F

riends, we are in unique and challenging times.

With the Shelter in Place Order in our state, we are all learning new ways to live our lives and conduct our businesses. California Women Lawyers has postponed our annual conference, and we are moving our connection to members to a more virtual platform.

We are working to create multiple zoom meetings for members, including coffee breaks for chatting and connecting, panels of various topics from lawyer moms working from home with small children, expectant moms and how they are navigating this time, and rainmaking when you can’t go outside. CWL is learning as we go (aren’t we all right now?), and we are excited about staying connected with each other and harnessing the resources we all have.

CWL is committed to being a place for our members to connect, build each other up, and advance the interests of women and children in law and society. Our members represent a broad range of California lawyers that, despite facing different challenges, have common goals.

We are here. We will continue to be here. And, when we come through this time in our history we will be stronger, more connected, and with new skills we never thought we would have. For myself, as a mom of a second grader and preschooler, while also being a partner at a mid-size firm, the new skill I am learning is to slow down and to be kind to myself. I have always been a multitasking aficionado that could muscle her way through any challenge. But, in the last 33 days of “work from home,” I have had to really lower expectations for myself and be okay with it (this is such a challenge!). I literally have to tell myself multiple times a day: “BE KIND, you are doing the best you can.” I hope that I am able to carry this skill forward for the rest of my life.

Editor’s Note Jodi Cleesattle This issue of CWL News comes to you amidst the COVID-19 pandemic, with California still largely shut down. Most of us are working from home. Some of us may be struggling to find work to keep our practices afloat or worrying about lay-offs at our firms. Many of us are navigating how to home-school our children, or simply how to help them cope with the upside-down world we find ourselves in. Some of us are grieving the loss of family or friends affected by the coronavirus. Some of us are grieving, in a different way, the loss of milestones – graduations, birthdays, weddings – deferred.

This issue may make you nostalgic. It’s filled with news about and photos from CWL’s annual conference and annual dinner held in September 2019, when we all could take for granted the ability to gather in person to hear a prominent speaker or celebrate a colleague’s award, to crowd together for silly group photos, to network and make new friends at a cocktail reception.

It may make you nostalgic in another way, too. We take a look back 25 years at the 1994 CWL annual dinner, which featured U.S. Supreme Court Justice Ruth Bader Ginsburg, then newly sworn in as the second woman to sit on the Supreme Court.

Thanks to the efforts of CWL member Prudence Hutton and longtime CWL photographer Howard Watkins, we share Justice Ginsburg’s remarks at the annual dinner and plenty of photos from the event. Justice Ginsburg’s remarks then, full of optimism, addressed issues of equality that are just as relevant today – and not yet resolved.

Flipping through this issue, you’ll find the calendars of CWL signature events and CWL’s affiliate events a bit more sparse than usual – as we and our sister bar associations around the state have had to cancel or postpone in-person gatherings. But take notice of the virtual events being hosted by CWL – details available at www.cwl.org and on our Facebook page – and our affiliate bar associations. For its CWL at Home series, CWL is hosting Zoom webinars on rainmaking during the time of social distancing, litigation tips during a pandemic, surviving COVID-19 with kids, and more. Our affiliates have put together programs on resilience tools for women (Lawyers Club of San Diego), virtual bedtime stories to help moms wind down their stir-crazy kids (Black Women Lawyers Association of Los Angeles), virtual book club meetings (Orange County Women Lawyers Association), and CLEs on everything from health issues to employment law (Women Lawyers Association of Los Angeles). This is a great opportunity to mingle with women lawyers from around the state, and to get ideas for your own local bar association.

How ever you are spending your days, CWL is here for you. We’re working for you – planning virtual events to help you in the now, planning in-person events to help you later, signing on to amicus briefs supporting issues advancing equality, researching legislative priorities for the year, and more. ELECTED CWL first vice president Michelle Ialeggio was elected judge of the San Diego Superior Court March 3. Ialeggio, a San Diego County deputy district attorney, serves as the office’s ethics advisor, overseeing and handling allegations Michelle Ialeggio of office-wide misconduct. In her 15 years at the District Attorney’s Office, she has held assignments as a team leader in the Family Protection Division, handling child abuse, molest and domestic violence crimes; as a misdemeanor trial deputy and a preliminary hearing deputy; and in assignments in the Juvenile Branch and on the felony trial team. She will take office in January 2021.

HONORED CWL at-large board member Mika Domingo was honored with a Minority Bar Coalition (“MBC”) Diversity Award at a reception for the MBC Unity Awards at University of California, Hastings, Law School, Nov. 12. Domingo, founder and managing partner of M.S. Domingo Mika Domingo Law Group, which has offices in Walnut Creek and Berkeley, received the award as a representative of CWL who has shown dedication to working in a unified manner to advance the cause of diversity in the legal profession.

