Increased Accountability T

he power of the people, the power of the press and the power of top-notch consumer advocacy all contributed to TURN’s success in FY 2012-13. TURN and our allies dealt SDG&E a stunning defeat in its bid to stick consumers with wildfire costs, utilizing local press and allied organizations to pack CPUC hearings with hundreds of angry and outspoken customers. We relied on the same methods in our successful campaign to cut guaranteed profits for gas and electric companies statewide. Lower profits literally mean money in your pocket. This victory translated into about $25 in reduced bills annually per customer. TURN successfully demanded accountability from PG&E when we convinced the CPUC to disallow about $1 billion in pipeline safety maintenance costs

that were a result of PG&E’s past pipeline neglect, and defeated hundreds of millions in rate hikes that SoCal Edison wanted to burden customers with. We also won new protections for basic phone service customers, and defeated phone company challenges to reporting requirements. All this for just pennies! A state audit confirmed that consumers get great value for their money when TURN and other consumer groups intervene at the CPUC. TURN’s attorneys participated in a whopping 113 CPUC cases this year. T

URN’s Organizing and Media Outreach Departments — both one-woman shops — are responsible for spreading the word about TURN’s campaigns and concerns statewide. From our base in San Francisco, TURN turns people out for CPUC hearings from San Diego to the Oregon border, encouraging customers to speak up, demand consumer protections and see through self-serving utility schemes. In addition, TURN’s PolicyVoice organizing project conducts trainings on lobbying, CPUC public testimony and direct consumer assistance for a network of statewide organizations, creating hundreds of new activists and advocates. TURN organizing director Ana Montes said “PolicyVoice is bringing new voices to the CPUC process, empowering consumers, and educating community groups on how to avoid shut-offs, stand up for their rights, and oppose onerous and unnecessary rate hikes.” (For more on PolicyVoice accomplishments, and TURN Legislative accomplishments, see Winter 2013 issue.) n TURN held 35 events throughout California, including lobbying days, consumer trainings, public participation hearings and community meetings. n Over 1,000 consumers contacted TURN with questions and complaints about their utility service. Executive Director Mark Toney and other TURN staff were featured in TV COMMUNICATIONS DIRECTOR MINDY SPATT and radio news across the state, including KPBS San Diego, KPCC Los Angeles, KPFA Berkeley, KBAK Bakersfield, NBC Bay Area, KGO San Francisco, KTVU Oakland, KSEE Fresno and KCET public television in southern California. Major TURN press initiatives received national coverage from the top outlets in the US, including Associated Press, Fox Business, Bloomberg and the Wall Street Journal. uge, profitable phone companies like AT&T and Verizon receive public subsidies to support lowincome rates and service in high-cost areas. But the CPUC must hold those companies accountable for the subsidies they receive, and ensure that basic service rates are not used to cross-subsidize the telecom’s profitable new cable video ventures. That is one of the reasons TURN objected when the phone companies wanted to eliminate reporting requirements on executive salaries, political donations and charity. Customers have a right to know whether the phone companies are engaging in ‘cross-subsidization’ that burdens them with costs unrelated to the services they buy. In addition, the companies wanted to pull a veil over their generous spending on donations to politicians or community

olicies determined in Washington at the Federal Communications Commission (FCC) have a huge impact on consumers, and are shaping the future of mobile phone and Internet communications. TURN has long advocated universal service both here in California and at the federal level, and will urge that approach to broadband services as well. As co-chair of the NASUCA Telecom Policy Committee, TURN’s Telecommunications Director Regina Costa drafts briefs, submits comments, and monitors progress in FCC proceedings and court appeals. In 2013 TURN, through NASUCA, urged the FCC to define broadband as a Title II communications service subject to regulatory oversight, and was the only public interest organization to conduct a detailed analysis and present testimony on the Broadband Cost Model. “We can’t let the phone companies call all the shots in Washington,” said Costa. “Consumers must have a strong, unified voice.”

