Students from Sharon Elementary School said goodbye to their bus driver, Deborah Peay, who retired after 30 years of service. Peay also drove students from Randolph and Alexander Graham middle schools and Myers Park High School.

"She's driven some children from kindergarten through high school," said CMS parent Alicia Thrasher. "She's a wonderful bus driver, always prompt and always in a good mood helping to get kids' days started off on a good note."

CMS wants to sell surplus land at Sedgefield Middle to developer

Dilworth and Sedgefield residents convinced county commissioners Wednesday, Aug. 3, to delay a real estate deal that would

net Charlotte-Mecklenburg Schools $3.85 million from a homebuilder.

Pulte Home Corporation has offered to buy 3.7 acres on the northeast portion of Sedgefield Middle School, between Sedgefield Park and McDonald Avenue.

The school board declared the parcel as surplus property in October 2015 and voted to move forward with negotiations with Pulte Home Corporation in June.

School said the developer was interested in building townhomes.

City zoning would allow a developer to build up to 17 multifamily units per acre.

“I can attest that myself, my friends and my neighbors have been blindsided by this shortsighted decision by the school system,” said Allen Davidson, who has lived in the area for 16 years.

State law requires CMS offer the county the opportunity to buy the property prior to selling it, according to Jacqueline McNeil, a real estate manager with the county.

Davidson asked commissioners to postpone their first right of refusal so neighborhood associations, the school PTA and residents can engage with CMS. Commissioners delayed the vote for one month.

The Sedgefield Neighborhood Association found out about the negotiations when it tried to build an extended disc golf course on the property, according to President Will Johns.

CMS agreed to grant the county an easement through the northern part of the property to ensure the neighborhood still had access to a walking path that extends to Sedgefield Park.

Still, residents have expressed several other concerns to Johns, including losing green space to development.

“Development on this property raises security issues for the school and its student population,” Davidson said, noting the parcel is next to two school athletic fields.

Commissioner Vilma Leake was concerned about townhomes being built “at the backdoor” of the school.

“We always talk about greenway and property for the kids to have some place to play in the community together,” Leake said. “So I’m saddened the school system is not thinking from that perspective.”

“I think it’s a bit disingenuous on our part to say we’re going to defer it unless we’re seriously thinking about buying it,” Puckett said. “The fact of the matter is, all we’re going to do with it is say, ‘We’re not going to buy it.’”

Puckett preferred not to get into a fight with CMS over a piece of land he doesn’t own or want to own.

“It isn’t our job to decide whether it ought to be nice pretty trees with squirrels or anything else,” James said with a shrug. “It’s not our job to decide whether nature would be better served. I’m not going to spend county dollars to rebuy something I already bought.”

Commissioner George Dunlap said he’d like to hear more about the sale and its consequences; however, he cautioned colleagues that they had not previously interfered with CMS’s right to buy and sell land.

“If we don’t allow them to sell it, they are going to come

back to the taxpayers asking for a future project,” Dunlap said. “That’s a lot of money. I think all the facts need to be on the table. We need to vet it. “ County Attorney Marvin Bethune advised commissioners that residents would have time to convince the school district to nix the deal regardless of their vote.

Commissioners passed on a first right of refusal in December 2015 after Meritage Homes offered $6 million for 32 acres surrounding Ballantyne Elementary School. CMS told South Charlotte Weekly on Aug. 3 that staff was still negotiating the sale.

Real estate transactions involving surplus property are typically included in the consent agenda for school board and county commission meetings. The consent agenda consists of items that are routine or non-controversial. They are usually approved as a group at the beginning of the meetings.

Members of either board have the option of pulling an item out of consent agenda to discuss it.

Ericka Ellis-Stewart pulled the Sedgefield Middle School item from the school board’s June 21 consent agenda so she could ask if the surplus property would eventually be developed for workforce housing.

She was the lone vote against moving forward on the sale of the property when Superintendent Ann Clark told her that workforce housing wouldn’t be likely.

“I think as we continue to talk about student assignment, we don’t have any levers to pull to impact neighborhoods,” Ellis-Stewart said at the time. “To the extent that our neighborhoods are separated, our schools will be separated.”

Clark told the school board that her staff was working with the city and Charlotte-Mecklenburg Housing Partnership on workforce housing.