ON THE MOVE CWL board member Sabrina Ashjian was appointed California State Director for the Humane Society of the United States, taking the post in October. Ashjian, who formerly was chairperson for the State of California’s Cannabis Sabrina Ashjian Control Appeals Panel, serves on the CWL Board of Governors as District 5 Governor, representing Fresno, Inyo, Kern, Kings, Madera, Mariposa, Merced, Mono, Monterey, San Benito, San Joaquin, Santa Cruz, Stanislaus and Tulare counties.

LEGAL VICTORY CWL members Leslie Levy and Katherine Smith, attorneys at Levy Vinick Burrell Hyams LLP in Oakland, along with senior staff attorney Brenda Adams and staff attorney Maha Ibrahim, of Equal Rights Advocates in Oakland, secured a settlement with the Leslie Levy Sacramento City Unified School District in a high profile sexual assault lawsuit in November. The settlement requires the school district to implement district-wide policy improvements and to pay $400,000 to a former student, whom school officials forced to Katherine Smith leave school for the rest of the semester after discovering she was raped by two schoolmates at an off-campus party in 2016. The lawsuit, filed in March 2018, alleged that the school district did not investigate or take any action against the two

McClatchy High School students who raped the plaintiff.

According to the lawsuit, school officials broke several federal and state laws, including Title IX, by denying the plaintiff equal access to education; failing to inform her of her rights; discouraging her from taking legal action; failing to provide any psychological resources or counseling; failing to provide options for avoiding her assailants at school (other than kicking her out); not conducting a Title IX investigation; and failing to take effective action to stop the bullying, threats, and harassment she experienced when she later returned to school or provide any accommodations for the resulting trauma symptoms that interfered with her education.

The school district has agreed to work with Equal Rights Advocates to draft, implement, and monitor progress of new policies for responding to reports of sexual assault and harassment.

PUBLISHED CWL affiliate governor Patanisha Davis, who represents the Contra Costa County Bar Association Women’s Section on CWL’s board of governors, independently published “Barren But Not Broken: A Journey From Infertility to Patanisha Davis Adoption,” a memoir about her experience with infertility and her path to motherhood.

The book, published in September 2019, is available on Amazon.

CWL Cancels 2020 Annual Conference, Annual Dinner CWL has canceled its 2020 annual conference, which was set for May 8 at the Hyatt Waterfront Hotel in Oakland, and its annual dinner, which was set for Sept. 11 at the Omni Hotel in Los Angeles, out of concern for the health and safety of attendees during the COVID-19 pandemic.

CWL leadership made the difficult decision to cancel the conference in early March after Governor Gavin Newsom declared a state of emergency in response to the public health threat of COVID-19. The CWL board voted in early May to cancel the annual dinner.

The hotel staff of both hotels are working with CWL to schedule new dates for the 2021 annual conference and annual dinner, and CWL will share the dates with our members as soon as possible.

We hope the pandemic subsides over the next several months, and we look forward to seeing you all as soon as possible. In the meantime, please join us on Zoom for our CWL at Home programs.

CWL Announces Winners of 2020 Annual Awards

California Women Lawyers is pleased to announce the 2020 winners of our four signature awards – two honoring judicial officers and two honoring attorneys.

The coronavirus pandemic and governor’s stayhome orders have upended CWL’s plans to honor each of the award winners at our traditional receptions.

CWL has postponed the receptions honoring two of the award winners – the Joan Dempsey Klein Distinguished Jurist Award, originally set for a reception March 13 in Santa Barbara, and the Fay Stender Award, originally set to be presented during the now-postponed CWL annual conference on May 8 in Oakland.

Plans are still tentatively set to present the Rose Bird Memorial Award on July 17 in Contra Costa County and the Soley Award at the annual dinner on September 11 in Los Angeles.

ROSE BIRD MEMORIAL AWARD Hon. Anita Santos, Superior Court of California, County of Contra Costa The Rose Bird Memorial Award is presented annually to a Northern California judge who is courageous and compassionate, exhibits brilliance and excellence, demonstrates a devotion to public service, and inspires the women lawyers of California.

The award’s namesake, Rose Bird, was the first female California Supreme Court justice and the first female Chief Justice. Chief Justice Bird was actively engaged in civil service prior to joining the bench. This year’s award winner, Contra Costa Superior Court Judge Anita Santos, has similarly devoted her life to vigorous and varied public service.

