The case of the Missing Link
Diane English announces retirement

W
e’ve been around and around more times than a wheel on a century ride and, while we seem to make progress with each revolution, we’re not there yet. On Thursday, Feb. 16, King County Superior Court Judge Jim Rogers issued a decision on the Burke-Gilman Trail “Missing Link.” The decision—his second—is the latest in a series of lawsuits brought on by the Ballard Business Appellants. We’d been eagerly awaiting a decision on the case so the City of Seattle can stop with all the legal defense and move forward to finally complete the necessary safety improvements on the Missing Link. The decision does find in favor of the City of Seattle and joint-defendant Cascade Bicycle Club on 18 of 19 conclusions, but this does not clear the way for trail construction. Specifically, Judge Rogers ruled against conclusion #9 of the Hearing Examiner’s ruling, asserting that, despite already being at a 10 percent level of design as is usual under the State Environmental Policy Act (SEPA), further design details from the City of Seattle are necessary. Back we go. And yes, we’ve been here before. Completing the Missing Link has been planned by the City since it agreed to acquire the abandoned rail line right of way from Burlington Northern Santa Fe in 1989. It’s been stalled by lawsuits and appeals since 2003, mainly by a handful of businesses opposed to the corridor safety improvements.

t is with sadness, great respect, admiration, and much appreciation for her time at Cascade that we announce Diane English’s retirement. After more than eleven years serving as the Club’s membership services manager, office manager, and all around gracious club hostess, Diane announced her retirement on Valentine’s Day. While Valentine’s Day may seem an ironic time for her announcement, it actually is fitting. Diane will take a part of our hearts with her and I’m guessing that she’ll leave a bit of hers with us. It will seem strange not to have her pedaling into the office; not sitting at one of the many desks she has occupied during her tenure; and not hearing her quick and quirky retorts that always lighten up the office. While the Club will march on—as it will whenever any of us leave—the office will be a somewhat different place for those of us who have worked alongside Diane, whether for a month or eleven years. I assume it will be likewise for those who volunteered in the office. I know that she is looking forward to retirement life with her husband Joe. We wish them both well and all the happiness one can have in life. I invite you to stop by the office to thank Diane for all she has done for us and to say “goodbye” before she
leaves around the end of March (some of you might want to bring tissues—for Diane if not for yourself ). (Diane, a personal thanks for always being there for me and the club during the long and sometimes strange trip. hat’s right; it’s not too early to mark your calendar for an entire month of bicycle fun, festivities and frolicking. Bike Month is all about bringing bicycling to more people, and bringing more people to bicycling. We do that throughout Bike Month with events, education, outreach, rides and advocacy. And YOU are a key part of making Bike Month fun and successful!

So where are we? Is this just another turn of the crank or are we actually getting somewhere? Once SDOT fills in some of the details that Judge Rogers is looking for, it’ll likely go back to the Hearing Examiner for a third go. Then back to Judge Rogers, also for the third time. We’re disappointed for several reasons. We had hopes that this case would be behind us by now, but the appellants continue to frustrate the process with a mentality that bicycling and industry cannot mix. But this has been proven untrue. Cities around the world have succeeded in sharing transportation corridors, and here in Seattle we’re showing it can be done respectfully and safely as with the new Ship Canal Trail and the Alaskan Way Trail. It’s also likely that the project will miss this summer’s construction season due to more legal wrangling. And finally, it’s wrong that we may see yet more unnecessary injuries on the tracks and along the corridor as this gets figured out. So be careful out there and help us finish this up. We are confident that the City will be able to provide the necessary detail to show that the project would not pose a significant impact to the environment, and we’ll do what we can to help. And unfortunately, that means going back to the Hearing Examiner later this year.
