Welcome from Shropshire Council Welcome to the 2013/14 Shropshire Care Services Directory which provides information for older people and adults with disabilities about the range of social care services available across the county.

Shropshire Council’s Adult Services teams work with people aged over 18, and their families who may need help with their care. This could be because they have

mental health issues, a learning or physical disability, a sensory impairment or because they have become frail and are struggling to continue to live independently and receive support at home or may need to live in a supported environment such as a care home or care home with nursing.

Live Life: Your Way – Transforming Adult Services The transformation (sometimes called ‘personalisation’) of Adult Services is a national programme aimed to shift the balance of power from the local authority, over to the person who requires care and support. The programme will give people who use services more choice and control in who, when, and how they can receive services.

In Shropshire we are now looking at the way we deliver services and this will mean some changes in how our services work in the future.

Our transformation of Adult Services programme is called ‘Live Life: Your Way’. We are looking at how best to provide information and guidance to everyone who needs extra support in order to offer Personal Budgets to people who meet the eligibility criteria for social care funding. Please see pages 7 and 30 for more information on funding your care and the eligibility criteria we use.

The offer of Personal Budgets to older people, and people with disabilities, is via a system called ‘SelfDirected Support’. This means exactly what it says - the person who needs a service can make key decisions about their own support.

The process involves having an assessment, and then (if you are eligible) you will be told an indicative amount of money (your Personal Budget) that you can spend on your care and support. The next step is to create a support plan, which lets us see how you plan to spend your budget. Providing your plan comes within the budget, meets your needs and identified outcomes and will help you be safe and well, it should be signed off.

to your home. Depending on how you choose to manage your budget, some services can still be provided directly by us and others by private or voluntary organisations.

Personalisation We are working to give people more choice and control when deciding what support meets their needs. We call this ‘self-directed support’.

Self-directed support fits within the government’s ‘personalisation’ agenda. It is an innovative approach to providing social care to older people and adults with learning disabilities, mental health issues, physical disabilities and sensory impairment.

Instead of a package of care being organised by us, self-directed support gives individuals more opportunity to identify their own needs and enables them to plan how to meet them.

If you feel that you may benefit from some support, you can contact our customer service centre on 0345 678 9044 who will ask you some key questions about your personal details and your circumstances.

These questions are the first stage of carrying out an assessment of your needs and enabling you to identify

what support is available in your local community that can help you grow in confidence and enable you to develop and regain your skills for independent living.

You will be given advice and guidance on how to access the support services in your local community and will be signposted to these services.

If the community resources available to you are not enough to meet your needs then you may be entitled to some funding from us in the form of self-directed support which could be given to you as a Personal Budget. This will enable you to meet your needs and remain safe.

Personal Budgets are discussed further on page 30.

With support from our Adult Services Team you will develop a support plan that identifies your eligible needs, you will be able to choose what support would be best to meet your needs and this will be regularly reviewed to ensure that we are enabling you to regain your independence and prevent you from losing your skills.

Making it Real in Shropshire We are working to develop Adult Services to give people more choice and control over how they are supported.

People have told us they want a wide range of support that is personalised to their needs and enables them to remain independent and active members of their communities for as long as possible.

We have signed up to Making it Real (MiR) to help make sure we are improving services in this way.

Any council or other organisation that provides social care services can sign up to MiR and use the MiR checklist which has been developed by people using services and their carers, supported by more than 30 national social care organisations.

The checklist is a list of statements which outline what people expect if services are personalised.

We will work with people receiving services and carers, using the MiR checklist, to see how we are doing, develop an action plan for making services better, which will be shared with the public, and check progress.

Reablement and independence Independence assessment When you, or someone on your behalf, first contacts us about social care, you are likely to be asked some key questions about your personal details and your circumstances.

These questions are the first stage of carrying out an assessment of your needs and working out if you are entitled to social care support from us. Working out if someone is eligible for support is done using guidance from the government, called ‘Fair Access to Care Services’ (FACS). More information on FACS can be found below.

Before any support from us can be considered we must continue to the next stage of this assessment of

your needs. This is called an ‘independence assessment’ and will look at all areas of your life and consider how effectively your needs are currently met, and whether there are any risks to your health and wellbeing.