The daughter of immigrants from Cape Verde, Judge Santos put herself through law school, working as a police dispatcher with the City of Concord Police Department, later becoming a patrol officer. Upon passing the Bar, she joined the Contra Costa District Attorney’s Office, where she served for eleven years.

After running her own family law practice for a few years, Judge Santos went on to become a child support commissioner. Two years later, Governor Jerry Brown appointed Judge Santos to the Contra Costa County bench in 2014, where she currently serves in a felony criminal trial assignment.

Her passion for mentoring and for actively encouraging other women to join the bench is well known, as is her commitment to diversity, exemplified by her founding of the Diversity Section of the Contra Costa Bar Association.

JOAN DEMPSEY KLEIN DISTINGUISHED JURIST AWARD Hon. Louise A. LaMothe, U.S. Magistrate Judge, Central District of California The Joan Dempsey Klein Distinguished Jurist Award honors a Southern California judge each year, recognizing excellence as a jurist and longstanding vigorous service and inspiration to the women lawyers of California.

Central District U.S. Magistrate Judge Louise A. LaMothe will receive the 2020 Joan Dempsey Klein Distinguished Jurist Award at a reception in Santa Barbara, postponed from the original date of March 13. Currently serving part-time as a magistrate judge for the Central District in Santa Barbara, Judge LaMothe also serves as a professional arbitrator and mediator.

Attending Stanford Law School at a time when there were no women law professors and only a handful of women judges, Judge LaMothe immediately began working to ensure that women coming behind her would have the support and role models she had lacked.

Beginning her career at the University of Kansas law school, she quickly moved on to Irell & Manella where she became the firm’s first woman partner and member of the firm’s executive committee.

A former law clerk of U.S. Supreme Court Justice Ruth Bader Ginsberg, Brill’s practice focuses on complex civil litigation and appeals in media, entertainment, commercial, and regulatory matters.

The Soley award is named for a longtime CWL board member who was active in her Fresno County legal community and in the greater world around her before being killed by the husband of a client during a lunch break in their divorce proceedings. The Soley Award recognizes attorneys who have made a significant contribution to their community, extending beyond the practice of law, to devote time and effort to the public good through public service and community involvement, and who demonstrate a commitment to the mission of CWL. Founder of The Civics Center, a nonprofit organization dedicated to building a foundation for civic engagement and voter participation, Brill used little known law and procedure to increase voter pre-registration for high school students in California, Arizona, and Nevada.

Joining with others around the nation, Brill’s efforts have led to students nationwide using The Civics Center’s “Democracy in a Box” toolkit to engage high school students in the democratic process and to build a habit of civic engagement.

Brill writes articles for a variety of outlets and actively participates in panel presentations on issues of voting rights as well as judicial independence.

to enforce laws prohibiting fraud and predatory practices.

A graduate of St. John’s College, Columbia University, and Yale Law School, Goldberg has also devoted her considerable energy and ability to advocating for military veterans, including persons who have been improperly dishonorably discharged from the military and, as a result, were unable to obtain veterans’ benefits. Whether through direct representation, active participation on expert panels, or her writings, she is a zealous advocate for persons who have been victims of military sexual trauma. A Wall Street Journal op-ed Goldberg authored about how VA policy harmed veterans who, like her Purple Heart-recipient client, had less than honorable discharges, led the VA to change policy.

Goldberg has also advocated to improve care for and protect the rights of terminally ill hospice patients and female inmates. As one colleague wrote of Goldberg, “When she sees injustice, she makes sure others do, too, and pushes society to look in the mirror and change.”

Ana M. Storey serves on the CWL Board of Governors as Treasurer and as a District 7 Governor, representing Los Angeles County. She also chairs CWL’s Awards Committee. She is executive director of the nonprofit law firm LevittQuinn Family Law Center in Los Angeles.

Rise: Lifting As We Climb 2019 CWL Annual Conference Promotes Action, Advocacy

CWL’s 2019 annual conference, held Sept. 20 in Sacramento, featured inspiring keynote speakers and a day full of programs aimed at helping women advance, while lifting up others – in line with the conference theme, “Rise: Lifting As We Climb.”

The conference kicked off with a morning keynote presentation by Lauren Babb, public affairs director for Planned Parenthood of Northern California, who also serves as an appointed commissioner and executive committee member of the California Commission on the Status of Women and Girls and a 2019 state policy fellow with the Women’s Foundation of California on the Reproductive Health, Rights and Justice team.

