Court Deciding On Discounts
Whether or not manufacturers may legally discount prices to wholesalers and not to retailers will be decided by the LJ.S. Supreme Court. The court will review the case which, according to industry groups, "threatens to undermine perhaps the most common distributional arrangement in American business: the dual-channel system in which a manufacturer or supplier sells to wholesalers at discounted prices lower than those it charges directpurchasing retailers. "
Texaco is appealing the ruling in favor of l2 service stations in Spokane, Wa., which claimed illegal price discrimination since wholesalers selling to their competitors were charged less.
The recent Ninth Circuit Court ruling could be valid nationally if upheld by the Supreme Court.