It may be that your eligible needs can be met through support already available in your local community that you can readily access and this information will be provided following your assessment.

People who help or care for you, a relative, partner or friend may also request an assessment for themselves.

This is called a ‘carer’s assessment’.

Fair Access to Care Services Regardless of your financial situation you are entitled to information and advice about any care needs you may have.

We follow government guidance called ‘Fair Access to Care Services’ (FACS), which has been issued to local authorities across the country. The aim is to make sure all decisions on who receives financial help with care and support are made fairly, openly and consistently. This means each council has to set criteria to make sure help is allocated fairly and to those in greatest need.

FACS eligibility criteria is divided into four bands representing the seriousness of the risk to your

independence: ‘critical’, ‘substantial’, ‘moderate’ and ‘low’. Currently you are only eligible for community care services in Shropshire if your needs are assessed as ‘critical’ or ‘substantial’. This ensures that people in the greatest immediate or longer term need will get most help. Some things are not covered by ‘Fair Access to Care Services’ including Blue Badges and disabled facilities grants.

Maximising Independence This is a service which allows you to receive some help on a short term basis so you can retain your independence and remain in your home. Help could include supporting you with skills such as cooking or helping with travel arrangements, avoiding the early intervention of social care services.

The service has input from social workers, occupational therapists and the Short Term Assessment and Reablement Team (START).

Occupying a convenient and picturesque position next to the Uplands at Oxon Care Home, the Day Resource Centre has been designed as a comfortable, safe and stimulating environment which is available for the use of all adults of mature years.

START (Short Term Assessment and Reablement Team) Older people want to stay in their own homes for as long as possible. To do so they might need some form of support.

Our in-house short term assessment and reablement service offers a specialist support service and is called START. This service is aimed at working with people to regain and maximise their independence. START provides a short burst of intensive support which lasts up to two weeks and is then reviewed, extending by a further four weeks where required. During this time START works with the service user setting goals and assessing if there are any on-going care needs. If there are then any on-going needs

the social worker will arrange for this to be provided by an independent home care provider.

START is available as part of a care package provided you meet the eligibility criteria following an assessment of your care needs, discussed on page 7.

Community-based support Community Action Team Shropshire Council’s Community Action Team is a community-enabling service with a diverse range of skills, knowledge and experience to deliver cost-effective grass roots solutions that make the most of community resources, and meet community priorities at a local level.

Community Action Officers are located across Shropshire and work very closely with the elected Shropshire Councillors, and Town and Parish Councils to help and support communities to anticipate and understand local priorities, and make the most of the economic, social and environmental challenges that face them, through local activities and action. We have a wide knowledge of local community networks, contacts, etc.

Some of the skills also included in the team include: • consultation and community engagement techniques for all ages;

• fund finding; • partnership building; • problem solving; • event organisation; • community planning and development; • action and business planning; • project management; and • social enterprise/community interest company start up advice.

Community-based resources South West Shropshire CasCA – Craven Arms Community Centre (Community arts sports Craven Arms) The building has recently been taken over by the South Shropshire Furniture Scheme. As well as its general use as a community centre, there are three defined aspects to the centre which make it a wonderful asset for the community and give it massive potential: the sports hall; the conference facility and the training/catering kitchen.

Enterprise South West Shropshire, Bishop’s Castle Enterprise House is the headquarters of the Bishop’s Castle and District Lifeline Company Limited and trades under the name Enterprise South West Shropshire.

It runs the drop-in IT Centre, the Village Outreach equipment hire project and a number of local regeneration projects.

The building houses the Public Library, the Registrar of Births, Marriages and Deaths, an outpost of the South Shropshire Housing Association, Dial-a-Ride and several private offices.

Community-based resources continued South West Shropshire continued Mayfair Community Centre, Church Stretton Mayfair is a Community Centre and healthy living centre.

It takes a leading role in the development of a strong, thriving and supportive community. They aim to improve the quality of life for people in the Strettons and the surrounding area. The centre has a number of paid staff, but in addition over 200 local volunteers support the work that is undertaken at the centre.