“If my life plan went perfectly, I would be sitting in this room with you,” Babb said. “My initial life plan was to be a lawyer and practice election law. My strength was never in standardized testing, which ultimately ended my chances of being in this room. … Everyone’s path is different, but what drives you, what makes you tick is what should guide the next steps you take. For me, that was advocacy.”

Babb gave a rollicking review of her path from her childhood in Detroit – learning about political activism from her anti-pothole, letter-writing grandma and being quizzed about current events by her papa, a retired police officer studying for his political science degree – to her multiple current positions as a political and community activist.

Babb herself got a political science degree, and while studying at American University in Washington, D.C., she joined the 2012 Obama re-election campaign as a regional college manager. After deciding against law school, she worked at a political mail firm, as a labor union organizer in Los Angeles, and managing the union’s field campaigns for Hillary Clinton’s presidential bid before going back to school for a master’s degree in political management. She returned to union organizing, this time in the Bay Area, then worked in political consulting before joining Planned Parenthood.

“As I took a deeper dive into my work, I thought about what I could do for my local community, so I looked at county commissions,” said Babb, who joined the Contra Costa Commission for Women, serving as its legislative chair. “My sole goal was to include women and girls in as much policy as possible, and it worked.”

She encouraged conference attendees to seek appointments to state and local commissions and other statewide appointments, and she talked about the recent work the California Commission on the Status of Women and Girls has done on equal pay, convening a Pay Equity Task Force to provide guidance for meaningful compliance with the California Fair Pay Act enacted in 2018.

“For nearly two-and-a-half years, industry and subjectmatter experts worked to craft resources and guidance documents for employers who seek to ensure pay equity at their companies,” Babb said. “The commission published their resources this spring [of 2019] and launched the #EqualPayCA campaign on April 1, 2019.”

She urged CWL members to join in education and advocacy efforts at the local level.

“As attorneys, it is important that you not only advocate for your clients in legal proceedings, but it is imperative that you advocate in your own firms and with lawmakers about issues impacting women,” Babb said. “Pay disparities exist for women even in the highest paid professions. Ask yourself how many times you were passed up for a promotion in your firm or how many female partners you know. California made important strides in passing the Fair Pay Act, but it will take local advocacy and education to ensure that people know their rights and how they are protected under the law.”

CWL Honors Eileen Decker with 2019 Judith Soley Award California Women Lawyers honored Los Angeles attorney Eileen M. Decker with the 2019 Judith Soley Lawyer as Citizen Award at a reception in Sacramento Sept. 19, kicking off the CWL Annual Conference.

CWL gives the Judith Soley Lawyer as Citizen Award to an attorney who has made a significant contribution to her community, extending beyond the practice of law, to devote time and effort to the public good and values through the tradition of public service and involvement, and who exemplifies the values and mission of California Women Lawyers.

“It’s worth pausing to appreciate the progress that has been made,” Decker said. “Doing so reminds us of the vital work of CWL. This work matters. It matters to the thousands of women in this state practicing law. We know we have a long way to go. We face concerted efforts to take away rights we have worked so hard to achieve.”

CWL Honors California Chief Justice at 2019 Annual Dinner

California Women Lawyers celebrated its 45th Annual Dinner Sept. 20, capping off the CWL annual conference and presenting the Rose Bird Memorial Award to California Chief Justice Tani Cantil-Sakauye.

This was the first year CWL combined its annual conference – traditionally held in the spring – and its annual dinner. The conference and dinner, held at the Kimpton Sawyer Hotel in Sacramento, also celebrated the 100th anniversary of the 19th Amendment to the U.S. Constitution, recognizing women’s right to vote. The evening’s theme, “Rise: lifting as we climb,” called on CWL members to aim high and to support other women along the way.

“I would not be standing here tonight without the people that have lifted and continue to lift me up, most important of which is my family,” 2019-2020 CWL president Jessica Lynn Rowe said. “My mom marched so I could walk, and I will run so my baby girl Birdie can fly.”

Rowe, a shareholder with Aaron, Riechert, Carpol & Riffle APC in Redwood City, thanked outgoing CWL president Amee Mikacich as well as the CWL Board of Governors.

“In addition to my family, I would like to thank this amazing board,” Rowe said. “It is no surprise that California Women Lawyers is where I found my people.

Every single person on this board has inspired and continues to inspire me. I am excited just to be a member of this board, to lead it is a dream and a true honor.”

Mikacich, a partner at Hinshaw & Culbertson in San Francisco, welcomed members and guests, before 20172018 CWL president Renee Stackhouse presented the Rose Bird Memorial Award to Cantil-Sakauye.

