Welcome to the 2018 Select Auction Greetings to all, and welcome to the Third Annual Snow Diamond Select Invitational Alpaca Auction in Bend, Oregon! We are thrilled to have eight new consignors this year, and we’re very grateful to the returning consignors who seem to have an endless supply of outstanding alpacas. We appreciate all of you. Of course, we wouldn’t have a sale if we didn’t have buyers, so a huge thank-you goes to our all-important phone bidders as well as the hearty souls who come from far and near. This year, we are also indebted to our Sponsoring Consignors, Jeff and Faye Farley of Majestic Meadows Alpacas and Pamela Brewster of Stillmeadow Alpaca Farm. These two breeders consigned five and four lots respectively, and that’s what we call support! Many thanks. When you thumb through the pages of this catalog, we think you’ll agree that our consignors have offered some of their very best alpacas for this sale—the ones that it hurts to part with. Some are champions and others are going to be, but there is some deep quality here, folks, and we’re going to have some fun on Saturday, October 6th. This lovely Defiance daughter kicks off the Select, because she's a fitting example of what to expect from the six auction lots that offer Defiance genetics--either through Defiance offspring or through dams bred to him. Using Destry as a model, the first thing you'll notice is her correct conformation and pleasing phenotype. Then you'll see fineness and density in a fleece that is beautifully grown out. Welldefined structure and organized bundling will catch you eye, and you're likely to notice good brightness. Her soft-handling fleece is a pleasure to touch, and uniformity of micron and crimp reaches far down the belly. You may not see it at first, but most Defiance offspring are gentle and willing, reflecting the quiet calm of their sire. In Destry's case, many of those traits also come from her dam, Crescent Moon's Dreamy, who has given us three beautiful daughters, two of them banner winners. When you see the uniformity in fleece, conformation and style of these three sisters, you know that she--like most dams--deserves to share the credit. We knew that she was special early on and she proved it by taking her first TWO Championships at just 7 months of age (against a class of 42 greys at the show under Peter Kennedy and Cheryl Gehly). Her sire RR Touchstone, at age 5, is still sporting the outstanding fleece character that merited 9 banners and included consecutive brown fleece championships at the Nationals and a Halter Championship at age 4, where competing as a mature male. Judges have consistently commended him for his incredible sustained fineness. RR Hermoine wasn't a fluke... her fleece is stunning and she is a pleasure to work with. We will miss this girl! They just don't assemble these lines in grey much anymore. She will be an out cross to just about any grey herd and we believe will have many more championships in her future.

Esprit is a great example of what Snowmass Defiance has produced for us time after time. This young male filled out beautifully when he reached yearling status, and so did his fleece. Check out his fiber stats. This fleece has impossibly soft hand, high-frequency crimp, well defined structure, and uniformity in micron, crimp and color. You just have to see and touch. Esprit's dam is Ecstasy, a gorgeous female we acquired from Greg Mecklem's program. Ecstasy played a major role in passing on elite traits that she inherited from her sire Kashmir and her dam Willow, an El Nino daughter. Kashmir is noted for maintaining fineness and uniformity, and so are Defiance and his sire Elite Legend. Esprit's EPDs have not been calculated yet, but you can get the idea when you look at his dam's EPDs, below. Majestic's Sealed with a Kiss is a true black female with a beautiful phenotype and head with fleece that is soft, crimpy, bright and consistent in color and uniformity. This girl is loaded with grey genetics on both the top and bottom. Amora was the third daughter born to Champion female CCNF Flirtatious, all of them sired by our 6P Monarch son, Snowmass Sub-Zero. Defiance, like many great herdsires, can improve upon almost any respectable female, but he does his best work when paired with a great dam, such as Xanadu P Cadeau. A Barnabus daughter, Cadeau earned four CCs and one RCC. All of her EPDs are in the top 16% or better. At eight years of age, she is still an elegant female. Breeding her to Defiance was a no-brainer, and Cadet is the rewarding outcome of that pairing of champions. So pleased were we with Cadet, that we repeated the pairing for 2018, and we recently welcomed a very promising full brother. Cadet's