The centre hosts a number of clubs and activities. It runs successful holiday schemes for young people. There is also a host of activities for people of all ages. Their aim

is always to build confidence, encourage friendships and support people in any way to make the most of opportunities. They also offer volunteer work placements and develop skills to help people seek out and secure employment.

Every Thursday at the Rockspring Centre there is a drop in between 9.30am and 12.00pm, call in for a cuppa and a chat, take part in free activities and get help with any problems you may be facing. Staff are on hand from the Multi Agency Team, Benefits Adviser, County Training, Community Housing Officer and Credit Union.

Basic IT Skills – get help with word processing, emails, file management etc. Thursday lunch is from 12:15pm, £1, all welcome.

Community living Support from the NHS NHS Continuing Healthcare is arranged and funded by the NHS, where it has been assessed that an individual’s primary need is a health need. It can be provided in any setting. In a person’s own home, it means that the NHS funds all the care that is required to meet their assessed health needs. In care homes, it means that the NHS also makes a contract with the care home and pays the full fees for the person’s accommodation as well as their care.

NHS Continuing Healthcare is provided if you have extensive healthcare needs. The cost will be covered by the NHS. Continuing Care is a package of care that involves services and funding from both the NHS and the

Department of Community Services.

You can ask for an assessment by health and social care professionals if you think you may be eligible for either NHS Continuing Healthcare or Continuing Care. They will visit you to identify and prioritise your needs and the assessment will be used to decide what services will be provided, where and who funds them.

Regular reviews will monitor your care needs and if they change, your care and/or funding arrangements will change to meet them. You can pick up a leaflet about Continuing Care from your GP or hospital.

Independent home care providers Care in your own home is often referred to as either ‘domiciliary’ or ‘home care’.

Given the choice, many people prefer to stay in their own homes surrounded by their possessions and near to their family and friends. This, of course, applies to everyone whether they are elderly and frail, convalescing, have a physical or learning disability, or have dementia. The range of care available is varied and each client should be involved, and agree, with the care provider, a care plan, which states their needs and the expected outcomes.

Domiciliary care is usually arranged in a manner dependent upon needs: Low level domiciliary care – this may be to assist with household chores such as shopping, cleaning and assistance with food preparation. It may also involve a carer accompanying clients on trips out and even holidays. Calls from carers can be flexible and assistance can be given for as little as 15 minutes or when the client needs.

Medium level domiciliary care – in addition to low level care this will normally involve personal care (assistance with washing, dressing etc.), and/or one carer to assist with mobility. Clients may wish to have a carer sleep in their home overnight for security and reassurance.

High level care – this involves visits by two or more carers who assist clients with high dependency needs such as being transferred from a bed to a chair etc. Carers may require specific training for the health needs of a client.

Live-in care – a carer lives in the client’s home, is allowed time off each day and must have a night’s sleep. Live-in care can be arranged as a short respite for the client’s main carer or a permanent arrangement to suit the client’s needs.

24 hour care – this is required when the client needs assistance or monitoring through the day and night; it differs from live-in

advertorial care in that carers work on a roster to ensure that a carer is on duty and awake both day and night.

Some agencies are also registered as Nurses’ Agencies, meaning they can provide registered nurses if needed.

All service providers must be registered and inspected by the Care Quality Commission (CQC). It is important to be assured that all carers have been vetted by the Disclosure and Barring Service, have received necessary training, are properly referenced, and are eligible to work in the UK prior to them visiting your home.

Ask the service provider to show evidence that the carers they introduce are indeed compliant with the legislation, and check their latest CQC report at www.cqc.org.uk or call the CQC on 03000 616161. More information on the CQC can be found on page 28.

Paying for home care Domiciliary care for social needs may be funded in part or whole by the local authority, or alternatively private arrangements can be made with service providers. The majority of social services funded care is contracted out to private companies, rather than the internal local authority service.

Fees for services vary, a good service provider will be able to give you a detailed cost breakdown prior to the commencement of any service.

Most service providers will accept clients who pay using Direct Payments (discussed further on page 31). You will still need to have an assessment of your needs, and if you are eligible, you can decide whether you would prefer to arrange the services yourself. If you do not meet your council’s eligibility criteria, you must organise your own care as a ‘self-funder’. Listings of home care providers start on page 17. Ask to see a copy of their registration certificate.