“We have had some exciting staff level conversations particularly about some of the CMS properties that they are very excited about being for workforce housing,” Clark said.

“We look forward to bringing those in early fall.”

Yours, mine and ours (no longer): distributing marital property before divorce

One of the most legally complex issues for divorcing couples is how their marital assets will be divided. In North Carolina, the division of marital property following a separation of the spouses is referred to as “Equitable Distribution.” Generally speaking, “marital property” is defined as all assets and debts that you and your spouse, either independently or together, acquired after the date of marriage and prior to the date of separation. “Separate property” is defined as assets or debts that one spouse acquired prior to the marriage or during the course of the marriage under very specific circumstances. Marital property is subject to Equitable Distribution; separate property is not.

NC law instructs the Court to divide marital property equally unless such division is not equitable, in which case, the Court may consider the following factors: each spouse’s income, property and liabilities; any support obligation from a prior marriage; the marriage duration; each spouse’s age and physical and mental health; the need of a parent with custody of a child to occupy a jointly owned home; a spouse’s contributions as a wage earner or homemaker; the tax consequences to each spouse; any acts of either spouse to maintain or waste marital property after the date of separation; any

separate property owned by either spouse; the difficulty of evaluating business interests; and any direct contribution to an increase in value of a spouse’s separate property.

The long list of factors demonstrates that Equitable Distribution isn’t always as simple as giving each spouse fifty percent (50%) of the assets and/or debts. In many cases, it may be more “equitable” for one spouse to be distributed more than fifty (50%) of either the assets or debts. It’s almost always within a divorcing couple’s best interest to have control over the division of their marital property and come to an agreement.

Otherwise, a judge will determine distribution based on the testimony in court. No matter how resolved, once an agreement is reached, you should leave the drafting of the Agreement to a licensed attorney with experience in Equitable Distribution. The Charlotte-Mecklenburg Board of Education (BOE) got to work this week, planning how it will carry out the first phase of its upcoming student assignment plan.

In a four-hour work session Aug. 2, the BOE started defining potential models and courses of action CMS could take, based on information provided by CMS staff and its consultant, Alves Educational Consultants Group.

CMS board accelerates superintendent search

Residents could find out who will lead Charlotte-Mecklenburg Schools in 2017, as the school board bumped up its timeline to name a finalist.

The CMS Board of Education (BOE) approved an updated superintendent search timeline at its July 26 meeting in a 7-1 vote, with Paul Bailey in opposition and Tom Tate absent. The timeline states the new superintendent would be announced at the Jan. 10, 2017 BOE meeting, provided CMS counsel has vetted the finalist in time.

The previous timeline scheduled an announcement for Feb. 22, but BOE members voiced concerns about not having enough time to focus on potential General Assembly legislation and its bond presentation to Mecklenburg County commissioners in early 2017, according to District 1 BOE member Rhonda Lennon.

The new timeline schedules the board interview and select a finalist on Dec. 14, and have counsel work with the finalist’s

contract over the winter break.

The accelerated deadline allows for the new candidate to have a lengthier transition period Bailey was not pleased with the new timeline because he said it wasn’t posted until the previous evening, and didn’t initially lay out a specific date to announce the finalist.

At-large member Ericka Ellis Stewart made an amendment to add the December and January dates.

District 5 BOE member Eric Davis felt it wasn’t right to vote on the timeline with Tate absent.

Lennon countered that she didn’t expect the board to wait for her when she was absent because of a breast cancer surgery and urged the board to continue its work.

Both Thelma Byers-Bailey and Ruby Jones felt the new timeline helped move the superintendent search along, something their constituents have requested.

“When we first entertained the motion to extend (Superintendent Ann Clark’s) contract, I thought that we would start the search now,” Byers-Bailey said. “…When we talked to the search firm (McPherson Jacobson), the

schedule was not a search now, it was a search later. I’m pleased this is coming forward, so the search can carry on.”

McPherson told the BOE in May that the search should begin in the fall because that’s when candidates are looking for a job, not sooner. The new timeline sets a start date for advertising the position on Aug. 5 and the position to close Sept. 30.

Jones said her constituents have questioned whether the board has abandoned the search and whether it was still continuing.

“To keep moving the ball back and forth says that we are not steadfast in what we are appointed to do,” she said.

