Q. Our condominium contracted with a pest control company to spray all the units several times a year. The week before the company comes to our association to spray, a notice goes out to all owners. Each owner is supposed to let the company into the unit for spraying. We have one unit owner who is never home to let the company into the unit. Can the manager of our condo let the company into the unit to spray? A. Florida law is quite specific about when someone can enter a unit. The association has the irrevocable right of access to each unit during reasonable hours when it’s necessary for the maintenance, repair, or replacement of any common elements or any portion of a unit maintained by the association to prevent damage to the common elements or to a unit or units. If your association can reasonably argue that by entering the unit, it will prevent damage to the common elements or to a unit, you may be able to allow the spray company into the unit. Since I do not know the severity of the pest problem, it is difficult to give you an accurate answer.

Q. I live in a cooperative and asked to inspect the official records of the association. The president told me that since there are privileged documents in the official records, I couldn’t inspect them. Can you tell me if there is any privilege to any documents and whether I can be barred from inspecting them? A. The only documents you are not entitled to inspect are: A record that was prepared by an association attorney or prepared at the attorney’s express direction that reflects a mental impression, conclusion, litigation strategy or legal theory of the attorney or the association. A record prepared exclusively for civil or criminal litigation or for adversarial administrative proceedings or in anticipation of imminent civil or criminal litigation or