• If this is a private contract ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything.

The Citizens Advice Bureau or Age UK (sometimes called Age Concern in some areas) can help with this.

Carers • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding?

Assistive Technology and Telecare Put simply, ‘Assistive Technology’ is any piece of equipment which can help someone stay as independent as possible and lead a fulfilling life. This can range from those clever but simple devices which help with daily living tasks, to the more technologically advanced equipment which alerts support networks for you if it detects a problem at your home.

This kind of technology, known as ‘Telecare’, has been launched in Shropshire and already some people are benefitting from having it installed. It can make a huge difference to vulnerable people’s lives, giving them the confidence to try things independently, secure in the knowledge that they can get support if needed. It can also be highly beneficial to those who act as carers for loved ones giving them more time and space to pursue their interests because they know that if it’s needed then the support is in place - 24 hours a day, 7 days a week - to help their loved ones.

Telecare uses a range of simple sensors matched to your personal needs which can help you to continue to live as independently and safely as possible. These are usually linked to a lifeline (a kind of telephone) which will pick up on the sensor’s alert. For example if they detect you have fallen over, the lifeline picks up on this and alerts support who can communicate with you directly in your home. This avoids the risk of someone falling and being left on the floor all night, cold and in pain.

Telecare could be part of a support plan to assist with things you worry about. It can help get support when a person leaves the property at an inappropriate time, like the early hours of the morning. Or it can react to situations such as epileptic seizures or fire, where you need help from family, carers or the emergency services. Some more examples of how Telecare can be used include: • Telecare can remind you to take medication;

• Telecare can raise an alert that the cooker hob has been left on; • Telecare can detect gas leaks from the cooker/fire and raise an alert; • Telecare can provide early warning of a sink or bath overflowing; • Telecare can raise a call to a monitoring centre who can keep a phone line open to you in an emergency; • Telecare can give people space and time on their own, instead of being checked up on just in case something has happened.

The Telecare support available is made up of trained operators. Often they are retired police and health workers who will be speaking to you through the speaker on the lifeline. They will have your details and know who to call in an emergency. This could be family, friends, carers or the emergency services. Alternatively, you could choose to have calls made directly to your chosen emergency contact.

Support for family carers Carers contribute an enormous amount to our communities by providing help and support to people who could not manage without this care. Shropshire Council works to support carers in two important ways: offering care and support to the people they care for, and offering direct support to the carer in their caring role.

A family carer is entitled to an assessment of their own needs – this is called a ‘carer’s assessment’.

Carer’s assessment This is the carer’s opportunity to tell us about the things that could make caring easier and support them to continue caring.

A carer can have an assessment even if the person they care for does not wish to be assessed for community care services themselves. The assessment can take place in a number of different ways to suit you: in confidence and away from the person you care for, alongside an assessment of the person you care for, in your own home, at the social work offices or even over the telephone.

Respite care and short stays Short breaks can provide respite for the carer as well as a break for the cared-for person. This might involve someone coming to your own home, a stay in residential accommodation or a supported holiday away. The best option for you will depend on your needs, the urgency of the situation and personal choices. This could be included in the carer’s support plan or the support plan of the person who requires services.

A Carers Emergency Respite Scheme aims to provide

peace of mind to carers through home-based care at short notice. Care can be provided for up to 72 hours.

The scheme enables someone to remain safely in their own home until the emergency is over or other care arrangements can be made.

Intermediate care Intermediate care differs from respite care. While respite care provides full-time care on a temporary basis, immediate care is designed to rehabilitate you and enable you to manage by yourself.

Intermediate care, including care home fees, provided by the NHS, is free. It can be provided in your own home or in a single care home in Shropshire and is usually limited to a maximum of two weeks.

Based around a programme of therapy and treatment, intermediate care is designed to make you as independent as possible.

The structured programme of support may mean that you do not have to go into hospital at all, or may enable you to get home faster after you finish hospital treatment, but cannot manage independently at home.