fleece is very soft to the touch, and has fineness (15.0), density and a beautiful high frequency crimp that is organizing really well. Auction The Select Information 2018 Terms and Conditions of Sale The following Terms and Conditions, as amended by any posted notices or announcements by the Auctioneer during the auction, constitute the entire agreement between Snow Diamond Alpacas LLC, (the “Host”) or guest consignors (the “Sellers”), and bidders and buyers (the “Buyers”) at the auction. Celebrity Sales (the “Auctioneer”) shall be the party identified by the Host, on or before the auction as the auctioneer for the respective auction event, the Snow Diamond Select. WARRANTIES A. PROVEN PRODUCERS: A proven producer is a female that has already had a cria. Proven producers will be considered to be fertile. There are no expressed or implied warranties for proven producers. B. NEWBORN CRIAS: There are no expressed or implied warranties for new born crias sold with their dams. C. BRED MAIDENS: A bred maiden is a female that has not yet had a cria and is determined to be pregnant. If the cria is not born alive or fails to survive to 24 hours, the Buyer will receive a breeding at no charge to a male owned by the Seller. Buyer must notify Seller within 48 hours of still-birth / death of cria, and Buyer must use the breeding within 6 months from the date of still-birth / death of cria. This breeding is non-transferrable to any other alpaca. Birth of a live cria which survives 24 hours from birth shall be considered fulfillment of the warranty, and at which point the warranty ends. There are no other expressed or implied warranties for bred maidens. D. MAIDEN FEMALES: Young females sold as individual lots are guaranteed to have the ability to become pregnant by the time they reach 36 months of age and to give birth to a live cria. The female must be delivered to seller’s farm for breeding before the female reaches 24 months of age. The female may NOT have been bred or been exposed to any other male prior to delivery to the Seller. Should the buyer fail to deliver the female as set forth above, or if female has been bred/exposed to a male not owned by the Seller, all warranties either implied or express are void, and no free breeding will be given. If the cria is not born alive, the buyer will receive a breeding at no charge to a male owned by the Seller. This breeding is
non-transferrable to any other alpaca. Birth of a live cria which survives 24 hours from birth shall be considered fulfillment of the warranty, and at which point the warranty ends. E. PROVEN MALES: A proven male is a male that has settled a female or which has been tested fertile. Proven males will be considered to be fertile. There are no expressed or implied warranties for proven males. F. YOUNG MALES: Young males have been checked by a veterinarian and have been found to have anatomically normal reproductive organs. Young males are warranted to have the ability to impregnate a female by the time the male is 40 months of age. Warranty shall be considered fulfilled with the first confirmed impregnation of a female, at which point warranty ends. With respect to Young Females and Young Males, Seller must be notified in writing by the Buyer’s veterinarian of any claimed abnormality within one year of sale. Seller will, at Seller’s option, either: (1) replace the alpaca with an alpaca of equal quality, (2) give the Buyer credit toward the purchase from Seller of another alpaca of the same or different sex in an amount equal to the total amount of the purchase price or (3) give a refund of the purchase price paid at the auction. All alpacas must be cared for in a manner consistent with generally accepted industry practice. Failure by the Buyer to do either of the above will void all warranties either express or implied. EXCEPT AS STATED ABOVE, SELLER MAKES NO WARRANTY OF MERCHANTABILITY AND NO WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE, NOR DOES SELLER MAKE ANY WARRANTY EXPRESS OR IMPLIED OF ANY NATURE WHATSOEVER WITH RESPECT TO THE ANIMALS IN THIS SALE. The foregoing is the full extent of the responsibility of the Seller, and by way of illustration and not limitation, in no event shall the Seller be liable for incidental or consequential damages, or for any changes or expenses of any nature incurred without Seller’s written permission. PAYMENT CASH SALE: Terms of the sale are cash and payment in full must be made to the Cashier immediately following purchase; person-