Stakeholder group meetings to obtain feedback of qualities the public wants to see in their new leader are slated for Sept 6 to 16.

The board will hear a comprehensive report on that feedback on Oct. 19, which was pinned down by an amendment by Davis.

Education Briefs Polo Ridge names principal The Charlotte-Mecklenburg Board of Education approved the appointment of Jovanna Edwards as principal of Polo Ridge Elementary School at its July 26 meeting.

Edwards has worked as an assistant principal at Providence High School since 2012 Jovanna Edwards and served as assistant principal at Smithfield Elementary after teaching there for eight years.

She earned a bachelor’s degree in elementary education from UNC Charlotte, a master’s degree in school administration from Gardner-Webb University and a doctorate in educational leadership from Wingate University.

Charlotte Christian student goes to Washington, D.C. Nkiru Afulukwe, a rising senior at Charlotte Christian School, was one of 100 women selected to attend the 70th American Legion Auxiliary (ALA) Girls Nation session in Washington, D.C. last month.

state to serve as a representative in a mock senate session, in which attendees write, caucus and debate bills.

The six-day leadership conference provides aspiring young women leaders with practical insight into the workings of government, instills a sense of pride in our country, promotes youth civic engagement, and creates friendships and memories that last a lifetime, according to a news release.

Participants elect an ALA Girls Nation president and vice president. Construction moving forward at Myers Park The Charlotte-Mecklenburg Board of Education approved the next phase of the project at Myers Park High School within the consent agenda at its July 26 meeting.

The $13.76-million bid was received on July 13 from BE&K Building Group. Funds come from 2007 and 2013 bonds.

The project scope for this phase includes the construction of a second multi-story classroom building, which will include 28 classrooms, as well as renovations in the vocational building and site work improvements.

The scheduled completion is set for August 2018.

South Meck grad could send research to space

Oscar Velasco received the chance of a lifetime this summer.

The 28-year-old, South Mecklenburg High School graduate has spent the last 10 weeks participating in an intensive research program at the University of North Dakota in Grand Forks.

Velasco researched and developed software that could fly on the OpenOrbiter CubeSat, the University’s spacecraft set to launch later this year.

The 10-week program, sponsored by the National Science Foundation and the U.S. Department of Defense, gives undergraduate students a chance to research and develop a project around small spacecraft development. “Developing software for a small spacecraft presents many challenges,� OpenOrbiter Small Spacecraft Development Initiative Director Jeremy Straub said. “You have limited computing capabilities and a need to develop optimized code, as the processing is running it’s consuming very valuable power resources that could be used to power other parts of the satellite. It’s not like programming for a desktop, where in many cases you have far more resources that you need for an application – it drives you to make the best possible use of the resources.�

Velasco’s portion of the project focused on the development of a BalloonSat high altitude balloon test platform. The hardware could reach 60,000 feet or higher and is designed to mirror aspects of

the satellite.

Various elements and conditions can cause launching a satellite to be “tricky,� Straub said, but the balloon can serve as a testing mechanism for those conditions. The high altitude balloon payloads can be recovered to retrieve data for analysis, unlike Oscar Velasco satellites that often burn upon reentry into the Earth’s atmosphere.

Velasco, who created the project from scratch, developed software that plots exactly where the balloon would be so scientists can retrieve the data. “His software takes (GPS coordinate and altitude data) and makes it into digital data, so then we can see trends and plots mapped out,� Straub said.

Velasco, who is currently a computer science major at UNC Charlotte, said what he most took away from the experience was the ability to work collaboratively with group to create a project that has practical takeaways. He now feels more confident of his technical skills.

All projects and software will be used on a spacecraft sent by NASA into orbit later this year.

Charlotte-Mecklenburg Schools wants to hear from the community regarding the district’s student assignment plan – specifically pertaining to Phase I, which include magnet school options and transportation zone maps.

CMS staff and the Board of Education have already begun looking into expanding magnet school seats in existing programs, but want to hear from residents about what new programs parents want.

The board will hold community engagement events from Aug. 8 to 18, based on high school feeder patterns. However, if a parent cannot attend their high school’s session, they are encouraged to attend others.