Sheltered housing Sheltered housing is a practical step if you would like more security and companionship but don’t need to move into a care home and is usually provided by housing associations across the region.

In a sheltered (or retirement) housing scheme you would live independently in a flat or bungalow built especially for older people within a larger complex, sometimes around a garden or communal facility and linked to a central control centre for security. Some schemes have access to a resident or non-resident

manager who provides support, advice and a link to services for older people. After your needs have been assessed, you will still be able to receive care in the scheme if required.

Sheltered housing is available to rent or buy and is usually provided by local councils or non-profit-making housing associations. Further information can be found on the website www.housingcare.org, run by the Elderly Accommodation Counsel which specialises in retirement property.

Extra Care Extra Care covers a range of specialist housing models.

It incorporates particular design features and has key guiding principles.

Extra Care housing can be owned, rented, partowned and part-rented and leased. Some developments mix types of tenures. Specialist care Learning and physical disabilities With Personal Budgets, everyone will go through the same format of assessment, regardless of whether you have a physical or learning disability, mental health issues, or whether you are an older person who requires additional care and support. Services are always designed around people and reflect the needs of those who use the service, their families and carers.

Dementia care Usually, the initial point of contact to access care services is either via your GP (for health care solutions) or your local Adult Services office (for most other services).

Your GP, as well as discussing your concerns, will be able to carry out a series of tests which will establish the nature of your condition and advise whether treatment is possible.

Following a diagnosis of dementia, your GP may refer you to a specialist like a Consultant in Old Age Psychiatry, a Community Psychiatric Nurse or an occupational therapist with a special interest in dementia care.

Support in the community As it can be best for the person with dementia to remain living in their own home for as long as possible (as opposed to going into residential care), a range of community care services is available to facilitate this, including the ‘Maximising Independence’ model, as mentioned on page 7. Following your assessment, your Support Plan would help to identify the right level of support that you need. This could include help with cooking meals, home care, advice on equipment day centres, and many other options.

These services can be provided directly by registered providers to those who do not require our financial help,

however we will still be willing to offer an assessment of need. You may have a choice of which agency you receive your care from whether or not we assist with the funding of your service.

Residential dementia care If the time comes when remaining at home with support is no longer viable, you may wish to consider the option of residential care. Differentiating one home from another can be difficult but the quality and quantity of staff training is especially important, along with the turnover of staff as continuity of relationships in this type of home is critical.

Mental health Services for people with mental health issues are usually accessed via the Community Mental Health Team (CMHTs) which are based on GP practice areas. An assessment of your needs will be done by a member of staff working in the Community Mental Health Team, usually a nurse, social worker or occupational therapist, this should be similar to the

assessment process as described on page 7. You will then develop a Support Plan, as described above.

The initial point of contact for services and support is through your GP. Hospices are another very useful provider of services and support. They provide in-patient care, day services and Hospice at Home services. The main provider of care in Shropshire is the Severn Hospice, based in Shrewsbury and Telford. Care homes What is a registered home?

Fundamentally, there are two types of residential care home: homes offering personal care only, and homes offering ‘care with nursing’. Following your assessment, your care manager can advise you on the different options that may be appropriate for you.

Personal care only This type of home (commonly referred to as a ‘residential home’) will suit you if you are reasonably active but require help with tasks such as bathing, eating, dressing and moving about. District nurses visit to handle any nursing needs. It may be worth considering what your future needs may be – will the home be able to meet them in a few years’ time? Take along the care homes checklist on page 29 to prompt any questions you will have for the manager.

Care home with nursing This kind of home is suitable for those needing nursing care, where it will be delivered by qualified nursing staff alongside care workers. Nurses are on duty around the clock. Fees are generally higher than personal care only homes because of higher ratios of staff to residents. Some of the cost of your nursing care will be met by the NHS, who will pay the home directly. At the moment the rate for NHS Continuing Healthcare and NHS funded Nursing Care is £109.79 (price correct as of October 2013) per week. This is paid directly to the home. Figures mentioned here may change during the life of this Directory.

Inspection and registration of care services Since October 2010, all care providers must be registered under a new system, introduced by the Health and Social Care Act 2008, which will bring Adult Services, independent healthcare and the NHS under a single set of essential standards of quality and safety for the first time.