Cantil-Sakauye was sworn in as Chief Justice in January 2011 and has emerged as one of the country’s leading advocates for equal access to justice, transparency, and reform of state court funding models that unfairly impact the poor. Her Pretrial Detention Reform Workgroup provided recommendations that informed work between the judicial branch, the governor and the legislature on a bill to eliminate money bail and replace it with a system that values public safety while ensuring defendants are treated fairly no matter their wealth. She also has taken a stance against allowing federal authorities to arrest undocumented residents at state courthouses. Her efforts at transparency have included opening and webcasting Judicial Council meetings, making public comment more accessible, and webcasting state Supreme Court arguments.

She has guided the court system in joining the #metoo movement, appointing a group of judicial officers, court executive officers and lawyers to address how the judicial branch can prevent harassment, discrimination and inappropriate workplace conduct. She also has convened leaders to address human trafficking and truancy as well as initiatives promoting civic learning.

Cantil-Sakauye reflected on receiving the award named for California’s first woman Supreme Court justice and first woman Chief Justice, noting that her job as the state’s second woman Chief Justice is easier today than during Bird’s tenure from 1977 to 1986.

“Our work is hard, and it’s made more difficult when we have unhappy colleagues to work with every day,” Cantil-Sakauye said. “My work is easier today than what Rose Bird experienced.”

Noreen Farrell – executive director of San Franciscobased Equal Rights Advocates, a national civil rights organization that advances the rights of women and girls through policy reform, litigation, community education, and movement building – gave the keynote address at the annual dinner.

Farrell, who has represented thousands of women and girls in groundbreaking impact litigation to end sex discrimination in schools and the workplace, said she was inspired being in the company of CWL members, but said it can be discouraging to keep fighting the same battles against discrimination and sexual harassment.

“There is nothing better than a room full of strong women lawyers at this moment when the movement for equality needs each and every one of us,” Farrell said.

“It is important to think about how we rise and lift as we climb at this moment in our movement for gender, racial, and economic justice. I come to this with mixed feelings knowing how long all of us in this room have been working for equality and the power it brings. I probably should not say this, but it is incredibly irritating to me that Equal Rights Advocates still must exist.”

Farrell talked about early victories in the women’s rights and civil rights movements and recent setbacks, then shared some of the lessons learned along the way.

“We’ve learned a lot since we passed the 19th Amendment 100 years ago,” she said. “We’ve learned a lot since we passed the Civil Rights Act of 1964. We have learned a lot since Rose Bird was kicked off the court. No time has been wasted. We’ve been in training my friends. … And we have been joined by young people who are helping us keep the pace as we mentor and give them all we know.”

She said women have reimagined power in transformative ways – with women entrepreneurs owning 200 million businesses around the world, thousands of women running for office in 2020, students challenging their schools’ handling of sexual harassment and sexual assault, women in the fast food industry and janitorial industry pushing for better pay and protection from sexual assault, and more.

“Despite our setbacks,” Farrell said, “we continue to rise.”

She encouraged CWL members to run for office, vote their values, mentor young people, volunteer with and write checks to social justice organizations, support legislation that advances women, and work to fill the judiciary with judges who reflect the diversity of our lives and who have demonstrated respect for women.

“My call to action to all of you today is simple,” Farrell said. “I would like each and every one of us to leave here tonight committed to reimagining your power in the movement for gender justice and the goals of your work as lawyers and members of families and communities who need us. … At this moment, social justice needs big ideas. And we need you. This moment needs our courage. It needs all of us. So, ask yourself how that plays out in your lives.”

Farrell thanked CWL members and guests for using their position as lawyers to help those who are most impacted by inequities.

“Thank you for persisting, donating, and being inspirational leaders in law every day until we are at least 50% of all leaders, making 100% of what we have earned, with 0% stereotyping, harassment, abuse, and assault,” she said. “Thank you for reimagining power and leading with a bold vision.”

In her closing remarks, 2019-2020 CWL president Jessica Rowe asked for continued support of CWL and its work.

“Our organization is as strong as its collective voice,” Rowe said. “We promise to use that voice to push forward our mission of the advancement of the interests of women and children in law and society. Please go rise and lift as you do.”

Looking Back 25 Years Ruth Bader Ginsburg Speaks at 1994 CWL Annual Dinner

U.S. Supreme Court Justice Ruth Bader Ginsburg spoke at the California Women Lawyers annual dinner on Sept.

22, 1994, less than a year after being sworn in as the second woman to sit on the Supreme Court.

Her remarks are reprinted here, courtesy of the Pepperdine Law Review, and thanks to CWL member Prudence Hutton, who located Justice Ginsburg’s speech from the 1994 CWL annual dinner.1

I will speak of the exhilarating changes I have witnessed in the composition of our profession since that day, and of my hopes for the future.