al checks are to be payable to CELEBRITY SALES. Seller reserves the right to require a certified check as settlement before releasing the animal. FINANCED SALE: Sellers may elect to finance their alpacas with a 35% down payment made by the Buyer immediately following the purchase at the auction. The balance may be financed at the fixed rate of prime + 1%. Finance terms are 24 months for alpacas sold for $12,000 or more, or 12 months for alpacas sold for $12,000 or less. Payments are to be made monthly unless arranged otherwise with the Seller. If a Seller wishes to make available materially different financing terms, those terms may be announced from the podium during the auction of the lot. All alpacas being financed must have proof of insurance before the Buyer takes possession, naming the Seller as Loss Payee. Buyer must maintain mortality insurance on the animal in the amount of the remaining balance until paid in full with the Seller named as the loss payee. Any income generated by the animal in outside breedings or sales of offspring shall be paid in full to the Seller and applied first to interest and then toward the remaining principal balance. In the event the scheduled payment on a financed alpaca is not received by Seller within 10 days of the due date, Buyer agrees to pay a penalty payment of $250 per late payment. Additionally Buyer agrees that they will pay a $250 service charge on any NSF checks. Should any payment become 60 days or more past due, this note shall be considered to be in default, and Buyer agrees that the interest rate on this promissory note shall automatically increase to 14% per annum on any and all unpaid balances, penalties and service charges, until principal balance, services charges, penalties and interest are paid in full. In the event of any default, any remaining balance, including accrued interest and penalties shall be immediately due and payable in full. BIDDING: The highest bidder recognized by the Auctioneer shall be the Buyer. Bids tendered after the fall of the hammer are not valid grounds for dispute. If any dispute arises between two or more bidders or in the event of doubt on the Auctioneer’s part as to

The Auctioneer’s determination of the successful Buyer hereunder shall be final and Buyer waives any claims whatsoever of any nature against the Auctioneer, the Host and the Seller. The Auctioneer reserves the right to reject any bid.

Any information or representation in a Catalog or announced by Celebrity Sales or the Auctioneer regarding the animal is information provided solely by Seller. Information in the Catalog or reported by Celebrity Sales in any advertising or announcement or other medium employed does not constitute a guarantee, warranty, or representation, from Celebrity Sales whatsoever. Seller and Buyer both acknowledge that they have not relied on any representation from Celebrity Sales regarding the animal in determining whether to enter into any sale. Buyer and Seller agree to hold CELEBRITY SALES AND/ OR Snow Diamond Alpacas HARMLESS AND FREE FROM ANY LIABILITY for any problem in quality or defect in the animal sold. Arbitration. Any dispute in which Celebrity Sales is named as a party, including any claim that arises out of any agreement between Seller and Celebrity Sales and Buyer and Celebrity Sales or any agreement between Seller and Buyer whereupon Celebrity Sales is included as a party either by cross claim or third party claim including any suit or claim to the interpretation or breach of any agreement or tort concerning Celebrity Sales, or to the existence, scope, or validity of any agreement or the arbitration agreement, such dispute shall be resolved by arbitration in accordance with the then effective arbitration rules of (and by filing a claim with) Arbitration Service of Portland, Inc. (“ASP”), and judgment upon the award rendered pursuant to such arbitration may be entered in any court having jurisdiction thereof. The arbitration shall be in Corvallis, Oregon or as otherwise may be mutually agreed to by all the parties. A sole arbitrator shall be utilized. In lieu of the arbitrators available through ASP, the parties may instead elect to mutually select an arbitrator not available through ASP, including but not limited to an arbitrator who is not an attorney and is instead a recognized professional in the industry. Regardless of which arbitrator is chosen, ASP arbitration

If any arbitration, mediation, or other proceeding is brought in lieu of litigation, or if suit or action is instituted against Celebrity Sales the party not prevailing shall pay the prevailing party’s costs, disbursements, and attorney fees and expenses of expert witnesses. In determining reasonable attorney fees, ORCP 68 shall apply. Additionally, the Court or arbitrator shall award the prevailing party attorney fees of $2,500, which the parties agree is a reasonable attorney fee for collecting any resulting judgment.