CQC will hold and publish up to date information about the compliance of Adult Services providers with essential standards of safety and quality.

The Care Quality Commission (CQC) registers, inspects and reviews all Adult Services and healthcare services in England in the public, private and voluntary sectors. This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others.

Following an inspection, each care home and home care agency is given a report of how it rates against national essential standards of quality and safety. Each service’s report can be seen on the CQC website: www.cqc.org.uk

The focus of an inspection is on the standards of care that people who use the service receive and whether they are happy with their care. Virtually all inspections are unannounced.

Paying for care Personal Budgets People who are eligible for social care funding under Fair Access to Care criteria will be offered a Personal Budget which is an indicative amount of funding that could be made available to meet their needs and achieve outcomes. This means that the person can exercise choice

and control in how that budget could be used in a way that works for them. They will be asked and supported to develop a support plan that sets out how they wish the funding to be used and how they intend to manage the money. This will need to be agreed by the care manager.

Direct Payments A Direct Payment is money from a council’s Social Services department to cover a specific assessed need.

People who are eligible are given an agreed amount and can use it to employ a personal assistant themselves or through an agency to help support them.

You aren’t allowed to use Direct Payments to pay for permanent residential accommodation - but you may be able to use them to pay for occasional short periods in

residential accommodation, if your council agrees that is what you need.

If you are applying for services for the first time, your social worker should discuss the Direct Payments option with you when they assess your care needs.

Direct Payments are made directly into your bank, building society, Post Office or National Savings account.

Individual Service Funds You can choose a service provider that you wish to provide your care or support (for existing clients this may be their current provider if they are happy with them.) Some or all of the Personal Budget is then paid by us directly to the service provider as an ‘Individual Service Fund’. In practice, this is not very different to what happens currently but the important difference is that

you (and/or those closest to them) are making a choice about that organisation.

We will enter into a contract with that service provider and you and the provider must agree how the money will be used. The provider is accountable to you and us to deliver the service they have agreed.

Council-managed account There are three scenarios whereby we may manage all or some of the money on a person’s behalf: 1. The person may wish to receive a service that is directly provided by us. They will have been informed of the cost of this service, and agreed with the service itself the detail (nature, frequency etc.) of what they wish to receive. We will then internally deduct that amount of money from your Personal Budget. The person will have an agreement with that service detailing what will be provided.

2. The care manager makes a decision based on an assessment of risk that the service needs to be directly arranged, purchased or provided by us. There would need to be a good reason for this and the resulting

service still needs to reflect your preferences within the Support Plan as far as is reasonable and it will still need to come within the Personal Budget amount.

3. The person does not wish to exercise choice and control at the current time and requests that decisions about your care and support are made by your care manager. As above, the care manager will need to work within the Personal Budget amount and complete a Support Plan that will need approval.

(Note: it may be that at a later stage the person wishes to have more of a say so it should not be assumed that this is a permanent arrangement and should always be questioned at any subsequent review.)

Third party-managed fund Some people will want greater control over the money than a council-managed fund gives them, but will not want a Direct Payment and will not want to purchase support from an organisation. In these cases a third party managed fund would be the favoured option whereby all or some of the Personal Budget would be paid directly to a voluntary sector organisation that will manage the money on the person’s behalf as a ring-fenced budget.

Only reputable organisations that have been approved by us to provide this service will be used. Selection is currently underway and a list will be available shortly of those that are providing this service. The organisation may charge the person a small administrative fee that can be met out of the Personal Budget amount.

General advice about Personal Budgets If you are employing someone yourself, we strongly recommend you carry out a Disclosure and Barring Service check before employing the person, if the person is not known to you. When you complete your support

plan, risk management and safeguarding will be covered.

A Personal Budget can only be spent on meeting your assessed needs. Your Support Plan will outline the way in which you plan to spend the money.

Self-funding advice If you have capital or savings of more than £23,250 (correct as of October 2013) you will have to pay for any care services you require but you are still entitled to an assessment of your needs by us.

If you will be moving into care, you may be entitled to some of the following financial assistance and support, subject to an assessment of need.