I’ll start with a snapshot of a moment in our Court long before my time, way back in 1853. Sarah Grimke, a great feminist and anti-slavery lecturer from South Carolina, was in Washington, D.C., that December, and wrote this to a friend:

Women make up close to one-third of President Clinton’s nominees to the federal bench, 42 out of 135 as of September 19, to be precise. A critical mass, social scientists might say. Are we really there? Well, not quite, I was reminded just last month when I received a note of apology from Reverend Jesse Jackson. In his syndicated column in the Los Angeles Times, he criticized a decision written by Justice Ruth Bader Ginsburg. There were, he later recognized, two things wrong with the criticism: the decision had issued prior to my appointment to the Court; and the writer was Justice O’Connor.

An American Bar Association report in the late 1980s expressed concern that lawyers in commercial practice may be losing their sense of perspective and ethics, under relentless pressure to produce business and billable hours. The report noted the attendant tug on young lawyers to cut back on family involvement, but it ended on an upbeat note. The reporters expressed hope that the increasing participation of women in the profession would have an ameliorating effect. Returning to the way it was, the few women who braved law school in the 1950s and 1960s, it was generally supposed, presented no real challenge to (or competition for) the men. What were those women, after all, one distinguished law professor commented, “only soft men.” The idea was they would devote themselves not to paying clients represented by law firms, or to top jobs in corporations and government, but to serving the poor and the oppressed, the truly needy – those who could not afford to pay for legal services.

These issues must become human issues, not just “women’s issues.”

To illustrate my point, travel back with me to an incident in the mid1970s, when I was teaching at Columbia Law School and trying to manage a full docket of sex equality cases in or headed toward the Supreme Court. The incident concerned my son, then a spirited ten-year-old.

But as women join men in diverse fields of endeavor, as lawyers, engineers, bartenders, computer programmers, we are discovering that personality characteristics for both sexes span a wide range. Harvard President Neil L. Rudenstine, at a Radcliffe Convocation in March 1994, expressed what we are coming to appreciate: “We [now] know that talents of all kinds analytic, creative, athletic, argumentative, and entrepreneurial are distributed in essentially equal portions and an infinite variety of combinations among women and men alike.”

Immodest aspiration is as evident in some women as it is in some men. Caring for one’s family, on the other hand, sharing in bringing up children or attending to elderly parents, cooking dinners, helping to keep the house in order, no longer mark a man as strange. (To the abiding appreciation of my daughter, son, and now grandchildren, meals at our house, some fourteen years ago, were taken completely off Mommy’s track – she has no talent for the job – and switched to Daddy’s. He has indeed mastered the art.)

Yes, large problems remain. Largest of all, raising young children continues to present more trying psychological and logistical obstacles for women than for men. A representative of the Women’s Legal Defense Fund recently commented on the reality in some quarters:

“A woman who does less than everything for her child is seen as a terrible mother; a man who does more than nothing is praised as a wonderful father.”

Yet the distance traveled from the 1950s to the 1990s is large, and I am optimistic that the trend toward shared roles for men and women, at work and at home, will continue. And I am heartened by a recent University

of Michigan survey, undertaken by Professor David Chambers, showing that of all lawyers graduated from that fine law school, women with children are the most content. They are beleaguered, the survey report noted, but they are also satisfied. They enjoy their family lives.

They enjoy their jobs. And to the extent each causes stress, each also provides respite from the other.

There is a hopeful sign, too, in a United Nations report published in conjunction with the recent world population conference in Cairo. The report emphasizes that the best way to avert a catastrophic global population explosion is to educate and empower women. “Had we paid more attention to empowering women thirty years ago,” the Director of the UN Fund for Population Activities observed, “we might not have to battle so hard for sustained development today.”

There are still those who insist that men inevitably have an edge on leadership opportunities – on power positions at the bar and on the bench – because men are innately more aggressive. I am particularly fond of the comment on that point made in a book published in 1974, “The Psychology of Sex Differences.”2 The authors, two Stanford University Professors, Eleanor Maccoby and Carol Jacklin, convincingly confirmed a link between aggression and dominance in little boys – and also in apes. But, those authors hastened to add, human boys grow up. The leadership style thought most effective in civilized society is not the ruthless tough guy who forcibly imposes his will on others. Rather, the qualities that count most are the ability to conciliate among opposing factions and to foster development of younger, less experienced people in return for their loyalties. These interactive qualities, the kind vital to the successful mediation of controversies, do not appear to be linked to one sex to a greater extent than to the other. Women, I believe, are as generously endowed with them as men are.