Superintendent Ann Clark said the sessions were broken into high school feeder patterns so staff can gauge feedback from each geographic area. That information could pave the way for future new programs in specific areas.

Magnet school parents are asked to attend their home school’s engagement session, but some magnet forums will still continue as needed.

All sessions will run from 6:30 p.m. to 8 p.m., including an open session in which community leaders and CMS staff will explain what Phase I entails and how community feedback will affect the process.

If someone cannot attend any community engagement sessions, Clark said residents can follow the process on the CMS website. “We want to make sure our community can

follow the process,� she said. “We really want them to be engaged in that process.�

My daughter’s wedding Part 1: The Sword Ceremony

My daughter’s wedding was held in a castle. Gone were the tuxedos.

The groomsmen wore cloaks similar to what a squire would wear in the days of Rev. Tony Marciano King Arthur and the Knights of the Roundtable. My son-in-law wanted a sword ceremony.

The internet only showed sword ceremonies similar to what is used for military weddings. The swords are held high in the air as the bride and groom walk under it. This is not what he wanted. He wanted me to present to him a sword, symbolic of our trust to take care of our daughter.

When we arrived at the rehearsal, Will asked to see the sword ceremony. I told him I wrote it in my head and he would hear it for the first time during the wedding. I then asked, “Do you trust me?”

The sword was at least 36 inches long and kept in a leather case.

Let me take you through the ceremony: After walking my daughter down the aisle, the minister started the ceremony by asking, “Who gives this woman in marriage?” I answered the question, and turned to my wife who was holding the sword. She gave it to me and I walked with it between the bride and groom and turned to face the congregation. The groom was not facing me. I looked at Will and told him to kneel. I withdrew the sword from its sheath and tapped him on each shoulder and said, “Will – I tap you on the left shoulder because when I walked down the aisle with my daughter, it was symbolic that my wife and I believe you are the man to marry our daughter. I tap you on the right shoulder because as I give you my daughter’s right hand, I believe you will protect her. Please stand.”

That was as much as he was aware of – the rest was a surprise to him.

I continued by saying, “Will, Maria comes from a long line of men who married well. Her great grandfather, Joseph Marciano, married well, as did her great grandfather, Raphael Meola. My father married well. I wished you had met Nana before she got ill. I married very well. It is my wife who taught me what it means to

marry very well. Your soon to be brotherin-law Anthony also married very well. I know the heart of my daughter. You are about to marry very well. You will be able to say with the wisest man who ever walked the planet, Solomon – ‘a good woman who can find, she is far more precious than jewels. The heart of her husband trusts in her and she does him good and not harm all the days of his life.’

“Will – today on your wedding day, Maria will tell you she loves you. Like most men, you are good for 30 years or 100,000 miles, whichever comes first.

Maria is different. She is a woman. She will awake each day and wonder, ‘If he had to choose me again, would he choose me over every other woman on this planet?’ You are about to make vows to our daughter. Right now I need you to make a pledge to my wife and me. If you accept this sword, you pledge to us that you will, with the best of your ability, let my daughter know that if you had to choose her again, you would choose her over every other woman on this planet.”

Will had a speech prepared. He completely forgot it and spoke from his heart.

Support ministry launches fall season Calvary Church will launch its new fall support ministry classes on Monday, Sept. 12, at 6:30 p.m. The interactive study groups will address practical issues from a Christian worldview.

If a Mount Rushmore for North Carolina high school softball existed, Charlotte Catholic’s Carrie Eberle would be on it.

The recent graduate is one of the top athletes in the state, and her drive and talent helped raise the standard of success for the Cougars.

Charlotte Catholic entered the season with one of the area’s youngest, if not the youngest, teams.

The roster consisted of nine freshman and only three upperclassmen, including Eberle. When the season started, a So. Meck 8 title seemed unlikely to outsiders. But once Catholic got a few games under their belt, it was smooth sailing.

Eberle’s freshman year, Catholic split the regular season conference title with Olympic before defeating the Trojans in the conference tournament. This season was sweeter, because the Cougars (26-2, 14-0 So. Meck 8) won the league outright. Now, she is the South Charlotte Weekly Player of the Year. “I set such high expectations with a good freshman year that I had to live up to them every year after that, which put a lot of pressure on myself, which I think was good for me,�

Eberle said. “I learned how to work under pressure. “We definitely improved every year. When I came in, softball wasn’t really that big of a thing here.

