence coming. Overwhelmingly, the community does not support the antics of this group. Just last week they wrote that I should attend all the trustee meetings. They also state the former fiscal officer attended all meetings. The record reflects she missed seven regular meetings in just her last eight months of office. Observer staff members attended those meetings, but reported the exact opposite. What does that tell you as to the credibility/character of these people and their Observer? They fail to mention that the Aug. 22 meeting was the first regular meeting I missed since taking office 19 months ago (I’ve missed three in total). They also fail to report that I stated that the reason I would only be coming as the law requires was due to their constant disruptions and the embarrassment they continually bring to this community and those meetings. I asked Trustee Ken Radtke, who has proclaimed his friendship with this group, if this group felt that their ideals represented the ideals of Chester residents. Ken’s response was that he “didn’t think that this group considered the views of the community. They had their objectives and weren’t concerned with the community’s wishes.” There was not one commu-

nication supporting the actions of the former fiscal officer either. Residents also ask the Observer to publish some contact information such as email or phone so people can opt out or give direct feedback on articles. Please add this to future editions and put a byline on the articles so we know who gathered your information/misinformation. The people want to know why in the last four elections, not one of you has had the courage to put your own name on a ballot and run for election. Support Your Roads As head of the Russell Township Road Department, I would like to ask Russell residents for your support of the road levy on Nov. 5. The 1.10-mill levy will generate an estimated $277,310 per year and will cost the owner of a single family home with a market value of $100,000 approximately $37.90 per year. This levy would replace money this department used to receive from the General Fund for operations, which we will no longer receive because of state cuts. My goal has, and always will be, to put as much money as I can into the road infrastructure

and to keep our equipment up to date and in good shape. In order to accomplish this, I always look at ways to save on costs. Examples include staffing levels are the same as when I took over as department head 12 years ago; we are still in the same facility that was purchased from a trucking company in 1979; purchasing salt and equipment through the State of Ohio, resulting in thousands of dollars in savings; doing most mechanical work in-house, so not paying high shop rates by hiring this work out; doing crack sealing in-house after the purchase of a used crack sealing machine in 2004, resulting in thousands of dollars in savings plus better quality work; construction of a small salt storage unit by Road Department personnel, resulting in thousands of dollars in savings; use of recycled concrete instead of virgin stone; Ohio public works grants secured to resurface Music Street, Pekin Road and Hemlock Point Road, resulting in thousands of dollars saved; secured sign grant — replaced most speed and stop signs in the Township. The majority of the township roads are now paved and in good shape, and it will be very important to maintain them.