Theoretical discussions are ongoing today – particularly in academic circles – about differences in the voices women and men hear, or in their moral perceptions. When asked about such things I usually abstain. Generalizations about the way women or men are – my life’s experience bears out – cannot guide me reliably in making decisions about particular individuals. At least in the law, I have found no natural superiority or deficiency in either sex. I was a law teacher until I became a judge. In class or in grading papers over seventeen years, and now in reading briefs and listening to arguments in court for fourteen years, I have detected no reliable indicator of distinctly male or surely female thinking – or even penmanship.

Minnesota Supreme Court Justice Jeanne Coyne reports an exchange several times quoted by Justice O’Connor, and more than once by me. Justice Coyne was asked: “Do women judges decide cases differently by virtue of being women?” She replied that, in her experience, “a wise old man and a wise old woman reach the same conclusion.” I agree. But I also have no doubt that

women, like persons of different racial groups and ethnic origins, contribute what a fine jurist, the later Fifth Circuit Judge Alvin Rubin, described as “a distinctive medley of views influenced by differences in biology, cultural impact, and life experience.” (Judge Rubin said that in a case brought in his court in the middle 1970s, a case that put an end to the once prevalent exclusion of women from service on juries.3) A system of justice is the richer for diversity of background and experience. It is the poorer in terms of appreciating what is at stake and the impact of its judgments, if all of its members – its lawyers, jurors, and judges – are cast from the same mold.

A New York Times reporter, writing about the Supreme Court last Term, commented that, although the work is hard, the Justices reap rewards for it, including attention and respect typically harvested at public appearances.

A Look at CWL’s 2019 Legislative Successes

CWL had a banner year in 2019 for legislative successes on our priority issues. Each year we develop a legislative priority agenda of bills we support. This decision is based on our priorities of: (1) ensuring reproductive justice, including choice, maternity care, access and privacy; (2) preventing violence against women and children, including domestic violence, human trafficking, gun violence and sex crimes; (3) supporting human rights and equality; (4) protecting court funding and access to justice; and (5) overcoming economic inequities.

We are thrilled that the Governor signed all of our priority bills that reached his desk. Here is a look at those bills: SB 22, Senator Leyva: Rape kits: testing. This bill seeks to ensure the prompt testing of rape kits.

We would like to express a heartfelt thank you to CWL’s own Past President Nancy O’Malley for her sponsorship of this legislation and for her years of tireless advocacy work on this critical issue.

SB 24, Senator Leyva: Public health: public university student health centers: abortion by medication techniques. This bill makes abortion medication available at on-campus student health centers at postsecondary educational institutions in California.

SB 464, Senator Mitchell: California Dignity in Pregnancy and Childbirth Act. This bill makes legislative findings relating to implicit bias and racial disparities in maternal mortality rates. The bill requires hospitals to implement an evidencebased implicit bias program to resolve these disparities.

AB 467, Assemblymember BoernerHorvath: Competitions on state property: prize compensation: gender equity. This bill requires entities seeking to receive a permit for state property for a competition event to have prize award compensation that is identical between gendered categories at each participant level, to ensure “equal pay for play.”

AB 931, Assemblymember Boerner-Horvath: Local boards and commissions: representation: appointments. This bill seeks to reach gender parity on local boards and commissions.

We thank all of the legislators for working on these important issues; this legislation will change the lives of so many women and girls for the better.

CWL Supports Equal Pay Rights and Denounces Sexual Orientation Gender Discrimination and Rape Kit Backlogs in Amici Briefs

CWL’s amicus committee joined several amici briefs in the second half of 2019 in important cases that further our mission.

DISCRIMINATION BASED ON SEXUAL ORIENTATION OR GENDER IDENTITY CWL joined an amicus brief filed in three related cases pending in the United States Supreme Court advocating a determination that discrimination against an employee because of sexual orientation or gender identity constitutes prohibited employment discrimination “because of . . . sex” within the meaning of Title VII of the Civil Rights Act. The amicus brief explains that the contrary view that sex discrimination only encompasses discrimination for being male or female, as assigned at birth, contradicts the plain meaning of Title VII’s text. The amicus brief further explains that there is no meaningful distinction that can be made between a claim of sex stereotyping based on a person’s assigned-at-birth gender and a claim of sex stereotyping based on sexual orientation or gender identity such that a ruling in favor of the employers “would negate the entire history of Title VII’s probation on sex stereotyping by pronouncing some forms of sex stereotyping impermissible under the law, while permitting others.” The cases are Bostock v. Clayton County, Georgia (No. 17-1618), Altitude Express, Inc v. Zarda (No. 17-1623), and R.G. & G.R. Harris Funeral Homes, Inc. v. Equal Employment Opportunity Commission (No. 18-107).