Twelve-week property disregard This applies if: • your former home is included in your financial assessment • your other capital is less than £23,250, and • your income is not enough to meet your care home fees.

Adult Services will help with the cost during the first twelve weeks of permanent care in a home, provided their assessment has shown that this is the kind of care you need. This is called the ‘property disregard’ period.

Deferred payment agreements After the twelve-week property disregard period, Adult Services may be able to help you while your property is being sold. They will charge any financial help they give against the value of your home. This means they will take back the amount they have paid once your property has been sold. However, they may limit how much they will pay.

It may affect your entitlement to Pension Credit if your property is not seen to be on the market and becomes treated as capital by the Department for Work and Pensions (DWP).

Attendance Allowance This is a non-means tested, non-taxable benefit from the Department of Work and Pensions paid at the lower rate of £53.00 per week (correct as of October 2013) for those needing care by day or night, and at the higher rate of £79.15 per week (correct as of October 2013) for those needing care both during the day and night. Everyone is entitled to claim this benefit. A benefits check is part of your initial assessment for us.

may be entitled to a non-means-tested NHS Nursing Care Contribution (currently £109.79 per week for the standard rate) towards the cost of your nursing care. This is paid directly to the home.

NHS Continuing Care Funding You can receive continuing healthcare services in any setting, including your own home or in a care home. The NHS will pay if you need healthcare from a community nurse or a therapist as well as personal care to help you at home like having a bath or dressing.

If you live in a care home with nursing (traditionally called a ‘nursing home’), you may qualify for the full cost of your care home fees, including board and accommodation, under the National Framework for NHS Continuing Healthcare. If you live in a residential home and need help from a registered nurse, this will be free, covered by the NHS again.

Running out of money If your capital is likely to reduce to £23,250 (correct as of October 2013), you must let us know well in advance as we may step in to help with your care fees. We must conduct an assessment of your situation and may make a contribution.

If the home you have chosen charges more than what we will contribute, you must find someone to help pay the difference – a ‘top-up’ payment. Whoever does this, whether family or a benevolent charity, they should realise that they may have to pay this for some time. Alternatively, you would have to find a home with lower fees.

Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself.

Comments, compliments and complaints All organisations need to know how they are performing.

They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service.

If you do need to make a complaint you should feel able to complain about any aspect of your care that affects your happiness or comfort. This could be about the way you are treated by a staff member or the quality of the food you are served.

You can also make comments and suggestions about possible improvements to your surroundings and the services provided.

Making a complaint should not be difficult for you.

Providers are required under the National Essential Standards of Quality and Safety to have a simple and easy

to use complaints procedure that they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it.

However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made. If your complaint is about a breach of regulations, contact your local office of the Care Quality Commission, see page 28 for contact details.

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney.

Some can also offer guidance on immediate and longterm care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees.

Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. An LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable to.

The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney.

An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make

a living will, properly known as an ‘advance decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result.

Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability.

Long-term care: whether you remain in your own home or move into sheltered or residential care, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits.

If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. It’s important to find a solicitor who specialises in this area of the law. The Citizen’s Advice Bureau offer an advice service and will be able to recommend solicitors in your area.

Out of county care homes Did you know you can choose a care home outside your home county? You may want to be closer to friends, family members or you may want to relocate to another part of the country.

If your care home place is funded by the local authority, you can still choose a care home that is in a different county. You can use your Personal Budget to pay for this (discussed on page 30). The home you choose must be suitable for your assessed needs and comply with the terms and conditions set by the authority. The fees that your local authority will pay may vary, and your Support Plan will need to reflect this.

They will only fund those with an assessed eligible need at ‘critical’ or ‘substantial’ levels, as explained on

page 7. They may offer you the fees you would receive if you remained within the county, or they may offer you the fees that the local authority would pay in your chosen region (you will find out about the amount of money that you are entitled to after your assessment – this will be the maximum amount of money that you have available to meet your support needs).

If your indicative budget is not enough to cover an out of county placement, you will have to speak to the care management team to see if there are any other options available. If you have to pay for services yourself (otherwise known as being a ‘self-funder’), there are no restrictions (apart from your own budget).