groups. AT&T’s benevolence comes with a price tag. AT&T can strong-arm its grantees into either being silent or supporting its agenda, even on obvious anti-consumer initiatives like its proposed takeover of T-Mobile. TURN has long-standing concerns about this practice: it often skews CPUC MANAGING ATTORNEY BILL NUSBAUM public hearings toward the utilities’ demands, drowning out ordinary consumers. TURN raised strong objections to the phone companies’ demands, and convinced the Commission not to give in. “For now, “ said managing attorney Bill Nusbaum, “telecom companies will have to submit to at least some transparency and accountability for their attempts to influence donees.”

URN and our PolicyVoice Partners, including the Central City SRO Collaborative (CCSRO) and the Chinatown Community Development Center (CCDC), organized key consumer groups and impacted customers to speak out at CPUC public meetings in support of TURN’s demands for basic service guarantees. Phone companies were resisting even the most minimal consumer STAFF ATTORNEY protection standards. CHRISTINE MAILLOUX Our efforts paid off when the CPUC finally agreed to hold phone companies accountable for providing reliable service in the home. Under the rules advocated by TURN and our allies, ALL residential telecom carriers must provide good quality reliable basic voice service in the home — or let the consumer find a company that will. Many consumers have been trapped into a contract for service only to find out the service doesn’t work in a key location — their home. For low-income tenants living in Single Room Occupancy hotels, being able to call 911 and other needed services from their homes is an absolute necessity. “The Commission recognized the importance of reliability, and agreed with us that customers should not be stuck with bad service in their homes,” said TURN staff attorney Christine Mailloux. Now, if a residential phone doesn’t work reliably, companies must either fix the connection or provide the customer with alternatives. The new rules will apply to companies providing residential basic phone service and carriers offering wireless LifeLine under the state program, as well as rural basic service carriers. TURN also won additional enhancements to basic service including continued free access to 911/E911 services and customer service, choice of a flat rate plan, choice of a no-term contract and a prohibition on forced bundling.

URN won cost responsibility for some of the pipeline maintenance needed in the wake of San Bruno, defeating close to $1 billion in costs PG&E wanted to pass on to customers. TURN argued that the costs were a direct result of PG&E’s previous neglect of pipelines, brought to light by the San Bruno explosion. TURN had demanded that all the costs related to pipelines for which PG&E failed to LEGAL DIRECTOR produce records should be borne by PG&E’s TOM LONG shareholders, and that the CPUC not allow PG&E to profit on overdue investments in pipeline safety. PG&E’s customers pay the company a return on capital investments, but the CPUC can reduce utility returns due to “mismanagement,” “poor performance” or other failures. “The Commission did agree to disallow $1 billion in costs PG&E wanted to pass on to consumers, but did not go far enough,” said TURN legal director Tom Long. With billions more still at stake in remaining CPUC proceedings to determine what penalties PG&E should pay for its violations of pipeline rules, TURN joined the City of San Bruno and the City and County of San Francisco to protest a back room deal to appoint Senator George Mitchell and his law firm DLA Piper to mediate the cases. DLA Piper had a significant conflict of interest and had received confidential information regarding the parties’ negotiation positions in advance. After learning that DLA Piper represented a large insurance carrier that might be required to pay explosion-related costs incurred by PG&E, TURN and its allies demanded that Mitchell quit the negotiations. The groups called his dual representation “incompatible with DLA Piper’s duty of impartiality as mediator in this matter.” “By violating confidentiality and unilaterally imposing DLA Piper as mediator without even asking the opinion of four of the six parties, CPUC management had doomed the mediation even before it started,” said Long. The pressure TURN and our allies created in the media and the public ultimately caused Senator Mitchell to withdraw from the post.