We definitely built it up. One of my goals was to make the team better. I think I was able to do that all four years, which makes the memories that much better, because I actually helped.�

For Eberle, the highlight of the season came when Catholic hammered Olympic, 18-2, on the road April 15. “That never happens,� Eberle

Eberle, a Charlotte native, said learning how to lead a team was easier than she initially expected, because the younger girls on the team were ready and willing to make the program better.

The ace pitcher, who will take her talents to Virginia Tech, was a four-year varsity letter winner for basketball, too, and played JV volleyball as a freshman and sophomore at Catholic. Even with her athleticism in every sport, though, it always came back to softball for Eberle – her first love.

Now, she’s getting ready to take that love for the sport to the next level. “Some of my friends have been dancing their whole life,� Eberle said. “They’re not getting the opportunity to continue it as much as they want to. It’s a blessing to be able to play for four more years, especially at that level, so I’m really excited about that.�

Softball has given her confidence off the field, which has been empowering for her to have success outside of the sport in the classroom and in the community.

Her father T.J. Eberle, who serves as an assistant coach at Charlotte Catholic, has coached her ever since she started playing T-ball. “We go on all the trips for our travel ball team together,� Eberle said. “We’re always together, so it’s fun to be able to share it with him.�

Once she arrives at Virginia Tech, Eberle hopes to pursue a degree in biology and eventually a career in forensic science or medical examination. Whatever she chooses, she’s left a lasting legacy at Catholic. “My four years here were great, but I’m excited to move on to the next opportunity.�

Sam Russ Providence Day

Paige Rivas was one of several freshmen at Charlotte Catholic to take the Queen City softball landscape by storm as a rookie. The center fielder earned all-conference recognition after hitting .551 for the year, and connecting for 43 hits, 10 RBI, three doubles and a triple.

Sam Russ, a junior and N.C. State commit, maintained a .694 batting average, .745 on base percentage, 1.165 slugging percentage, and recorded 23 RBI, 55 runs and 50 stolen bases. The centerfielder earned all-conference, Conference Player of the Year and all-state honors.

Haylee Ewert Ardrey Kell

Julianna Roupas Providence Day

Haylee Ewert was key to Ardrey Kell’s lineup at shortstop. She graduates as the Knights’ all-time hits leader with 114. Ewert recorded a .514 batting average, .532 on base percentage and a .635 slugging percentage. She was named Team MVP and to the all-conference and all-district teams.

Julianna Roupas confounded batters with her pitching as a junior at Providence Day. The Appalachian State commit struck out 221 batters, and recorded six no hitters along with a 2.031 ERA on her way to an 18-5 record. She made all-conference and all-state teams.

Laura Hay Providence

McKenzie Lewis Charlotte Christian

Laura Hay capped an impressive sophomore season at Providence. She gave the Panthers a boost with her stellar player at second base and with her bat (.414 batting average, .557 on base percentage and 23 RBI) to make the all-conference team.

McKenzie Lewis was relatively unhittable during her junior year with the Knights. She mowed down opposing batters with 199 strikeouts and 0.91 ERA. Lewis also was quite the hitter, as she had .468 batting average, seven homeruns and 28 RBI. She earned all-conference and all-state recognition.

Natalie Hallman Providence

Christi Takac Charlotte Christian

Providence third baseman Natalie Hallman is on the heels of a dynamic sophomore campaign with the Panthers. She recorded a .419 batting average, .463 on base percentage, five doubles, three triples and 23 RBI to secure a spot on the all-conference team.

Christi Takac was superb behind and at the plate during her senior year. The catcher, a Charleston Southern commit, had one of the hottest bats, with a .572 batting average, 19 doubles and 29 RBI. She scored 37 runs, and stole 22 bases. Takac was named an all-conference player.

Player of the Year

Carrie Eberle Charlotte Catholic Carrie Eberle, a Virginia Tech signee, was a stalwart for Charlotte Catholic for four years. Eberle, a pitcher, handcuffed batters with a 0.920 ERA on her way to a 23-2 record. She finished with a .567 batting average, 34 hits, nine doubles, five triples and 10 homeruns to unanimously earn So. Meck 8 Conference Player of the Year honors.
