Maxxam Sues The FDIC
Maxxam Inc., Houston, Tx., parent of The Pacific Lumber Co., is suing the Federal Deposit Insurance Corp. for allegedly using its own funds to finance an Office of Thrift Supervision proceeding against the timber firm and its chairman, Charles Hurwitz.
The suit claims that the FDIC supported OTS's endeavor rather than prusue the matter in court where congressionally imposed procedural and legal rules could limit its effectiveNESS.
The firm also is questioning the legality of the FDIC's $821 million lawsuit against Hurwitz for the failure of U.S. Association of Texas, a thdft that went into receivership during that state's Savings and Loan crisis. Maxxam insists that the 1995 suit was initiated solely to enable other government agencies to gain leverage in negotiations with The Pacific Lumber Co. over acquiring old growth redwood trees in Humboldt County, Ca.
If successful, Maxxam's suit would free Palco from having to surrender 63.000 acres of timberlands to satisfy claims by the FDIC.

Meanwhile, Quality Veneer & Lumber permanently closed its QVL Plywood Division in Omak, Wa., and D.R. Johnson shuttered its Wallowa, Or., stud mill, with possible reopening if market conditions improve.
Other facilities are cutting shifts, including Roseburg Forest Products' big-log mill in Winston, Or.; Umpqua Lumber's Dillard, Or., stud and planer mills; L-P's Deer Lodge, Mt., finger- joint plant, and Gilman Forest Products' six mills in Florida and Georgia.