CHANGE OF VENUE: The Sellers and Buyers agree to hold the Host harmless from any and all damages in the event of a change in location, time, or date or cancellation or similar modification of the sale, arising from any cause whatsoever.
REGISTRATION & MICRO-CHIPPING: Seller shall warrant that all alpacas made available for sale at the auction shall be registered with AOA and micro-chipped, except for crias at side.
FORCE MAJEURE: The obligations of any of the Host, the Auctioneer, the Seller, or their agents, to perform under this Agreement shall be excused during any period of delay if such delay arises from any cause or causes which are reasonably beyond their control, including, but not limited to, the following: acts of God, acts or omissions of any government, or any rules, regulations or orders of any governmental authority or any officer, department, agency or instrumentality thereof; fire, storm, flood, earthquake, insurrection, riot invasion or strikes. HOLD HARMLESS INDEMNIFICATION AGREEMENT: The Host is not acting as an agent or a representative of the Sellers or the Buyers. Both the Sellers and the Buyers warrant that all sales represent a contract SOLELY between the Seller and the Buyer and further agree to hold harmless and indemnify the Host against any and all claims made for any reason at the time with respect to this sale. Sellers and Buyers warrant that the Seller and the Seller alone is responsible for all warranties and representations concerning its alpaca(s) in the sale and that the Host and the Auctioneer have made no representations or warranties or any guar-
GOVERNING LAW: The sale and all transactions between the Buyer and Seller will be governed by the laws of the State of Oregon. In the event of any legal disputes regarding default of payment or any other condition of this sale, jurisdiction shall be Deschutes County, Oregon.
AUTHORIZED AGENTS: Persons acting as agents must be indicated as such when signing the Acknowledgement of Purchase, and the Host and Seller may rely on such agency representation and Buyer shall be bound by the acts of its agent. WITHDRAWAL RIGHTS: Sellers reserve the right to withdraw any alpaca from the sale prior to the fall of the hammer without liability to anyone. However, in doing so, Sellers forfeit their consignment fee. Sellers are permitted to substitute for their consigned lot. SELLERS’ RIGHTS: Unless stated to the contrary, the Seller or representative/agent of Seller shall have the right to bid on its own alpaca, or place a minimum reserve bid with the auction company. In either case, in the event of the Seller repurchasing said lot, Seller is obligated to pay the auction company a commission of no less than 10% of the reserve bid. IMPORTANT NOTICES HEALTH REQUIREMENTS: All alpacas entering Oregon must meet state veterinary requirements and must be BVDV negative. All alpacas in the auction must have a pre-purchase health examination conducted
by a veterinarian within 30 days prior to the auction. INSPECTION OF ALPACAS: Buyers are urged to examine the alpacas carefully. Unless otherwise specifically agreed to in writing by the Seller, all sales shall be “As-Is,” and failure to inspect the alpacas will not be grounds for rescission of the purchase. Failure of Buyer to perform due diligence shall not be grounds for modification or rescission of purchase. ABSENTEE BIDS: Absentee bidding is available to Buyers subject to these Terms and Conditions of Sale and is provided as a convenience for Buyers who are unable to attend the auction. Bids may be left with an auction representative who will try to purchase the lot or lots of Buyer’s choice for the lowest price possible. Although every reasonable effort will be made to execute these bids, the Host will not be responsible for error or failure to execute absentee bids. TELEPHONE BIDDING: Telephone bids are accepted subject to the Terms and Conditions of Sale. Although every reasonable effort will be made to execute these bids, neither the Host nor the Auctioneer will be responsible for any error or failure to execute bids. No Internet bidding will be offered. BREEDING/DUE DATES: Breeding dates and due dates will be announced at the sale if not included in the catalog. These dates are for information only and are not binding upon the Host, the Auctioneer or the Sellers. AGISTMENT AVAILABILITY: Buyers of alpacas at the auction who wish to agist their alpacas until transportation can be arranged may do so at Snow Diamond Alpacas for a complimentary period up to 15 days. After 15 days, an agistment fee of $4.00 per day will be charged for adult alpacas and no charge for crias at side.
