Bill 28 - Enabling Regional Growth Boards Act, S.A. 2013, c. 17

Summary:

In Force:

This Act began as the “Modernizing Regional Governance Act”. The Act, which involves amendments to the Municipal Government Act (the “MGA”), legislates the Capital Region Board and enables the creation of other growth-management boards in Alberta.

The Capital Region Board is a 24-member intermunicipal organization responsible for coordinating development between municipal jurisdictions, including land-use planning, interregional transit planning, and land, air, and water considerations, for integration into plans. The Act also validates 15 other regulations made under the MGA. December 11, 2013

Pursuant to this Act, the Registrar now has the authority to suspend a licence instead of automatically having to cancel it.

Summary:

The Statutes Amendment Act, 2013 amends 13 pieces of legislation. Some of the amendments include amendments to:

(I) the Alberta Personal Property Bill of Rights, which would exempt the recently proclaimed International Interests in Mobile Aircraft Equipment Act from the Alberta Personal Property Bill of Rights; (II) the Civil Enforcement Act, such that property in a registered education savings plan are exempt from any enforcement process;

(III) the Dower Act, such that spouses who wish to waive their rights pursuant to the Dower Act must, in addition to signing a consent form, also acknowledge that they understand the implications of the waiver and disposition. This acknowledgement must be made “apart from the person disposing of the property,� and before a lawyer; (IV) the Family Law Act in order to clarify the rights and obligations of a person who is declared not to be the parent of a child. The Statuses Amendment Act, 2013 makes it clear that the declaration does not affect any rights and duties that have been exercised or any interest in property that has been distributed before the declaration was made unless the court so orders;

(V) the Fatal Accidents Act, to move new increased bereavement damages amounts from the regulation to the Act. Note that the increased amounts only apply to actions in respect of persons who die on or after May 1, 2013;

(VI) the Judicature Act, to make appeals available to parties to an application for an order declaring a person a vexatious litigant; (VII) the Motor Vehicle Accident Claims Act, to expedite payments of compensation to claimants injured in accidents where the owner and operator of the vehicle is unknown or unascertainable, or the operator is unknown or unascertainable and the owner may not be liable to an action for damages. This will be done at the discretion of the administrator when the claim is less than $25,000.00;

(VIII) the Police Act, to provide the Lieutenant Governor in Council with the authority to grant a serving senior police officer the designation of a commissioned officer. This would apply to those with the rank of inspector, superintendent, deputy chief of police, or chief of police; (IX) the Special Areas Act, to change the membership of the Special Areas Board from three members to four; and (X) the Provincial Court Act, to allow the Provincial Court to use electronic documents in proceedings.

Given the broad scope of the Statutes Amendment Act, the Legislative Review Committee recommends that practitioners review the Act in its entirety to ascertain its implications on their practice.

Bill 39 - Enhancing Consumer Protection in Auto Insurance Act, S.A. 2013, c. 18

The Enhancing Consumer Protection in Auto Insurance Act amends the Alberta Insurance Act. This Act also amends the New Home Buyer Protection Act so that it’s language is consistent with existing language in the Insurance Act. Mandatory and optional insurance coverage are to be regulated by the Automobile Insurance Rate Board. The Act provides additional guidelines to ensure the solvency of insurance companies. Every auto insurer will need to apply for premium adjustments on an as-needed basis instead of an annual, industry-wide rate adjustment.

Following the announcement by the Federal Government on November 1, 2013 of the formal ratification of the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (commonly known as the ICSID convention), the Alberta Legislature passed the Settlement of International Investment Dispute Act, to implement the ICSID convention “concerning the jurisdiction and powers of the Court with respect to the recognition and enforcement of awards”.

Summary:

The Premier’s Council on the Status of Persons with Disabilities Act was enacted in 1988 and has not been amended since then. The Act contains housekeeping amendments including the requirement that the membership of the Council must “include persons with disabilities or individuals who have involvement and experience with disability issues”.

The Alberta Economic Development Authority Amendment Act (The “AEDAAA”) revises the governance structure of the Economic Development Authority (the “Authority”) to include Committees. Membership on Committees is limited to 12 people and a term of not more than 3 years, eligible for reappointment so long as the reappointment does not result in the member serving more than 10 consecutive years.

Summary:

The Notaries and Commissioners Act repeals the Notaries Public Act and the Commissioners for Oaths Act and consolidates them into one Act. The Act amends the maximum fines so they are in line with other acts and makes provision for the enactment of a code of conduct in the regulations.

The Public Sector Services Continuation Act relates to persons who provide services in the public sector and among other things, outlines daily fines for Alberta unions, officers or representatives of trade unions or any other persons who undergo strikes; outlines liability of trade unions for losses suffered by an employer as a result of a strike threat or a strike and the employer’s recourse therefrom, establishes liability funds for trade unions to facilitate the payment of costs for losses suffered by an employer or any other remedies outlined in the Act, and establishes a limitation period of one year for prosecution for an offence under the Act. Bill 46 - Public Service Salary Restraint Act, S.A. 2013, c. P-43.5

In Force:

The Public Service Salary Restraint Act bridges the gap between the collective agreement between the Government of Alberta and the Alberta Union of Provincial Employees, which expired on March 31, 2013, and a potential new collective agreement. The Act dispenses with the application of Division 2 Part 6 of the Public Service Employee Relations Act, (the “PSERA”) which provides for Compulsory Interest Arbitration. The Act terminates any arbitration proceeding, which was commenced pursuant to Division 2 Part 6 of the PSERA. The Act is repealed on proclamation.
