RATIONALE (a)

Camberwell Grammar School (the "School") has a range of tuition fees (“Fees”) and Charges (collectively “Fees & Charges”) for the various services it offers/provides.

(b)

This document outlines the business terms and conditions for the payment of these Fees and Charges ("Terms and Conditions").

PRINCIPLES The School aims to ensure that:

It operates its business efficiently and in a manner that is financially responsible and fair for all families – collectively and individually;

(b)

All families understand their responsibilities as to the amount, timing and payment of Fees and Charges; and

(c)

The School does not suffer loss from non-payment or slow payment of Fees & Charges.

AUDIENCE This Policy applies to all parents, guardians and carers of students at the School ("you" and "your").

DEFINITIONS Word/s

Definition

"Camps, Trips & Excursions”

Including (but not limited to) incursions, single-day excursions, overnight excursions, camps, interstate trips, international / exchange / cultural trips and adventure activities.

"Extracurricular Activities"

Including (but not limited to) Music lessons (including Academy), Aquatics (including lessons and squads), Cadets, Sports lessons (including Academy) and Chess.

"Other Activities"

Including (but not limited to) attendance at the Year 12 Valedictory Dinner (parents/friends) and borrowings from the library beyond the due date (including losses).

"Activity / Activities"

Any one or more of Camps, Trips & Excursions; Extracurricular Activities and Other Activities.

"Charges"

Charges levied by the School (on its behalf or on behalf of a third party) including (but not limited to) in relation to Camps, Trips & Excursions; Extracurricular Activities and Other Activities.

"Due Date"

The date by which a Fee or Charge becomes due and payable as stipulated in the Schedule of Fees and Charges and Activity documentation (including for each instalment), respectively.

TERMS (a)

By enrolling your son at the School, you confirm you:

have read, understood and agreed to these Terms and Conditions and the Terms of Enrolment (available on CGS website);

(ii)

understand the financial commitment as to Fees, and as to both their amount and timing; and

(iii)

will pay all Fees by the stipulated Due Date.

By consenting to your son’s participation in the Activity being conducted by or on behalf of the School, you confirm that you: (iv)

have read, understood and agreed to these Terms and Conditions and the Terms and Conditions and any other documents provided by the School to you in connection with the Activity;

(v)

understand the financial commitment as to Charges, and as to both their quantum and timing; and

(vi)

will pay all Charges by the stipulated Due Date.

ACCOUNT

(a)

The School publishes its Schedule of Fees and Charges (available on the CGS website) no later than the last quarter of a year for the following year. This schedule contains (among other things) the relevant Fees for each year level (K-12), the Fee per term and stipulates the relevant Due Dates.

(b)

Fees will be charged to the family School account (“Account”) ahead of the Due Date and will note the Due Date.

(c)

The costs associated with the conduct of some Activities are built into your Fees. However, if the costs of an Activity, in whole or in part, are not covered in Fees, you will be asked to pay for all such costs in the resultant Charges.

(d)

The manner in which Charges are levied will be advised by the School representative(s) associated with the Activity. You will also be advised of the Due Dates of those Charges. In the absence of such advice, the Due Date for Charges is 30 days after receipt of invoice or other payment instructions.

(e)

At the School’s discretion, Charges may be levied directly to you or added to your Account.

(f)

Failure to pay a Charge levied directly to you by the Due Date will, at the School’s discretion, result in that Charge being transferred and added to your Account and will then, together with all other Fees & Charges comprising the balance of your Account, become subject to the School’s Overdue Account Provisions.

OVERDUE ACCOUNT PROVISIONS (a)

(i)

If your Account includes amounts for which the Due Date has passed (“Overdue Amounts”), and unless you have made prior arrangements with the Business Manager, at the School’s discretion: (i)

The Overdue Amounts may attract interest at the current rate, specified under section 2 of the Penalty Interest Rate Act 1983;

(ii)

Discounts including (but not necessarily limited to) sibling discounts (refer Schedule of Fees and Charges) may be withdrawn;

(iii)

Scholarships and Bursaries may be withdrawn;

(iv)

Your son may be disqualified from participation in upcoming Activities

(b)

Non-payment of Overdue Amounts may result in the student’s enrolment being suspended or terminated.

(c)

Any delay or failure by the School to strictly enforce these Terms and Conditions, or any agreement by the School not to strictly enforce them, or any agreement to defer payment, will not operate as a waiver of the School’s rights in relation to such amounts.

(d)

If a payment to the School is declined or if the School refers an outstanding amount to an external debt collection agency, you agree to reimburse the School for any costs or expenses arising therefrom.

If you require alternative payment arrangements, please contact the School’s Business Manager prior to the Due Date.

8.

RIGHT OF OFFSET Any amounts payable to you from the School will be credited to the Account and will be offset against any current or future amounts outstanding on the Account. If, at the closing of an account, an amount remains payable to you, that amount will be refunded.