Guaranteed profits provide an incentive for utility executives to inflate capital spending, since the payoff is assured. So it is especially unfair when bills are further padded with unfairly high rates of return. Yet the CPUC had authorized SoCal Edison, PG&E, SDG&E and SoCal Gas to charge California consumers some of the highest profit rates of any U.S. utility company. TURN challenged these artificially high profits, arguing that lower interest rates and CPUC policies that insulate utilities from risks made the inflated profits unnecessary. Our allies sent the same message, and our supporters spoke out at statewide CPUC public hearings to demand fairer rates. The Commission was forced to agree with TURN that times had changed and that profit levels had to change with them. “This is a win-win for customers,” said TURN staff attorney Marcel Hawiger. ”They can pay a few dollars less every month with no negative impacts on safety, reliability or service!”

fter being found liable for the Witch, Guejito and Rice wildfires that destroyed hundreds of homes, SDG&E proposed a Wildfire Expense Balancing Account (WEBA) to the CPUC. The balancing account would have allowed SDG&E to charge consumers for the costs of all wildfires, EVEN IN CASES WHERE SDG&E WAS FOUND CRIMINALLY LIABLE! SDG&E wanted to pass on at least $400 million in costs for past neglect as well. TURN protested SDG&E’s shocking attempt to shield itself from liability at the CPUC. “Fire victims should not be further victimized. The CPUC should require utility companies to put safety first, not give them incentives to cut back on safety measures,”

said staff attorney Nina Suetake. TURN members joined hundreds of San Diego consumers to speak out forcefully at CPUC public hearings in San Diego, expressing outrage at the utility’s attempt to add insult to injury, which consumer advocates were firmly united in opposing. GAS SAFETY & RATE REDUCTIONS WON FOR SOCAL CUSTOMERS

I

n May 2013 the CPUC finally decided the General Rate Case (GRC) for SoCalGas and SDG&E for the rates that would retroactively be in effect as of the start of 2012. Thanks in large part to TURN’s efforts on behalf of southern California consumGENERAL COUNSEL ers, the Commission scaled BOB FINKELSTEIN back the utilities’ demands for rate increases. SoCalGas’s request was reduced by nearly two-thirds (a $154 million reduction to the $239 million requested increase), while SDG&E’s request was approximately cut in half ($116 million reduced from the $239 million requested). General counsel Bob Finkelstein said, “While the CPUC still approved more of an increase than TURN had demonstrated was reasonable, the substantial reductions won in this case will help keep more money in consumers’ pockets for other household necessities, without any negative impacts on service or safety.” In fact, the transparency TURN has fought for in the wake of PG&E’s fatal mismanagement in San Bruno was extended to the Sempra utilities as well. The Commission agreed to require each utility to submit reports demonstrating that the authorized ratepayer money was being spent to promote system safety, as intended.

he CARE program is intended to keep essential heat and light affordable for everyone in California, including eligible low-income customers. But proposed changes to the program would have created onerous and discouraging barriers to eligibility and enrollment, and eliminated customer rights. TURN believes ALL customers should have consumer protections, regardless of income. STAFF ATTORNEY We were able to defeat a PG&E proposHAYLEY GOODSON al to impose extra requirements on certain CARE customers — and subject them to automatic removal. New rules won by TURN require accessible, multi-language notices, outreach about Medical Baseline, and an appeals process. TURN also won continuation of “categorical enrollment” for the CARE program and re-certification the same way, both of which make it easier for eligible customers to receive discounted rates. Additionally, TURN continued to push for improvements to the energy efficiency upgrade program serving low-income households that encourage “whole house” retrofits and deepen savings. Making energy efficiency programs more effective means lowincome residential customers will have more ways to lower their bills, and hence be more likely to avoid costly and dangerous utility shut-offs. “All customers will benefit from the improvements TURN won to the low-income energy efficiency program, especially policies to encourage whole house retrofits,” said TURN staff attorney Hayley Goodson. “Energy efficiency has a direct and lasting impact on customer rates, yielding savings that can replace expensive and dirty power plants. Moreover, TURN’s contributions will promote long-term rate stability, reduce risks to ratepayers and help reduce air pollution from power plants.”