Pay Act and Title VII claims. Professor Freyd is challenging gender-based pay discrimination at the University of Oregon’s Department of Psychology where she has worked for over 30 years. Her case raises important issues about the interpretation and application of the Equal Pay Act and Title VII that are of vital importance to all workers, not just those in academia. The amicus brief highlights gender inequities in pay, power, and access to resources across the workforce.

RAPE KIT BACKLOG CWL joined an amicus brief supporting a petition for a writ of certiorari to the United States Supreme Court in Marlowe v. City and County of San Francisco.

The petitioner alleges that the San Francisco Policy Department refused to test her rape kit and failed to investigate her claim that she was drugged and raped in 2010. The amicus brief highlights how untested rape kits illustrate a deprioritization of sexual assault cases and are part of a pattern and practice of gender discrimination.

“Confidence Lost, Confidence Found” Offers Roadmap for Boosting Sense of Self-Worth

“Grit” and “resilience” have been big words for women in the legal profession in recent years – but underneath it all, confidence is key. If you are trying hard to bring grit to your personal toolkit, and striving to become resilient, pause for a moment. What underpins grit and resilience?

Confidence.

Right now, on the brink of a financial depression, at a time of pandemic and most of all at a time of uncertainty, all of us could use a little confidence.

Kate McGuinness, author of “Confidence Lost, Confidence Found: How to Reclaim the Unstoppable You,” is a living example of how confidence can be gone in a moment, but also, how confidence can be built from the ground up. In full disclosure, she was also my executive coach when I decided to leave a successful law firm partnership to start my own firm – so I have lived her methods firsthand.

By combining personal experience with resources on neuroplasticity, mindfulness and self-care, this book – published by Two XX Press in January – is a great resource for lawyers at any stage of their careers.

McGuinness’ personal stories are woven throughout the book, and they speak volumes. As a lawyer, McGuinness had a string of successful accomplishments.

An early equity partner at O’Melveny and Myers, in 1995 she was recruited by Times Mirror Group, then a Fortune 200 company, to serve as vice president and general counsel. She was riding high and preparing to be honored by her law school as a distinguished alumnus. Then, without warning, she was fired. I won’t spoil the story by sharing what happens next, but trust me when I say that McGuinness has experienced disappointments and setbacks that would shatter the strongest women I know.

McGuinness describes the careful reconstruction of her confidence as “similar to Japanese kintsugi pottery in which broken pieces are repaired with lacquer mixed with powdered gold to highlight the cracks.” To find answers on how to make those repairs, McGuinness explored meditation, trained as an executive, career and life transition coach at the Hudson Institute, and took time to pause and consider how neurological training can strengthen our confidence (and yes, resilience and grit too).

“Confidence Lost, Confidence Found” takes readers through a series of exercises, starting with a deep dive to find our innate confidence and then sharing the foundations for rebuilding it. Each exercise comes with the why, and the how, and also something more powerful. By sharing her own vulnerability at various times in her career, McGuinness is giving readers permission to be vulnerable as well. The structure of the book is simple, moving from authenticity and self-compassion to real-world advice on networking, performance reviews and public speaking. Hands-on exercises and practical advice are interwoven with resources and well-researched references to other materials. It is clear that McGuinness enjoys her work immensely, and this shines through the energy and enthusiasm she has for her readers’ success.

I especially enjoyed the chapter on adopting a growth mindset. Pointing out that many women (and men, I would add) think their abilities or talents are fixed, McGuinness explodes the myth that we can’t grow and develop new skills. First, McGuinness points out, people with a growth mindset are free of the urgent need to succeed, and thus better able to accept failure. By taking pleasure in learning a new skill and being open to setbacks and bumps in

the road, we not only build resilience, but we gain the confidence needed to take risks. How do we develop our growth mindset? By learning, of course. Taking our brains back to school and going step by step through the process of embracing growth is no different, it turns out, than learning to read, or as many of us are doing right now, learning to bake sourdough bread. The more we practice, the more we succeed.

The conscious exploration of our strengths and the decision to build on our weaknesses might seem like a lot for people struggling with shelter-in-place orders, remote law practice and homeschooling. However, I think we need this more than ever. What better time to master mindfulness and strengthen ourselves for what might come next? CWL will also share job openings and pertinent information it receives with its membership through this Listserv.

To share a message with CWL members statewide, just email members@cwl.org. Just remember to use common sense, and abide by the Listserv policy, found online here.
